AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTI-
FIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING
DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE BELL
RANCH TERRACE ADDITION; PROVIDING FOR A CHANGE OF
ZONING FROM SINGLE FAMILY ATTACHED (R -lA) TO
PLANNED DEVELOPMENT (PD) FOR SINGLE FAMILY DE-
TACHED HOUSING; PROVIDING FOR A SEVERABILITY
CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Commission conducted a public hearing
on the 20th day of September, 1988, in conjunction with Zoning Case
No. 88 -12, and rendered a recommendation to the City Council with
respect to same;
WHEREAS, the City Council conducted a public hearing on the 11th day
of October, 1988, considered the recommendation of the Planning and
Zoning Commission, and determined that the proposed change is in the
best interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas,
being a part of Ordinance No. 347, be amended to read so that the
zoning district classification of that 3.447 acres of land generally
located along the north side of the 1300 and 1400 blocks of Kynette
and along the east side of the 300 and 400 blocks of Nita Lane, more
particularly described as Lots 2A -R through 7B -R, Block 1; Lots IA-R
through 5B -R, and 8 -AR through 11B -R, Block 7, Bell Ranch Terrace
Addition (Volume 388 -209, Page 78), now zoned Single Family Attached
(R -1A) is hereby changed to Planned Development (PD) for Single Family
Detached housing, in accordance with the site plan described herein as
Exhibit A, bearing the City of Euless received date of September 8,
1988 (attached hereto and made a part hereof).
Said property described in Exhibit A, pursuant to Section 7 -1000 of
the Euless Zoning Ordinance, shall be subject to all the safeguards
and conditions set forth on said site plan described herein as Exhibit
A. Said site plan shall be applicable only to the property described
herein.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the
City Council of the City of Euless that the sections, paragraphs,
sentences, clauses, and phrases of this ordinance are severable and if
any phrase, clause, sentence, paragraph, or section of this ordinance
shall be declared unconstitutional by the valid judgment or decree of
any court of competent juristiction, such uncontitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs,
or sections of this ordinance, since the same would have been enancted
by the City Council without the incorporation in this ordinance of any
such unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation violating the
terms and provisions of this ordinance, or the amendments to the City
of Euless Charter hereby made, shall be deemed guilty of a misdemeanor
and, upon conviction thereof, shall be liable to a fine in an amount
not to exceed One- thousand Dollars ($1,000), and each day such viola-
tion shall be permitted to exist shall constitute a separate offense,
as provided by Ordinance No. 347, and subsequent amendments to the
Euless City Charter and the Statutes of the State of Texas.

EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after its passage, as provided by the Euless City Charter and the
laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless
City Council on the 11th day of October, 1988, by a vote of 4 ayes, 0
nays, and 0 abstentions.
