HomeMy WebLinkAbout994 12-13-1988ORDINANCE NO. 994 AN ORDINANCE DETM4 NMG THE NECESSITY OF IMPROVING THAT PORTION OF MARLENE DRIVE IN THE CITY OF EULESS, TEXAS, WHICH EXTENDS FROM WESTPARK WAY EAST TO HURRICANE CREEK BY WIDENING THE ROADWAY, CONSTRUCTING, PAVING, CURB AND GUTTER, SIDEWALKS AND STORM DRAINAGE IMPROVEMENTS; APPROVING THE CITY ENGINEER'S PLANS AND SPECIFICATIONS FOR IMPROVEMENT OF MARLENE DRIVE; APPROVING THE CITY ENGINEER'S ESTIMATE OF COST AND THE ASSESSMENT ROLL; DIRECTING THE CITY MANAGER TO SOLICIT BIDS FOR THE IMPROVEMENTS TO MARLENE DRIVE; DECLARING THE INTENT OF THE CITY COUNCIL TO LEVY AND ASSESSMENT FOR A PORTION OF THE COSTS OF IMPROVING MARLENE ROAD; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas, has determined the necessity for improving Marlene Drive by constructing an improved and widened roadway with paving, curb and gutter, sidewalks and storm drainage improvements; and WHEREAS, the City Council of the City of Euless, Texas, being presented with the engineer's plans and specifications for the improvements of Marlane Drive; and WHEREAS, the City Council of the City of Euless, Texas, being presented with an estimate of costs and improvements to Marlene Drive in the amount of $ 119,809.84 , and assessment roll of abutting property owners to Marlene Drive prepared by the City Engineer; and WHEREAS, the City Council of the City of Euless, Texas, recognizes the necessity of the City Manager advertising the improvements to Marlene Drive to facilitate attracting bids for those improvements; and WHEREAS, the City Council of the City of Euless, Texas, intends to levy an assessment for a portion of the costs of the improvements to Marlene Drive: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: ORDINANCE NO. 994, PAGE ONE OF THREE I. The City Council of the City of Euless, Texas, adopts the plans and specifications prepared by the City Engineer detailing the improvements for that portion of Marlene Drive extending from Westpark Way eastward to Hurricane Creek. II. The City Council of the City of Euless, Texas, approve the City Engineer's estimate of costs for the improvements of Marlene Drive extending from Westpark Way eastward to Hurricane Creek, in the amount of $ 119,809.84 III. The City Council of the City of Euless, Texas, directs the City Manager to solicit bids for the improvements to Marlene Drive. IV. The City Council of the City of Euless, Texas, declares that it is the intention of the City Council to levy a portion of the costs of the improvements to Marlene Drive upon abutting property owners of Marlane Drive. V. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. VI. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. GIVEN SECOND READING AND APPROVED at a regular meeting of the Euless City Council on the 13th day of December, 1988; by a vote of 5 ayes, 0 nayes, and 0 abstentions.
