AN ORDINANCE AMENDING ORDINANCE NO. 347, IDENTI-
FIED AS THE ZONING ORDINANCE OF THE CITY OF
EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING
DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE
JOHN GROVES ADDITION; PROVIDING FOR A CHANGE OF
ZONING FROM COMMUNITY BUSINESS DISTRICT (C -2) TO
COMMUNITY BUSINESS DISTRICT WITH SPECIFIC USE
PERMIT (C -2 W /SP) ALLOWING INCREASED SIGN AREA;
PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR
VIOLATION AND AN EFFECTIVE DATE.
WHEREAS, Planning and Zoning Commission conducted a public hearing on
the 7th day of March, 1989, in conjunction with Zoning Case No. 89 -01
and rendered a recommendation to the City Council with respect to
same;
WHEREAS, City Council conducted a public hearing on the 28th day of
March, 1989, considered the recommendation of the Planning and Zoning
Commission, and determined that the proposed change is in the best
interest of the general welfare of the City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas,
being a part of Ordinance No. 347, be amended to read so that the
zoning district classification of that 0.425 acres of land generally
located at 3008 West Euless Boulevard, more particularly described as
Lot 1, Block 2, John Groves Addition as filed at Tarrant County Plat
record in Volume 388 -88, Page 10, now zoned Community Business
District (C -2) is hereby changed to Community Business District with a
Specific Use Permit (C -2 W /SP), allowing increased sign area (143
square feet area and 30 feet high), in accordance with the site plan
described herein as Exhibit A, bearing the City of Euless received
date of February 24, 1989, (attached hereto and made a part hereof).
Said property described as Lot 1, Block 2, John Groves Addition,
pursuant to Section 7 -1000 of the Euless Zoning Ordinance, shall be
subject to all the safeguards and conditions set forth on said site
plan described herein as Exhibit A. Said site plan shall be appli-
cable only to the property described herein.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the
City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable; and if any phrase, clause,
sentence, paragraph, or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs, or sections
of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation violating the
terms and provisions of this ordinance, or the amendments to the City
of Euless Charter hereby made, shall be deemed guilty of a misdemeanor
and, upon conviction thereof, shall be liable to a fine in an amount
not to exceed One- thousand Dollars ($1,000), and each day such vio-
lation shall be permitted to exist shall constitute a separate of-
fense, as provided by Ordinance No. 347, and subsequent amendments to
the Euless City Charter and the Statutes of the State of Texas.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from
and after its passage, as provided by the Euless City Charter and the
laws of the State of Texas.
PRESENTED AND GIVEN FIRST READING at a regular meeting of the Euless
City Council on the 28th day of March, 1989, by a vote of 4 ayes, 0
nays, and 0 abstentions.

of 3 ayes, 0 nays, and 0 abstentions.
