CALL TO ORDER A regular meeting of the Euless City Council was called to order at. 8:05 P.M,, Tuesday, January 12, 1982, in the Council Chambers of the Euless Municipal Building, by Mayor Pro Tem Willie Mae McCormick, Councilmembers present were Councilmen Glenn Walker, Robert Pippin, Ron Sternfels, and Bob Eden. APPROVAL OF MINUTES The minutes of a Regular Meeting on December 8, 1981, and the minutes of a Called Meeting on December 29, 1981, were approved as written, 1982-004 Euless City Council Regular Meeting - January I2 , 1982 - Page Two ITEM 1: SECOND AND FINAL READING OF ORDINANCE NO 694 Mr. Pippin moved to approve second and final reading of Ordinance No, 694 for a change of zoning from. "R-2" Two- Family Dwelling District and "R-4" Multi-Family Dwelling District with "CUD" for Conforming Housing to same with an amended site plan, for certain property out of the Ray Shelton Subdivision, located at the southeast corner of Ash Lane and Fuller-Wiser Road_ Mr. Eden seconded the motion. Ayes: Messrs. Pippin, Eden, Sternfels, and Walker, and Mrs, McCormick Nays: None Mayor Pro Tem McCormick declared the motion carried. ITEM III: CONSIDERATION OF AN ORDINANCE FOR THE 1981 NATIONAL ELECTRICAL CODE Mr, Larry Finney, Code Enforcement Officer for the City of Euless explained that there were no major changes in the electrical code, just adjustments and updating. Mr. Eden moved to approve first reading of an ordinance to adopt the 1981 National Electrical Cede for the City of Euless. Mr. Walker seconded the motion. Aves: Messrs. Regular Meeting - :January 12, 1982 - Page Three ITEM. III: • CONSIDERATION OF RESOLUTION NO. 82-516 TO SET AN ELECTION FOR THE CITY OF EULESS MTS. McCormick explained that this resolution was to set an election date for the City of Euless, for Saturday, April 3, 1982, from 7:00 A.M. to 7:00 P.M., in the Community Building at 201 North Ector Drive. The resolution also appoints the election judges, and announces that elections will be held for Councilpersons Place One Place Three, and Place Five, Mr. Eden moved to approve Resolution No. 82-516. Mr. Walker seconded the Motion. Ayes: Messrs, Eden, Walker, Pippin, and Sternfels, and Mrs.McCormick Nays : None Mayor Pro Tem McCormick declared the motion carried. ITEM TV: CONSIDERATION OF RESOLUTION NO, 82-517 TO SUSPEND ACTION 3' TEXAS POWER. 4 LIGHT COMPANY Mr, Gary N. Johnson, Texas Power F4 Light Company District Manager, explained the action requested by Texas Power 4 Light Company. Mr. Johnson stated that on December 4, 1981, Judge Herman Jones, Travis County, Austin, ruled that Texas Power 4 Light Company must amend their procedures for obtaining regulatory approval of payments made to affiliates before they can be passed on to their customers through the fuel clause. In the past, this procedure was automatic on a monthly basis. Now, due to the judge's ruling, each fuel cost adjustment mist be handled. similar to a rate change. Texas Power & Light Company is requesting that the City of Euless suspend action for ...70 days in the hope that the court ruling will be changed by that time Mr. Walker moved to approve Resolution No 82-517 to suspend. for 120 days the action by Texas Power 4 Light Company regarding procedures in this matter. Mr. Pippin seconded the motion. Ayes: Messrs. V CONSIDERATION OF RESOLUTION NO, 82-518 SUPPORTING THE HURST-EULESS-BEDFORD INDEPENDENT SCHOOL DISTRICT PARENT TEACHER ASSOCIATION'S WAR ON DRUGS COMMITTEE Mr. Pippin moved to approve Resolution No. 82-518, supporting the Hurst-Euless-Bedford independent School District. Parent Teacher Association's War on Drugs Committee. MT. Sternfels seconded the motion_ Ayes Messrs. Pippin, Sternfels , Eden, and. Walker, and. Mrs. McCormick Nays: None Mayor Pro Tom McCormick declared the motion carried. ITEM VI: CONSIDERATION OF VACATING A. UTILITY EASEMENT IN WOODLANDS ADDITION Mr. James Knight, City Engineer, stated. he had talked with Mr. Douglas Moss Vice President, Pulte Home Corporalion, 1236 Executive Drive West, Richardson, Texas, regarding this request. Mr. Moss was unable to attend the meeting due to the driving conditions tonight, and requested Mr. Knight explain the item to the Council. house that was built on Lot 13, Block 6, Woodlands Addition, has a chimney that extends eleven inches onto the existing utility easement. This chimney was built different from the plans dictated. due to an existing tree that was in the way. The builder wanted to save the tree, so the chimney design was slightly altered,thus placing the chimney on the easement. Mr. Moss has obtained signatures from the three utility companies, stating they have no objection to vacating this utility easement since it is not being used Exhibit. No, 3 to the Application . reflects signatures of Lone Star Gas Company, Texas Power F4 Light Company, and Southwestern Bell Telephone Company. MT. Eden moved to approve the application to vacate this utility easement. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Steyn #gels, Pippin, and Walker, and Mrs. McCormick None Mayor Pro Terr McCo'i.'i1:ick declared the motion c=arried. 1982-008 Euless City Council Regular Meeting - January 12, 1982 - Page Six ITEM VIII: CONSIDERATION OF AUTHORIZING CITY MANAGER TO ADVERTISE FOR BIDS Mr, Sternfels moved to authorize the City Manager to advertise for bids for the following items: 1) radio communication. system for police and fire services 2) 74' rotary' mower for Parks Department; 3) tree spade for Parks DepartMent; and 4) construction of Fire Station No 3, Mr. Walker seconded the motion. Ayes: Messrs, Sternfels, Walker, Pippin, and Eden, and Mrs. McCormick Nays: None Mayor Pro Tem McCormick declared the motion carried. ITEM IX: CONSIDERATION OF IMPROVEMENTS TO FM 157 AND ACCEPTANCE OF A MINUTE ORDER B THE TEXAS STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION Mr. Sustaire explained. that the Texas State Department of Highways and Public Transportation is planning to improve FM 157, from SH 10, south to South Pipeline Road, at the Euless City Limits. They have requested the right-of-way and the City. of Euless to maintain the utility easements. The roadway will be widened to five lanes, with earthern channels for drainage. The State expenditures will be approximately $2.7 million, with the project beginning in May 1.982 and taking about eighteen months to complete Mr. Walker moved to approve Minute Order No 79143 dated. December 16, 1981, by the Texas State Department of Highways and Public Transportation, and the City of Euless' participation as required for these improvements, Mrs. McCormick seconded the motion, Ayes: Mr. Walker, Mrs, McCormick, and Messrs. Pippin, Eden, and Sternfels Nays: None Mayor Pro 1 em McCormick declared the motion carried. 1'982 --009 Euless City Council Regular Meeting - January 12, 1982 - Page Seven ITEM X: CONSIDERATION OF AN ORDINANCE AND AN AG REEMENT FOR SIGNALIZATION IMPROVEMENTS TO SH 1 0 -- ORDINANCE NO. 69S Sustaire explained that the Texas State Department of Highways and Public Transportation is upgrading the signal lights along State Highway 10 in Euless. They will be changing the light fixture heads from six-inch to t'weive...in.ch size on four existing signals on SH 10. Also, they will be adding an additional signal system. at Ecto.r Drive and Simmons Drive, where they intersect SH 10. This will be an improvement for • the safety of traffic all along ;>H 10< The State is asking for the City to agree to allow these improvements; to maintain the signal lights; and to be responsible for police enforcement of these lights. Mr. Eden moved to approve first and final reading of an ordinance, and to enter into the agreement with the Texas State Department of Highways and Public Transportation for the s nnalization improvements to SH 10, Mr. Eden also moved to consider the ordinance on an emergency basis for the immediate preservation of the pudic peace, health, safety, and general welfare of the citizenry. ITEM XI: CONSIDERATION OF A BOARD APPOINTMENT TO THE LIBRARY BOARD • Mrs. McCormick stated that Librarian Betty Yarbrough had requested this item be tabled.. The Library Board wishes to submit additional applications, and would like for these to be considered at the same time at a later date. meeting Mat Eden moved to table this item until a future Mr. Sternfels seconded the motion. eyes: Messrs. McCormick Nays : None Mayor Pro Teri: McCormick declared the motion carried. 1982010 Euless City Council Regular Meeting - January 12, 1982 - Page Eight ITEM XII: PUBLIC HEARING ON A WATER RATE INCREASE FOR THE CITY OF EULESS • Mrs. McCormick opened the Public Hearing for a water rate increase for the City of Euless,, and asked if there were any proponents for consideration. Mr. James Knight, City Engineer, submitted a water rate analysis. He stated the last water rate increase had in the City of Euless was in October 1977, During 1981, the Trinity River Authority- informed the City that the cost of raw water will increase in 1982, but no definite figures have been forwarded from TRA regarding the amount of the increase. Mr. Knight stated that the recommended figures for the rate increase are $6.00 for the first. 2,000 gallons and then $1.05 for each additional 1,000 gallons. This two tier structure would replace the existing four-tier rate structure which reads as follows: $6,00 minimum rate for the first 2,000 gallons ; $1.00 per thousand gallons for the next 11,000 gallons; $0.85 per thousand gallons for the next 17,000 gallons; $0.75 per thousand gallons for any usage over 30,000 gallons. These revenues derived from water utility. billings pay for the cost of raw water, as well as operating the water office, maintenance of water lines, and outstanding bond indebtedness. Mrs, 'McCormick asked the City. Manager if he had a recommendation to offer. MT. Sustaire recommended that if raw water costs exceed. 26 per thousand gallons, that the actual pass through to the customer be what the actual increase is, and that this provision be written into the ordinance, He stated that this would amount to about a 40; per month increase to the average customer, This is figured on the average customer using about 8,000 gallons of water year-round, Mrs, McCormick asked if there were any further questions or discussion of the proponents, There being none, she asked. if there wore any other proponents. There being none , she asked. if there were any opponents. Mr, Raymond Salis, 1400 Driftwood Drive, Euless, spoke as an opponent to the request for a water rate increase. He stated he has lived in .Euless for seventeen years, and does not understand why the water rates in Euless are so large. He compared Euless charges for water and sewer to Grand Prairie charges for same. He stated that Euless charges $15,00 for 11000 gallons of water, and $15.80 for sewer fees, Grand Prairie charges $13.19 for 11,000 gallons of water, and $8,97 for sewer charges, He felt a family of four would use 11,000 gallons of water in the cooler 1982 -011 Euless City Council. Regular Meeting - January 12, 1982 _ Page:; Nine months, but would use 30,000 to 35,000 gallons o f water in the summer months. Mr. Sans state: that Euless has one of the highest rates in the mid-cities area. He also expressed concern. that more citizens wish d to protest the water rate increase, but the bad weather prevented. them from appearing tonight. He suggested that the City. look into saving money from the st.a.ndpoint of streamlining the management of the water office and possibly conducting an audit of the office to detee_.t. wasted costs. Mr. Sa"lis felt like Euless should be charging rates in line with wh.at. the neighboring cities are charging. Mr. Sustaire responded to Mr. Salis r remarks with some explanation. and answers to his questions. He informed Mr. Sails that the costs that keep going up are the raw water cots, not the operating and maintenance costs. Mr. Sustaire explained that Euless purchases water from the Trinity River.. He told Mr. Sas..i.s that the operating cost of the water system. in Euless has not increased $10,000 in seven years; the same p=eopl. e are still em i'_o gyred; the crew has been reduced; and. corners have been cut wherever possible in order to accomplish this Pt Walker suggested to Mr. Sa.l:i_s that he might read. two articles which appear in the Mid - Cities Daily News, one being in today's paper, which explains why Fort Worth and Dallas can purchase water at a Bess rate then Euless. Mr. Sal i s asked if the sewer rate would. increase. Mr. Sustaire stated it would not he affected by this water rate increase request. Mrs. McCormick stated that due to the bad weather tonight, the Public Hearing would be continued. to the next meeting on -January 26, 1982, to allow more citizens to appear and present their comments to the City Council. Mr. Pippin moved to continue the Public Hearing to January 25, 1982, at 8 :00 P.M. Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Eden, and Sternfels, and. Mr.'s. McCormick Nays: None Mayor Pro Tem McCormick declared the motion carried. 1982-012 Euless City Council Regular Meeting - January 12, 1982 - Page Ten XITI: CONSIDERATION OF PRELIMINARY PLATTING OF TALL TIMBERS ADDITION Mr, Jerry LaFountain, One Fountain Center, Euless, Texas, presented the preliminary platting of Tall Timbers Addition. Ile stated. that the Planning and Zoning Commission has approved the platting, and now requests City Council approval of same. The streets in this addition are private streets, and the City Attorney and Planning Department have been working on the project, Mr, Pippin asked if the City Council could require the streets to he built to City standards in the event the City would one day own the streets. Mr Knight, City Engineer, explained that the streets are being built to City standards. Mr. LaFountain said there would. be no problem with City inspectors examining the construction of the streets to ensure this was done. Mr. Sternfels asked if the final plat would determine il this had been done, and Mr. Knight stated it would. Mr, McFarland asked Mr, LaFountain why the streets were not now being designated as City streets. Mr. LaFountain answered that the addition included a security guard house at the entrance to the addition. Otherwise, the streets were like any other City street. Mts. McCormick moved to approve the preliminary platting of Tali Timbers Addition, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Eden seconded the motion. Mr. Boyd requested the City Council's approval of the prel imi.nary and final platting for ::urn's Cafeteria, Mr. Knight said there are no problems with the platting, and the Planning and Zoning Commission has approved both the preliminary and final platting s. Mr. Eden. moved to approve the preliminary platting of Lots 1 and 2, flock A, Furr''s Cafeteria Addition, .located south of Airport Freeway, west of_ South Sheppard Drive, and east of FM 157, in accordance with the Plannin`, and Zoning Commission. St.erif'elS and Pippin, and Mrs, McCormick Nays: None Mayor Pro Tem McCor'mr.ck declared the motion carried. 1982-014 Euless City Council Regular Meeting - January 12, 1982 - Page Twelve ITEM XVI : CONSIDERATION OF CALLING A PUBLIC HEARING FOR ZONING CASE NO. 357 Mr. Walker moved to call a Public Hearing for Zoning Case No. 357, an amended request of Andy Kidd. for a change of zoning from "C-2" Community Business District and "R-5" Multi- Family Dwelling District, to "PD" Planned Development (R-5 Density) on a portion of Tract 7, 7E1 FA 7E2, j, P. Halford Survey , A-711, located south. of Gibson 's, east of FM 157, and north of Clinic Drive, on February 9, 1982, at 8:00 P.M. Mr, Sternfels seconded the motion. Ayes: Messrs. Walker, Sternfels, Pippin, and Eden , and Mrs. McCormick Nays None Mayor Pro Tem. McCormick declared the motion carried. ITEM XVII: CONSIDERATION OF PARTICIPATION AS PLAINTIFFS IN HURST-EULESS-BEDFORD INDEPENDENT SCHOOL DISTRICT VS, TARRANT COUNTY AND MADRTN HUFFMAN City Attorney Bob McFarland. explained that this is a lawsuit to determine a question of law relating to the award ing of voting entitlements to various political subdivisions. Madrin Huffman certified for voting entitlements the various political subdivisions in Tarrant County and included special districts, such as the water district, and awarded those votes to the County If that stands, the voting entitlement of the other political subdivisions such as the schools and the cities, would obviously be diminisned If they are nut allowed voting entitlement based on their taxable revenue, then the County's vote total is reduced, and the cities stand in a higher status with a greater percentage of the total vote. This lawsuit was filed to obtain. a declaratory ruling of the Court. If the plain- tiffs prevail, it would be to the advantage of the City of Euless, and the School District has asked the cities to contribute from $100 to $400 to the anticipated costs of the lawsuit. Mr. McFarland stated that he joins with the recommendation of the City Manager and Mavor Samuels, to enter into this lawsuit. Mr. Walker moved that the City of Euless loin in as plaintiffs in Hurst-Euless-Bedford Independent School District vs. Tarrant County and Madrin Huffman- Mr. Sternfels seconded the motion. ITEM XVIII: CITY ATTORNEY'S REPORT Mr. McFarland stated that procedures are underway for the Bluebonnet Bridge project, in an effort to remedy the flooding situation. He said he hopes to have more news at the next meeting. ITEM XIX: CITY ENGINEER'S REPORT Mr. Knight stated he would like to recognize Mr. Larry Finney, City Building Official. He is a. member of the North Texas Chapter of the international Conference of Building Officials, and. was recently elected. their Secretary- Treasurer. PROGRESS OF DICKEY DRIVE RECONSTRUCTION Mr. Knight advised that crews have begun to remove the surface of Dickey Drive. Notices were posted in advance that this would be done , and if there were any problems for anyone, to con- tact City Hall, ITEM XX: CONSIDERATION OF AUTHORIZING CITY. MANAGER TO PROCEED WITH INSURANCE PACKAGE. FOR CITY OF EULESS Mr< Sternfels moved that the City Manager proceed with the 'insurance package as presented to City Council, and to authorize the City Manager to enter into the contract for same. Mr. Pippin seconded the motion. Ayes: MOSTS. Sternfels, Pippin, Eden, Walker, and Mrs, McCormick Nays: None Mayor Pro Tem McCormick declared. the motion carried. COMMENTS Mr. Sustaiye stated that studies are continuing with the Little Bear Creek Channelization Project. Mr,Sustaire recognized Col. Perkins , and advised that a study is still underway to try to improve his dangerous corner, and that progress is being made.
