Tuesday, March 9, 1952, in the Council Chambers of the Euless Municipal Building, by Mayor Harold D. Samuels, Councilmembers present were Mayor Pro Tem Willie Mae McCorrnick, and Councilmen Glenn Walker, Robert Pippin, Ron. Sternfels, and Bob Eden, Staff Members Present W. M. APPROVAL OF MINUTES The minutes of the regular meeting of February 23, 1982, were approved as wr {tten.. RECOGNITION ION OF BOY SCOUT TROOP Mayor Samuels recognized Boy Scout Troop 253 of Euless, and their Scoutmaster Guytan Roberts, and welcomed then; to the meeting. Green B) POLICE RADIO BIDS RECEIVED Motorola Corporation $16,800,00 $24,000.00 $166,466.00 1982-048 Mrs. McCormick moved to approve the bid received from Motorola, inc., in the amount of. $166,466.00 for the police radio system. Mr. Pippin seconded the motion. Ayes: Mrs. McCormick., Messrs. Pippin, Eden, Sternfeis, Walker Nays: None Mayor Samuels declared the motion carried. ITEM II: CONSIDERATION OF A BOARD APPOINTMENT Mrs. McCormick moved to table consideration of the board appointment to the Council for Social Concerns, as well as for all City boards and commissions, until reappointment time in May 1982. Mr. Walker seconded the motion. Ayes: Mrs. McCormick and Messrs. 'Walker, Pippin, Eden, Sterrifels Nays: None Mayor Samuels declared the motion carried. ITEM 111: CONSIDERATION OF RESOLUTION NO. 8,2-.523 Mr. Walker moved to approve Resolution No. 82-523, which adds a Bingo Proposition to the Official Ballot of the April 3rd Elections in the City of Euless. Mr. Sternfels seconded the motion, Mayor Samuels explained that the required number of valid signatures were presented by legal petition to the City Secretary's Offic.e, and that the proposition must now be brought before an election process. Ayes: Messrs. Walker, Sternfels, Eden, and Pippin, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1982 -0'9 Euless City Council Regular Meeting - March 9, 1982 Page Three ITEM Ian. CONSIDERATION OF CALLING A PUBLIC HEARING Mr. !Walker moved to call a Public Hearing on April 1.3, 1982, for Zoning Case No. 362, a requst of John Lynch for change of zoning from "R-1" Single Family Dwelling District to "PD" Planned Development for Single Family Attached and Townhome Dwellings with Variable Yards and Building Standards on the western portion of Tract 3H, A. J. Huitt Survey, A --709, located east of South Main Street:, south of E. Huitt Lane, and north of South Euless Elementary School. Mrs. McCormick seconded the motion. Ayes: Mr, Walker, Mrs. McCormick, Messrs, P;Ispi.ri, Sternfels Nays: None Abstentions: Mr, Eden Mayor Samuels declared the motions carried, ITEM. V: CONSIDERATION OF FIRST AND FINAL READING OF ORDINANCE. 698 City Attorney Bob McFarland that this ordinance was prepared to bring the City of Euless in compliance with recently passed legislation regarding platting procedures, Mr. Eden moved to approve first and final reading of Ordinance No 698, and to eiiini -irate the necessity of two readings due to urgent public necessity, Mr. Walker seconded the motion, Ayes: Messrs, Eden, Walker Sternfels, Pippin, and Mrs. McCormick Ni y None Manor Samuels declared the motion} carried, ITEM VI: PUBLIC HEARING FOR ZONING CASE. `O. 358 Mayor Samuels explained the Public Hearing process to those in attendance, and recognized Mr, Ron Addison to speak as a proponent for the zoning case. 1.982-050 Euless City Council R.egu.L r Meeting 4 March 9, 195 -- Page Four Mr. Ron Addison, 301 Westpark Way, Euless, represented Mr.Neal Adams and the owners of the property, George Midgley and Jaynes Packer. Mr. Addison reviewed the physical location of the property and the surrounding zoning. He stated that the owners felt the property would not develop under the commercial zoning it now has. This opinion was arrived at by reviewing the businesses in the. v'acinity, Many shops in this area have gone out of business in a short time. The owners wish to change the property to multi- family zoning and make it an active asset to the City. He commented that traffic would he no problem due to SH 10 nearby. Mr, Addison pointed out that even though the Planning and Zoning Commission denied the zoning request, he felt it was not a strong negative .feeling, toward the proect. The vote was close and was not a unanimous denial. He furthe r stated that the developer was more than wining to protect the integrity of the neighborhood. Mr. Pippin asked what the exterior of the buildings would look like. Mr. Mike Bowman explained that the exterior would be :prick, rec_tarngular, and .the setbacks would be staggered to give a more attractive appearance and avoid a 'cookie - cutter' effect. Mayor Samuels asked if there will he individual ownership of. the residences. Mr. Addison answered that an individual owner could purchase one of the buildings, but there would be apartments within the building. There was no plans at this time to convert to condominiums. Mr. Sternfeis asked exactly how many units would be built. Mr. Mike Stewart answered there would be 70 units, at 15.7 units per acre. Mayor Samuels asked if there were any other proponents to the zoning case. There being none, he asked if there were any opponents to the zoning case. Ms. Annabel Head, 2927 Needles, spoke against the zoning case. She stated that she has been a resident of Euless for twelve years and is employed with the Hurst-Euless-Bedford independent School District in the Special Education Section. She said that this school district is one of the best, but in the past five or six years there has been a decline in academic achievement due to the rise of transient students within the system. Ms. Head also mentioned t13;3.t the apartments in the area are not well maintained and their appearance is in a run -down condition. She said that the Euless Square .Apartments are the only ones that look nice and are well taken care of. She also stated that she would like to see the subject property develop as it is now zoned, for commercial business. Mayor Samuels asked if there were any other opponents to the zoning case. There being none, he asked if there were any questions or discussion of the Council. There being none, he declared the Public: Hearing closed, 1982-051 Euless City Council Regub r Meeting _ March 9, 1982 -- Page Five Mayor Samuels explained that since the Planning and Zoning Commission had denied the zoning chan6e request, it would require a four-fifths vote in the affirmative to approve the zoning case.. Mrs. McCormick moved to approve Zoning Case .No. 358 es presented tonight., with the 70 units, at 15.7 units per acre, for "R -`'F .Dwe ling District. Mr. Eden seconded the rTIotiort Mr. Eden further stated that he was in favor of the zoning change due to the lack of commercial development in this particular area. He said that at the time commercial zoning was placed at this property, it was blanket zoning and there was expected to be more traffic generated by whet was then `3H 183. Now, he believed. commercial is not the best use of the land. and it would be nice to have an attractive four -plex buffer in the area. Mrs. McCormick stated that the Torn Thumb Shopping Center is not always full of business establishments, so additional commercial zoning in this location would not be beneficial. Mr. Pippin stated that he could not support the "R -4" density due to the other a..ra.rtrnent.s in the area, but would be favorable for an "R...3" density- He stated he would like to see more single family attached or duplex units here rather than 70 units, Mayor Samuels commented that "1t --3's density would be 53 units. Mr. Pippin stated he could compromise to somewhere in the 50's for the number of units. Mr. Ster.:nfels stated he was concerned with the antpeor ante more so than the number of units. He wanted the buildings to be attractive and pleasing to the e� J e. Mr, Eden stated that he agreed, and that density is not always the answer. Quality; is the issue. Mr, Pippin further stated that he was concerned with the irripact on the schools in the area; that Central Junior High School is already occupied with the high density apartments in the area. Ayes: Mrs. McCormick, Messrs. Eden, Walker, Sternfel s Nays: M r. Pippin Mayor Sarni!s declared the motion carried. 1982-052 Euless City Council Regular Meeting - March 9, 1982 Page Six ITEM VII: CITY ATTORNEY'S REPORT Mr, McFarland stated that he had discussed his subject matter in the precouncil executive session, and had nothing further to report. ITEM VIII: CITY ENGINEER'S .REPORT Mr. Knight stated he had nothing to report. COMMENTS Mr. Sustaire advised that he would be out of town on March 23rd, at the time of the next City Council meeting. CITIZEN COMMENTS ON AIRPORT NOISE Ms. Ginger Smith, 601 Tanbark, expressed concern over the problem of aircraft noise over Euless. With the expansion of WI:NV Regional Airport she feared the noise would become even worse than it is at this time. She asked the Mayor why he had made a particular statement which appeared in a newspaper artide and asked the Mayor what position the City was going to -take regarding this noise problem. Mayor Samuels commented that he did not make the statement and cautioned Ms, Smith about believing everything she reads in the newspaper. Mr. McFarland explained the City's legal position on the matter and advised Ms. Smith as to what actions she or any citizen could take in the matter, Mayor Samuels agreed to talk to the D/FW Regional Airport Board and see if some remedy can be obtained for the noise problem created b aircraft over the City of Euless. Mr. Alan Moffett, 802 Dickey Drive, also commented on the airport noise and offered substantial information for the benefit of Ms, Spilth. It was mentioned That Mr. Moffett, Ms. Smith, and Mr. Bessemer might get together and see if favorable action can be taken. CITIZEN COMMENTS ON -rpm: RATE INCREASE Mr. L. B. Holmes inquired about the status of the Texas Power and Light Company rate increase. Mayor Samuels advised NM it would be later in the year before the City of. Euless would hold their Public Hearing on the matter. He advised that a study is underv,,ay at this time to detern-tine if Texas Power and Light Company .is justified in asking for the rate increase. Council Regular Meeting - March 9, 19S2 - Page Seven CITIZEN COMMENTS ON DUMPSTER NOISE 1982-053 Mr. Jim Morris, 3903 Pipeline, expressed concern about durnoster trucks making excessive noise at 300 and 4:00 in the mornings. Mrs. McCormick wiui contact Tarrant County Waste Disposal and see if the problem can be eliminated.
