CALL TO ORDER
1982 -206
:a regular meeting of the Euless City Council was called to order at 8:0.5
Tuesday, November 23, 1982, in the Council Chambers of the Euless Municipal
Building, by Mayor Harold D. Samuels. Councihnembers present were Mayor Pro Tem
Willie l.Iae. McCormick, and Councilmen Bob Eden, Robert Pippin, and R.or: Stern.tels.
Councilman sn Glenn Walker was absent.

APPROVAL OF MINUTES
The minutes of the regular meeting on November 9, 1982, were approves_: as

ITEM .I: SECOND AND FINAL. READING OF OR.DINANC E NO. 721
Ni ir, Pippin moved to approve second and final reading of Ordinance No.. 721,
or a change of zoning from "C.--2" Community Busines.s District and "I°1" Light
Industrial District to "C-22' Community Business District and "I-1" Light Industrial
District with Special Permit for Commercial Arnusernent and Beer Sales on certain
property of the A.M. Downing S1 rey, 3 -til . relating ciing tc Zoning Case
No. 376.
Mr. Sternfe s seconded the motion.

ITEM 2: FURTHER CONSIDERATION OF ZONING CASE NO, 373
Mayor Samuels asked City Attorney Bob McFarland to explain the City's
legal standing in further consideration of a zoning case after dosing of the Public
Hearing. Mr. McFarland explained that the Public Hearing for Zoning Case No. 37.3
was I:elc and closed at a previous City Council meeting on October 26, 1982, Further -
testimony from any parties for or against the proposed zoning change would violate
State law provisions regarding legal notice on such (natters; therefore, the City Council
can at their pleasure rna.ke inquiries of the parties involved, but cannot allow nor
conduct a testimony situation.
Mayor Samuels asked the City Council if they had any questions concerning
the matter before it was placed on the table for consideration. There being no
questions at that time, Mayor Samuels brought for .further consideration Zoning Case
No. 373 and asked the City Council if they had any questions. Mayor Samuels asked if
Sharon Emrick was in attendance. Mrs. Emri ;k stated that she was present, as well
as 3. A. Norman and Sheryl Mayes, who had all signed a letter which protested the
zoning rase. Mayor Samuels informed those in attendance that he had received Mrs.
Er; crick's letter and would file it with the zoning case.
Mr. Eden and Mr. Pippin requested clarification of the point that there would
be no driveway cuts or access to West Pipeline Road from the proposed "R -3" section
01 the apartments complex. It was confirmed by Mayor Samuels that this was what
the revised development plan reflected, and that all ingressiegress would be to Highway
10.

Mr. Sternfels stated that he felt. the decrease in density did not eliminate all
the problems previously discussed, but the "R-4" density would be compatible with the
surrounding community and would buffer the "R-I zoning from the heavy industrial
area to the south,
Mrs. McCormick moved to approve Zoning Case No. 373 in accordance with
the recommendations of the Planning and Zoning Go(nlmmiiSsion, but with a density of
sixteen units per acre: with the "R°3" buffer at the north next to West Pipeline Road
remaining as shown on the development plan submitted November 19, 1982; that the
total project contain no more than 400 units; and that the "R..3 section he constructed
to meet "R -3" standards,
Mr. Pippin seconded the motion.
Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Sternfels
Nays: None
Mayor Samuels declared the motion carried.
Mayor Samuels commented that Councilman Glenn: Walker had expressed that
he 'H'o'ld favor an "R-4" overall density for this zoning case.
ITEM 3: CONSIDERATION OF PLATTING
Mr. Eden moved to approve the final platting of Sizemore Estates, Lots 1 and
2, Block 1, located east of South Main ,Street, south of Alexander Lane, north of Nuitt
Lane, and 'west of Cullum Drive, in accordance with the recommendations of the
Planning and Zoning Commission.
Mrs. McCormick seconded the Motion.
Ayes: Mr. Eden, Mrs. McCormick, Messrs. Sternfels, Pippin
Nays: None
Mayor Samuels declared the motion carried.

ITEM 4: CONSIDERATION OF PLATTING
Mr. Eden moved to approve final platting of McCormick Farm Phase Two 13,
located west of Fuller-Wiser .Road, east of North Main Street, south of proposed Cheek-
Sparger Road, and north of Little., Bear Creek, in accordance with the recommendations
of the Planning and Zoning Conwilssion.
Mr. Sternfels seconded the motion.
Ayes: Messrs. Eden, Sternfels, Pippin, Mrs, McCormick
Nays-. None
Mayor Samuels declared the motion carried.
ITEM .5: PUBLIC HEARING FOR ZONING CASE 378
Mayor Samuels opened the Public Hearing for Zoning Case No. 378, a request
of Wayne Brewer for a change of zoning from "R-1" Single Family Dwelling District to
"C-2" Community Business District on Lots 11-.1.5, Block 3, and Lots 1-4 and 23, Block
4, 13e11 Ranch Terrace Addition, located south of Euless Town Centre Shopping Center,
west of and a.djacent to FM 137, and north of Signet Drive.
Mr, Wayne Brewer, 320 Fort Worth Club Biiilding, Fort Worth, Texas,
presented the zoning change request, explaining the plans for establishing a retail
center at the site and completing Kynette Street to FM 1.57. He informed the Council
that there were no formal lease agreements at this time, but they were planning on
establishing a convenience store with a self-service gasoline facility, as well as several
small retail shops, He stated they plan to blend architectually with. the surrounding
buildings, to offer attractive landscaping, and to improve the drainage situation on
these lots. Lot 20, though not a part of this zoning case, is included in their retail
center COF npiex.
Mayor Samuels asked if there were any additional proponents to the zoning
case. There being none, he asked if there were any opponents to the zoning case.
There being none, he asked if there were any questions or discussion of the Council.
There being none, he declared the Public Hearing closed,
Mrs, McCormick moved to approve Zoning Case No. 378 in accordance with
the recommendations of -the Planning and Zoning Commission.
Mr. Pippin seconded the motion.
Ayes: Mrs. McCormick, Messrs, Pippin, Eden, Sternfels
Nays: None

ITEM 6: PUBLIC HEARING FOR ANNEXATION

Mayor Samuels opened the Public Hearing for annexation of 3.3 acres of land
located directly south of State Highway 183 and east of Huntington Drive approximately
200 to 600 fee, , being land situated in the A 1> Huitt Survey, A 709, E air n t County,
Texas.
City Attorney Bob Mc:Farlarld spoke as the proponent for the City of Euless
and explained that this annexation proceeding \,vas brought about to better align t he city
limit boundaries between Euless and Fort Worth. The boundary was originally
established along a creek and the creek over the years has changed its course, making
it difficult to deterrnine a definite legal boundary line. The annexation proceeding would
more clearly define the boundary and eliminate the need for depending on the
establishment of the creek for city lilt determination. Mr. McFarland explained the
annexation process, including public hearing requirements, and the service plan for the
area involved.
Mayor Samuels asked if there were any other proponents for the annexation,
There being none, he asked if there were any opponents to the annexation. There being
none, he asked if there were any questions or discussion of the CouncE :. There being
none, he declared the Public Hearing closed.
Mr. Sternfels moved for the City to proceed further to complete the
annexation process and service plan for annexation of this land into the City of Euless.
Mr. Pippin seconded the motion.
Ayes: Messrs. Stern. els, Pippin, Eden, Mrs. McCormick
Nays: .None
Mayor Samuels declared the motion carried.
ITEM 7: CITY ATTORNEY'S REPORT
Mr, McFarland stated he had nothing to report.

ITEM 9: COMMENTS
A) City Manager Sustaire stated that the Senior Citizens Thanksgiving Dinner
was greatly en)oyed by those who attended, and those who did not attend were missed.
He stated that a special prayer was offered for Mrs. McCormick, for her speedy
recovery from eye surgery.
B) City Manager Sustaire stated the City's Christmas Dinner would be on
December 20th at 1130 and the City Council and their families were invited to
attend.
ADJOURNMENT
There being no further business before the City Council, the meeting was
adjourned at 845 P.M.
