CALL TO ORDER

A called meeting of the Euless City Council was called to order at 6 :3O P. *-1.,
Tuesday, December 21, 1982, in the Council Charnbers of the Euless Municipal Building,
by Mayor Pro Tern Willie Mae McCormick. Counci-lrnernbers present were Bob Eden,
Gj.erm Walker, and Ron Sternfels, Mayor Harold D. Samuels and Councilnternber Robert
M, Pippin were absent,

The minutes of the regular meeting on November 23, 1982, were approved as
written,

Mr. Eden moved to approve second and final reading of Ordinance No. 722, for
a change of zoning from "C^ -2" Cornrnunity Busfness District to "R• -.3`f and "R -4 Multi-
Family Dwelling District with "CUD" for Conforming T-Iousinl.; for certain property out
of the 3. Groves Survey, A-599, relating to Zoning Case No. 373.
Mr. Walker seconded the motion.

Nays: None
Mayor Pro Tem McCormick declared the motion carried.
ITEM 2: SECOND AND FINAL READING OF ORDINANCE NO. 723
:Mr, Sternfels moved - to approve second and final reading of Ordinance No. 72.3,
.for a change of zoning from "R -1" Single Family Dwelling District and "C-I"
Neighborhood Business District to "C-2" Community Business District for certain
property out of the Bell Ranch Terrace Addition, relating to Zoning Case No. .378.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Eden, Mrs. McCormick
Nays: None
Mayor Pro Tern McCormick declared the motion carried.
ITEM 3: CONSIDERATION OF ORDINANCE NO. 728
Mr. Walker moved to approve an ordinance for annexation of.3.3 acre.:; of land
located directly south of State Highway 183 and east of Huntington Drive, for certain
property out of the A. 3. Huitt Survey, A -709.
Mr. Eden seconded the motion.

.1TE m 4-A: CONSIDERATION OF AN ORDINANCE
Mr. Paul Unzicker- of Duncanville, Texas, presented the request for approval
of an ordinance for vacation of a portion of North Main Street, north of Little Bear
Creek. The purpose of the action was outlined as twofold: (1) for the proposed
alignment of the northbound lanes of North Main Street, with a different radius curve;
and (2) for the development of property adjacent to the northbound lanes, filling in the
elevated hanks between the roadway and property, far enough for two buildings to drain
forward toward the street approximately one .toot above the curb elevation. Mr.
Sternfels asked about the possibility of soil erosion and Mr. Unzicker explained there
would be sufficient slope to avoid this problem, and seeding and/or sodding would be
started. Mr. Eder: asked about the slope to the south. Mr. Unzicker stated that slope
was gradual enough not to pose an erosion problem, being a three --to -one slope, whereas
the other was a ten-to-one slope. Mr, Walker asked if they planned to install retainer
walls, and Mr. Unzicker stated they did not pan to do this; that they felt the slope with
sodding was sufficient to avoid developing an erosion problem. Further discussion was
had concerning the opposing curb alignment on North Main Street, maintenance of right-
of-ways, paving, and what the City might gain from the change. Mr. Eden asked the
City Engineer who would gain 'frorn this proposal, and the City Engineer responded that
the developer would be the one who would gain. Mr. Eden stated he had no problem
with doing away with right --of -way if the City benefits, or if the City would not need
it in the future, David Bagwell stated that the developer would be willing to bear the
expense of the curb realignment on North Main Street which would be necessary from
their proposed change. Mr. Walker was concerned with the City Council setting a
precedent for street right-of-way abandonment on future issues.

Mr. Eden moved to approve an ordinaance for vacation of a portion of North
Main Street, south of Cheek - Sparger Road and north of Little Bear Creek, with the
following conditions: (1) that the developer bear the expense for curb realignment
necessary by the change; (2) that the developer fill the banks to the level determined
necessary by the City Engineer; and (3) that the ordinance be approved on an emergency
basis.

ITEM 4-B: CONSIDERATION OF PLATTING
At the developer's request, Mr. Walker moved to table consideration of final
platting of McCormick .Farris Phase Three A until a later date.

ITEM 5: CONSIDERATION OF CALLING A PUBLIC HI.ARING
Mr. Eden moved to call a Public Hearing on January 11, 1983, for Zoning Case
No 380, a request of Bobby Harrell for a change of zoning from "R -1" Single Family
Dwelling District and "R-3" Multi -- Family Dwelling District with "CUD" for Conforming
Housing to `tR--5 Multi- Family .Dwelling District with "CUD`{ for Conforming I..Iousirig
and "C--2" Community Business District, on Tracts 4B, 4P5, 4B6, and a portion of 4E,
R. Crowley Survey, A-312, located south of Little Bear Creek, east of Fuller-Wiser
Road, west of DFW Airport property, and north of Harwood Road,
Mr. Walker seconded the motion.
Ayes: Messrs. Eden, Walker, Sternfels, Mrs. McCormick
Nays: None
Mayor Pro Tern McCormick declared the notion carried.
ITEM 6: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr. Walker moved to call a Public Hearing on :January 25 198.3, for Zoning
Case No 331, a request of Robert W. Cummings for Donald H. Ditmore for a change
of zoning from "R-1" Single Family Dwelling District to "C -2" Community Business
District, on Tracts IA & ?Al, A. M. Downing Survey, A -415, located north of SH 10,
south of Mary Drive, east of Debra Drive, and west of Marlene. Drive.
Mr. Eden seconded the motion.
Ayes: Messrs. Walker, Eden, Sternfels, Mrs. McCormick
Nays: None

ITEM 7: CONSIDERATION OF ORDINANCE NO. 724
Mr. Eden moved • to approve Ordinance No, 724, declaring an emergency for its
passage on first reading, vacating and abandoning a public utility easement on a portion
of Lot 14, Block G, Cinnamon Ridge Phase Two Addition to the City of Euless.
Mr. Sternfels seconded the motion,
Ayes: Messrs. Eden, Sternfels, Walker, Mrs, McCormick
Nays: None
Mayor Pro Tein McCormick declared the motion carried.
ITEM 8: CONSIDERATION OF ORDINANCE NO. 72.5
Mr, Eden moved to approve Ordinance No. 725, declaring an emergency for its
passage; on first reading, for vacating and abandoning a public ?E%.E.I.tty easement on a
portion of Lot 31, Block .1: Cinnamon Ridge Phase Two Addition to .the City of Euless.
Mr, Stern.fels seconded the rnotion.

Mr. Eden moved to approve Ordinance No. 726, declaring an emergency for its
passage on first reading, vacating and abandoning a public utility easement on a portion
of Lot 35, block E, Cinnamon Ridge Phase Two Addition to the City of Euless.

ITEM 10: CONSIDERATION OF ORDINANCE NO. 727
Mr. Eden moved to approve Ordinance No 727, declaring an emergency for its
passage on first reading, vacating and abandoning a public utility easement on a portion
of Lot 44, Block K, Cinnamon Ridge Phase Two Addition to the City of Euless.
Mr. Sternfels seconded the notion.

ITEM 11: CONSIDERATION OF RESOLUTION NO, 82-:535 FOR A STREET AND OPEN
SPACE DLDI(. ATIO
Mr, Sternfels moved to approve Resolution No 82-515 for a street and open
space dedication of approximately 26,420 square feet of land to the City of Euless at
the 2300 block of North Main Street.
Mr. Eden seconded the ruction.

City Attorney Bob McFarland stated he had nothing to report.

ITEM 13: CITY ENGINEER'S REPORT
Mr. Knight stated that Tarrant County Planning Department had received bids
for the reconstruction of freestone Drive, Limestone Drive, and Limestone Court in
Midway Park Addition. Harrod Paving Company, Inc., submitted the low bid of
$43,327.50. This project would be funded from the Community Development Block
Grant program. Tarrant County Commissioners' Court will award the bid; however, they
require that the City of Euless recommend award of the contract since work is to be
performed in the City of Euless.
Mr. Walker moved to accept the low bid of $43,327.50 by Harrod Paving
Company, Inc. for the reconstruction of Freestone Drive, Limestone Drive, and
Limestone Court in Midway Park Addition.
Mr. Eden seconded the motion.
