Samuels, Councilmembers present were Mayor Pro Tern Willie Mae McCormick; and Councilmen Robert Pippin, Bob Eden, Glenn Walker, and Ron Ster-nfels, Staff Members Present W. M. APPROVAL OF MINUTES The minutes of the regular meeting on March 8, 1983, were approved as written, ITEM 1: SECOND AND FINAL READING OF ORDINANCE NO. 733 Mrs, McCormick moved to approve second and final reading of Ordinance No 733, for a change of zoning from "R -I." Single Family Dwelling District, to "C-2" Community Business District, for certain property out of the A. 3. l'luitt Survey, A. -709, relating to Zoning Case No. 371. Mr, Walker seconded the motion. Ayes; Mrs. McCormick, Messrs. Walker, Eden, Pippin, Sternfels Nays: None . Mayor Samuels declared the motion carried. ITEM 2: SECOND AND FINAL READING OF ORDINANCE NO. 734 SIr, Pippin moved to approve second and final reading of Ordinance No 7314, for a change of zoning from "R-i'° Single Family Dwelling District, to "R_3" Multi - Family Dwelling District with "CUD" for Townhornes, for certain property out of the 3. P> Halfor•d Survey, A-711, relating to Zoning Case No. 388. Mr. Sternfels seconded the motion. Ayes: Messrs. Pippin, Sternfels, Eden, Walker, Mrs. McCormick (Flays: None Mayor Samuels declared the motion carried, 1.983 -i=r8 lt.uless City Council Regular Meeting - March 22, 1983 - Page Three ITEM 3: CITY SECRETARY'S REPORT The City Secretary's Report stated that on Monday, March 7, 1983, a thirty - seven page ''Petition by the Citizens of the City of Euless, Texas," was presented to the City Secretary for certification and presentation to the Euless City Council. The petition requested the City of Euless to change the zoning classification of property now zoned "R -.4" and "R -5" to "R-1," being 11.516 acres of land exhibited in the James Matson Survey, A-1080 and presently owned by Chow P. Tsai. The following results were indicated: .513 signatures were verified as registered voters presently residing within the corporate limits of Euless; 82 signatures were not reflected as registered Voters; 4 signatures were unable to be verified`, and a total of 599 signatures submitted. The 513 verified signatures appeared to present in excess of the required number of verified voters for an Initiation Petition. The City Secretary's certification was dated March 16, 1 98 3. Mr. Walker moved: to refer the petition to the City Attorney to research the legal aspects involved and present a written legal opinion at the next regular City Council meeting on April 12, 1983. Mr. Sternfels seconded the motion. Ayes: Messrs. Walker, Sternfels, Eden, Pippin, Mrs. McCormick Nays: None Manor Samuels declared the motion carried. ITEM 4; AUDIT NC. E REQUESTED BY ELEENE HOSKINS Mrs. .leene Hoskins, 1802 Marlene, Euless, made a presentation to request the City of Euless to consider purchasing a number of outdoor civil defense sirens to notify persons who are outdoors of impending danger from weather or attack. Mayor Samuels stated that he had asked Mr. Frank Douglass to he at this meeting and Mr. Douglass was in attendance. Mayor Samuels requested Mrs. Hoskins to meet with Mr. Douglass and work with him to outline a proposed plan for obtaining the sirens, ,,v.th projected costs and justification for same. Both Mrs. Hoskins and Mr. Douglass agreed to conduct this study and report back to the City Council. .1983 -049 Euless City Council Regular Meeting -- March 22, 1983 -- Page Four ITEM .5: CONSIDERATION OF RESOLUTION NO. 83 -338 Mr. Sternfels moved to approve Resolution No. 83-538, calling a bond election for the City of Euless on Saturday, May 21, 1983. Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Walker, Eden, Pippin, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 6: CONSIDERATION OF A CERTIFICATE OF CONVENIENCE E fir. Walker moved to grant a certificate of convenience. to Mid- Cities Taxi Company, with the stipulation that the annual fee for same be paid in advance each year. Mr. Pippin seconded the motion. Ayes: Messrs, Walker, Pippin, Sternfels, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 7: CONSIDERATION OF A CONTRACT RENEWAL Mr. Sternfels moved to renew the annual contract with the Hurst-Euless- Bedford Chamber of Commerce for their services to the City of Euless, said contract for the period of October 1, 1982, to October 1, 1983. Mr. Pippin seconded the motion. Ayes: Messrs. Sternfels, Pippin, Walker, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. Mrs. McCormick mentioned that the audience may like to know that the funds for this contract come from the collection of hotel and motel tax revenues, authorized by the State, and designated for expenditure on items to attract visitors and tourism to the City of Euless. 1983 -050 Euless City Council Regular Meeting -- March 22, 1983 Page Five ITEM 3: CONSIDERATION OF FEES Mr. Eden moved to approve the suggested Parks and Recreation Department fee adjustments per departmental memo dated March 14, 1983, to City Manager W. M. Sustaire from Jufla Wakeiy, outlining five areas of needed adjustment. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Pippin, Sternfeis, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1TE. -M 9: CONSIDERATION OF PLATTING Mr. Eden moved to approve preliminary platting of Ector Gardens, Lots 4 and S, Flock 1, located west of South Ector Drive, east of Skyway Drive, north of SH 10, and south of SH 133, in accordance with the recommendations of the Planning and Zoning Commission. Mrs. McCormick seconded the motion. Ayes: Mr. Eden, Mrs, McCormick, Messrs. Pippin, Walker, Sternfeis Nays: None Mayor Samuels declared the motion carried. ITEM 10: CONSIDERATION OF PLATTING Mr. Pippin roved to approve final platting of Ector Gardens, Lot 4, Block 1, located west of South Ector Drive, east of Skyway Drive, north of SH 10, and south of SH I83, in accordance with the recommendations of the Planning and Zoning Commission, Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Eden, Sterrifels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1 983 -051 Euless City Council Regular Meeting - March 22, 1983 - Page Six ITEM 11: CONSIDERATION OF PLATTING Mr. Eden moved to approve final platting of McCormick Farm - Phase Three B, located south of proposed Cheek - Sparger Road, west of Fuller -Wiser Road, east of North Main Street, and north of :Little Bear Creek, in accordance with the recommendations of. the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Pippin, Mrs. McCormick Nays: Mr. Sternfels Mayor Samuels declared the motion carried. :Mr, Sternfels stated that he had voted nay for this platting because he had previously voted nay regarding the zoning case related to this plat. Mrs. McCormick stated that even though the addition carries the name of McCormick Farm, she has no interest in the property. ITEM .12: CONSIDERATION OF PLATTING Mr, Eden moved to approve final platting of Sycamore Square Addition, located south of Needles Street, north of SH 10, and east and adjacent to Raider Drive, in accordance with the recommendations of the Planning and Zoning Commission. Mr, Walker seconded the motion. Ayes: Messrs. Eden, Walker, Sternfeis, Pippin, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1953 -052 Euless City Council Regular Meeting March 22, 1983 - page Seven ITEM 13: PUBLIC HEARING FOR. ZONING CASE NO. 384 Mayor Sarnuels explained the Pu blic Hearing process and opened the Public Hearing for Zoning Case No. 384, a request of Jim Dunaway for Jim Harris for a change of zoning from "PD" Planned Development with "R--2" Two - Family Dwelling District to "PD" Planned Development with "R -2" Two - Family Dwelling District with Revised Site Plan of Northgate Addition, located south and adjacent to Glade Road, west of North. Main Street, and east of Quail Run Estates, Mr. :Jim Dunaway presented the zoning request and outlined the provisions as presented to the Planning and Zoning Commission, He stated that after the Planning and Zoning Public Hearing was closed, an item of discussion came up that warranted further attention. Because se the hearing had been closed, the petitioner was not allowed to explain or discuss the matter, so he would like to go into detail on the subject tonight. The question arose concerning the T- -parking configurations on the proposed plan. x;1r. Dunaway explained that FHA had refused to finance the lots with the original parking designs, and had suggested alternative designs. After meeting with the City Staff, the petitioner had finally arrived at the design as reflected on the plans presented to the City Council this night, Mayor Samuels asked if there were any other proponents for the zoning change. There heirrg none, he asked if there were any opponents to the zoning change. There being none, he asked if there were any discussion or questions of the Council. There being none, he declared the Public Hearing closed. Mr. Pippin moved to approve Zoning Case No. 384, with the revised site plan and with the following stipulations: (1) minimum floor area for any one unit of 1,000 square feet and maximum loor area of .1,2.50 square feet; (2) minimum floor area for any combination of two units be set at 25% at 2,000 square feet, 25% at 2,100 square feet, and 50% at 2,200 square feet; and (3) parking be provided at the rear of the units. Mr. Sternfels seconded the motion. Ayes: Messrs. Pippin, Sternfels, Eden, Walker, Mrs. McCormick Nays; None Mayor Samuels declared the motion carried. 1983 -055 Euless City Council Regular Meeting - March 22, 1983 - Page Eight ITEM 14: PUBLIC HEARING FOR ZONING CASE NO. 389 Mayor Samuels stated that the item for consideration was Zoning Case No, 3S9, a request of Glen Hinkley for a change of coning from "R -1" Single Family Dwelling District to "C -2" Community Business District and "R--5" Multi-Family Dwe.iling District, on Tracts 2C, 3B, 4B, 2, 3 & 4, B. Harrington Survey, A-8O8, and Tracts 4D, 4F & 4F1, Levi Franklin Survey. A -513, located east of FM 157, west of Ba.ze Road, and south of Glade Road. Mr. Glen Hinkley had presented a written request that this item be tabled :until a later date in order to ac complkh some changes in the area of commercial zoning and a "CUD" classification for the property. 1983. Mr. Walker moved to table this Public Hearing and reschedule it for April 26, Mr. Pippin seconded the motion. Eaves: Messrs. Walker, Pippin, Eden, Sternfels, Mrs. McCormick Nays: None Mayor Sarnuels declared the motion carried. ITEM 15: PUBLIC HEARING FOR. ZONING CASE NO. 390 Mayor Samuels stated that this item of consideration was for Zoning Case No. .390, a request of Jack Reimer for a change of zoning from "R -1" Single Fannnily Dwelling District 10 "R--5" Multi - Family Dwelling District with "CUD" for Conforming Housing, on Tracts 4 & 4B, Levi Franklin Survey, A--513, located east and adjacent to FM 157, west of Bear Creek Estates, and north of Little Bear. Creek. Mr. Jack .Reimer had also submitted a written request to table this item until a later date. His and was adjacent to Mr. Hinkley's property, and they had planned to work together to accomplish the chan6es discussed regarding the commercial and "CUD" aspects of zoning. Mr. Walker moved to table the Public: Hearing for Zoning Case No. 390, and to reschedule it for April 26, 1983. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Eden, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried, 1983 -054 Euless City Council Regular Meeting - March 22, 1953 -- Page Nine ITEM 16: CONSIDERATION OF CALLING A PUBLIC HEARING Mr. Sternfels moved to call a Public Hearing on May 10, 1983, for Zoning Case No. 395, a request of .Harry Chapman for a change of zoning from "R--I" Single Family Dwelling District to "Id -3" Multi- Family Dwelling District on Tracts 1A4 and 1A5, 3. E. Field Survey, A- 540, located south of Glade Road. north of Augustine Drive, east of Baze Road, and west of Clover Lane. Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Walker, Pippin, Eden Nays: None Mayor Samuels declared the motion carried. (City Secretary Notation: Mrs. McCormick was absent from the room during voting.) ITEM 17: CONSIDERATION OF CALLING A PUBLIC HEARING Mr. Pippin moved to call a Public Hearing on May 10, 1983, for Zoning Case No. 396, a request of Paul Spain for a change of zoning from "R -1" Single Family Dwelling District to "R-5" Multi- Family Dwe.l.ling District with "CUD" for Conforming Housing, on Tracts 4B1, 4B1A & 4D, R. Crowley Survey, A -312, located south of Little Bear Creek, west of DPW Airport, east of Fuller -Wiser Road, and north of Harwood Road. Mr, Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Eden, Sterntels Nays: None Mayor Samuels declared the motion carried. Crowley Survey, A-312, .located south of Little Bear Creek, west of DPI' Airport, east of Fuller -Wiser Road, and north of Harwood Road. Mr. Walker seconded the motion. Ayes: Messrs, Pippin, Wacker, Sternfels, Eden Nays: None Mayor Samuels declared the motion carried. (City Secrtary Notation: Mrs. McCormick was absent from the room during voting.) ITEM 19: CONSIDERATIO. OF RESOLUTION NO. 83 -543 Mr. Eden moved to approve Resolution No. 83-543, to nominate Mr. Gaylon Mayfield as a representative to the Tarrant Appraisal District. Mr, Walker seconded the motion. Ayes: Messrs. Eden, Wacker, Sternfels, Pippin, Mrs. -lcCorniick Nays: None Mayor Samuels declared the motion carried, ITEM EM 20: CONSIDERATION OF RESOLUTION NO. 83 -54t Mr. Sternfels moved to approve Resolution No. 83-544, to recommend that the City of Euless participate in the :lobs Partnership Training Act which will replace the CETA program, with the City of Fort Worth. Mr, Pippin seconded the motion. Ayes: Messrs. Sternfels, Pippin, Eden, Walker, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1983-056 Euless City Council Regular Meeting - March 22, 1983 - Page Eleven ITEM 21: CITY ATTORNEY'S REPORT Mr. Crib ?cis stated he had nothing to report. ITEM 22: CITY ENGINEER'S REPORT Mr. Knight stated that he had nothing to report COMMENTS City Manager W. M. Sustaire advised the City Council that he would be out of town until next Monday, March 28th.
