Mayor Harold D. Samuels. Councilmenabers present were Mayor Pro Tem Willie Mae N'1cCormick, and Councilmen Bob Eden, Glenn Walser, Robert Pippin, and Ron Sternfels. Staff Members Present. W. M. APPROVAL OF MINUTES The minutes of the regular meeting on March 72, 1983, and the called meeting on April 2, 1983, were approved as written. 1983-064 Euless City Council Regular Meeting T April 12, 1983 - Page Two ITEM 1: SECOND AND FINAL READING OF ORDINANCE NO. 735 Mrs, McCormick moved to approve second and final reading of Ordinance No. 735, for a change of zoning from "PD" Planned Development "R-2" Two- Family Dwelling District to "1='D" Planned Development "R -.2" Two - Family Dwelling District with Revised Site Plan, for certain property out of the 3. E. Field Survey A -540, relating to Zoning Case No. 384. Mr. Sternfels seconded the 'motion. Ayes: Mrs. McCormick, Messrs. Sternfels, Pippin, Walker, Eden Nays: None Mayor Samuels declared the motion carried. ITEM 2: CITY ATTORNEY'S REPORT ON INI I°1AT1VE. PETITION City Attorney Bob McFarland presented the legal opinion regarding the initiative petition presented on March 7, 1983, and containing 599 signatures, 313 of whic h were found to be valid. On March 22nd the Euless City Secretary formally presented the petition to the City Council, at which time the Euless City Council requested a legal opinion as to its proper and legal direction. Mr. McFarland presented an eight-page written opinion which indicated the following summary comments: "Though the initiative petition submitted on March 7, 1983, contains the requisite number of signatures of registered voters residing within the City of Euless, Texas, to comply with the provisions of Section 1 of Article IV of the Euless City Charter, the subject matter of such petition, to-wit: the call of an election for the adoption of an ordinance zoning property within the City of Euless, Texas, is not permitted under Texas law." Mr. McFarland distributed copies of the opinion to the Euless City Council, to member of the press, and to representatives of the Westpark Way Homeowners' Association, He informed the audience that the document could be viewed and /or copies purchased from the City during normal business hours. 1983-06.5 Euless City Council Regular ~Meeting - April 12, 1983, Page Three TTE.M 3: PU[kl..IC. HEARING FOR ZONING CASE NO 385 Mayor Samuels explained the Public Hearing process and opened the Public Hearing for Zoning Case No. 385, a request of Jack Craycroft for Frank E. Crumie,; for a change of zoning from "R -1" Single Farnlly Dwelling District, "R-2" Two -- Family, Dwelling District, and "R -5" Multi-- F- an-iily Dwelling District to "PD" Planned Develop- ment for Multi- Family (R -3 Density), 0 -Lot Line Single Family, and Office Complex, on Tracts 2, 2A & .3, of the .1. Matson Survey, A -1050, located east of \vestnark s‘VayQ nort h and south of Marlene Drive, and west of Oakwood Terrace North Addition, Mr. Jack Craycroft, The Craycroft Architects, Inc., 2710 Oaklawn, Suite 101, Dallas, Texas, 75219, presented the request for, rezoning. He stated that approval was requested for a planned development with an office complex to be located north of Marlene Drive, 180 one -- story condoninium.s to he located south of Marlene Drive, and 17 0 -lot line single family homes to be located east of and along the path of the creek at this site. He pointed out that the density had been reduced with this request, and that the largest building in the multi-family area Would contain six units. Other persons speaking in favor of the zoning change were Randall McMullin and James Clark, both property owners to the south of the subject site. Mayor Samuel: asked if there were any additional proponents for the zoning case. There being none, he asked if there were any opponents to the zoning change, Mr. Evan P. Cottrell, 713 Live Oak Drive, Euless, stated he was concerned about the extra drainage, traffic, and density the proposed development would bring to the area. Mr. Scott Heitman, .508 Live Oak, stated he was speaking on behalf of the West park Way Homeowners' Association, who had presented a formal petition of protest for this zoning change. The petition consisted of 91% of the residents living within 200 feet of the site. Mayor Samuels asked if there were any additional opponents to the zoning change. There being none, he asked if there were any further questions or discussion of the Council. "i'here being none, he declared the Public Hearing closed. After discussion of several aspects of the case, Mr. Sternfels moved to give the developer an opportunity to withdraw his zoning change request. Mr. Pippin seconded the motion. Ayes: Messrs, Sternfels, Pippin, Eden, Walker, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. At this time, Mr, Jack Craycroft announced that he was withdrawing his zoning request. 198.3 -066 Euless City Council Regular Meeting - April 12, 1983 -- Page Four ITEM 4: PUBLIC HEARING FOR ZONING CASE NO. 392 Mayor Samuels opened the Public Hearing for Zoning Case No. 392, a request of J. R. Mc Dearman for a change of zoning from "R-1" Single Family Dwelling District to ''C -2" Comfnunity Business District and "1?- -r.F„ Multi- Family Dwelling District, on Tracts 1A2 a 1A6, E. Taylor Survey, A-1505, located south and adjacent to Glade Road, west of Fuller-Wiser Road, and east of North Main Street. Mr. Sohn Mc Dearman presented the request for a zoning change at this location, stating that the area included 5,513 acres of R_4 and 9.482 a.cres of C -2, of which 4,41 acres includes proposed right -of -way for SH 360. He had agreed to keep the R -4 area as shown on the site survey map, to set a 250 foot strip northeast from the R-4 section to be C -2, and leave the remaining balance as R- honing. Mayor Samuels asked if Mr. McDearman would consider continuing this Public Hearing until May 24th, at which time Zoning Case Nos. 398 and 400 would be heard, since these three cases were in the same area and contained si.rnilar zoning requests. Mr.. McDearman stated he had no objection to such a. continuation.. Mrs. McCormick moved to continue the Public Hearing on Zoning Case No. 392 until the May 24, 1983, City Council meeting. Mr. Pippin seconded the motion. Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Walker, Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM .5: ACCEPTANCE OF THE OFFICIAL ELECTION RESULTS Mr. Walker moved to accept the official election results as presented on April 2_ 1983, by Election Judge Howard W ilkinson. Regular Meeting - April 17, 1983 - Page Five ITEM 6: OATH OF OFFICE FOR ELECTED OFFICIALS City Attorney Randy !`rice administered the oath of office to Mayor Samuels, Councilwoman McCormick, and Counc_iirnan Eden. ITEM 7: COMMENTARY BY SCOTT HEITMAN Scott Heitman, 503 Live Oak Drive, Euless, presented a commentary relating to multi -- family zoning near the area of town in which he resides, being Westpark Way Addition. ITEM 8: CONSIDERATION OF RESOLUTION NO, 83 --545 Mr. Pippin moved t o approve Resolution No 83 -545, granting approval to the Tarrant County Housing Finance Corporation for use of its Series 1983A Single Family Mortgage .Revenue Bonds for acquiring home rnortgages related to homes within the City of Euless. Mr. Sternfels seconded the motion. Ayes: Messrs. Pippin, Sternfels, Walker, Mrs. McCormick Nays: None Absent: Mr. Eden Mayor Samuels declared the motion carried. ITEM 9: CONSIDERATION OF BOARD APPOINTMENT ;r, Pippin moved to approve the appointment of Mrs. Joy Baldwin to .Place 5 on the Advisory Board for Social Concerns, which term is due to expire with the 1984 ap poin `rn en ts, Mr. Walker seconded the motion. Ayes: Messrs. Mrs. McCormick seconded the motion. Ayes: Mr, Walker, Mrs. McCormick, Messrs. Pippin, Sternfels Nays: None Abstentions: Mr. Eden Mayor Samuels declared the motion carried. ITEM 11: CONSIDERATION OF PLATTING Mr. Eden moved to approve the combined preliminary and final platting of Park Central Addition, loca.ted west and adjacent to West park Way and south of T ibbets Drive, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Sternfels, Pippin, Mrs. Mc_ Corrnick Nays: None vlayor Samuels declared the motion carried. ITEM 1.2: CONSIDERATION OF PLATTING Mrs. McCormick moved to approve final platting of the right-- of- -w-ay, dedication of Village Drive and Ash Lane in the city limits of Euless, located east and adjacent to Fuller-Wiser Road and west and adjacent to DFW Airport property, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes Mrs. McCormick, Messrs, Walker, Pippin, Eden, Sternfels Nays: N one Mayor Samuels declared the motion carried, 1983 -O69 Euless City Council Regular Meeting - April 12, 193 -- Page Seven ITEM 13: CONSIDERATION OF PLATTING Mrs. McCormick moved to approve final platting of Lakewood Addition, Second Installment, Lot 3, Block 3, (Aspen Oaks), located north and adjacent to Ash Lane and east of FM 157, in accordance with the recommendations of the Planning and .Zoning Commission, Mr. Pippin seconded the motion. Ayes: Mrs. McCormick, Messrs. Pippin, Walker, Sternfels Nays: None Abstentions: Mr. Eden Mr. Eden advised that he had no personal interest in the property, but did own property near the area N•layor Samuels declared the motion carried. ITEM 14: CONSIDERATION OF PLATTING Mr. Pippin moved to approve the preliminary- platting of Bear Creek Villas Addition, located south of Harwood Road, north of East Denton Drive, west of Fuller- - Wiser Road, and east of North Main Street, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Sternfels, Mrs. McCormick Nays: None Abstentions: Mr. Eden Mr. Eden advised that he had no personal interest in the property, but did own property in the area. Council Regular Meeting - April. 12. 1983 - Page Eight ITEM 15: CONSIDERATION OF PLATTING Mr. Walker moved to approve final platting of Bear Creek Villas Addition, Phase 1, located south of Harwood Road, north of East Denton Drive, west of Fuller - Wiser Road, and east of North Main Street, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Sternfels, Mrs, McCormick Nays: None Abstentions. Mr. Eden Mr. Eden advised that he had no personal interest in the property, but owned property in the area. Mayor Samuels declared the motion carried. ITE ;, 16: CONSIDERATION OF CALLING A PUBLIC HEARING Mr. Sternfels moved to call a Public Hearing on May 24, 1983, for Zoning Case No. 398, a request of Nancy Seay for a change of zoning from "R.-1" Single Family Dwelling District to "C -2" Community Business District and "R - - -4'• 'Multi-- Farily Dwelling District on Tracts "ALA, I A I §, E. Taylor Survey, A -13 50, located south of Glade Road, east of North Main Street, north of Cinnamon Ridge Addition, and west of Fuller -Wiser Road, Mr. Eden seconded the motion. Ayes: Messrs. Sternfels, Eden, Pippin, Walker, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried, 1983 -071 Euless City Council Regular Meeting - April 12, 1983 Page Nine ITEM 17: CONSIDERATION OF CALLING A PUBLIC HEARING Mr, Sternfeis moved to call a Public Hearing on May 24, 1983, for Zoning Case No, 400, a request of Troy Fuller for a change of zoning from "R -•1" Single Family Dwelling .District to "R_2" Two-Family Dwelling District, "C -1" Neighborhood Business District, and "C -2" Community Business .District, on Tract IC, E. Taylor Survey, A- 1.5.50, located south and adjacent to Glade Road, east and adjacent to North Main Street, and north of Cinnamon Ridge Addition, Mr. Eden seconded the motion. Ayer: Messrs, Sternfels, Eden, Pippin, Wacker, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. iTEM 18: CONSIDERATION OF APPOINTMENT OF MAYOR PRO TEM Mr. Eder: moved to appoint Mrs, Willie Mae McCormick as the Mayor Pro Tem for the remainder of her term which expires in April 1985.
