CALL TO ORDER
1983 -160
A regular meeting of the Euless City Council was called to order at 8:00
P.M., Tuesday, August 9, 1983, in the Council Chambers of the Euless
Municipal Building, by Mayor Harold D. Samuels. Councilmembers present
were Mayor Pro -Terri Willie Mae McCormick, Councilman Robert Pippin,
Councilman Bob Eden, Councilman Glenn Walker , and Councilman Ron Stern -
fe1s.

OLD BUSINESS
ITEM 1: SECOND AND FINAL READING OF ORDINANCE NO. 752
Mr. Pippin moved to approve second and final reading of Ordinance No. 752
for a change of zoning from "R -1" Single - family Dwelling District to "R -2"
Two - family Dwelling District with "CUD" for Conforming Housing to Single-
family Attached Regulations, on certain property out of the Arnett
Addition, relating to Zoning Case No. 406.
Mr. Walker seconded the motion.
Ayes: Messrs. Pippin, Walker, Eden, Mrs. McCormick
Nays: Mr. Sternfels
Mayor Samuels declared the motion carried.
ITEM 2: SECOND AND FINAL READING OF ORDINANCE NO. 753
Mr. Eden moved to approve second and final reading of Ordinance No. 753,
for a change of zoning from "R -1" Single- family Dwelling District to "C -1"
Neighborhood Business District and "R-2" Two - family Dwelling District with
"CUD" for Conforming Housing for Single - family Attached Regulations, on
certain property out of the J. E. Whitener Estate, relating to Zoning Case
No. 405.
Mr. Pippin seconded the motion.
Ayes: Messrs. Eden, Pippin, Walker, Sternfels, Mrs. McCormick
Nays: None
Mayor Samuels declared the motion carried.
ITEM 3: PUBLIC HEARING FOR ZONING CASE NO. 407
Mayor Samuels opened the public hearing for Zoning Case No. 407, a request
of John Landon with Crow Development Company, for a change of zoning from
"R -1" Single - family Dwelling District to "R -2" Two- family Dwelling Dis-
trict, on Tract 2B, B. Harrington Surrey, A -808, located south of Carlisle
Pines, west and adjacent to Baze Drive, and north of Bear Creek Estates.
Mr. John Landon, Crow Development Company, presented the request for the
zoning change, He stated that on June 7, 1983, the Planning and Zoning
Commission voted to deny the zoning case. Three homeowners appeared and
spoke against the zoning change at that time, with the main objection being
the increased traffic that would be placed onto Baze Road and Priest Lane.
Mr, Landon reviewed the zoning case request, stating that they proposed to

build 60 single-family attached homes. He reviewed the surrounding
property it the area and stated this proposed zoning would be a good
buffer. There would be three cul-de-sacs, with all lots being serviced by
an alley. No lots would face on future collector streets. They plan: to go
to great extent to preserve all the trees possible and have an attractive
landscaping in the area, They proposed 30-foot yards instead of the 25
required, to preserve more trees. Mr. Landon pointed out that the Crow
Development Company had developed Woodlands Addition and McCormick Farms
Addition.
Mayor Samuels asked if there were additional proponents for the zoning
case. There being none he asked if the City Council had any questions of
the proponent. There being none, he asked if there were any opponents to
the zoning case.
Mr. Gene Burker, who resides at the corner of Cherry Ann [}rive and Bale
Road, objected to the zoning change because of increase in traffic creating
unsafe conditions, roadways in the area being too narrow, and devaluation
of his home, Mr. Clifford Johnson, 509 Westover, was against the zoning
change because the Planning and Zoning Commission had denied it and he felt
they should be supported. Mr. Allen Nickel, who lives at the corner of Bear
Creek Drive and Cherry Ann Drive, objected because of the traffic increase
the zoning change would create. Mr. Dale Huffman, who resides on Regina
Court, was against the zoning case. Mr. Gary Wright, 513 Westover, was
opposed because of the increase in density. Mr, Bill Pulwenski, 515
Westover, was opposed to the zoning change due to congestion in the area
and the present streets being inadequate for increased traffic flow. Lynn
L oile, 201 Westover, objected due to it creating a traffic hazard, single -
family residences being zoned there now, creating a hazard for children in
the area, and just wanting to keep the area a nice place to live.
Mayor Samuels asked the audience if those who were present and in
opposition to the zoning case would please raise their hands for a count.
Mayor Samuels counted the hands and advised there were 47 people present
who opposed the zoning change.
Mayor Samuels asked if there were other opponents to the zoning change.
There being none, he asked if there were any further questions or
discussion of the City Council. There being none, Mayor Samuels asked if
the City Council had any further questions of the proponent.
Mr. John Landon asked if he could address some of the objections made by the
homeowners. Mayor Samuels stated that he could.
Mr. Landon reiterated that there were nine and one -half acres involved in
this case, and reviewed some of the aspects of the case that he felt would
be a positive influence on the community.
Mayor Samuels asked if any persons in opposition would like to say anything
else.

Members of the audience asked a few information questions, with their
questions being answered.
Mrs. McCormick asked Mr. Landon what size the units would be. Mr. Landon
stated they would be a minimum of 1,100 square feet.
Mayor Samuels asked if there was any further discussion or questions.
Discussion was had relating to City services in the north section of town
regarding the new fire station, new water storage tank, new police officers
and patrol district, etc. A proposal for placing speed bumps on some of the
neighborhood streets was discussed. Enforcement of speed zones in the
neighborhood areas was discussed.
Mr. Roland Knott joined the meeting at this time and stated that he was
originally opposed to the zoning case; however, had met with the developer
and had several items explained to him, and he understood the zoning

request more clearly now. He was now in favor of the zoning change.
Mayor Samuels asked if there were any further discussion or comments from
anyone. There being none, he declared the public hearing closed.
Mr. Sternfels moved to accept the recommendation of the Planning and Zoning
Commission and deny the zoning request.

ITEM 4: PUBLIC HEARING FOR ZONING CASE NO. 410
Mayor Samuels opened the public hearing for Zoning Case No. 410, a request
of Paul Spain for a change of zoning from "R -1" Single - family Dwelling
District, " -1" Light Industrial District, "C -2" Community Business
District, and "PD" Planned Developmen, to "R -3 ", "R -4 ", and "R-5' Multi-
family Dwelling District with "CUD" for Conforming Housing, "C-1" Neigh-
borhood Business District, "C -2" Community Business District, and "I -1"
Light .industrial District, on Tracts 3, 3A1, 3A2, 3A3, 4 and 6, S. Tucker
Survey, A -1512; Tracts 1, 2, 3, 3A, 5, and 6, R. Crowley Survey, A -312; and
Tracts l., 1A, 1A1, 4, 5, 5A, and 6, A. Bradford Survey, A -152, located
between Fuller -Wiser Road and DFW Airport..
Mr. Robert Power, Attorney at. Law, 700 West. Airport Freeway, Irving, Texas,
represented Paul Spain and Terra Properties in presenting this zoning
request. He reviewed the location and description of the property, and
stated that it contained 681 acres, with 515 acres involved in this
particular zoning case. He presented his professional opinion of the

quality of workmanship of Terra Properties and Triland Corporation, and
outlined their professional abilities and reputation in completing their
work within the highest quality possible. He outlined the years of
research in this project, the many consultants that were involved in its
planning, and the millions of dollars of funds available to be escrowed
regarding this project. He stated the Euless Planning and Zoning
Commission had unanimously approved the project as presented at its public
hearing. He stated that Mr. Paul Spain had recently met with approximately
35 persons who lived in the area and had answered their questions and
explained the details of the proposal to them. Mr. Powers outlined the
details of the project regarding street configurations and landscaping
innovations.
Mr. Paul ;pain, One Lincoln Center, Dallas, Texas, explained the current
zoning of these tracts of land, and advised what the proposed changes were.
He remarked that this would be a total plan, with streets, utilities,
landscaping, and all -site influences being worked out and constructed and
improved in a specific pattern to accomplish an overall common goal that
would benefit the city and the people who would reside in the area to the
maximum extent possible.
Mayor Samuels asked if there were other proponents for the zoning case.
Duane White, 1700 Acorn Drive, Euless, Texas, stated that he preferred
private -home ownership rather than commercial and industrial use, but he
felt this development would be an asset to the City, since it included
cement streets, good drainage, good landscaping and was overall well
planned.
Mayor Samuels asked if there were other proponents for this zoning case.
There being none, he asked if there were any questions from the City
Council. There being none, he asked if there were any opponents to the
zoning case.
The following persons spoke in opposition to the zoning case: Rick Carson,
421 Thorn Wood, Euless; Ron Tipton, 505 Thorn Wood, Euless; Jesus Perez-
Guillermety, 1804 Chittam Drive, Euless; Gerald Hill, 2614 Kaylin Lane,
Euless; David Butler, 501 Thorn Wood, Euless; Leti Carson, 421 Thorn Wood,
Euless; and Mark W. Hardy, 1805 Chittam Drive, Euless. Their reasons for
opposition include more density in the area, more traffic on the streets,
more demand on City services, and a threat to the quiet life style they now
enjoy at their hones. Rick Carson presented a petition with 118 signatures
from residents of Woodland Addition, expressing a desire that the City seal
off the streets in their neighborhood to eliminate through traffic coming
through their area. He stated that they wanted the City to consider
installing speed bumps and making deadend streets to discourage residents
who moved into the new development ent area from traveling through their area.
Mir. Ron Tipton requested that the City consider installing three -foot
cement walkways along Fuller-Wiser Road for persons who would be walking in
that area.

Mayor Samuels asked if there were any other opponents to the zoning case.
There being none, he asked if there were any other questions or discussion
of the Council. There being none, he declared the public hearing closed.
Mr. Eden remarked that a good portion of this project was already zoned,
and that the City Council could not change the zoning that was already
there. He stated that he would prefer all of the land to remain as a
pasture, but this just will not happen and would not be good for the overall
citizenry of Euless. He felt that having this development under the
control of one developer would ensure the highest quality project
possible, and that the City could control its progress and ensure that
positive actions be taken in its building. There is best control in use of
land when working with one developer, as opposed to working with many
developers on many different projects. That was one big advantage with
this proposal.
Mrs. McCormick moved to approve Zoning Case No. 41.0 in accordance with the
recommendations of the Planning and Zoning Commission. She commented that
it would make an excellent buffer between the airport and other properties
to the west of the proposed development. She stated that 200 condominiums
were being built to the south and east of her home, and she felt that having
one developer do this would be best for quality and control.
Mr. Walker seconded the motion.

Mayor Samuels declared the motion carried.
NEW BUSINESS
ITEM 5: CONSIDERATION OF RESIGNATIONS
Mrs. McCormick moved to accept the resignation of Dorothy A. Zimmerman from
Place 2 of the Advisory Board for Social Concerns.
Mr. Sternfels seconded the motion.
Ayes: Mrs. McCormick, Messrs. Sternfels, Pippin, Eden, Walker
Nays: None

ITEM 6: CONSIDERATION OF APPOINTMENTS
Mr. Eden moved to (a) approve the appointment of Miss Elsa Cavazos to Place
10 of the Advisory Board for Social Concerns, with her terry to expire at the
time of the 1985 appointments, and (b) to approve the appointment of Mrs.
Sonya Adams as the lay representative to the Texas Library System.
Mr. Sternfels seconded the motion.
Ayes: Messrs. Eden, Sternfels, Pippin, Walker, Mrs. McCormick
Nays: None
Mayor Samuels declared the motion carried.
ITEM 7: CONSIDERATION OF PLATTING
Mrs. McCormick moved to approve preliminary platting of Park Hill
Addition, located north of State Highway 10, south of Marlene Drive, and
east and adjacent to Westpark Way, in accordance with the recommendation of
the Planning and Zoning Commission.
Mr. Walker seconded the motion.
Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Eden, Sternfels
Nays: None
Mayor Samuels declared the motion carried.
ITEM 8: CONSIDERATION OF PLATTING
Mr. Eden moved to approve final platting of Cinnamon Ridge Addition - Phase
III, located east of North Main Street, west of Fuller -Wiser Road, south of
Glade Road, and north of McCormick Farm, in accordance with the recommen-
dations of the Planning and Zoning Comission.
Mr. Pippin seconded the motion.
Ayes: Messrs. Eden, Pippin, Walker, Sternfels, Mrs. McCormick
Nays: None

ITEM 9: CONSIDERATION OF PLATTING
Mrs. McCormick moved to approve final platting of Cinnamon Ridge Addition
- Phase P1, located east of North Main Street, west of Fuller - Wiser Road,
south of Glade Road, and north of McCormick Farm, in accordance with the
recommendations of the Planning and Zoning Commission.
Mr. Pippin seconded the motion.
Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Walker, Sternfels
Nays: None
Mayor Samuels declared the motion carried.
ITEM 10: CONSIDERATION OF PLATTING
Mr. Eden moved to deny the replatting of Tract A. Bear Creek Estates
Addition, located north and adjacent to Bear Creek Drive, south of Westover
Drive, west of North Main Street, and east of Driskill Drive, until the
plat reflected the screening fence requirement, and that the replat be
scheduled for the September 13, 1983, City Council meeting for further
consideration.
Mr. Sternfels seconded the motion.
Ayes: Messrs. Eden, Sternfels, Pippin, Walker, Mrs. McCormick
Nays: None
Mayor Samuels declared the motion carried.
ITEM 11: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr. Sternfels moved to call a public hearing on September 13, 1983, for.
Zoning Case No. 413, a request. of Dale McFarland for a change of zoning from
"I -2 to "I -1" with special permit for a Dance Hall on a portion of Block
0, International /Regional Industrial Complex, located on the southeast
corner of Westpark Way and Regal Parkway.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick
Nays: None

ITEM 12: CONSIDERATION OF CALLING A. PUBLIC HEARING
Mr. Sternfels moved to call a public hearing on September 27, 1983, for
Zoning Case No. 414, a request of Keith Wallace for a change of zoning from
"R_1" to "C -2" and "R -5" "CUD" on Tracts 4, 48, and 4C, Levi Franklin
Survey, A -513, located east and adjacent to FM 157, and north of proposed
Cheek Sparger Road.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick
Nays: None

ITEM 13: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr. Sternfels moved to call a public hearing on September 27, 1983, for
Zoning Case No. 415, a. request of Bill Dunn for a change of zoning from "C-
1" to a PLanned Development for Retail, Office/Warehouse, and Self-storage
on Lot 27, Block C, Somerset Place Addition, located east and adjacent to
North Main Street, south and adjacent to Midway Drive, and west of Primrose
Hill.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick
Nays: None
Mayor Samuels declared the motion carried.
ITEM 14: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr, Sternfels moved to call a public nearing on October 11, 1983, for
Zoning Case No. 416, a request of Jim Fitzgerald for a change of zoning from
"C -1" and "C -2" to "R-3" "CUD" on Tracts 28 and 281, J. P. Halford Survey,
A -711, located west and adjacent to North Main Street, south of Midway
Drive, west of Rimes Drive, and north of Fuller Street.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick

ITEM 15: CONSIDERATION OF RESOLUTION NO. 83 -551
Mrs. McCormick moved to approve Resolution No. 83 -551, to participate with
the Trinity River Authority in the regulation of an industrial waste water
pretreatment program.
Mr. Walker seconded the motion.
Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Eden, Sternfels
Nays: None
Mayor Samuels declared the motion carried.
ITEM 16: CITY ATTORNEY'S REPORT
Mr. Cribbs stated that he had nothing to report.
ITEM 717: CITY ENGINEER's REPORT
Mr. Knight stated he had nothing to report.
ADJOURNMENT
There being no further business before the City Council, the meeting was
adjourned at 11 :05 p.m.
