HomeMy WebLinkAbout1983-10-11MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL October 11, 1983 CALL TO ORDER A regular meeting of the Euless City Council was called to order at 8:15 p.m., Tuesday, October 11, 1983, in the Council Chambers of the Euless Municipal Building, by Mayor Harold D. Samuels. Councilmembers present were Mayor Pro-Tem Willie Mae McCormick, Councilman Robert Pippin, Councilman Glenn Walker, Councilman Ron Sternfe1s, and Councilman Bob Eden. Staff Members Present W. APPROVAL OF MINUTES The minutes of the regular meeting on September 27, 1983, were approved as written. 1983 -212 Euless City Council Regular Meeting October 11, 1983 - Page Two ITEM 1: PRESENTATION OF EMPLOYEE SERVICE PINS Mayor Samuels announced that eight city employees were eligible to receive their ten -year service pins tonight. These pins were distributed by Mayor Samuels to the following persons: FIRE DEPARTMENT Wayne Britt -- Lieutenant -- employed October 1, 1973 David Byers -- Captain -- employed October 9, 1973 Michael Logan -- Fire Marshall -- employed October 1, 1973 Franchot Thomas -- Inspector -- employed October 1, 1973 Jack Watson -- Lieutenant -- employed October 1., 1973 POLICE DEPARTMENT Ray Cissna -- Property Room & Crime Scene Search Officer -- Service Division -- employed December 3, 1972 Rodney Davis -- Sergeant -- Uniform Patrol Division -- employed October 1, 1973 Gary McKarrie -- Sergeant -- Uniform Patrol Division -- ernployed September 20, 1973 Mayor Samuels stated that employees of the City were the most valuable asset of the City, and it is always a pleasure to see them stay for many years. He and the City Council thanked each of the employees for their tenure of service and stated their appreciation for the good work they do. 1983 -213 Euless City Council Regular Meeting - October 11, 1983 - Page Three 0!D BUSINESS ITEM 2: SECOND AND FINAL READING OF ORDINANCE NO. 761 Mr. Eden moved to approve second and final reading of Ordinance No 761, to increase the rate of deposits to the Texas Municipal Retirement System by the employees of the City of Euless from 5 percent to 7 percent, effective October 1, 1983, Mrs. McCormick seconded the motion. Ayes: Mr. Eden, Mrs. McCormick, Messrs. Pippin, Walker, Sternfels Nays.: None Mayor Samuels declared the motion carried. ITEM 3: FIRST AND FINAL READING OF ORDINANCE NO. 762 Mrs. McCormick moved to approve first and final reading of Ordinance No. 762, declaring an emergency, and providing revisions to the Euless Zoning Ordinance No. 347 for the accommodation of parkway signs and the regulations pertaining thereto. Mr. Sternfels seconded the motion. Ayes: Mrs. McCormick, Messrs. Sternfels, Pippin, Eder:, Walker Nays: None Mayor Samuels declared the motion carried. 1983 -214 Euless City Council Regular Meeting - October 11, 1983 - Page Four ITEM 4: PUBLIC NEARING FOR ZONING CASE NO. 416 Mayor Samuels explained the public hearing process and opened the public hearing for Zoning Case No. 416, a request of Jim Fitzgerald for a change of zoning from "C-1" Neighborhood Business District and "C -2" Community Business District to "R -3" Multi-Family Dwelling District with "CUD" on Tracts 28 and 281, 3. P. Halford Survey, A-711, located west and adjacent to North Main Street, south of Midway Drive, west of Nimes Drive, and north of Fuller Street. Mr. vim Fitzgerald, 590 Singleton Road, Midlothian, Texas, presented the request for a zoning change for this property. Mr. Fitzgerald stated that he had one copy of the revised plan which reflected the Planning and Zoning Commission revisions regarding dumpsters and height limitations of the buildings. These revisions were added at the August 2, 1983, Planning and Zoning Commission meeting. He stated at that time there were homeowners who had expressed opposition to the case. He had since met with them and tried to comply with their wishes. Mr. Fitzgerald stated this property would consist of Commercial Business Zoning and "R -3" Density Apartments. He did agree that the apartments would be single- story and no durnpsters would be placed within 25 feet of the existing rear property line. Mayor Samuels asked if there were any questions of the Council. There being none, he asked if there were additional proponents for the zoning case. There being none, he asked if there were any opponents to the zoning case. There being none, he asked if there were any other further questions or discussion of the Council. There being none he declared the public hearing closed. Mr. Pippin moved to deny the rezoning request for three reasons: (1) increased traffic, although that is not reason enough alone; (2) surround- ing property not being compatible with this usage; (3) three people at the Planning and Zoning meeting not being adequate for a public hearing. Mr. Pippin was also concerned with adequate access to the apartments. Mrs. McCormick seconded the motion. Mr. Sternfels stated that he had a little problem with the density, but would like to see a continued commercial usage along North Main Street. Mrs. McCormick stated that the future land -use map reflects •comrercial usage along North Main Street. Mr. Sternfels asked Mr. Fitzgerald if he would consider addressing a commercial usage on North Main Street. Mr. Fitzgerald stated that he would agree to that change. There was considerable discussion about amending Mr. Pippin's motion and making various changes to the zoning request. Mrs. McCormick stated at this time that she would withdraw her second to Mr. Pippin's motion. 1983-215 Euless City Council Regular Meeting -- October 11, 1983 - Page Five ITEM 4: PUBLIC HEARING FOR ZONING CASE NO 416 (Con.) Mr. Pippin commented that he felt the property that was reflected as "R -1" immediately to the south of this site was not in fact "R -1 ", but "R -a ". He asked if this could be checked out. Mr. Pippin stated that he would withdraw his motion at this time, and would request more time to study the facts of this case and make a decision. Mr. Walker agreed that more time was needed to study this particular case. Mayor Samuels asked Mr. Fitzgerald if he would be willing to wait on a decision from the Council regarding this case, in order to enable them to obtain more information for consideration of the item, and come back with a decision at a future Council meeting. He also mentioned to Mr. Fitzgerald that he might consider looking carefully at a commercial usage along North Main Street. Mr. Fitzgerald agreed to wait on a decision and to strongly consider commercial usage at this time. Mr. Eden moved to table a decision on Zoning Case No. 416 until a future date. Mr. Pippin seconded the motion. Ayes: Messrs, Eden, Pippin, Walker, Sternfels, Mrs. McCormick gays : None Mayor Samuels declared the motion carried. ITEM 5: PUBLIC HEARING FOR ZONING CASE NO. 418 Mayor Samuels opened the public hearing for Zoning Case No. 418, a request of Richard Thomes for a change of zoning from "CUD" Conforming (R -2) to "PG" Planned Development for 0-Lot Line Homes and Single - family Attached Homes on Block 1 and Block 3, Tall Timbers Addition, located south and adjacent to Ash Lane, west of Fuller -Wiser Road, and north of Meadowview Addition. William Snyder, Architect with Thomes Corporation, presented the zoning request. He stated they were requesting patio-style homes rather than duplexes with a common wall. They were changing the area from a duplex buffer to single - family buffer along the edge of Tall Timbers Addition. Mr. Pippin asked what the revised rear yard 15 -foot requirement was for the homes that would back up to Meadowview Addition. Mr. Snyder stated this would be a 15 -foot, plus a 6-foot measure, which would equal 21 or 22 feet and would vary from house to house. Mayor Samuels asked if the cul -de -sac onto Sycamore would actually enter that street. Mr. Snyder stated it would be the same as before and there would be a curb there, 1983 -216 Euless City Council Regular Meeting - October 11, 1983 - Page Six ITEM 5: PUBLIC HEARING FOR ZONING CASE NO. 418 (Con.) Mr. Sternfels asked about the time frame for development. Mr. Snyder stated that development would begin immediately, if possible. Mr. Eden asked if building had already begun. Mr. Snyder stated it had begun on the multi - family section to the north, but not on the duplex area. Mayor Samuels asked about the Planning and Zoning Commission stipulations regarding building permits being secured. Mr. Snyder stated that there was an attachment to the site plan. Mayor Samuels asked if there were other proponents for the zoning case. There being none, he asked if there were any opponents to the zoning case. There being none, he asked if there were any questions or further discussion of the Council. There being none, he declared the public hearing closed. Mrs. McCormick moved to approve Zoning Case No. 418 as presented this date. Mr. Walker seconded the motion. Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Eden, Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM 6: PUBLIC HEARING FOR ZONING CASE NO. 417 Mayor Samuels opened the public hearing for Zoning Case No. 417, a request of John Hallman; for a change of zoning from "R -1" Single - family Dwelling District to "R -5" Multi- family Dwelling District on Lots 1, 2, 3, 4, Flock 1, Cedar Hills Estates, located on the north side of Hollywood Boulevard, between Cannon Drive and South Main Street. Mr. Hallman, 1203 High Meadows Cove, Round Rock, Texas, presented the rezoning request. Mr. Hallman stated that the site plan development was presented tonight for City Council review. This would be a unique, expensive, and different apartment dwelling. They were requesting a zoning change from a "R -1" Dwelling District to "R -5" Multi - family Dwelling District. Mr. Hallman felt the density would not be destructive and would complement the community. He presented a slide presentation of a sister project at 2400 South Lamar Street, Austin, Texas, to enable the Council and audience to see the development that would be built there. He stated they would preserve all trees on the site. There would be 68 units. Mr. Hallman stated that the single - family residences that immediately backed up to the property would be able to utilize the pool, sauna, and other facilities of the apartments, as long as the present owner occupied the homes. 1983 -217 Euless City Council Regular Meeting - October 11, 1983 - Page Seven ITEM 6: PUBLIC HEARING FOR ZONING CASE NO. 417 (Con.) Mayor Samuels asked if there were any questions of the City Council. There being none, he asked if there were any additional proponents for the zoning case, There being none, he asked if there were any opponents to the zoning case. Mrs. Jana Cockrell, 207 Reaves Court, Euless, Texas, stated that she represented some of the homeowners who opposed the zoning change. She stated the slide presentation was quite lovely and they appreciated the concessions of the }pool and sauna, etc. She stated, however, that the homeowners still opposed construction of multi - family dwellings in this area. She stated that the traffic would be a problem, especially when combined with school children crossing the streets in this area. She stated that she had spoken with the principal of the elementary school in their neighborhood, and there was a possibility that the influx of additional students who would reside in these apartments could put the school in a position of having to cancel some of their services being provided at this time. She mentioned that crime could increase and City services could be diminished due to the development of apartments in this area. Mr. Tom Shaw, 7921 Main, Euless, Texas, stated that he had worked very hard for many years to buy a home that was not near apartments. Mr. Jeff Ball, 116 Reaves Court, Euless, Texas, stated that he objected to this zoning case. Mr. Ball is a retired civil engineer with post - graduate work in city planning. He had 15 years experience in city planning, and was familiar with the negative aspect that could be derived from development of an °R -5" Multi- family density within this neighborhood. He was present to oppose the zoning change as a property owner, and felt this particular development would be good, but not in this particular place. He stated that to place a multi- family density in a single - family area not only violates the present land -use map recently adopted, but also violates land-use planning principles. He stated that high density apartments were generally placed near major thoroughfares and intersections, and this was not the case at this location. He felt the apartments, if built, would decrease the value of his property and contribute to the degradation of the neighborhood. 1983 -218 Euless City Council Regular Meeting - October 11, -1983 - Page Eight ITEM 6: PUBLIC HEARING FOR ZONING CASE NO. 417 (Con.) Mr. Melvin Kraatz, 703 Henslee, stated that if this apartment complex contained 68 units, it would add approximately 100 to 125 additional cars in the area coming and going at crucial times throughout the day. He felt that was detrimental to the neighborhood. Mr. Vernon Monroe, 608 Cannon, Euless, Texas, stated that he had lived in Euless since 1965, and would like to see this area maintained as single - family dwellings. Mayor Samuels asked those who were present and opposed to this zoning case to please raise their hands for a count. Mayor Samuels counted the hands and announced that there were from 20 to 25 persons present who objected to this zoning case. He stated that this zoning case had a petition against it, and therefore was a zoning under protest. The case had also been denied by the Planning and Zoning Commission. A four - fifths vote would be required to approve this zoning case. Mayor Samuels asked if there were any additional opponents to the zoning case who would like to speak. There being none, he asked if there were any further questions of the Council. There being none, he declared the public hearing closed. Mr. Eden moved to concur with the Planning and Zoning Commission and to deny this zoning change request. He stated that. the °R -5°' density with 68 units would amount to 24 units to the acre, and this would be out of place with the surrounding area. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Pippin, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1983 -219 Euless City Council Regular Meeting - October 11, 1983 - Page Nine NEW BUSINESS ITEM 7: CONSIDERATION OF PLATTING Mrs. McCormick moved to approve the replatting of Tall Timbers Addition, Lots 1 through 32, Block 1, and Lots 1 through 31, Block 3, into Lots 1R- 32R, Block 1 and Lots 1R -31R, Block 3, located south and adjacent to fish Lane, west of Fuller -Wiser Road, and north of Meadowview Addition, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Eden, Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM 8: CONSIDERATION OF PLATTING Mr. Eden moved to approve the combined preliminary and final platting of Euless Gardens II, located on the northwest corner of Vine Street and State Highway 10, in accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Pippin, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 9: CONSIDERATION OF ORDINANCE NO. 763 Mr. Walker moved to approve first and final reading of Ordinance No. 763, declaring an emergency, and providing for the vacating and abandonment of a public utility easement on portions of Lots 1 through 6, Block 1, Airport Business Park Addition. Mrs. McCormick seconded the motion. Ayes: Mr. Walker, Mrs. McCormick, Messrs. Pippin, Eden, Sternfels Nays: None Mayor Samuels declared the motion carried. 1983 -220 Euless City Council Regular Meeting - October 11, 1983 - Page Ten ITEM 10: CONSIDERATION OF RESOLUTION NO. 83-552 Mr. Walker moved to approve Resolution No. 83 -552, to convey the City of Euless support for the extension of Highway 360 from State Highway 183 to State Highway 121, and that this resolution be provided to appropriate members of Congress and officials of the State of Texas. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Eden, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 11: CONSIDERATION OF RESOLUTION NO, 8.3 -553 Mr. Sternfels moved to approve Resolution No. 83 -553, nominating Mr. Gaylon Mayfield as a 1984 member of the Board of Directors of the Tax Appraisal District of Tarrant County, Texas. Mr, Walker seconded the motion. Ayes; Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick plays : None Mayor Samuels declared the motion carried. ITEM 12: CONSIDERATION OF AUTHORIZATION TO CITY MANAGER TO ADVERTISE FOR BIDS Mr. Eden moved to grant authorization to the City Manager to advertise for bids for construction of an elevated storage tank on North Main Street, utilizing alternate number three with storage beneath the tank and the riser offset to the side of the tank. Mr. Pippin seconded the motion. Ayes: Messrs. Eden, Pippin, Walker, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the notion carried. 1983 -221 Euless City Council Regular Meeting - October 11, 1983 - Page Eleven ITEM 13: CITY ATTORNEY'S REPORT Mr. Price stated that he had nothing to report.
