Samuels. Counc: members present were Mayor Pro -Ten, Willie Mae McCormick, Councilman Glenn Walker, Councilman Robert Pippin, and Councilman an Ron Sternfels. Councilman Bob Eden was absent. APPROVAL OF MINUTES The minutes of the regular meeting on January 24, 1984, were approved as written. 1981 -032 Euless City Council Regular Meeting February 14, 1984 - Page Two Mayor Samuels recognized a group of Morrisda.le Addition residents, who were present to present the City Council with a petition relating rg to the closing of Pebble Creek and Woodridge Circle and in opposition to a pending zoning case in the City of Hurst, Mayor Samuels informed the group that the petition was being forwarded to the City of Hurst, and the City of Euless would do what it could to cooperate with the homeowners of Morrisdale Addition in seeking favorable response to their requests. Mayor Samuels stated that the City would keep in touch with the group, and let them know what progress was obtained, OLD BUSINESS ITEM 1: SECOND AND FINAL READING OF ORDINANCE NO. 773 Mrs. McCormick moved to approve second and final reading of Ordinance No, 773, for a change of zoning from "R -l" Single-family Detached Dwelling District to "C-- 2' Community Business District on certain property out of the Levi Franklin Survey, A -513, relating to Zoning Case No, 422. Mr. Pippin seconded the motion. Ayes: Mrs. McCormick, Messrs, Pippin, Walker, Sternf Nays: N o n e Mayor Samuels declared the motion carried. ITEM EM 2: SECOND AND FINAL READING OF ORDINANCE NO. 774 Mayor Samuels stated that further information would be submitted tonight regarding this zoning case, in an effort to save as many trees as possible along the southern boundary of the proposed site, Mayor Samuels recognized Mr. Huey Ball, who presented a registered survey of all the trees of the adjacent properties. Mr, Ball also presented a different building configuration to make the development more attractive and compatible with the single - family residences to the south. Mr. Steve Blasdell, 1908 Kynette Drive, Euless, Texas, spokes- ,person for the Kynette Drive homeowners, stated that they still did not feel the new plan would save enough trees. Mrs. McCormick moved to approve second and final reading of Ordinance No. 774, with the exhibits as presented tonight, and with the currently proposed fence, tree line, and building and parking lot configuration being included as permanent exhibits for the ordinance, and for a change of zoning from 'R-I" Single- family 1984 -033 Euless City Council Regular Meeting February 14 1984 - Page Three ITEM 2: SECOND AND FINAL READING OF ORDINANCE NO 774 (Cont.) Detached Dwelling District, "C_2" Community Business District, and 'tR --2" Two- family Dwelling District, to "C -2" Community Business District. and "PD" Planned Development, on certain property out of the T. Jasper Survey, A -861, relating to Zoning Case No. 425. Mr. Sternfels seconded the motion. Ayes: Mrs. McCormick, Messrs. Sternfels, Pippin, Walker €days. ITEM 3: CONSIDERATION OF BID AWARD FOR CIVIL DEFENSE SIREN SYSTEM Mr. Walker.. moved to accept Staff's recommendation of Gifford Electric's low bird proposal for an outdoor warning siren system in the amount of $50,600. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried, ITEM 4: SECOND AND FINAL READING OF ORDINANCE NO. 775 Mr. Walker moved to approve second and final reading of Ordinance No. 775, as presented this date, and reflecting the noise Zone "B" western boundary to be in conformance with the 1971 Airport Noise Zone Study, amending Ordinance Nos. 1.47 and 148, Subdivision Rules and Regulations, relating to requirements for avigation easements- and relating to the establishment and limits of an aircraft exposure Zone "B" and the requirements thereof. Mrs. McCormick seconded the motion. Ayes: Mr. Walker, Mrs. McCormick, Messrs. Pippin and Sternfels rays None Mayor Samuels declared the motion carried. 1984_0341. Euless City Council Regular Meeting February 14, 1984 - Page Four ITEM 5: SECOND AND FINAL READING OF ORDINANCE NO. 776 Mr. Walker moved to approve second and final reading of Ordinance No. 776, as presented this date reflecting the 1971 Noise Zone "6" western boundary line and changing the 30 decibels figure to read 25 decibels, amending Ordinance No. 715, Uniform Building' Code 1982 Edition, relating to aircraft noise attentuation requirements, exposure Zone "B", minimum noise level reduction requirements, building plan requirements, and certifications by registered architects or engineers as to compliance with said regulations. Mr, Sternfels seconded the motion, Ayes: Messrs, Walker, Sternfels, Pippin, Mrs, McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 6A: FIRST AND FINAL READING OF ORDINANCE NO. 777 `:r, Pippin moved to declare an emergency and approve first and final reading of Ordinance No. 777 vacating and abandoning the portion of Kynette Drive, in the Bell Ranch Terrace Subdivision in the City of Euless, from Renee Drive to Highway 157 contingent upon Signet Street between Wilshire and Highway 157 being immediately upgraded to a collector street, and that the value of the right-of- way reverting to the property owner, Mr. Wayne Brewer, be reimbursed to the city at fair market value for compensation and placed into the right -of -way fund. Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 6B: CONSIDERATION OF A POLICY Mr. Pippin moved that the minutes reflect a City Council Minute Order to establish city policy for future abandonments of public streets, requiring that the value of the right-of-way reverting to a property owner be established, and said value to be compensated to City funds for future right-of-way projects. Mr, Wacker seconded the motion. Ayes: Messrs. Pippin, Walker, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1984-035 Euless City Council Regular Meeting February 14, 1984 -- Page Five ITEM 60: CONSIDERATION OF RESOLUTION NO. 84 -558 SUPPORTING RELOCATION OF EXIT T M ROFAIRPORT FREEWAY AT H1C}WA'Y 157 Mr. Sternfels moved to approve Resolution No. 84-558 supporting the relocation of the exit ramp from Airport Freeway test of Highway 157, *With the stipulation that no expense wi l l be incurred by the City Mrs. McCormick seconded the motion. Ayes: Mr. Sternfels, Mrs. McCormick, Messrs. Pippin and Walker Nays: None Mayor Samuels declared the motion carried. *See new page NEW BUSINESS ITEM 7: CONSIDERATION OF PLATTING Mr. Walker moved to approve replatting of Lot 1, Block 1, Vine Addition, into Lot 1R, Block I, Vine Addition, located east and adjacent to Vine Street, north of SH 10, and south of Huffman Road, in accordance with the recommendation of the Planning and Zoning Commission. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Sternfels, Mrs, McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 8: CONSIDERATION OF A CONTRACT RENEWAL Mr, Walker moved to approve the contract renewal with the Hurst:- Euless - Bedford Chamber of Commerce for business development services for the 1983-1984 year. Mrs. McCormick seconded the motion. Ayes: Mr. Walker, Mrs. McCormick, Messrs. Pippin and Sternfels N ys: None Mayor Samuels declared the motion carried, 1984-035 Euless City Council Regular Meeting February 14, 1984 - Page Five ITEM 6C: CONSIDERATION OF RESOLUTION NO. 84-558 SUPPORTING RELOCATION OF EXIT RAMP FROM AIRPORT V?FWAY AY HIGHWAY 157 Mr, Sternfels moved to approve Resolution No. 84 -558 supporting the relocation of the exit ramp from Airport Freeway west of Highway 157, east of Wilshire Drive, with the stipulation that no expense will be incurred by the City. NEW BUSINESS ITEM 7: CONSIDERATION OF PLATTING Mr. Walker moved to approve replatting of Lot 1, clock 1, Vine Addition, into Lot IR, Block 1, Vine Addition, located east and adjacent to Vine Street north of SH 10, and south of Huffman Road, in accordance with the recommendation of the Planning and Zoning Commission. Pippin and Sternfels Plays: None Mayor Samuels declared the motion carried. 1984 -036 Euless City Council Regular Meeting February 14, 1984 W Page Six ITEM 9: CONSIDERATION OF A RATE INCREASE REQUEST Mrs. McCormick moved to approve a 20 percent rate increase for Mid-Cities Taxi for distance and waiting time only. Mr. Sternfels seconded the motion. Ayes: Mrs, McCormick, Messrs. Sternfels, Pippin, Walker Nays: None Mayor Samuels declared the motion carried. ITEM 10: PUBLIC HEARING FOR ZONING CASE NO. 426 Mayor Samuels explained the public hearing process and opened the public hearing for Zoning Case No. 426 a request of Robert Carlin for a change of zoning on Tracts 6B, 6E, and 6F, 5. Huitt Survey, A -705, a total of 15 acres, from "R-I" Single - family Detached Dwelling District to "C-2" Community Business District, located on the southeast corner of North Main Street. and Harwood Drive, and north of Woodcreek Addition. Mr, Robert Carlin, 3500 Oak Lawn Avenue, Dallas, Texas, representing Maclay Carlin Companies, presented the rezoning request. He stated they were requesting commercial zoning on the southeast corner of the intersection of Euless North Main Street and Harwo od Road. He outlined the commercial attributes of this site and stated it was anticipated that a Kroger Supermarket would be included at the shopping center, as well as some type of drugstore and other small businesses. At the Planning and Zoning Public hearing the "C -?" section included the entire tracts of the zoning case, in an effort to provide more of a buffer between the proposed "C - ?." area and the single-family residences to the south and east, it is additionally proposed tonight that the commercial area be reduced and placed in a diagonal fashion facing the corner of this intersection, They are proposing that other single - family residences and tcwnhomes be developed immediately to the south and east along the strips as reflected on the drawings displayed at this public hearing. A gentleman from Kroger Food Stores was present at this hearing to answer any questions. Mayor Samuels asked him the proposed square footage of the store, to which he replied it would be a 43,000 square foot supermarket, what they term as a "super" store. It was clarified that a screening fence would be constructed around the site. Mayor Samuels asked if there were other proponents for the zoning case. There being none, he asked if the City Council had any questions. There being none, he asked if there were any opponents to the zoning case. 1984 --037 Euless City Council Regular Meeting February 14, 1.984 - Page Seven ITEM 10: PUBLIC HEARING FOR ZONING CASE NO. 426 (Cont.) Mr. Steve Roberts, 203 Stoney Creek, Euless, Texas, stated that a group of area homeowners had presented a petition containing approximately 40 signatures, who were in opposition to the zoning change. He stated that he was against commercial zoning where the previous zoning had been for single-family residences. He stated that commercial development on this site would create a problem with traffic and schools, and was premature for Fries, area. Other persons who spoke in opposition to the zoning case were Elaine Fries, 117 Stoney Creek, Euless; John Johnson, 107 Stoney Creek, Euless. Mayor Samuels asked if there were any other opponents to the zoning case. There being none, he asked if there were further questions of the Council. There being none he declared the public hearing closed. Mrs. McCormick stated that the City of Euless does need commercial development, and that the sales taxes it produces aids the City and assists in keeping the homeowners' ad valorem taxes at a lower rate. She then moved to approve the zoning chance request for "C-2" Community Business District for Zoning Case No. 426, in accordance with the recommendations of the Planning and Zoning Commission, and including the altered site design as presented tonight. Mr. Walker, seconded the notion. Ayes: Mrs. McCorrnick, Messrs. Walker, Pippin and Sternfels Nays: Ni ont Mayor Samuels declared the motion carried. ITEM 11: PUBLIC HEARING FOR ZONING CASE NO. 427 Mayor Samuels opened the public hearing for Zoning Case No. 427, a request of William E. Pasteur for a change of zoning on Lot 20, Block 13, Bell Ranch Terrace, a total of .227 acres, from "R-1." Single - family Detached Dwelling District to "C- 2° Commercial Business District, located north and adjacent to Toplea Street, west of FM 157, and south of Signet. Street. Mr. William E. Pasteur, 1004 West Euless Boulevard, Euless, Texas, stated that they were requesting this property to be zoned "C--2" Community Business District to enable then to install a larger retail project at the location. He stated the property immediately to the east was already zoned for commercial usage, and this zoning change would simply allow the deepening of 'C -2" development, thereby enabling a better quality commercial usage of the property. Mayor Samuels asked if there were any additional proponents for the zoning case. There being none, he asked if there were any opponents for the zoning case. There being none, he asked if there was any discussion or questions of the Council. There being none, he declared the public hearing closed. 1984 --006 Euless City Council Regular Meeting February 14, 1984 - Page Eight ITEM 11: PUBLIC HEARING FOR ZONING CASE N0. 427 (Cont.) Mr. Walker moved to approve Zoning Case No, 427, in accordance with the recommendations of the Planning and Zoning Commission, Mr. Pippin seconded the motion, Ayes: Messrs. Walker, Pippin, Sternfels, Mrs.. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 12: PUBLIC HEARING FOR ZONING CASE NO. 84 -01 Mayor Samuels opened the public hearing for. Zoning Case No, 84 --01., a request of Vernon A. Porter, Jr., for a change of zoning on Tract IE1A1, J. Groves Survey, A-599, and 2603 West Euless Boulevard, a total of 3.69 acres, from »C-2" Community Business District to "I-_" Light Industrial District, at 260.3 West Euless Boulevard (Texas Continental Express, Inc.) and the property east and adjacent to 2603 West Euless Boulevard. Mr. Jim Haskell, 1427 Porta Bella, Court, Arlington, Texas, presented the rezoning request. He stated that the property was now zoned for "C-2" Community Business District, and they wished to have it changed to "I -?" Light Industrial District, to accommodate more adequate storage for the area. He explained that this site had previously been the Texas Continental Truck Line facility, and contained four buildings. They anticipated utilizing the development for a medium-sized vehicle distribution point, and needed the zoning changed to be able to locate vehicles throughout the property. Mr, Haskell stated that it seemed that the commercial development along Highway 10 was gradually changing to a Light Industrial fashion, and felt this would be more compatible with the area at this time. Mayor Samuels asked if there were other proponents for the zoning case, There being none, he asked if there were any opponents to the zoning case. There being none, he asked if there was any discussion or questions of the Council. There being none, he declared the public hearing closed. Mr. Pippin asked if this zoning change had been recommender by the City Staff. City, Engineer ,lames Knight stated that it would be in compliance with the General Future Land Use Plan, and Staff considered it with a favorable recommendation, Mr. Pippin moved to approve Zoning Case No, 84-01 for a change of zoning from "C- 2" to "I-I", i n accordance with the recommendations of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs, Pippin, Walker, Sternfels, and Mrs, McCormick 1s None Mayor Samuels declared the mot ion carried. 1984-039 Euless City Council Regular Meeting February 14, 1984 - Rage Nine ITEM 13: CONSIDERATION OF A BID AWARD Mr. Walker moved t o accept Staff's recommendation and make the bid award for one microfilm reader /printer to Micro -Data Services, for one IMTEC-2000, at a purchase price of $11,249.74. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Sternfels, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 14: CITY ATTORNEY'S REPORT Mr. McFarland stated he had nothing to report. ITEM 15: CITY ENGINEER'S REPORT Mr. Knight stated that he had nothing to report.
