Saneuel.s. Councilmembers present were Mayor Pro -Tern Willie Mae McCormick, Councilman Glenn Walker, Councilman Robert Pippin, Councilman Bob Eden, and Councilman Ron Sternfels. Staff Members Present W. M. Sustaire, City Manager Bob McFarland, City Attorney James Knight, City Engineer Kay Rainey, City Secretary Tom Hart, Assistant City Manager Visitors John Morris Karl B. APPROVAL OF MINUTES The minutes of the regular meeting on April 24, 1984, were approved as written. Euless City Council Regular Meeting - May 8, 1984 - Page Two J.TEM 1: PRESENTATION OF EMPLOYEE SERVICE PINS 1984 -104 The following ernployees were presented their employee service pins by :Mayor Samuels and the City Council. A 20 -Year pin was presented to Deputy Chief Bill Thompson, Police Department, employed since March 15, 1964. Fifteen-year pins were presented to .Lt. Richard 1--Iamm, Police Department, employed since September 1, 1967; Sgt. Pat Crawford, Police Department, employed since August 21, 1967; and Officer Freddie Grigsby, Police Department, employed since April. 16, 1969. Police Chief T. M. Wilson accepted the service pin for L.t. T. C. Free, employed since June 9, 1969, who could not attend tonight's meeting. Ten -year pins were presented to Becky Null, Development Coordinator, Planning Department, employed since April 30, 1974; Ethel Gunter, Secretary /Receptionist, Environmental Health Department, employed since November 26, 1973; Harold Phillips, Meter Reader, Public Works Department, employed since May 13, 1.974. Mayor Samuels stated the Council found it very pleasing to have such a large group of employees receive their service pins. Mr. Walker expressed appreciation for the City's long- term personnel. City Manager W. M. Sustaire stated he was proud of the Police Department employees that had stayed for their 15 and 20-year pins, especially since they had worked for him when he was Police Chief. OLD BUSINESS None NEW BUSINESS ITEM 2: A PROCLAMATION FOR MUNICIPAL CLERK'S WEEK 1984 Mayor Samuels proclaimed the week beginning May 13, 1984, as "Municipal Clerk's Week" and quoted the first three paragraphs of a proclamation by the President of the United States of America, Ronald Reagan. Mayor Samuels stated that this is the first year that a week has been designated as Municipal Clerk's Week on a national level, and the first time the President has signed a proclamation. Mayor Samuels also stated that the City Secretary of the City of Euless was the City's municipal clerk, and that he and the City Council appreciated her services and had issued the same proclamation for Euless in honor of its City Secretary, Kay Rainey. Euless City Council Regular Meeting - May 8, 1984 - Page Three ITEM 3: CONSIDERATION OF FIRST READING OF AN ORDINANCE 1984-105 Mr. Sternfels moved to approve first reading of an ordinance, an omnibus amendment, raising the maximum fine for violation of certain city ordinances from $200 to $1,000. Mr. Walker seconded the motion. Ayes: Messrs, Sternfels, Walker, Pippin, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 4: CONSIDERATION OF AN APPOINTMENT FOR. CITY HEALTH AUTHORITY Mrs. McCormick moved to appoint Don R. Warren, M.D., as the City Health Authority for the City of Euless for the term of April 1, 1984, to April 1, 1986. Mr. Pippin seconded the motion. Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Walker, Sternfels Nays: None -favor Samuels declared the motion carried. ITEM 5: PUBLIC HEARING FOR ZONING CASE NO. 84 --04 Mayor Samuels explained the public hearing process and opened the public hearing for Zoning Case No. 84 -04, a request of Fox Electric Company for a change of zoning on a portion of Block 2, Tucker Addition, 4,678 acres of land, from a Planned Development for Office /Retail to "C--2" Community Business District, located east and adjacent to Ector Drive and north and adjacent to Huffman Road. Mr. Paul Goetz, 1400 West Abrams Street, Arlington, Texas, presented the rezoning request, outlining a history of the property and adjacent zoning. Fox Electric Company owned the property and wished to change the zoning specification from "PD" Planned Development to "C -2" Community Business District to enable then; to have the flexibility of development of the property in the future. Mr. Goetz stated that the property had been zoned "C--2" before it had been changed to "PD" in 1971 to accommodate the building of a seven -story office structure. His client was simply asking that the previous zoning be restored at this time. Mr. Pippin asked Mr, Goetz if his client had considered submitting a development plan for this site, outlining the specific uses intended. Mr, Goetz stated that his client had not considered this, because he had no specific plans at this time. 1984 -106 Eu ess City Council Regular Meeting - May 8, 1984 - Page Four ITEM 5: PUBLIC HEARING FOR ZONING CASE NO. 84 -04 (Cont.) Mayor Samuels asked if there were other questions of the Council. There being none, he asked if there were any other proponents for the zoning change. There being none, he asked if there were any opponents to the zoning change. Jana Cockrell, 207 Reeves Court, Euless, Texas, stated that she was here tonight at the request of Mr. Curtis, Principal of Euless Junior High School, and as representative of the Euless Junior High School PTA. She stated that they do not oppose progress in Euless, but were opposed to a straight "C -2" zoning next to the Junior High School, because it would allow such a variable commercial establishment at the site. She stated that their group realized that the freeway corridor was ;mostly "C -2" zoning, but that most of the freeway corridor was not immediately adjacent to Euless Junior High School. The group felt that, if the property were maintained with the "PD" zoning classification, then whatever was developed there would have to come before the Euless City Council for approval. This would enable the Council, thus the City, to ensure that no commercial establishment was installed which would be detrimental to the .school pupils. Mayor Samuels asked if there were other opponents to the zoning case. There being none, he asked if there were additional questions of the Council. There being none, he declared the public hearing closed. Mrs. McCormick moved to deny the zoning case, in accordance with the recommenda- tion of the Planning and Zoning Commission, and due to the close proximity of the junior high school and the City complex. Mr. Pippin seconded the motion and stated that he supported Mrs. McCormick's comment. He stated that this case points once again to the need to look at our zoning ordinance for graduated zoning that will be compatible with the area. Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Walker, Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM 6: PUBLIC HEARING FOR ZONING CASE NO. 84 -05 Mayor Samuels announced that this item would be a public hearing for Zoning Case No. 84 -05, a request of Jim Culbertson for a change of zoning on a portion of Tract 3, Ray Shelton Addition, 4.697 acres of land, from a CUD for Townhomes to "R -3" Multi- family Dwelling District, located north and adjacent to Harwood Road, west and adjacent to Harwood Park Townhomes, and east of North Main Street. Mr. Jackey Fluitt, with Sternbridge & Associates Inc., stated that Mr. Culbertson had asked hire to officially request that this zoning case be withdrawn. Mayor Samuels stated that if that was Mr. Culbertson's desire, then this item would be tabled pending receipt of a letter of withdrawal from Mr. Culbertson. 1984 -107 Euless City Council Regular Meeting - May 8, 1984 - Page Five ITEM 7: PUBLIC HEARING FOR. ZONING CASE NO. 84 -06 Mayor Samuels opened the public hearing for Zoning Case No. 84 -06, a request of Sang Beasley with Ray Blanchard Companies, for a change of zoning on Tracts 1A1, 1A1 A, T. E. Field Survey, A --540, 2.99 acres of land, from "C -1" Neighborhood Business District to "C--2" Community Business District, Ioc:ated south and adjacent to Glade Road, east and south of Northgate Addition, and west of North Main Street. Mr. Paul Shurbush, representing Sam Beasley, presented the rezoning request. He stated that the reason they were seeking a rezoning of this property was to obtain the flexibility to attract desirable tenants. Mr. Eden stated that he was concerned with the "C -2" zoning backing up to the single- - family attached district to the south, and asked if "C -1" would be a better zoning classification for this area. He asked Mr. Shurbush if "C -1" would be satisfactory with his client. Mr, Shurbush stated that his client was presently negotiating with the 7 -- Eleven Store and was not sure that the 'cC -1" would allow for negotiations with this type of business. Mayor Samuels asked if there were any additional proponents to the zoning request. There being none, he asked if there were any opponents to the zoning request. There being none, he asked if there were further questions of the Council. There being none, Mayor Samuels declared the public hearing closed. City Engineer .James Knight stated that the property immediately' to the south is currently zoned "C -2 ". Mrs. McCormick stated that she would not want to change the zoning in such a way that it would exclude a supermarket being built on the property. Mr. Eden moved to approve the zoning change, since "C -2" property is located immediately to the south of the site. Mrs. McCormick seconded the motion. Ayes: Mr. Eden, Mrs. McCormick, Messrs. Pippin, Walker Nays: Mr. Sternfels Mr. Sternfels expressed concern with buffering the single - family attached area. Mayor Samuels declared the motion carried.- 1984 -108 Euless City Council Regular Meeting - May S. 1984 - Page Six ITEM 8: PUBLIC HEARING FOR PE.PLATTING OF RAY SHELTON ADDITION Mayor Samuels opened the public hearing for the replatting of Tract 3 and a portion of Tract 4, Ray Shelton Addition, into Lot 1, Block 1, Brighton Square Addition :, located north and adjacent to Harwood Road, east of North Main Street and west of Meadowview Addition. Jackey Fluitt, Stembridge & Associates, Inc., stated that this replatting would allow the property to conform with the southern section R -3 district of the development. Mayor Samuels asked if there were additional proponents for the replatting. There being none, he asked if there were any opponents to the replatting. There being none, he asked if there were any questions or discussion of the Council. There being none, he declared the public hearing closed. Mr, Walker moved to approve the replatting of Tract 3 and a portion of Tract 4, Ray Shelton Addition, into Lot 1, Block 1, Brighton Square Addition, in accordance with the recommendation of the Planning and Zoning Commission. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Eden, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 9: CONSIDERATION OF PLATTING OF WESTPARK GARDENS ADDITION Mr. Eden moved to approve preliminary platting of Westpark Gardens Addition, located north of Marlene Drive, south of Silver Creek Drive, east of Westpark Way, and west of Live Oak Drive, in accordance with the recommendation of the Planning and Zoning Commission. Mr. Sternfels seconded the motion, Ayes: Messrs. Eden, Sternfels, Pippin, Walker, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1984 -109 Euless City Council Regular Meeting - May 8, 1984 - Page Seven ITEM 10: CONSIDERATION OF PLATTING OF ARBOR GLEN ADDITION Mr. Eclen moved to approve combined preliminary and final platting of Arbor Glen Addition, located north and adjacent to East Midway Drive, south of East Denton Drive, east of North Main Street, and west of International Drive, in accordance with the recommendation of the Planning and Zoning Commission. Mr. Walker seconded the motion. Ayes: Messrs. Eden, Walker, Pippin, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM .I1: CONSIDERATION OF PLATTING OF DORRIS ADDITION NO. .l Mrs. McCormick moved to approve combined preliminary and final platting of Dorris Addition No. 1, located south of Midway Drive, east of Himes Drive, and west and adjacent to North Main Street, in accordance with the recommendation of the Planning and Zoning C :on: mission, and with the stipulation that the plat not be recorded in the Tarrant County Deed Records until the easement is obtained. Mr. .Pippin seconded the motion. Ayes: Mrs. McCormick, Messrs. Pippin, Eden, Walker, Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM 12: CONSIDERATION OF PLATTING OF .LAKEWOOD ADDITION Mr. Pippin moved to approve final platting of Lot 1, Block 3. .Lakewood Addition, located east and adjacent to FM 157, north of Ash Lane, and west of .Lakewood Townhomes, in accordance with the recommendation of the Planning and Zoning Commission, and in accordance with the final plat supplied to City Engineer Janes Knight on this date, reflecting the perpetual maintenance agreement, new parking configuration, and new site plan. Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Eden, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1984 -110 Euless City Council Regular Meeting - May 8, 1984 - Page Eight ITEM 13: CONSIDERATION OF FINAL PLATTING OF RIGHT -OF- -WAY DEDICATION Mr. Walker moved to approve final platting of right -of -way dedication of Fuller -Wiser Road (north of Little Bear Creek) in the Villages of Bear Creek Addition, in accordance with the recommendation of the Planning and Zoning Commission. Mr. Sternfels seconded the motion. Ayes: Messrs. Walker, Sternfeis, Pippin, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 14: CONSIDERATION OF PLATTING OF RIGHT-OF-WAY DEDICATION Mr. .Sternfels moved to approve final platting of the right -of -way dedication of Bear Creek Parkway (Ash Lane to Mid- Cities Boulevard) in the Villages of Bear Creek Addition. in accordance with the. recornrrnerrdation of the Planning and Zoning Commissi.ori. Mrs. McCormick seconded the motion. Ayes: Mr. Sternfeis, Mrs. McCormick, Messrs. Pippin, Eden, Walker Nays: None Mayor Samuels declared the motion carried. ITEM 15A: CONSIDERATION OF BID AWARD FOR COMPUTER. SYSTEM UPGRADE Mr. Pippin moved that due to the delivery time being critical for the computer system upgrade, the City accept Staff's recommendation of Municipal Software's laid proposal of 63,130, and IBM's low bid proposal for a personal computer for $3,587. Mrs. McCormick seconded the motion. Ayes: Mr. Pippin, Mrs. McCormick, Messrs. Eden, Walker, Sternfels Nays: Norse Mayor Samuels declared the motion carried. 1984 -111 Euless City Council. Regular Meeting - May 8, 1984 - Page Nine ITEM 15E: CONSIDERATION OF BID AWARD FOR TWO TRUCKS Mr. Sternfels moved to accept Staff's recommendation of Graff Chevrolet's low bid proposal for two economy pickup trucks, in the amount of $6,684,00 per vehicle, making a bid total of $13,368.00. Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Walker, Pippin, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 15C: CONSIDERATION OF BID AWARD FOR INSURANCE COVERAGE Mr. Walker moved to reject all bids and authorize the City Manager to start a new bidding process for insurance coverage; to authorize the City Manager to secure Texas Municipal League price quoting for City insurance; and to authorize the City Manager to enter into temporary insurance binding agreements for insurance coverage for the City. Mr. Pippin seconded the motion. Ayes: Messrs. Walker, Pippin, Eden, Sternfels, Mrs. McCormick iNays: None Mayor Samuels declared the motion carried. ITEM 16: CITY ATTORNEY'S REPORT Mr. McFarland stated he had nothing further to report. ITEM 17A: CITY ENGINEER'S REPORT City Engineer :James Knight stated that Staff was ready to proceed with processing the reconstruction of Midway Drive and Ector Drive. Mr. Walker moved to authorize the City Manager to proceed with paving reconstruction of Midway Drive and Ector Drive, with a bid opening date of May 31, 1984, and a bid award at the first City Council meeting in June. Mr. Pippin seconded the motion. Ayes: Mr. Pippin, Mrs. McCormick, Messrs. Walker, Sternfels Nays: None Mayor Samuels declared the motion carried. (Secretary's Notation: Mr. Eden was absent from the room during vote.) 1984 -112 Euless City Council Regular Meeting -- May 8, 1984 - Page Ten ITEM 17B: CITY ENGINEER'S REPORT Mr. Knight advised the Council that improvements to Fuller -Wiser Road from Harwood Road to Little Bear Creek were ready to proceed. In order to construct the bridge, it will be necessary to close Fuller -Wiser Road. Signs and barricades will be posted, with construction lasting from four to six months. Projected date of closure is May 21, 1984. Mayor Samuels asked if the barricades in the Woodlands Addition area had already been installed, per citizens' request a few weeks ago. Mr. Sustaire stated that these barricades had not yet been installed, because the persons requesting them had agreed to wait until Fuller- -Wiser Road was actually closed, thereby erecting all the barricades at the same time. ITEM 17C: CITY ENGINEER'S REPORT Mr. Knight stated that he would ask for authorization for storm drainage improvements to Royal Oaks Addition at a later date, after contact was made with a couple of property owners in the area. Easements were needed before improvements can begin. COMMENTS City Manager W. M. Sustaire stated that the City finally has one new police vehicle, which was ordered 195 days ago. He was unhappy with this order placed with Chrysler-, and would not recommend the purchase of City vehicles from Chrysler in the future. Two vehicles Chrysler delivered were incomplete, one had to be repainted, and the vehicles were received in different colors than had been ordered. First delivery was received 187 days after ordered, and the vehicle was placed in service 195 days after the order. Maintenance of vehicles in operation, pending receipts of these new police units, had cost the City approximately $15,000, and forced police officers to ride double at times. Mrs. McCormick stated that this is possibly a good example of why it is not always wise to accept the low bidder. Mr. Pippin asked if the street sweeper was in good order. Mr. Sustaire stated that it was, but he had reduced the usage of the equipment due to the large expense of operating it. Mr. Pippin asked if the State was responsible for sweeping gravel accumulation at state highway intersections. Mr. Sustaire stated that yes, it was their responsibility; however, the City may have to take on that chore like they did the mowing of grass on the medians to improve the appearance of the City. Mayor Samuels asked when the paving of Glade Road would be complete. Mr. Sustaire stated that it should be complete in two to three weeks. Mayor Samuels asked if mosquito spraying had begun.
