HomeMy WebLinkAbout1984-06-26MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL June 26, 1984 CALL TO ORDER 1984 -144 A regular meeting of the Euless City Council was called to order at 8 :00 p.m., Tuesday, June 26, 1984, in the Council Chambers of the Euless Municipal Building, by Mayor Harold D. Samuels. Council €nembers present were Mayor Pro Te m Willie Mae McCor €nick, Councilman Glenn Walker, Councilman Ron Sternfel s, Councilman Robert Pippin, and Counci iman Bob Eden. APPROVAL OF MINUTES The minutes of the regular meeting on June 12, 1984, were approved as written. 1984 -145 Euless City Council Regular Meeting June 26, 1984 - Page Two OLD BUSINESS ITEM 1: CONSIDERATION OF SECOND AND FINAL READING OF ORDINANCE NO. 796 Mr Sternfels.rioved to approve second and final reading of Ordinance No. 796, relating to Zoning Case No. 84 -09, for a change of zoning from "R -1" Single- - family Detached Dwelling District to "C -2" Community Business District, for certain property out of the A. J. Huitt Survey, A -709. Mrs. McCormick seconded the motion. Ayes: Mr. Sternfel s, Mrs. McCormick, Messrs. Pippin, Eden, 'Walker •Nays: None Mayor Samuels declared the motion carried. ITEM 2: CONSIDERATION OF SECOND AND FINAL READING OF ORDINANCE NO. 797 Mrs. McCormick moved to approve second and final reading of Ordinance No. 797, establishing a new mainline extension rate applicable to mainline extensions by Lone Star Gas Company. Mr. Walkers seconded the notion. Ayes: Mrs. McCormick, Messrs. Walker, Pippin, Eden, Sternfels Nave : None Mayor Samuels declared the motion carried. 1984 -146 Euless City Council Regular Meeting June 26, 1984 - Page Three ITEM 3: CONSIDERATION OF AN ORDINANCE Mayor Samuels stated that this item would be consideration of amending Ordinance No. 505, relating to requirements and prohibitions for fences and walls. Mr. Robert C. Campbell, 904 Chestnut Oak Court, Euless, Texas, stated there were still some areas he felt would cause a problem if the ordinance was passed as drafted. Mr. Rod Tyler, Euless Planning Department, explained some of the aspects of the proposed ordinance to Mr. Campbell. After discussion, it was decided to make a few minor., revisions to the ordinance. Sections to be changed are: Section 2, Paragraphs 2.5 and 2.6; and Section 5, Paragraph 5.1. Mr. Pippin moved to table consideration of the ordinance until the next Council meeting to afford an opportunity to make these minor revisions. Mr. Sternfels seconded the motion. Ayes: Messrs. Pippin, Sternfels, Eden, Walker, Mrs. McCormick `ayss: None Mayor Samuels declared the motion carried. ITEM 4: FURTHER CONSIDERATION OF ZONING CASE NO. 84 -10 (City Secretary's Notation: Mr. Eden, at 8:14 p.m., stepped down from the Council and left the Council Chambers.) Mayor Samuels announced that public hearing was held on June 12, 1984, for Zoning Case No. 84 -10, and this item was being considered at tonight's meeting for revisions that were proposed at the last meeting. Mr. Will Snyder, 205 Springridge Lane, Euless, Texas, stated that the patio homes along the southern border of the property had been realigned as suggested at the last. Council meeting, making them on a one -to -one lot basis with the "R- 1" Single - family Detached Dwelling District lots to the south. Eighteen -foot wide driveways would be provided for each patio home, allowing three parking spaces per home. Additional guest parking spaces were also added for the patio homes. A 24 -foot fire lane, with head -in parking only, has been designated to discourage parking in the fire lane that the previously proposed parallel parking might have encouraged. The exit street alignment was readjusted at the June 12, 1984, City Council meeting. A revised site plan was presented to the Council reflecting these changes. ir. Pippin moved to approve Zoning Case No. 84 -10 as it was presented on the revised site plan dated June 19, 1984, and presented tonight. Mr. Walker seconded the motion. Ayes: Messrs. Pippin, Walker, Sternfels, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. 1984 -147 Euless City Council Regular Meeting June 26, 1981 - Page Four (Mr. Eden returned to the Council Chambers) NEW BUSINESS ITEM 5: PUBLIC HEARING Mayor Samuels announced that this would be a public hearing for the purpose of determining if certain areas of the City of Euless should be declared to be blighted or economically depressed areas, under the Development Corporation Act of 1979, as amended, and the rules and regulations promulgated by the Texas Economic Development Commission. Mayor Samuels announced that, before he opened the public hearing, he would like to make some comments regarding this subject. He explained that the City was looking at the possibility of declaring certain areas as blighted or economically depressed areas for the purpose of encouraging the development of commercial and industrial businesses. This would enable businesses to qualify for certain bond packages and tax advantages. It was not for the purpose of encouraging low - income housing. Mayor Samuels opened the public hearing and asked City Attorney Jaynes Cribbs to address the subject in the City's behalf. James Cribbs stated that this public hearing was required by State law to determine if reasons existed for certain areas of the City to be declared as blighted or economically depressed areas, which would qualify under the Development Corporation Act of 1979, as amended. This would also be under the guidelines of the Texas Economic Development Commission. He explained that industrial development bonds are for the purpose of assisting industrial development and encourages tax advantages to attract businesses to a com- munity. This public hearing is held in compliance with State law and the wording of "blighted or economically depressed areas" is the terminology required by State law for the purpose of utilizing this vehicle of industrial development. He stressed that these bonds cannot be spent on any type of housing. Mayor Samuels stated that the Mid- Cities Daily News' article by Liz Newlin did an excellent job explaining the intent and characteristics of the industrial development. Some cities have actually declared their entire city as blighted or economically depressed, enabling the City to attract industrial development in all areas of their city limits. Euless, however, aimed at the Highway 10 area, which is in need of a face - lifting to encourage commercial and industrial development. A map of the City of Euless, with the proposed area to be declared blighted or economically depressed, was highlighted and displayed on a projector screen for the Council and guests to view and study during the public hearing. James Cribbs stated that the City could detract or lessen the area proposed, but could not expand the proposed area. 1984 -148 Euless City Council Regular Meeting June 26, 1984 - Page Five ITEM 5: PUBLIC HEARING (cont.) Assistant City Manager Tom Hart stated that the issue had become confused by a recently filed zoning case in the Bell Ranch Terrace Addition. This zoning case involved the request of a developer to build multi- family housing in that area. Ironically, residents of Bell Ranch Terrace received notice of the zoning case in last Saturday's mail. Understandedly, the residents of that area connected the two issues and became confused over what was taking place. The zoning case is scheduled to go before the Planning and Zoning Commission at their July 3, 1984, regular meeting, and is not in any way connected to tonight's public hearing. In an effort to alleviate some of the worries of the Bell Ranch Terrace residents, and to further clarify the matter, a new proposed map was displayed. The proposed change excludes the Bell Ranch Terrace neighborhood, as well as a neighborhood further to the east and adjacent to State Highway 183. Mr. Hart explained that these revisions would remove established neighborhoods from the proposed area, and set the residents more at ease. Since these lands were not available at this time for industrial and commercial use anyway, it posed no problem at all with the project. Lines were withdrawn to omit residences and a church. Mayor Samuels asked if there were any additional proponents for the project. There being none, he asked if there were any opponents to the project. Debra Newman, 1505 Toplea, Euless, Texas, stated that she was presenting a petition this night with 216 signatures, consisting of homeowner; and residents of Euless, Texas, and asking that the City Council amend the proposed area to be declared blighted or economically depressed. She stated that their request asked that the lots in Bell Ranch Terrace be removed from the proposed project, and that the revised map presented by City Staff acco € €vnnodates their request. She stated they were happy with the revision and appreciated the City's efforts to work with the citizens. ls. Newman asked the City to verify again that the project would not include residential multi- family housing. Mr. Cribbs stated that it was strictly for commercial and industrial development. Mike Blair, Chief Deacon of Calvary Baptist Church, Euless, Texas, stated that they, too, were pleased with the revisions made by the City. He did request that the City move the line to the northern boundary of Bell Ranch Terrace No. 1, to further remove the church from the project. Assistant City Manager Tom Hari: stated that Per. Blair's request would create an island for the area south of Highway 183 and west of Euless Town Centre Shopping Center. He proposed that a ten- foot strip just i €nediately south of the Euless Town Center Shopping Center be retained in the project to keep this connection. Mr. Blair- agreed that this would be all right. 1984 -149 Euless City Council Regular Meeting June 26, 1984 - Page Six ITEM 5: PUBLIC HEARING (Cont.) Mr. Henry Kitchen, 109 Ridgecrest, Euless, Texas, stated that these revisions had solved the problem of his group, so they did not protest the project. Discussion was had on the zoning application process, definition of Euless Zoning Code and abbreviations, and a review of the proposed boundary lines. Mr. Pippin stressed that the present. City Council certainly favored and encouraged privately owned housing, and preferred that type of development within the City, Mrs. McCormick stated that the citizens of Euless should know that, to form an adequate sound tax base for the City, commercial and industrial zoning was a necessary factor to relieve the tax burden from the individual residential community. Mayor Samuels asked if there were any further questions or discussion of the Council. There being none, he declared the public hearing closed. Mr. Pippin moved to approve Resolution No. 84-568, and the proposal as outlined tonight, with the revised boundary lines and the ten -foot revision south of the Euless Town Centre, be approved as presented tonight, and be declared blighted or economically depressed areas of the City of Euless under the Development Corporation Act of 1979, as amended, and the rules and regulations promulgated by the Texas Economic Development Commission. ITEM 6: CONSIDERATION OF CALLING A PUBLIC HEARING Mr. Walker moved to call a public hearing on July 24, 1984, for Zoning Case No. 84 -11, a request of James Fitzgerald for a change of zoning on Tract 281 and a portion of Tract 28, J. P. Halford Survey, A -711, 3.5 acres of land, from "C- 2" Community Business District to "P8" Planned Development for miniwarehouses, located west and adjacent to North Main Street, south and east of Midway Park Addition, and north of Fuller Street. Mr. Eden seconded the motion. Ayes: Messrs. Walker, Eden, Sternfels Nays: None Mayor Samuels declared the motion carri (City Secretary's Notation: Mr. Pippin room during voting.) ed. and Mrs. McCormick were absent from the 1984 -150 Euless City Council Regular Meeting June 26, 1984 - Page Seven ITEM 7: CONSIDERATION OF CALLING A PUBLIC HEARING Mr. Walker moved to call a public hearing on July 24, 1984, for Zoning Case No 84 -15, a request of Gulf Oil Products Company, for a change of zoning on Lot 7R, Fuller Addition, 0,81409 acres of land, from "C -2" Community Business District to "C -2" with SP (55) Special Height and /or Area Sign, located north of Airport Freeway, west of North Main Street, at the southwest corner of Fuller Street. Mr. Eden seconded the motion. Ayes: Messrs. Walker, Eden, Sternfels Nays: None Mayor Samuels declared the motion carried. (City Secretary's Note: Mr. Pippin and Mrs. McCormick were absent from the room during voting.) ITEM 8: CONSIDERATION OF RESOLUTION 84 -567 Mr. Sternfels moved to approve Resolution No. 84 -567, supporting the contin- uation of planning for a County -wide Pre - hospital Emergency Medical Services System (EMS). Mr. Eden seconded the motion. Ayes: Messrs, Sternfels, Eden, Pippin, Walker Nays: None Mayor Samuels declared the motion carried. ITEM 9: CONSIDERATION OF APPOINTMENTS Mr. Walker moved to table consideration of board appointments until the next City Council meeting. Mr, Pippin seconded the motion. Ayes: Messrs. McCormick was absent from the room during 1984 °151 Euless City Council Regular Meeting June 26, 1984 o Page Eight ITEM 10: CITY ATTORNEY'S REPORT Mr. Cribbs stated that the City Engineer, City Attorney, and City Manager had been discussing the easement requested by the Trinity River Authority at the sewer plant site. It was suggested that a temporary construction easement be granted, and a contract with a completion date stated, be considered for the project. Mr. Sternfels moved to authorize the City Manager to enter into a contract with the Trinity River Authority for the best possible working arrangement for this project. Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Walker,, Pippin, Eden, Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. ITEM 11: CITY ENGINEER'S REPORT City Engineer James Knight stated that he had nothing to report. COMMENTS (1) Mrs. McCormick advised the City Council that Homer Fuller had passed away. Mr. Fuller was a previous Mayor to the City of Euless. Mayor Samuels thanked her for bringing the information to the Council. (2) Mr. Pippin requested that the City investigate a complaint received by the Meadowview Addition, It had been reported to him that a fence had been constructed which prohibited construction vehicles from taking a proper exit from the construction site near Meadowview Addition, thereby forcing the construction trucks through the Meadowview Addition.
