MINUTES OF A REGULAR MEETING
OF THE
EULESS CITY COUNCIL.
AUGUST 28, 1984
A regular meeting of the Euless City Council was called to order at 8 :00 p.m.,
Tuesday, August 28, 1984, in the Council Chambers of the Euless Municipal
Building, by Mayor Harold D. Samuels. Councilmembers present were Mayor Pro Tem
Willie Mae McCormick, Councilman Glenn Walker, Councilman Bob Eden, and
Councilman Ron Sternfels. Councilman Robert Pippin was absent.

OLD BUSINESS
ITEM 1: CONSIDERATION OF SECOND AND FINAL READING OF ORDINANCE NO. 803
Mr. Sternfels moved to approve second and final reading of Ordinance No. 803,
relating to Zoning Case No. 84-12, for a change of zoning from "R -3" Multi- -
family Dwelling District to "C -2" Community Business District on certain
property out of the T. Jasper Survey, A -816.
Mr. Walker seconded the motion.
Ayes: Messrs. Sternfels, Walker, Eden, Mrs. McCormick

Mayor Samuels declared the motion carried.
ITEM 2: CONSIDERATION OF ORDINANCE NO. 804
Mr. Sternfels moved to approve first reading of Ordinance No. 804 amending
Ordinance No. 505, relating to requirements and prohibitions for fences and
walls.
Mrs. McCormick seconded the motion.
City Attorney Bob McFarland stated that he will coordinate with Rod Tyler,
Senior Planner, and revise some of the wording in Section 5.1 and have it ready
for the second reading on September 11, 1984.

ITEM 3: PUBLIC HEARING FOR ZONING CASE NO. 84 -14
Mayor Samuels announced that this item was to be a public hearing for Zoning Case
No, 84 -14, a request of kinder- Care Learning Centers, Inc., for a change of
zoning on Lots 1 and 2, Block 1, Oakwood Acres Estates, 0.758 acres of land, from
"R -1" Single - family Detached Dwelling District to Planned Development. District
for a daycare facility, located on the northwest corner of Main Street and Ash
Lane
Mayor Samuels further explained that the City had received a letter from William
M. Blackburn, with Geary, Stahl & Spencer, stating that they would make no
presentation for this zoning case and requester: the matter be denied without
prejudice. Bob McFarland explained that in some cities zoning cases can be
denied without prejudice, in order to not prohibit future zoning requests on the
property. In Euless, however, this is not necessary. Mayor Samuels stated that
this case would simply be withdrawn.

ITEM 4: PUBLIC HEARING FOR ZONING CASE NO. 84 -16

Mayor Samuels explained the public hearing process and opened the public hearing
for Zoning Case No. 84 -16, a request of Brooks Builders, Inc., for a change of
zoning on Block 2, Lots 4 -7; Block 7, Lots 1 -5, 8 -11, 14 -17; Block 8, Lots 1 -6,
9-14; Block 12, Lots 2 -7, 12 -14; Block 13, Lots 14 -19; Block 14, Lots 1 -17; Block
15, Lots 1 -9; Block 16, Lots 1 and 2; that part of Crowe Drive between and
adjacent to Lot 2, Block 6, and Lots 1, Block 1.5, and Lot 1, Block 14, Bell Ranch
Terrace Addition, 24.68 acres of land, from "R -1" Single- family Detached
Dwelling District to Planned Development for multi- family (condominiums) and
commercial, located west of FM 157, north of West Euless Boulevard, east of
Wilshire Drive, and south of Airport Freeway.
Mr. Ben Brooks, Brooks Builders, Bedford, Texas, explained his proposed project
for the Bell Ranch Terrace Addition. He exhibited a site plan and pointed out
the condominiums, commercial areas, and single- family attached and detached
dwellings. Be stated that there were about 60 acres of land in this total tract,
with a church located on approximately two acres within the tract. Streets and
public utilities would have to be constructed. After the construction of
streets, the density would relate to 13 units per acre. Zero lot -line single-
family detached, and a few attached residences, would be built along the western
border of the project to allow for a buffer zone. Four additional lots were
added to the zoning request at the July 17, 1984, Planning and Zoning Commission
rreet:ing. A fence would be constructed around all the areas to maintain as much
privacy as possible, and probably an eight -foot fence would be built along the
southern boundary of the project, in order to screen off undesirable apartment
units to the south. There would be no two -story multi- family units immediately
adjacent to single - family residences, with one exception: One hone at the
southwest corner of the project, which has been vacant for seven years and was
extremely deteriorated.
Mayor Samuels asked if there were any questions from the Council at this point.
":here being none, he asked if there were additional proponents for the zoning
case.
Eddie Adams, Paster, Calvary Baptist Church, 304 Benbow Drive, Euless, Texas,
stated that he was in favor of this development because it was for a residential
community.
Mayor Samuels asked if there were further proponents for the zoning case. There
being none, he asked if there were other questions from Council. There being
none, he asked if there were any opponents to the zoning case.
Debora Newman, 1505 Toplea, Euless, Texas, stated that she represented Bell
Ranch Terrace homeowners. The group did not want the area rezoned from ;'R -1"
Single - family Detached Dwelling District. They did not feel that condominiums
would be a successful project, thereby causing the project to revert to
apartment usage in the future. She sited statistics for area condominium sales
to verify their belief that condominiums would not be successful in this area.
She stated that they were not questioning the integrity of Brooks Builders, or

the quality of their project; they just felt there was no market. The group is
also concerned with increased traffic in the neighborhood and access to State
Highway 183. They did not desire to have additional traffic flow on Wilshire
Drive through a school zone district. The homeowners felt their rights exceeded
the rights of the developer; they were residents, many were long-time residents,
and they were established in the neighborhood. She stated that they were not
opposed to growth, but were opposed to this type of growth.
Mrs. Newman further explained that the homeowners' group had met with Mr. Brooks
and reached a partial compromise. They had requested, and Mr. Brooks had
agreed, to end Toplea and Kynette Drives at Crowe Drive; and to build the single -
family residences with the zero lot—lines prior to beginning Phase TT of the
project. She further stated that the homeowners had requested, but Mr. Brooks.
had not agreed, to a north access out of the project through either Crowe Drive
or Nita Lane, not Benbow Drive as had been proposed. She stated this north
access was wanted to ensure quality residential traffic flow, and preserve their
neighborhood from the transient element.
Mayor Samuels asked for clarification of the homeowners' request on the three
points: (1) north- south access through Crowe Drive or Nita Lane (2) stub out
Toplea and Kynette Drives (3) the zero lot -line single - family residences would
be built along the western boundary with Phase I, or at least prior to building
Phase II. Mrs. Newman stated this.wa.s correct. Mr. Brooks outlined the areas
on the site plan being displayed, and did agree to those phases of construction.
Mayor Samuels asked if there were additional opponents to the zoning case.
Lavonda Samples, 504 'Wilshire, Euless, Texas, stated that she was opposed to the
development because sales of condominiums were down at this time, and she feared
the units would be converted to apartments. She fell. the 900 square foot living
area was too small, and the 570,000 price tag would not help sales. She had
discussed deed restrictions with Mr. Brooks, but realized this was not the
City's duty to enforce deed restrictions. She was also concerned with traffic
flow, especially leaving the area and trying to turn left on FM 157. She felt
the north access was essential for smooth traffic flow from the area.
Rick Barnes, 1408 Texas American Bank Building, Fort Worth, Texas, and residing
at 204 Yorkshire Court, Euless, Texas, stated that he thought the project was an
excellent project and would benefit the area. He was, however, concerned with
the property just to the north of the project, and encouraged development of the
north access. The property immediately to the north was being looked at now for
commercial zoning with office and retail space, and an access to it would be
quite beneficial.
Mr. McFarland posed a question to Mr. Barnes at this time. He asked Mr. Barnes
if Nita Lane was developed into an access to the north, would Mr. Barnes' group
agree to dedicate rights-of-way to Nita. Lane so this could be done, and later to
reimburse Mr. Brooks for his expenses in cutting the street through to Highway

183. Mr. Barnes stated that he could not commit for all the owners; that they
would not develop the two tracts concurrently; but that they would look at such
a proposal. He stated that it certainly made sense and would be an asset to all
concerned.
Mr. Brooks stated that this information was, of course, new to him. He stated
that he did not feel Nita Lane would be the best route, and would not be an asset
to those living there.
Blair Dufour, 507 Yorkshire, Euless, Texas, stated that he strongly supported
the access to the north and hoped the parties would collaborate to have this
street developed. He further stated that he felt commercial development
immediately to the north of this project would not be a detriment to the
neighborhood.
Fred Maddox, 410 Yorkshire, Euless, Texas, stated that he was concerned with the
fact that this proposal amounted to only about one -half the area. What will
happen to the other half frightens hire. He was afraid that apartment units would
be proposed next, and the residents here tonight would not be living within 200
feet of the proposed apartment units. Traffic would greatly worsen then.
A lady from the audience asked to see a floor plan of the units proposed by €1r.
Brooks. Debbie Newman stated that the homeowners' group had seen the zero lot -
line floor plans, and they were very nice buildings. Mr. Brooks stated that he
has built some zero lot -line homes in Bedford, and these could be viewed if
anyone was interested.
Mayor. Samuels asked if t :here were any further speakers or questions. There
being none. He declared the public hearing closed.
Mr. Sternfels stated that he felt the citizen request for a north - south entrance
to the project was reasonable, in fact, mandatory. The proposed exit ramp
change from State Highway 183 would be a factor to consider when looking at this
matter.
Mayor Samuels explained to those in attendance the proposed exit ramp change
that might be underway.
Mr. Eden stated that he would like to see single - family dwellings throughout the
project, but with negotiations between the homeowners and Ben Brooks, this
proposal seemed to be the most pleasing to both parties. Due to all the effort
and work put into it, he felt like the interested parties would not get a better
deal in the future. Mr. Brooks has agreed to most of the homeowners` wishes,
with the only point of contention being the north access of either Nita Lane or
Crowe Drive. Benbow Drive does seem to be too close to the ramp to be an
effective access route.

James Knight explained that stubbing off Kynette Drive on the eastern edge of
the project could be a problem for two lots located in that area. He suggested
that a cul- de-sac or turn - around be considered. Discussion was had regarding
this. It was decided that City Staff in the Traffic Safety Office and the Fire
Department should consider this issue and report back to the Council.
Mrs. McCormick stated that since the Council still has quite a few questions
pending, and one member absent, perhaps a decision on the case should be tabled
until September 11, 1984. She stated that it would be most desirable to consult
with the Traffic Safety Office and the Fire Department for the best recommended
location of the north access. Therefore, Mrs. McCormick moved to table making
a decision on Zoning Case No. 84 -16 until the September 11, 1984, City Council
meeting.

Mayor Samuels explained to those in attendance that the case was scheduled for
final decision on September 11, 1984, after Staff input was received on the
issues involved. Those persons interested could come to the next Council
meeting and see what happened on the matter.
ITEM 5: CONTINUATION OF AN AUDIENCE RERQUESTED BY RICK BAKER
Mayor Samuels announced that this audience was a continuation of an audience by
Rick Baker, regarding a special permit request for Softball World. Mayor
Samuels asked if Mr. Baker or any representative was present from Softball
World. No one responded, therefore, Mayor Samuels announced that this item
closed.

ITEM 6: CONSIDERATION OF APPOINTMENT
Mrs. McCormick moved to approve the following Board appointments:
A. Advisory Board for Social Concerns: Henry Boatright, Chairman; Brad Alien, Joy
Baldwin, and :ferry Walker for two-year terms expiring in 1986.
I.3, Civil Service Commission: Henry Boatright for a three-year term expiring in
.1987.
C. Zoning Board of Adjustment: Frank Douglass, Ralph Gibson, and fill Pasteur for
two-year terms expiring in 1986.
D. Parks and Recreation Board: Ken H. Balsinger, for a two -year term
expiring in 1986.
Mr. Eden seconded the motion.

ITEM 7: CONSIDERATION OF SITE DEVELOPMENT AND PLATTING NCB. P- 84 -t44
Mayor ,Samuels announced this would be consideration of a site development plan and
final platting and engineering plans for Lot 1, Block 1, Villa.ges of Bear Creek, First
Installment, located south and adjacent to Mid-Cities Boulevard, east and adjacent to
Fuller -Wiser Road, and north and adjacent to Hill Trail Drive.
Mr. George W. Seagraves, Engineering and Planning Firrn of Dunaway Associates, 4200
South Hulen Street, Fort Worth, Texas, stated that he represented Homecraft Land
Development, who is platting this property at Fuller-Wiser and Mid- Cities Boulevard.
He explained the site layout of the project, and. stated that it conforms to all City
ordinances, except for the requested variances. He stated that they agreed with the
Planning and Zoning Commission motion, with the exception of the brick requirement,
which was 70 percent or 74 percent average overall. He stated that if. the City
Council. would allow a 60 percent masonry requirement, the developer was willing to
convert the open drainage channel through the project to an enclosed drainage
channel.
Mrs. McCormick stated that if the open channel meets the requirements, she was not
willing to trade its enclosure for a 60 percent masonry requirement. Mr. Knight
stated that the drainage channel does meet City requirements in its present condition.
Mr. Sternfels stated that he would prefer even a higher masonry requirement of a
minimum of 75 percent.

Mrs. McCormick moved to approve Site Development and Platting No. P- 84 -44, being
the site development plan and final platting and engineering plans for Lot I.,
Block I, Villages of Bear Creek, First Installment, located south and adjacent
to Mid-Cities Boulevard, east and adjacent to Fuller-Wiser Road, and north and
adjacent to Hill Trail Drive, per the recommendations of the Planning and Zoning
Commission.
Mr. Eden seconded the motion.
Ayes: Mrs. McCormick, Messrs. Eden, Walker, Sternfels
Nays: None
Mayor Samuels declared the motion carried.
NEW BUSINESS
ITEM 8: CONSIDERATION OF SETTING A TAX RATE
Mayor. Samuels announced that. Item No. 8 would be consideration of setting a tax
rate for ad valorem taxes for property within the City of Euless for Calendar.
Year 1984.
Mrs. McCormick moved to set the 1984 Ad Valorem Tax Rate at S.44 (44 cents) per
$100 evaluation, and to have Staff prepare the necessary ordinance for the next
Council meeting.

ITEM 9: CONSIDERATION OF PLATTING NO. P -84 -49
Mayor Samuels announced that this item would be consideration of the Combined
Preliminary and Final Platting for Westpark One, located west and adjacent to
Westpark Way, north of West Pipeline Road, south of Westpark Way Estates, and
east of Bedford City limits.
Mr. Eden asked if this platting met all City requirements. City Engineer James
Knight confirmed that it did.
Mr. Eden moved to approve Platting No. P- 84 -49, the Combined Preliminary and
Final Platting for Westpark One, located west and adjacent to Westpark Way,
north of West Pipeline Road, south of Westpark Way Estates, and east of Bedford
City limits.
Mr. Walker seconded the motion.

ITEM 10: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr, Walker moved to call a public hearing on September 25, 1984, for Zoning Case
No. 84 -24, a request of Hagar Construction, Inc. , for a change of zoning on Tract
lay and 1B4A, 8. Harrington Survey, 6.862 acres of land, from "R -I" Single-
family Detached Dwelling District to "R-1A" Single-family Attached Dwelling
District, located west and adjacent to f3aze Road, and north, east, and south of
Carlisle Pines Addition.
Mrs. McCormick seconded the motion.

ITEM 11: CONSIDERATION OF CALLING A PUBLIC HEARING
Mr. Walker moved to call a public hearing on September 25, 1984, for Zoning Case
No. 84 -25, a request of D/F Development, Inc., for a change of zoning on Tracts
1 and 10, 3. Matson Survey, 22 acres of land, from "R -1" Single- family Detached
Dwelling District to "R -4" Multi-family Dwelling District and "C -2" Community
Business District, located north and adjacent to West Pipeline Road and Si" 10,
and east of Westpark Way.
Mrs. McCormick seconded the motion.

ITEM 12: CITY ATTORNEY'S REPORT
City Attorney Bob McFarland stated that he had nothing to report.
ITEM 13: CITY ENGINEER'S REPORT
A. Mr. Knight stated the signal light at Highway 157 and Midway could not be
installed on a fixed time sequence. He had checked with the State Highway
Department, and they had stated that they could not consider this because of
the traffic from the freeway. Paving should be complete in two to three
weeks, and the light should be operational by then.
6. The signal light at Harwood and North Main is in operation.
C. The signal light at North Main and Ash should be operational this week, and
would be left green on Main Street, unless traffic approaches on Ash Lane.
ITEM 14: UNITED WAY FLAG TO MAYOR SAMUEL`
Ms, Beverly Koons, with Family Services, presented a United Way s=hag to Mayor.
Samuels. Jim Stringer, Counselor with Family Services, was also in attendance.
They expressed hope that the City of Euless would display the flag during the
United Way Campaign this year.
Mayor Samuels thanked them for the flag and stated that the City of Euless would
proudly display the flag.

COMMENTS
Mrs. McCormick stated that she was very glad to have the light at North Main.
Mr. Sternfels stated that he was happy to have the signal light at Highway 157
and Midway, and would be glad when it was fully operational.
Tom Hart informed the Council that the City of Euless and the H -E -B Chamber of
Commerce would co -host an industrial revenue bond briefing meeting on commer-
cial and industrial development along Highway 10, this Friday, September 7,
1984, at 10 :30 a.m., in the City Council Chambers.
Bob McFarland stated that. the City of Euless application for the economically
depressed/blighted area, applied for with the Texas Economic Development
Commission, had been officially approved as of August 20, 1984.
ADJOURNMENT
There being no further business before the City Council, the meeting was
adjourned at 10:00 p.m.
