HomeMy WebLinkAbout1964-04-14Regular Meeting of the Euless City Council April 14, 1964 CALL TO ORDER" The regular meeting of the Euless City Council was called to order at 8:00 P. M. by Mayor W. G. Fuller, with the following Councilmen in attendance: Messrs. Bobby Fuller, Billy Byers, Billy Owens, and Roy Braswell. (Councilman Huffman was unable to attend due to a previous engagement.) Also present were City Manager Lee Cowell, City Attorney James Cribbs and City Secretary Vada Ferris. T kTX T V -` A -FT(ITkT invocation. City Councilman Owens presented the PRESENTATION OF MINUTES Minutes of the regular council meeting of March 24, 1964, and the called meeting of A p r i l 7, 1964, were approved by general consent of the council. VISITORS Visitors present were: Messrs. B i 11 Ratliff, David C.Moak, Phil Vinson, Harold Hall, R. J. Rhomerson, A. 0. Berg, Jr., Mrs. Roy Braswell, Mrs. Jan Fincher, and Mr. and Mrs. Roy Cooper. I. ORDINANCE NO. 218: SECOND READING EULESS ELECTRIC COMPANY City Attorney Cribbs read Ordinance No. 218, designating a zoning change from Residential to Commercial for Tract 2A1 and Tract 2B1 out of the J. P. Halford Survey - First Reading of Ordinance was March 24, 1964. After discussion, Councilman Owens made the motion that Ordinance No. 218 be approved ondSecond Reading as presented. RESIGNATION: FRAI,K DOUGLASS , CHAIRMAN, PLANNING & ZONING COMMISSION Mayor Fuller read a letter from Mr. Frank - Douglass, which is as follows: City of Euless Euless, Texas Frank E. Douglass 502 Martin Lane Euless, Texas April 7, 1964 Attention: City Council 73 W Gentlemen: Due to the election of my office to City Council, I hereby tender my resignation on the Planning and Zoning Commission to become effective immediately. Yours truly, /s/ Frank E. Douglass Councilman Fuller made the motion that the letter of resignation from Mr. Douglass be accepted. Councilman Byers seconded the motion which carried unanimously. (Original copy of letter of resignation filed in office of City Secretary.) Mayor Fuller thanked W. Douglass for his work on the Planning and Zoning Commission. III. PROGRESS REPORT: RECREATION PROGRAM AND PARK SITE LOCATIONS City Manager Cowell informed the council that a final agreement had been consummated with the :school District for use of the facilities at the Euless schools for the recreation program. He further advised the council that several sites had been suggested for parks; however, he considered that, possibly, a committee of citizens could be appointed to look at sites and offer their opinions and ideas to the council. After considerable discussion, Councilman Owens made the motion that the City Manager continue his study and analysis of pakk sites and present his findings to the council at the next meeting, April 28, which would permit the new Council members (recently elected) to have a vote in this matter. Councilman Owens' motion died for a lack of a second. After further disussion, Councilman Braswell made a motion that this matter be tabled. Councilman Owens seconded the motion which' carried unanimously. zv . RESOLUTIONS AND CERTIFICATES OF APPRECIATION TO RETIRING'COUNCILMEN BRASWELL AND HUFFMAN City Attorney Cribbs read a Resolution expressing gratitude and appreciation to Councilmen Braswell and Huffman for their tenure of service as members of the Euless City Council. Mayor Fuller presented a Certificate of Appreciation to Councilman Braswell and, on behalf of the council, thanked Councilman Braswell for his work, time and efforts while serving on the City Council.: Councilman Fuller made a motion that the Resolution be adopted as presented. Councilmarx Byers seconded the motion which carried unanimously. (Copy of Resolution filed with minutes of council meeting in Office of City Secretary). (Councilman Huffman's Certificate of Appreciation to be delivered to him later.) Councilman Braswell thanked members of the council and all present for this token and stated that he had enjoyed working with the council. (Councilman Braswell then retired from the council table.) 75 V. OATH OF OFFICE: MR. FRANK DOUGLASS , DR. DON WARREN & MR. BOBBY FULLER City Attorney Cribbs administered the Oath of Office as Councilmen of the City of Euless to Mr. Bobby R. Fuller, Mr. Frank E. Douglass, and Dr. Don R. Warren - these men having been elected to the office of City Council at the City Election held April 7, 1964. After administering the Oath and signing of copies of the Oath, Mayor Fuller welcomed the new councilmen and each were seated at the council table. (Copies of signed Oath on file in Office of City Secretary.) m T'RAILWOOD ADDITION, FINAL PLAT 69 LOTS, FIRST FILING A final plat of the Trailwood Addition, 69 lots, First Filing was presented to the council for approval. City Manager Cowell, read Item 111, Minutes of Planning and Zoning Commission meeting, April 7, 1964, pertaining to this plat. After discussion, Councilman Douglass made the motion that the final plat be approved in accordance with the Planning and Zoning Commission. The motion was seconded by Council- man Owens and carried unanimously. (Councilman Fuller abstained, stating that he had an interest in this property.) MWO ADDI TION$ AND DELETIONS - TAX ROLL TAX RFFTTNT) City Manager Cowell informed the council members that Tax Assessor - Collector W. E. Smith had submitted to the City< Secretary a list of taxable property to be added to the tax roll and a list to be deleted from the tax roll. Also, receipts indicating that taxes had been collected on property not in the City of Euless - and this should be refunded to the persons owning the property. After dis- cussion, Councilman Owens made a motion that the City Council comply with the recommendation of the Tax Assessor - Collector in adding to and deleting from the tax rolls, and refund monies as outlined. Councilman Byers sec- onded the motion which carried unanimously. (The council members viewed the lists as submitted and requested that the lists become a part of the Official Minutes of this council meeting.) (Copies on file in Office of City Secretary.) VIII . ZONING :CASE NO. 122: MR. JOHN SAWTELLE City Manager Cowell read Item 11, minutes of Planning and Zoning Meeting, April 7, 1964 - the minutes re- flecting that the Commission approved the rezoning request of Mr. John Sawtelle; the change in zoning from Residential to "A -2" Multiple Family. After discussion, Councilman Fuller made the motion that May 12, 1964, be set as the date for a Public Hearing before the City Council for the re- zoning of this property. Councilman Byers seconded the motion which carried unanimously. IX . ORDINANCE NO. 219: PAWN SHOPS City Manager Cowell informed the W council that due to recent inquiry concerning the operation of a pawn shop in the City of Euless, he had asked City Attorney Cribbs to prepare an Ordinance regulating Pawn Shops to be presented to the council for their consideration. City Attorney Cribbs read the Ordinance in its entirety, after which Chief of Police Sustaire commented that he considered the Ordinance very adequate and in line with similar ordinances in surrounding: cities. After discussion, Councilman Warren made the motion that Ordinance No. 219 be adopted regulating the operation of Pawn Shops in the City of Euless. Councilman Fuller seconded the motion which carried unanimously. (Original copy of Ordinance No. 219 on file in Office of City Secretary.) ►a TENNIS CT_AJRTS - BALL. PARK City Manager Cowell informed the council members that in order to advance the recreation program as rapidly as possible, he would recommend that the council authorize the taking' of bids on two (2) tennis courts and one (l)ball park to be located at the Euless Junior High School. After discussion, Councilman Owens made the motion that City Manager Cowell request bids for two tennis courts and one ball park, as suggested - the bids to be accepted and opened at the May 12, 1964 council meeting. Councilman Warren seconded the motion which carried unanimously. 0.1160 GENERAL DISCUSSION Mayor Fuller inquired of the visitors to the council meeting as to whether or not they had anything to submit to the council. Mr. Cooper requested to look at the lists of tax additions and deletions which had been presented to the council earlier in the meeting. After looking at the lists, City Manager Cowell proceeded to explain the tax procedure in the newly annexed areas of Euless. Mayor Miller thanked the visitors for attending the council meeting and informed them that the council meetings are open to the public and all citizens are welcome at any time. Councilman Owens read a letter from the Euless Junior High School faculty to a member of the Police Department expressing appreciation for the Police Department aiding in programs and projects they have at their school. Councilman Owens requested that reports from the various departments of the city government be submitted to the council from time to time. Councilman Douglass asked why the city election is held on Tuesday after the school board election on Saturday. He stated that he thought more people would vote if the "election could be held on Saturday. Several other members of the council':had the same opinion; however, the City Attorney advised that the Charter of the City of Euless states that the city election will be held on the first Tuesday in April - that an ameridment would be necessary to change this procedure. x1 i . Mayor Fuller presented a list of offices to be filled by appointmentr and asked that the councilmen submit their recommendations to the City Secretary not later than Friday, April 24, 1964. 77" XIII .
