M. by Mayor W, G. following councilmen present: Messrs. PRESENTATION OF MINUTES The minutes of the regular council meeting of April 14, 1964, were presented for discussion and approved by general consent of the council. VTCTTnT?c Visitors present were: Mr. and Mrs. F. O. Genseke, N+s, Effie McCoy, Messrs. Bobbie Leonard, Edward A. Smith, Paul D. Gates, W. J, "Doc" Hyde, W.H. Way, George Jetton, Roy Braswell, J i m Jones, and Mrs. and Mrs. H. F. Willis. I, ORDINANCE NO. 220 Mayor W. G. Fuller advi sed the council that a Public Hearing was in order for Zoning Case No. 115, which is a request by Mr. Herman Smith for the rezoning of Tract A, Block One, Tract A, Block Two, and Tract A, Block Three, Wilshire Village Addition, Section No. Seven (7); the zoning changed from '.'A" Single Family Dwelling to "A -3" Multiple Family Dwelling. City Manager Cowell read the minutes of the Planning and Zoning Commission pertaining to this rezoning request. City Attorney Cribbs informed the council that the ordinance was prepared for reading if the council so desired. After discussion, Councilman Douglass made the motion thAt the rule be suspended for the second reading of the ordinance and that the Ordinance be passed as an emergency measure on first reading, Councilman Byers seconded the motion which carried unanimously. Mayor Fuller declared Ordinance No, 220 approved and in f u l l effect. (Original copy of Ordinance'No. 220 filed in Office of City Sec- retary.) 1I . PUBLIC HEARING: W. L. BYERS REZONI— NG _ REQUEST Mayor Fuller informed the council that a Public Hearing was in order for Zoning Case No. 119 which is a rezoning request submitted by Mr. W. L. Byers for a zoning change in' thirteen (13) acres out of the J. P. Halford Survey (located on Farm Road No. 157 and Huffman Drive ) ... the rezoning request designated as change from Residential to Commercial. City Manager Cowell read Item I, Minutes of Planning and Zoning Commission, March 17, 1964, pertaining to the rezoning of the property. City Attorney Cribbs was requested to present the First Reading of the Ordinance designating this zoning change, and, after discussion, Councilman Owens made the motion that the Ordinance be approved on First Reading. Councilman Warren seconded the motion which carried. The vote is as follows: Ayes: Councilmen Douglass, Owens and Warren. Abstained: Councilman Byers. (Second Reading of Ordinance, May 12, 1964). III . ZONING CASE NO, 121: MR. ZOLON WILKINS Mayor Fuller informed the council that a Public'Hearing on Zoning Case No. 121 had been scheduled for this time; however, due to a technicality pertaining to the notification of persons interested in this case, the Public Hearing would be postponed at this time. Mayor Fuller stated that it is necessary to set a new date for a Public Hearing for this case. After discussion, Councilman Owens made the motion that May 26, 1964, be set as a date for a Public Hearing before the Euless City Council for Zoning Case No. 121. Councilman Douglass seconded the motion which carried unanimously. IV . ZONING CASE NO, 120: Mr. Jack Apwisch City Manager Cowell read Item IV., Minutes of Planning and Zoning Commission meeting , April'21, 1964, per- taining to Zoning Case No. 120, which is "a rezoning request from Residential to Commercial submitted by Mr. Jack Apwisch. After discussion, Councilman Warren made the motion that May 26, 1.1964, be established as a date for a Public Hearing before the Euless City Council on this rezoning request. Councilman Byers seconded the motion which carried unanimously. V. ZONING CASE NO. ,123: BELL, III STRIP ZONING City Manager Cowell read Item II, Minutes of Planning and Zoning Commission meeting, April 21, 1964, which approved the rezoning request for a strip on the east side of Raider Drive from Pipeline Road on the north to Highway No. 183 on the south - request for zoning change from "A" Residential to "C" Commercial. After discussion, Councilman Douglass made the motion that May 26, 1964, be established as the date for a Public Hearing before the Euless City Council for zoning Case No, 123. Councilman Warren seconded the motion which carried unanimously. VI. ZONING CASE NO, 125: REQUEST FOR STRIP ZONING ALONG HIGHWAY NO. 157, NORIII MAIN STREET, NORTH SIDE OF PIPELINE ROAD AND ALONG HIGHWAY NO. 183 City Manager Cowell read Item 1, Minutes of Planning and Zoning Commission meeting pertaining to "Zoning Case No. 125. After discussion, Councilman Byers made the motion that May 26, 1964, be established as the date for a Public Hearing before the B -iless City Council for Zoning Case No. 125. Councilman Warren seconded the motion which carried unanimously. M VII . AlVIEIvDING BI_ XEr Ai\D DRAFISVIAN SERVICES City Manager Cowell informed the council that the City of Euless is in need of a map of the boundary lines of the city.. .. the map is needed by the City Offices, as well as the Tax Office and Engineers. He advised the council that by redesignating some of the funds already in the Budget, the services of a draftsman can be obtained. Also, that he considers the purchase of a spray machine to aid in the control of insects is feasible. He stated that he had requested that the City Attorney prepare an,-''Ordinance amending the Budget and, at the request of the City Manager,City Attorney Cribbs read the Ordinance amending the Budget. After discussion Councilman Owens made the motion that this Ordinance be approved on First Reading. The motion was seconded by Councilman Byers and carried unanimously. (Second Reading of Ordinance, May 12, 1964.) awav ORDINANCE FOR CONTROL OF WEEDS City Manager Cowell informed the council that he and other city employees are concerned with the numerous calls received in the City Offices, concerning the weeds and other growth in the city and requests that the fire department burn off these areas. Mr. Cowell explained that he considers it very hazardous to burn the lots and that he has requested Cify Attorney Cribbs to prepare an Ordinance for the council's consideration..,. such Ordinance to aid in the control of weeds, etc. in the City of Euless. City Attorney Cribbs read the Ordinance to members of the council and after consideaable discussion, Councilman Douglass made the motion that the Ordinance be approved on First Reading. Councilman Warren seconded the motion which carried unanimously. (Second Reading of Ordinance, May 12, 1964.) IX. City Manager Cowell informed the council that the Tarrant County Baptist Association had deposited a check in the amount of $1,297.70 with the City of Euless to be placed in Escrow for the street work (North Sheppard Drive), and, that he had asked City Attorney Cribbs to prepare an Agreement for the councils approval pertaining to the escrow funds and responsibilities of the City and the Church. After the reading of the Agreement by City Attorney Cribbs, Councilman Owens made the motion that the Agreement be approved with this additional wording: that the church will pay any additional cost involved that is not included in this agreement. Councilman Byers seconded the motion which carried unanimously. (Copy of Agreement on file in Office of City Secretary.) X. ONE WAY STREETS City Manager Cowell informed the council that he had been notified by Mr. Croak- of the Texas Highway De- partment that, by June 1, 1964, the City should have completed plans for making the service roads along Highway No. 183 near Main Street one -way streets, After considerable discussion, Councilman Owens stated that he desires to have someone from the Highway Department meet with the Council and explain their reasons for their decision; City Manager Cowell informed the council that he would contact Mr. Crook's office and request that a representative meet with the council at the next regular meeting. XI. APPOINTNIINTS Mayor Fuller informed the council that , after receiving some of the lists of recommendations from council members , he had compiled a list for their consideration and discussion. Each councilman was presented a copy and after discussion, the following appoint- ments were made = PLANNING AND ZONING COMM SSION Bert Heyl - term expires 1965 J. A. Horton - 'term expires 1965 Henry Uselton - term expires 1966 LaVern Lee - term expires 1966 Edward Smith - t e r m expires 1966 After discussion , Councilman Byers made the motion that the appointments to the Planning and Zoning Commission be approved as submitted. Massey - term expires 1965 Herschel Morgan - term expires 1965 After discussion, Councilman Douglass made the motion that the appointments to the Board of Adjustments be approved as submitted. Councilman Owens seconded the motion which carried unanimously. After discussion , the following appointments were approved by a motion made by Councilman Owens and seconded by Councilman Byers. E. Nolley Robert Nash Councilman Byers made the motion that Councilman Bobby R. Fuller be appointed as Mayor Pro -.Tem of the City of Euless. Councilman Douglass seconded the motion which carried unanimously. OFFICIAL DEPOSITORY XII. City Manager Cowell informed the council that he had been advised by City Attorney Cribbs that the selection of an Official Depository could not be made at this time. Mr. Cribbs informed the council that it is necessary to publish a legal notice in the Official Newspaper stating that applications will be accepted for a banking corp- oration to be designated as Official Depository - that there is a time element involved. After discussion, Councilman Byers made the motion that the City comply with the procedure necessary for the selection of a depository. Councilman Douglass seconded the motion which carried unanimously. (It was suggested that the two banking institutions in the City of Euless be notified by registered mail of the accepting of applications. ) • XIII , OFFICIAL NEWSPAPER City Attorney Cribbs read A r t i c l e No. 1025 pertaining to the designation of an official newspaper. City Manager Cowell explained that a newspaper has to have been in operation at least one year before being designated as an Official Newspaper, After considerable discussion, Councilman Owens made the motion that the Daily News Texan be designated as the Official Newspaper for the City of Euless until July 1, 1964. Councilman Warren seconded the motion which carried unanimously. XIV. (U\EZAL DISCUSSION Mrs. McCoy, a visitor to the council meeting, requested that her house number be checked to determine if it.'-is correct. City Manager Cowell informed Mrs. McCoy that he would have the City Inspector investigate this matter. Councilman Owens stated that on behalf of the citizens in the area near his home, he wished to thank the City Manager for having the ditch cleared in that area. /:VIA ADJOURNMENT Councilman Owens made the motion to adjourn.
