HomeMy WebLinkAbout1987-08-11MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL AUGUST 11, 1987 CALL TO ORDER 19.5g-166 A regular meeting of the Euless City Council was called to order at 8 :05 p.m., on Tuesday, August 11, 1987, in the Council Chambers of the Euless Municipal Building, by Mayor Harold D. Samuels. Those present were. Councilmembers Ray Ozebek, Ron Sternfels, Carolyn Park, Bob Eden, and Mayor Pro Tem Glenn D. Walker. Staff Members Present Tom Hart, Assistant City Manager Kay Rainey, City Secretary Bob McFarland, City Attorney James Knight, City Engineer Lynn Shackelford, Director of Administrative Services Jean Harris, Administrative Secretary Visitors Mickey D. Nowell. Edward J. Denari Lloyd Johnson Lewis Lowe Jan Jordan John Stokes Bob Campbell Billy F. Owens Bill Brown and other interested parties PLEDGE OF ALLEGIANCE Mayor Pro Tem Glenn Walker led the pledge of allegiance. INVOCATION The invocation was given by Councilwoman Carolyn Park. 1987-167 Euless City Council Regular Meeting August 11, 1987 - Page Two ITEM NO 1: PRESENTATION OF SERVICE PIN Mayor Samuels explained that Mr. Sustaire was scheduled to receive his 30 -year pin; however, was out of town due to an illness in the family. He stated that this presentation would be made at a later date. NEW BUSINESS IT11 NO. 2: CONSIDERATION OF ORDINANCE NO. 934 Mr. Eden moved to approve second and final reading of Ordinance No 934, an ordinance amending Article 11, Sections 7 -25, 7 -27, 7 -28, and 7 -29 of Chapter 7 of the Euless Code of Ordinances entitled "Grass and Weeds," by repealing and replacing those sections in their entirety, and by the addition of a new section 7-31. thereto; establishing regulations for grass, weeds, and uncultivated pants located; providing for the cutting and removal. of grass, weeds, and uncultivated plants by the City of Euless. Mrs. Sternfels seconded the motion. Ayes: Messrs. Eden, Sternfels, Ozebek, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. ITEM NO. 3: CONSIDERATION OF ORDINANCE NO. 935 Mr. Ozebek moved to approve second and final reading of Ordinance No. 935, amending Ordinance No. 347, the comprehensive zoning code of the City of Euless, Texas, to provide for special use permits for half -way houses, restitution centers and other facilities utilized for the housing for criminal offenders. Mr. Walker seconded the motion. Ayes: Messrs. Ozebek, Walker, Sternfels„ Eden and Mrs. Park Nays: None Mayor Samuels declared the motion carried. ITEM NO. 4: CONSIDERATION OF ORDINANCE NO. 936 Mr. Eden moved to approve second and final reading of Ordinance No. 936, amending Ordinance No. 347, the comprehensive zoning code of the City of Euless, Texas, to provide for special use permits for seasonal, parking lot, sidewalk, truckload, and other temporary outside sales, with limitations thereon, in non - resident ;al zoning districts. Mr. Ozebek seconded the motion. Ayes: Messrs. Eden, Ozebek, Walker, Sternfels and Mrs. Park Nays: None Mayor. St CONSIDERATION OF ORDINANCE NO. 937 Mrs. Park moved to approve second and final reading of Ordinance No. 937, authorizing and allowing "Updated Service. Credits," for the Texas Municipal Retirement System, for service performed by qualifying members of such system, who presently are in the employment of the City of Euless; providing for increased prior and current service annuities for retirees and beneficiaries of deceased retirees of the City. Mr. Walker seconded the motion. Ayes: Mrs. Park, Messrs. Walker, Ozebek, Sternfels and Eden Nays: None Mayor Samuels declared the motion carried. TTEM NO, 6: CON STDFRATTON OF ORDINANCE NO. 938 Mrs. Park moved to approve second and final reading of Ordinance No. 938, affecting participation of city employees in the Texas Municipal Retirement System; granting the additional rights, credits and benefits authorized by Sections 64.202(f), 64.204, 64.405, and 64.410 of Title 1108, Revised Civil Statutes of Texas, 1925, as amended by the 70th Legislature. Mr. Walker seconded the motion. Ayes: Mrs. Park, Messrs. Walker, Ozebek, Sternfels, and Eden Nays: None Mayor Samuels declared the motion carried. ITEM NO. 7: CONSIDERATION OF ORDINANCE NO. 939 Mr. Eden moved to approve second and. final reading of Ordinance No, 939, Zoning Case No. 87-09, Racetrac Petroleum, Inc., for a change of zoning on a portion of Tract 1Ji.A of the A. J. Huitt Survey *, Abstract 684, totaling 0.89 acres, from its present zoning of C -2 to C -2 with Specific Use Permit for a general business pole sign of increased height and area. Mr. Sternfels seconded the motion. Ayes: Messrs. Eden, Sternfels, Ozebek, and Mrs. Park Nays: None Abstain: Mr, Walker Mayor Samuels declared the motion carried. 1937 -169 Euless City Council Regular Meeting August 11, 1987 - Page Four ITEM NO. 8. CONSIDERATION OF ORDINANCE NO. 940 Mr. Eden moved to declare an emergency and approve first and final. reading of Ordinance No. 940, vacating a 10 foot wide utility easement. between Tract A and Lot 4, Euless Gardens No. 2 Addition. Mrs. Park seconded the motion. Ayes: Mr. Eden, Mrs. Park, Messrs. Sternfels, Walker, and Ozebek Nays: None Mayor Samuels declared the motion carried. ITEM NO. 9: CONSIDERATION OF REPLA1TTNG P -87 -1O Mr. Sternfels moved to approve Replatting P- 87 -10, a request of Texaco, Inc., to replat Lots 3, 4 and Tract A, Euless Gardens Addition No. 2 into Lot 4R, Euless Gardens Addition No. 2, totaling 0.916 acres, generally- located. at the southeast corner of S. Ector Drive and Airport Freeway, in accordance with the recommendation of the Planning and Zoning Commission- Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Walker, Ozebek, Eden and Mrs. Park Nays: None Mayor Samuels declared the motion carried. ITEM NO. 10: CONSIDERATION OF AN ORDINANCE Mr, Eden moved to approve first reading of an ordinance amending Ordinance No. 347, the Zoning Code of the City of Euless, pertaining to certain. regulations regarding side yard setbacks and carports within mobile home districts. Mr. Sternfels seconded the motion. Ayes: Messrs. Eden, Sternfels, Ozebek, Walker and Mrs. Park Nays: None Mayor Samuels declared the motion carried. ITEM NO. 11: CONSIDERATION OF CALLING A PUBLIC HEARING Mrs. Park moved to call a public hearing regarding the proposed budget of Fiscal. Year 1987 -88 for August 25, 1987. Mr. Walker seconded the motion. Ayes: Mrs. Park, Messrs. Walker., Ozebek, Eden, and Sternfels Nays: N one Mayor Samuels declared the motion carried. .1987 -170 Euless City Council Regular Meeting August 11, 1987 - Page Five ITEM NO. 124., CITY MANAGER'S REPORT Mr. Hart, Assistant City Manager, stated he had nothing to report ITEM NO 13: CITY ATTORNEY'S REPORT Mr. McFarland stated he had nothing to report. ITEM NO 14: CITY SECRETARY'S REPORT A) Board and Commission Activity Mr. Sternfels moved to appoint Anita Head as Lay Representative to the North Texas Library System Mr. Walker seconded the motion. Ayes: Messrs. Sternfels, Wacker, Ozebek, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. B) Minutes Mrs. Park asked that the following be included in the City Council Minutes of July 28, 1987; regarding Item No. 6, the audience requested by Martin Case: (1) the statement concerning the Jui.y 9th meeting with the Corps of Engineers and a listing of all the entities involved in the. Morrisdale /Sulphur Branch flooding issue; (2) the statement made by the City Manager that Letters were sent to Hurst and Bedford asking for participation in the Corps of Engineers study; (3) the statement the City Manager made that he had contracted to dredge the creek. Mr. Sternfels asked that something be mentioned about his comments concerning retention to the north. Mrs. Park moved to include the additions requested by she and Mr. Sternfels to the minutes of July 28, 1987. Mr. Eden seconded the mot:i.on. 1987-171 Euless City Council Regular Meeting August 11, 1987 - Page Six Mayor Samuels recalled that he said we very definitely should take some action. He stated he felt the Corps of Engineers was the best way to deal with over all because it has come out since the meeting that regardless if *.he concrete channel were lined, if nothing was done is Hurst and nothing was done on Highway 10, and nothing was done upstream in Bedford, there still would be flooding problems. He added that this was probably the longest running, single major problem the City of Euless had faced over a long period of time, but even today, no one knows what the final solution will be or how it will come about. Ayes; Mrs. Park, Messrs. Eden, Ozebek, Sternfels Nays: None Abstain: Mr. Walker Mayor Samuels declared the motion carried. Mayor Samuels updated the audience an the situation in Morrisdale concerning the flooding problems in that addition. Edward Denari asked if a letter was sent to the City of Bedford, putting them on notice and alerting them to the problems that they were creating to the Morrisdale residents. Mrs. Park explained that the two letters mentioned were to be sent to the City of Hurst and to the City of Bedford asking that they in -turn send a. letter to the Corps of Engineers advising that they were willing to participate in this overall study. Mr. Denari stated that he seems to have picked up the information that the City was going to take a strong position with the City of Bedford, even to the extent of putting them on notice of potential damages and that he thought. the City Attorney mentioned it as a possible course of action. Mayor Samuels stated that was a strong recommendation by the Attorney for the Morrisdale residents, but he was not sure how the City responded to it. Mr. McFarland stated that his recollection was that Mr. Sustaire and/or Tom Hart indicated that they would monitor development activity at Bedford to assure that what was going on up there was not adversely affecting downstream drainage. There was a question as to whether or not there was a pending development now being initiated, and he thought Mr. Sustaire reported that he had checked on that and that was not in process. Mayor Samuels said that Euless would not do anything to enlarge Pipeline Road unt Li Euless' problem downstream is resolved and Euless has advised Bedford of that He added that Euless has not advised Bedford to cease development. Mr. Sternfeis stated that may have come about from his comments that perhaps we could look into the possibility of a retention area to the north and that Mr. Sustaire would approach them, even if they were not interested in putting in a retention program, to at least look at it as a temporary way of holding the water back. This might be a viable, potenti.al way of at least retaining the water to some extent to the. north. Mr, Denari said that was right. He assumed that they were at a meeting and there was going to be coordination on the part of the City to express this to Bedford. Mr. Sternfeis confirmed that was correct. 1987 =172 Euless City Council Regular Meeting August 11, 1.987 - Page Seven Mr. Denari stated that he had asked for a high priority pledge of the City Council to address this problem. He added that he would appreciate it if the minutes would reflect his request to the City to establish a high priority for this problem. Mr. Denari asked if there had been another direct communique with the City of Hurst regarding the two developments there and with respect to anything that would constrict the drainage. Mayor Samuels stated that has been done; that's what the Thursday meeting would be about. Mr. Denari asked that. the City clean out the creek south of the Woodvine Bridge. Mr, Hart said that was underway. Mr. Denari said that was okay, but he wanted it reflected in the minutes. Mrs. Park said that she believed she did request that because that statement was made by the City Manager that he had contracted with someone to do that, Mayor Samuels stated he thought all of those were correct and were said, and he had no problem with those being included in the minutes. Mrs. Park moved to include Mr. Denari's statements made. at that meeting be included in the minutes of July 28, 1987, Mr. Ozebek seconded the motion. Ayes: Mrs. Park, Messrs. Ozebek, Eden, and Sternfels Nays: None Abstain: Mr. Walker Mayor Samuels declared the motion carried. He explained that Mr. Walker was abstaining due to being out of town on July 28th. ITFA NO. 15: CITY ENGINE'S REPORT Mr. Knight stated he had nothing to report. ITEM NO. 16: CITY COUNCIL REPORTS Mrs. Park commended the City on the quality of the Business Newsletter and the Euless Digest. She also asked that a copy of the latest issue be sent to Mr. Rd Matthews since he was responsible for the picture of the bridge. Mr. Sternfels asked that the City's ordinances be enforced concerning weeds, outside sales, and street repairs. He stated that he felt unenforceable ordinances should be changed, and the City staff should ask for assistance if necessary in this area Mr. Billy Owens expressed his concern for the restrictions being put on business, both new and old, in the area of signs.
