HomeMy WebLinkAbout1988-04-26MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL April 26, 1988 CALL TO ORDER 1988 -057 A regular meeting of the Euless City Council was called to order at 7 ;05 p.m., on Tuesday, April. 26, 1988, in the Council Chambers of the Euless Municipal Building, by Mayor Harold D. Samuels. Those present were Council members Ray Ozebek, Ron Sternfels, Bob Eden, Councilwoman Carolyn Park, and Mayor Pro Tem Glenn D. Walker. Staff Members Present W. M. Sustaire, City Manager Tom Bart, Assistant City Manager Kay Rainey, City Secretary Jean Harris, Deputy- City Secretary Bob McFarland, City Attorney James Knight, City Engineer. Lynn Shackelford, Director of Administrative Services Kenneth Fuller, Police Chief Lee Koontz, Fire Chief Mike Harris, Data Processing Manager Visitors Marl.and and Alice Ernest Gerry Stiles David C. Hughes, Jr. Neal W. Adams Michael Applo and other interested parties PLEDGE OF ALLEGIANCE Councilwoman Carolyn Park led the pledge of allegiance. INVOCATION The invocation was given by Mayor Harold D. Samuels. 1988-058 Euless City Council Regular Meeting April 26, 1988 - Page. Two ITEM NO. 1: SPECIAL PRESENTATION OF APPRECIATION CERTIFICATES Mrs. Alice Ernest, Chairperson of the Euless BEE Committee, presented appreciation certificates to Mr. Michael Chance and Ms. Linda Jean Johnson, who were present in the audience, for their work and support in the planting of 200 -300 Bradford Pear trees in two neighborhoods in Euless. Mrs. Ernest expressed her appreciation and stated that she had driven through the neighborhoods since the trees had been planted and that they had certainly improved the aesthetics of the areas. Mrs. Ernest also had certificates for Charlene Culver and Raivo Sams who were not present. OLD BUSINESS ITEM NO. 2: SECOND AND FINAL READING OF ORDINANCE NO. 963 Mr. Walker moved to approve second and final reading of Ordinance 963, altering the prima facie speed limits established for vehicles under the provisions of Section 167 and 169 of Article XIX, R.C.S. 6701d, uniform act regulating traffic on highways, upon the basis of an engineering and traffic investigation upon certain streets and highways, or parts thereof, within the corporate limits of the City of Euless. Mr. Ozebek seconded the motion. Ayes: Messrs. Walker, Ozebek, Sternfels, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried, ITEM NO. 3: SECOND AND FINAL READING OF ORDINANCE NO. 964 Mr. Walker moved to approve second and final reading of Ordinance No. 964, amending Section. 7 -77 of Article V, "Junked 'Vehicles," and Section 7 -63 of Article IV Abandoned Derelict and Lost Personal Property" of Chapter 7, Garbage Trash, Weeds and Abandoned Property" of the Code of Ordinances, City of Euless, Texas; providing additional notices upon impoundment of manufactured. homes; and providing notices of 7.i.en.ho.lders of junked vehicles. Mr. Ozebek seconded the motion. Ayes: Messrs, Walker, Ozebek, Sternfels, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. 1988-059 Euless City Council Regular Meeting April 26, 1988 Page Three ITEM NO. 4: SECOND AND FINAL READING OF ORDINANCE NO. 965 Mr. Walker moved to approve second and final reading of Ordinance No. 965, amending the Euless Building Code to provide certain trench safety requirements as mandated by recent changes in Texas' statutes. Mr. Ozebek seconded the motion. Ayes: Messrs. Walker, Ozebek, Sternfels, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. ITEM NO. 5: SECOND AND FINAL READING OF ORDINANCE NO 966 Mr, Walker :roved to approve second and final reading of Ordinance No. 966, establishing the homestead exemption for 1988 and subsequent tax years at 20 %, the maximum allowed by Texas law. Mr. Ozebek seconded the motion. Ayes: Messrs. Walker, Ozebek, Sternfels, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. NEW BUSINESS ITEM NO. 6: CONSIDERATION OF FIRST AND FINAL READING OF ORDINANCE NO. 967 Mr. Boyd London, First Southwest Company, was present concerning the authoriza- tion of the issuance of "City of Euless, Texas, General Obligation Bonds, Series 1988." Mr. London explained to the City Council that the proposed bonds were to be used for Park and Recreation improvements, that the City's bond ratings were A -1 and A +, and that the interest rate for these bonds is 7.25%. Mr. Walker moved to declare an emergency and approve first. and final reading of Ordinance No 967, entitled: "An Ordinance authorizing the issuance of "City of Euless, Texas, General Obligation Bonds, Series 1988 "; specifying the terms and features of said bonds; levying a continuing direct annual ad valorem tax for the payment of said bonds; and resolving other matters incident and related to the issuance, sale, payment and delivery of said bonds, including the approval and distribution of an Offering Memorandum pertaining thereto; and declaring an emergency." Mr. Sternfels seconded the motion. Ayes: Messrs. Walker, Sternfels, Ozebek, Eden, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. 1988 -060 Euless City Council Regular Meeting April 26, 1988 - Page. Four ITEM NO. 7: CONSIDERATION OF RESOLUTION NO. 88 -677 Mrs. Park moved to approve Resolution No. 88 -677, entitled: "A Resolution approving and authorizing the execution. of a 'Paying Agent /Registrar Agreement' in relation to the 'City of Euless, Texas, General Obligation Bonds, Series 1988' and resolving other matters incident and related thereto." Mr. Eden seconded the motion, Ayes: Mrs, Park, Messrs, Eden, Ozebek, Walker, and Sternfels Nays: None Mayor Samuels declared the motion carried. ITEM NO. 8: CONSIDERATION OF REVISED PRELIMINARY PLAT -- P -88 -03 Mr. Eden moved to approve Revised Preliminary Plat and Engineering Plans of Glade Crossing Baptist Church, 1.9.76 acres, located south of Glade Road, north. of Nutmeg Lane and west of Oak Hollow Addition in accordance with the recommen- dation of the Planning and Zoning Commission. Mrs. Park seconded the motion. Ayes: Mr. Eden, Mrs. Park: Messrs, Walker, Sternfels, and Ozebek Nays: None Mayor :Samuels declared the motion carried. ITEM NO. 9: CONSIDERATION OF PRELIMINARY PLAT - P -88 -O5 Mr. Walker moved to approve Preliminary Plat and Engineering Plans of Racetrac Addition, 9.131 acres, located on the eastern side of F.M. 167 approximately 200 feet north of Midway Drive in accordance with the recommendation of the Planning and Zoning Commission. Mr. Knight advised the Council that homeowners had appeared at. the Planning and Zoning Commission meeting on Tuesday night, April 19, 1988, opposing the pro- posed sale of gas at this location. Mr. Sternfels seconded the motion. Ayes: Messrs, Walker, Sternfels, Eden, Ozebek, and Mrs. Park Nays: None Mayor Samuels declared the motion carried. 1988 -061 Euless City Council Regular Meeting April 26, 1988 - Page. Five ITEM NO 10: CONSIDERATION OF RESOLUTION NO, 88 -678 Mrs. Park moved to approve Resolution No. 88-678, supporting comprehensive planning and intergovernmental cooperation in the environmentally sound disposal. of solid waste. Mr. Ozebek seconded the motion. Ayes: Mrs. Park, Messrs. Ozebek, Eden, Walker, and Sternfels Nays: None Mayor Samuels declared the motion carried- ITEM NO. 11: CONSIDERATION OF RESOLUTION NO. 88 -679 Mr. Sternfels moved to approve Resolution No. 88 °679, opposing the issuance of permits allowing new and. /or expanded landfills within the village Creek Water- shed Area. Mrs. Park seconded the motion. Ayes: Mr. Sternfels, Mrs. Park, Messrs. Walker, Eden, and Ozebek Nays: None Mayor Samuels declared the motion carried, ITEM NO. 12: CONSIDERATION OF RID AWARD Mrs. Park roved. to award the bid. for Class III -A Bullet Proof Vests for police officers to G T Distributors, Inc., as recommended by Captain Richard Clark, in the amount. of $334,99 per vest. Mr. Eden seconded the motion. Ayes: Mrs. Park, Messrs. Eden, Ozebek, Sternfels, and Walker Nays: None Mayor Samuels declared the motion carried. STAFF REPORTS ITEM NO. 10: CITY MANAGER'S REPORT The City Manager advised the. Council that S. H. 157 would be extended to seven (7) lanes from S. H. 183 to S. 11. 121. He also advised the Council that he would be out of toen on vacation for the next 10 days to three weeks. 1988 -062 Euless City Council Regular Meeting April 26, 1988 - Page Six ITEM NO. 11: CITY ATTORNEY'S REPORT The City Attorney stated he had nothing to report:. ITEM NO. 12: CITY SECRETARY'S REPORT The City. Council Minutes dated April 1.2, 1988, were approved as written. ITEM NO. 13: CITY ENGINEER'S REPORT Mr. Knight advised. the Council that the contractor on Collins Drive had request- ed an additional 10 days be added to the completion time. ITEM NO. 14: CITY COUNCIL REPORTS Mr. Walker reminded the Council and the audience to vote on May 7, 1988.
