MEE'T'ING OF THE EULESS CITY COUNCIL NOVEMBER 28, 1989 EXECUTIVE SESSION 1989-181 The Euless City Council met at 5:43 p.m. and convened in an executive session in the Municipal Building Council Chambers on Tuesday, November 28, 1989, for the purpose of discussing pending litigation. The business of executive session being concluded, the City Council adjourned at 6:35 p.m. Those present were Mayor Harold D. Samuels, Mayor Pro Tnn Glenn D. Walker, and Counc.ilmegibers Frank Douglass, Bob Eden, Mary Lib Saleh and Ron Sternfels. CALL TO ORDER A regular meeting of the Euless City Council was called to order at 7:15 p. m. , on Tuesday, November- 28, 1989, in the Council Chambers of the Euless Municipal Building, by Mayer Harold D. Samuels. ;'hose present. were Mayor Pro Tem Glenn D. Walker, Counc :i.lmembers Frank Douglass, Bob Eden, Mary Lib Saleh and Ron Sternfels. Meeting November 28, 1989 -- Page Two PLEDGE OF ALLEGIANCE Councilman Ron Sternfels led the pledge of allegiance. INVOCATION The invocation was given by Councilman Bob Eden. ITEM NO. 1: PRESENTATION OF EMPLOYEE SERVICE PIN Mayor Samuels presented a 10-year service. pin to Joyce Smith, Switchboard Operator in the Police Department. Mayor- Samuels extended his and the City Council's thanks and appreciation for her hard work and years with the. City. OLD BUSINESS ITEM NO. 2: CONSIDERATION OF ORDINANCE NO. 1016 Mr. Douglass moved to approve the second and final reading of Ordinance No, 1016, amending Section 7 -1000 of Zoning Ordinance No 347, regarding amendments to the Specific-Use Permit section of the zoning ordinance, which includes „airport': as a use requiring a Specific-Use Permit, and amending Section 7 -1300 by adding "airport" as a use listed in the Specific -Use schedule, Mr. Sternfels seconded the motion. Ayes: Messrs. Douglass, Eden, Mrs. Saleh, Messrs. Sternfels and Walker Nays: None Mayor Samuels declared the motion carried, NEW BUSINESS ITEM NO. 3: CONSIDERATION OF AN ORDINANCE Mr, Walker moved to table the first reading of an ordinance providing for the continued ad valorem taxation of goods, wares, merchandise, other tangible personal property and ores, temporarily within the city for certain purposes. Mr. Walker stated he would like more information on this item. Mr. Eden seconded the motion. After discussion, Mr. Eden withdrew his second to the motion. The motion then died for lack of a second. 1989-183 Euless City Council Regular Meeting November 28, 1989 - Page Three ITEM NO. 3: CONSIDERATION OF AN ORDINANCE (coat.) Mrs. Saleh moved to approve the first_: reading of the ordinance. regarding Proposition 5, the .local option to tax goods in transient, and stated that the Council would like more information on this item before the. December 12, 1989, City Council meeting, due to the January 1, 1990, time constraints of this item- Mx. Sternfels seconded the motion. Ayes: Messrs. Douglass, Eden, Mrs. Saleh and Mr. Sternfels Nays: Mr. Walker Mayor Samuels declared the motion carried, ITEM NO. 4: CONSIDERATION OF AMENDING AN ORDINANCE Mr, Sternfels moved to approve the first reading of an ordinance regarding changes to the Euless Fee Ordinance. Mr. Douglass seconded the motion. Ayes: Messrs. Douglass, Eden, Mrs. Saleh., Messrs. Sternfels and Walker Nays: None Mayor Samuels declared the motion carried. ITEM NO. 5: CONSIDERATION OF GRANTING PERMISSION FOR CHRISTMAS TREE LOT SALES Mr. James McDonald, 1308 El Camino Real, Euless, Texas, was present requesting permission to operate his Christmas tree lot at 1015 South Industrial Boulevard during the hours of 3:00 p . m. to 9 :00 p.m., Monday through Friday, and 10 :00 a.m. to 9:00 p.m, o:n Saturday, and 12.00 noon. to 6:00 p.m. on Sunday. Mr. McDonald stated there is ample parking and the road up to the tree lot is graveled and should not present any problems to customers. Mr. Eden stated that he felt South Industrial is a traffic hazard and . would. present problems. City Manager Tom Hart suggested that due to the Location and traffic problems, the Council deny this request, but approve the location on South Ector (Item No. 6). Mr. Sternfels moved to grant permission to Mr. McDonald for a Christmas tree sales lot. at. 1015 South Industrial Boulevard and that rules and regulations be established for next year's Christmas tree lot sales. Four ITEM NO. 5: CONSIDERATION OF GRANTING PERMISSION FOR CIJRIST'MAS TREE LOT SALES (cont) Mr. Sternfels moved to grant permission to Mr. McDonald for a Christmas tree sales lot. at 1015 South Industrial al Boulevard with the stipulation that. Mr. McDonald work with traffic safety personnel to improve the access to his location and that guidelines be established for the sale of Christmas trees next year. Mr. Eden seconded the motion. Ayes: Messrs. Eden, Sternfels and Mayor Samuels Nays: Mrs, Saleh and Mr. Walker Abstain: Mr. Douglass Mayor Samuels declared the :notion carried. TT EN NO. 6: CONSIDERATION OF GRANTING PERMISSION FOR CHRISTMAS TREE LOT SALES Mr. Darrel_]_ Luna, Auto Doctor- Transmission, 123 South Ector Drive, Euless, Texas, was present requesting permission to operate a Christmas tree sales lot on his commercial. lot at the above location. Mr, Luna advised the. Council that the hours of operation would be 10 :00 a.m. to 10 :00 p.m., from November. 28, 1989, un.t.:i.l. December 23, 1989, and there would be no tents or campers on the lot during this time. Mr. Sternfels moved to grant permission to Mr. Luna for a Christmas tree sales lot at 123 South Ector Drive and that guidelines be established for the sale of Christmas trees next year. Mr. Eden seconded the motion. Ayes: Messrs. Eden, Sternfels and Mayor Samuels Nays: Mrs. Saleh and Mr. Walker Abstain: Mr. Douglass Mayor. Samuels declared the motion. carried. ITEM NO. 7: CONSIDERATION OF AUTHORIZING THE CITY MANAGER TO PROCEED WITH !NE IMPACT FEES PROJECT Mrs. Saleh moved to table this it :em regarding impact fees to a future. City Council meeting, after the December 28, 1989, City Council. worksession. Mr. Eden seconded the motion. Ayes: Messrs. Douglass, Eden and Mrs. Saleh Nays: Messrs, Sternfels and Walker Mayor Samuels declared the motion carried. 1989 -185 Euless City Council Regular Meeting November 28, 1989 - Page Five ITEM NO, 8: CONSIDERATION OF AUTHORIZING THE CITY MANAGER TO PROCEED WITH THE DRAINAGE UTILITY /IMPACT FEES PROJECT Mrs. Saleh moved to table this item regarding drainage utility district to a future City Council meeting, after the December 28, 1989, City Council worksession. Mr. Eden seconded the motion. Ayes: Messrs. Douglass, Eden and Mrs. Saleh Nays: Messrs. Sternfels and Walker Mayor Samuels declared the motion carried. ITEM NO. 9: CONSIDERATION OF A BID AWARD Mr. Eden moved to approve awarding the low bid of $16,173.00 to Lanier Voice Products, 5750 Rufe Snow, Suite 1.24, Fort Worth, Texas, B:i.d No 89-015, that meets specifications for Police Department dictating equipment. Mrs. Saleh seconded the motion. Ayes: Messrs. Douglass, Eden, Mrs. Saleh, Messrs. Sternfels and Walker Nays: None Mayor Samuels declared the motion carried. ITEM N0. 10: CONSIDERATION OF A BIT? AWARD Mr. Sternfels moved to approve awarding the low bid of $62,500.00 to Payton/Wright Ford, 440 East Highway 114, Grapevine, Texas, Bid No. 89 -018, for five (5) Crown Victoria pursuit vehicles for the Police Department, at $12,500 each and to approve awarding the low bid of $23,902.00 to Klement. Karl Dodge, 500 North Highway 287, Decatur, Texas, for three (3) 1/2 -ton pick-ups for the Water/ Sewer Department, at $9,634.00 each, meeting specifications. NOTE: Of the eleven (11) vehicles, a request was made for the above eight (8) vehicles to be purchased immediately, with the option to exercise the 90 -day "grace period" for the remaining three vehicles if needed. Mrs. Saleh seconded the motion. Ayes: Messrs. Douglass, Eden, Mrs. Saleh, Messrs. Sternfels and Walker. Nays: None Mayors Samuels declared the motion carried. 1989-186 Euless City Council. Regular Meeting November 28, 1989 - Page Six STAFF REPORTS IT ( NO. 11: CITY MANAGER'S REPORT Mr. Hart asked the Council if they would like to have a worksession on Thursday, December 28, 1989, to discuss the three items of concern tonight. The Council agreec, to the worksession with the items for discussion being: (1) (2) (3) Item No '3 d Proposition 5 for taxing goods in transient Item No. 6 - Impact Fees item No. 7 - Drainage Utility District ITEM NO. 1.2: CITY ATTORNEY'S REPORT Mr. Cr.:i.bbs stated he had nothing to report., ITEM NO. 13: CITY SECRETARY'S REPORT The minutes of the November 14, 1989, City Council meeting were approved as written. ITEM NO. 14: CITY ENGINEER'S REPORT Mr. Tyler stated he had nothing to report.
