Regular Meeting

Euless City Council
August 11, 1964
CALL TO ORDER
The regular meeting of the Euless
City Council was called to order at 8 :20 P. M. by Mayor W. G. Fuller
with the following councilmen present: Messrs. Billy Owens, Don Warren
and Frank Douglass. Absent were Messrs. Bill Byers and Bobby Fuller,
on vacation
Also present were City Manager Lee
Cowell, City Attorney James Cribbs and City Secretary Vada Ferris.

The Reverend Mr. James Cooper,14in-
ister, of Euless First Methodist Church, presented the invocation.
PRESENTATION CY MINUTES
Minutes of the regular council meet-
ing, July 28, 1964, and called council meeting, August 4, 1964, were
approved as written.
VISITORS
Visitors present were: Mrs. Joe
Selvia, Messrs, Melvin Ruyle, H. D. Morgan, Wayne Landers, W. J. "Doc"
Hyde, Bill Ratliff, Phil Vincent (Star - Telegram Reporter), Ted Ricken-
bather (Euless. Herald), and the Reverend Mr. Cooper.
PUBLIC HEARING: Z ONING CASE NO. 127
M. L. T)LLERY REOUEST FOR REZONING
City Manager Cowell read Item III,
Minutes dated July 7, 1964, of the Planning and Zoning Commission meet-
ing, in which the Planning and Zoning Commission approved the request for
rezoning from Residential to Local Business as submitted by Mr. M. L, -
Tillery. After discussion, and, there being no opponents or proponents
in Zoning Case No. 127, Councilman Owens made the mot ion: 'to concur with
the recommendations of the Planning and Zoning Commission and approved
the rezoning request as submitted. Councilman Douglass seconded the
motion which carried unanimously. (First reading of Ordinance, August
25, 1964. )
PUBLIC HEARING: ZONING CASE NO. 128
MR, ANDREW,H IMES REQUEST FOR REZONING
City Manager Cowe11 read Item IV,
Minutes of Planning and Zoning Commission, July 7, 1964, in which the
Planning and Zoning Commission approved the request for rezoning from
Residential to Commercial as submitted by Mr. Andrew Himes. After dis-
cussion, and there being no opponents or proponents' in Zoning Case No.
128, Councilman Douglass made the motion to concur with the recommend=
ations of the Planning and Zoning Commission and approve the rezoning

request as submitted. Councilman Warren seconded the motion which car-
ried unanimously. (First reading of Ordinance, August 25, 1964.)
PUBLIC HEARING: ZONING CASE NO., 130
MR. SEARCY DOBKINS REQUEST FOR REZONING
City Manager Cowell read Item I, Plan-
ning and Zoning Minutes dated July 7, 1964, i n which the Planning and
Zoning Commission approved the request for rezoning from Residential to
Commercial as submitted by Mr. Searcy Dobkins. After discussion, and,
there being no opponents or proponents i n Zoning Case No, 130, Council-
man Warren made the motion to concur with the recommendations of the
Planning and Zoning Commission and approve the rezoning request as sub-
mitted. Councilman Douglass seconded the motion which carried unanimously.

IV.
CITY ATTORNEY' S REPORT CONCERN I NG
ACCEPTANCE OF MIDWAY PARK
City Attorney Cribbs. reported to the
council that he had investigated the pending lawsuit against the Midway
Park Home Owners Association and, after discussion, Councilman Owens made
the motion that the City Council authorize the City Attorney to represent
the Home Owners Association in the case of B. F. Norvell against Midway
Park Home Owners Association and the transfer of t i t I e to the park to the
City of Euless wi I I consummate on disposition of the lawsuit. Mrs. Joe
Selvia, Mr. Herschel Morgan, Mr. Wayne Landers and Mr. Melvin Ruyle, re-
presenting the Midway Park Home Owners. Association agreed to the motion
made by Councilman Owens. The motion was seconded by Councilman Warren
and carried unanimously.
V.
PLAT: PROPOSED DEVELOPMENT
BY MR. JOHN MORGAN
City Manager Cowell presented a plat
which had been submitted to the city offices by, Mr. John Morgan, owner
of property located on Highway 183 due west of the City Hall. Mr. Morgam
proposed to develop the property to provide a truck stop with a paved
area which would adcommodate approximately- thirty - five trucks, also, will
have a cafe and retail store. The City manager also read a letter-from
the business people leasing the buildings on Martha Street requesting
that the City provide access to the back of their stores, stating that
trash and garbage must be taken to the front of the store for disposition.
After considerable discussion, Councilman Douglass made the motion the
City Manager, members of the Planning and Zoning Commission and a repre- -
sentative from the engineering firm meet with Mr. Morgan, Mr. McKenzie
(owner of the buildings on Martha Street) and the businessmen leasing
the buildings on Martha, in an attempt to provide a solution beneficial
t o a l l concerned Jn this matter. Councilman Owens seconded the motion
which carried unanimously.

VI.
CITY MANAGER'S REPORT
Ci.ty Manager Cowell read a letter which
had been sent to the Mayor and Commissioners of the City of Bedford advis-
ing that a representative would be present at the next Bedford Commission
Meeting to secure information concerning Bedfords intentions i n the ac-
quisition of the water and sewer works. Mr. Cowell advised the council
that, 'just prior to this council meeting, he, Mayor Fuller, Mr. Bert Heyl,
and Mr. B i I I Ratliff had been recognized at the Bedford Commission Meeting,
and, that Commissioner Paul Comola and Mr. Shirley Peters, Bedford City
Attorney, had been appointed to meet with two representatives from the
City of Euless, to discuss the feasibility of the purchase of the water
and sewer system from Municipal Service Company. City Manager Cowell
stated that the group from Euless was most cordially received by the
Commission of Bedford and that' he conside-rs the appointment of this
committee an important step for future planning between the two cities.
After discussion, Councilman Douglass made the motion that Mayor Fuller
and City Manager Cowell be appointed as representatives for the City of
Euless to meet with those appointed from Bedford. Councilman Warren sec-
onded the motion which carried unanimously. Councilman Owens stated that
he considered the purchase of the water and sewer system to be a most
important project for the Eity of Euless and that it is his conviction
t h a t the c o u n c i l members should be kept informed o f any and a l l progress
made in this matter.
VII,
PLEASANT GLADE - MINTERS CHAPEL
PROPERTY ASSOCIATION
City Manager Cowell read a letter re-
ceived in the city offices from the Pleasant Glade- Minters Chapel Property
Owners Association stating that this group is desirous of deannexing from
the City of Euless and that they do not accept the position of the City
of Euless that their property is legally within the city, and that this
association is in the process of preparing legal steps to nullify the
annexation of the property. (Letter, as presented, filed with official
minutes in Office of City Secretary.)
VIII.
COMMUNICATION: DR. ROY BRASWELL
City Manager Cowell read a letter from
Dr. Roy Braswell concerning the water and sewer rates. After discussion,
Councilman Douglass made the motion that the council recognize the letter
as submitted by Dr. Braswell and authorize the City Manager and City
Attorney to investigate to determine if there has been a breach of the
franchise agreement in this matter. Councilman Owens seconded the motion
which carried unanimously. (Letter filed with official minutes in office
of City Secretary.)
IX.
COMMERCIAL BUILDING PERMITS
Councilman Owens made the motion that
requests for commercial building permits be presented to the Planning and

Zoning Commission before being presented to the council . Councilman
Douglass seconded the motion which carried unanimously.
