Home My WebLink About1913 06-28-2011 ORDINANCE NO. 1913 AN ORDINANCE AMENDING CHAPTER 82, "TRAFFIC AND MOTOR VEHICLES", ARTICLE III, "OPERATION OF VEHICLE", SECTION 82- 62, "SAME — ON CERTAIN STREETS AND PORTIONS OF STREETS", OF THE EULESS CODE OF ORDINANCES CHANGING HARRINGTON GARDENS PARKWAY TO RIO GRANDE BOULEVARD, ESTABLISHING A SPEED LIMIT FOR RIO GRANDE BOULEVARD AND ESTABLISHING SPEED LIMITS FOR LOVING TRAIL AND CHISHOLM TRAIL; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the City of Euless has renamed Harrington Gardens Parkway to Rio Grande Boulevard; and WHEREAS, Section 82-62 of the Code of Ordinances established a speed limit for Harrington Gardens Parkway; and WHEREAS, right-of-way establishing Rio Grande Boulevard, Loving Trail and Chisholm Trail has been dedicated to the City of Euless; and WHEREAS, the City of Euless desires to change Harrington Gardens Parkway to Rio Grande Boulevard in Section 82-62 of the Code of Ordinances; and WHEREAS, the City of Euless desires to establish speed limits on the newly dedicated right-of-way for Rio Grande Boulevard, Loving Trail and Chisholm Trail. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EULESS, THAT: SECTION I Section 82-62 entitled "Same-On certain streets and portions of streets," of Article III, entitled "Operation of Vehicle," of Chapter 82, entitled "Traffic and Motor Vehicles: of the Euless Code of Ordinances is hereby amended to delete the street name Harrington Gardens Parkway and replace it with the street name Rio Grande Boulevard. SECTION H Section 82-62 "Same - On certain streets and portions of streets," of Article Ill, "Operation of Vehicle," of Chapter 82, "Traffic and Motor Vehicles" of the Euless Code of Ordinances, is hereby amended to establish a speed limit for vehicles traveling upon the named streets or parts thereof, as follows: Block number/(portion of street) a) Rio Grand Boulevard 2200-3000 Glade Road to Cheek-Sparger Road 30 mph b) Loving Trail 1100-1200 State Highway 121 to Rio Grande 30 mph Boulevard c) Chisholm Trail 1100-1200 State Highway 121 to Rio Grande 30 mph Boulevard. SECTION III Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in accordance with Chapter 1, Section 1-12, Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION IV This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. SECTION V That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
