HomeMy WebLinkAbout1981-06-09Regular Meeting Euless City Council June 9, 1981 The regular meeting of tie Euless City Council was called to order at 8:15 p.m., in the Council Chambers of the Euless City Hall, by Mayor Harold Samuels. Other Members present were Mayor Pro Tem Willie Mae McCormick, Councilmen 1-lobert Pippin, Glenn Walker, Bob Eden, and Ron Sternfels. C STAFF MEMBERS PRESENT: City Manager W. M Sustaire, City Secretary Kay Rainey, City Attorney James Cribbs, City Engineer James Knight, Director of Plannina and Development Kent Flynn, and Secretary Joyce Smith. VISITORS PRESENT: Helen Lightbody, Larry Lightbody, Keith E. Wallace, Tom Purvis, Don Calhoun and Walter Elliott. INVOCATION The invocation was given by Mayor Samuels. The minutes of the regular meeting dated May 2-6, 1981, and the called meeting of May 80, 1981, were approved as written. N RESOLUTION NO. 507_- TO RESCIND RESOLUTION NO. 505 FOR HURST-EULESS- BEDFORD INDEPENDENT SCHOOL DISTRICT TAX APPRAISAL Mr. Pippin moved to approve Resolution No. 507, thereby rescinding Resolution No. 505, for the Hurst-Euless-Bedford Independent School District to conduct a tax appraisal of Euless property in 1981. Mr. Walker seconded the motion, and the vote is as follows: Ayes: Messrs. ORDINANCE NO. 661 - CHANGE OF ZONING FROM "C-2" COMMUNITY BUSINESS DISTRICT TO "PD" PLANNED DEVELOPMENT ON LOT 1R, BLOCK 1, EULESS TOWN CENTRE Mrs. McCormick moved to approve the second and final reading of Ordinance No. 661, to change zoning from "C-2" Community Business District to "PD" Planned Development of Lot 1R, Block 1, Euless Town Centre, property located at the southwest corner of Airport Freeway and FM 157. Mr. Eden seconded the motion, and the vote is as follows: Ayes: Mrs. McCormick, Messrs. Eden, Walker, Sternfels, and Pippin Nays: None Mayor Samuels declared the motion carried. ORDINANCE NO. 662 - CHANGE OF ZONING FROM "C -2" COMMUNITY BUSINESS DISTRICT TO "PD" PLANNED DEVELOPMENT ON LOTS 18, AND 19, BLOCK 4, BELL RANCH TERRACE ADDITION Mr. Eden moved to approve the second and final reading of Ordinance No. 662, to change zoning from "C-2" Community Business District to "PD" Planned Development of Lots 18 and 19, Block 4, Bell Ranch Terrace Addition, property located at the south- west corner of Toplea Drive and FM 157. Mr. Walker seconded the motion and the vote is as follows: Ayes: Messrs. FINAL PLAT - LOT 2, BLOCK C, INTERNATIONAL/REGIONAL INDUSTRIAL COMPLEX Mr. Eden moved to concur with the recommendation of the Planning and Zoning Commission and approve the final plat of Lot 2, Block C/ International/Regional Industrial Complex, property located at the northeast corner of Regal Parkway and Westpark Way. Mr. Walker seconded the motion and the vote is as follows: Ayes: Messrs. Eden, Walker, Sternfels, Pippin, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. CONSIDER TERMINABLE RIGHT-OF-WAY T�—ND -fKS-KZK���20F A —TRACT —OFLA—ND---- IN THE JAMES MATSON SURVEY, A-1080, TARRANT-COUNTY Mr. Sternfels moved for acceptance of the Terminable Right-of-Way and Easement of a tract of land in the James Matson Survey, A-1080, Tarrant County, Texas. 120 Page Four, Regular Meeting, Euless City Council, June 9, 1981 Mrs. McCormick remarked to the audience that this right-of-way will benefit the City of Euless and its citizens. She wanted to thank the many people who have worked on this project: W. M. Sustaire, James Cribbs, Bob McFarland, Jack Bullard, Frank Crumley, and others. Mr. Walker seconded the motion and the vote is as follows: Ayes: Mr. Sternfels, Mrs. McCormick, Messrs. Eden, Walker, and Pippin Nays: None Mayor Samuels declared the motion carried. Mayor Samuels requested the minutes reflect that the Council does express a desire to accept the donation of this land and for the City Manager to proceed with the project. VII. FURTHER CONSIDERATION OF THE PROPOSED REVISIONS TO THE CITY OF EULESS ZONING ORDINANCE Mayor Samuels requested the City Attorney prepare the necessary documents for conformance based on Staff recommen- dations for Phase I of the revisions to the Euless Zoning Ordinance and have ready for final reading at the regular council meeting on June 23, 1981. City Attorney James Cribbs stated he would pre- pare the documents for the June 23, 1981, regular meeting of the Euless City Council. CALL A PUBLIC HEARING - TEXAS POWER AND LIGHT COMPANY REQUEST FOR RATE INCREASE Mrs. McCormick moved to set a public hearing for July 28, 1981, to receive citizen input regarding a rate increase by Texas Power and Light Company. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Mrs. McCormick, Messrs. HUITT SURVEY, A­684 Motion was made by Mr. Walker to set a public hearing for June 23, 1981, concerning Zoning Case No. 339, a request of Dan McLeland for a change of zoning from "PD" Planned Development to "C-2" Copa-iunity Business District, on a portion of Tract 4D3, A. J. Fuitt Survey, A-634, located south of Airport Freeway, east of LaQuinta Motel, and west of Park Crestmoor Addition. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Messrs. CALL A PUBLIC HEARING - ZONING CASE NO. 341 - A PORTION OF TRACT B-R, LAKEWOOD ADDITION - A PORTION OF BLOCK I, LAKEWOOD ADDITION, SECOND INSTALLMENT Motion was made by Mr. Walker to set a public hearing for June 23, 1981, concerning Zoning Case No. 341, a request of Jimmy Wolff for change of zoning from "C-2" Community Business District to "R-4" Multi-Family Dwelling District on portion of Tract B-R, Lakewood Addition, and "R-4" Multi-Family Dwelling District to"C-2" Community Business District, on portion of Block I, Lakewood Addition, Second Installment, located south of Ash Lane and East of FM 157. HUITT SURVEY, A-705 Motion was made by Mr. Walker to set a public hearing for June 23, 1981, concerning Zoning Case No. 336, a request of Bruce French for change of zoning from "R-1" Single Family Dwell- ing District to "R-3" Multi-Family Dwelling District with "SP" Special Use Permit for daycare facility on portion of Tracts 1B, 6A, and 6D, S. Huitt Survey, S-705, located east of North Main Street and south of East Midway Drive. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Messrs. CALL A PUBLIC HEARING ZONING CASE NO. 335 - TRACTS 13 AND 14, RAY SHELTON SUBDIVISION Mr. Pippin moved to set a public hearing for July 7, 1981, for Zoning Case No. 335, request of Richard J. Thomes for change of zoning from "PD" Planned Development to "R-2" Two Family Dwelling District and "R-4" Multi-Family Dwelling District on Tracts 13 and 14 of Ray Shelton Subdivision, property located west of Fuller-Wiser Road and south of Ash Lane and north of Harwood Drive. Mr. Walker seconded the motion and the vote is as follows: Ayes: Messrs. Pippin, Walker, Eden, Sternfels, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. xiv. AUTHORIZE CITY MANAGER TO PROCEED WITH TAKING BIDS FOR CONSTRUCTION OF NEW FIRE STATION Mr. Walker moved to authorize the City Manager to proceed with the taking of bids to begin construction of a new fire station. Mr. Pippin seconded the motion and the vote is as follows: Ayes: Messrs. Walker, Pippin, Sternfels, Eden, and Mrs. McCormick Nays: None Mayor Samuels declared the motion carried. xv. -AUTHORIZE CITY MANAGER TO PROCEED WITH THE INVESTMENT OF BONDS TO MATURE IN 1982 Mr. Sternfels moved to authorize tho City Manager to proceed with the investment at best available rate and time period of revenue funds retained by New York bond bankers which are due to mature in early 1982. V14?A8 CITY ENGINEER'S REPORT Mr. Knight stated he had nothing to report. XVIII. CALL A PUBLIC HEARING - ZONING CASE NO. 342 - TRACTS 1, 1C, 1D, AND 6, S. HUITT SURVEY, A-740 Mr. Walker moved to set a public hearing for July 28, 1981, for Zoning Case No. 342, request of Jim Culbertson for change of zoning from "R-1" Single Family Dwelling District to "R-311, "R-4", and "R-5" Multi-Family Dwelling Districts on Tracts 1, 1C, 1D, and 6, S. Huitt Survey, A-705, property located south of Harwood Road. Mr. Sternfels seconded the motion and the vote is as follows: Ayes: Messrs, Walker, Sternfels, Pippin, and Mrs. McCormick Nays: None Abstentions: Mr. Eden Page Nine, Regular Meeting, Euless City Council, June 9, 1981 Mayor Samuels announced that Council would hear further consideration of Zoning Case No. 311, request of Helen Lightbody for change of zoning from "R-l" Single Family Dwelling District to "R-5" Multi-Family Dwelling District with "CUD" for conforming housing Lots 14 through 19, Block 2, J. E. Whitener Estates, property located south of Whitener Road, west of Fort Worth City Limits and north of South Pipeline Road. Mayor Samuels recognized Mr. Keith Wallace. Mr. Keith Wallace, Owen Ayres Associates, Inc., Consulting Eingineers, Dallas, Texas, stated that he represents the 'U-ightbodys, and that the prospective purchaser of this property is Mr. Tom Purvis. Mr. Wallace stated that Staff has worked with his company and has done an excellent job, but there is one over- sight that was unnoticed until just before this Council meeting. This is related to the Staff letter of June 9, 1981, from Kent Flynn, and is concerning the provisions made by Planning and Zoning to provide a buffer, with the revised plat being in exact accordance with this letter. One of the comments reads that the first one hundred foot strip be designated to follow Euless' "R-2" zoning, which would be either duplex, single family, or single family attached. it was his understanding that: they intended to put a buffer there of d lower density, but because of the nature of Whitener, not to put a duplex; they agreed to a density of eight units per acre on this first one hundred foot strip along Twin Creek. However, he said because of Whitener being a collector if it is built, the City would not allow nor want lots fronting onto Whitener. He stated their intention was �_u buffer the single family develop- ment with a lower density multi-family usage, plus a sizeable green space, and not to actually plat those lots as duplex because of the location and the direction they would be facing. It was on City Council recommendation that a lower density buffer be there, and they are in full accordance with the letter and have no objection to it in any way. Mayor Samuels asked if they were proposing there would be an access to whatever is built on Whitener. Mr. Wallace stated he believed there is a sub- division ordinance which states there is no driveway attached oil a collector. Mr. Knight stated if Whitener is a designated collector street, then that would be true, the recommendation is no driveway there. Mayor Samuels inquired if the total density would still be 220 units spread over the entire complex, including that area. 126 Paqe Ten, Regular Meeting, Euless City Council, June 9, 1981 Mr. Wallace stated that was right and the density would figure out to be 19.09 over the property, virtually nineteen units per acre over this 112 acre tract. Mrs. McCormick requested clarification that the maximum would still be 220 units regardless of whether "R-2" or 11R-311. Mr. Wllace verified this is correct, over the entire property. Mrs. McCormick moved that the zoning change be approved, including the letter dated June 9, 1981, from Planning and Development, and not greater.than 220 units. Mr. Eden seconded the motion. Mr. Cribbs inquired if the maximum one hundred foot depth would be "R-3", limited to eight units per acre. Mr. Wallace said yes; that would be best. Mayor Samuels revised the letter of June 9, 1981, from Mr. Kent Flynn, to read as follows on Paragraph 1, Item 1, second sentence: "In addition, a 100 foot deep area of "R-311 not to exceed eight units per acre, adjacent to proposed Whitener Drive has been provided to buffer Twin Creek Estates on the north." Mr. Wallace stated this is written as a special condition on the site plan itself. Mr. Pippin asked what is the total acreage involved in this lesser density. foot strip. hundred foot strip. Mr. Wallace stated it is 0.95 in the one hundred Mr. Pippin asked what is the width of the one Mr. Wallace state it is 414.6, 415 feet. Mr. Sternfels stated he is concerned with the total density of the area, that he thinks the property will be suitable for this type development, but the density is his concern. Mr. Pippin state this is the same concern he has. There is, in his opinion, two solutions to the problem. One is to have two means of access, with one automatically being taken care of 12/ Page Eleven, Regular Meeting, Euless City Council, June 9, 1981 out through American Boulevard. The other would appear to have to flow up through the residential area of Raldon Homes, unless Whitener is completed. With anything less than the completion of Whitener Drive, he said he has some concern with the density flowing through Raldon Homes and the shopping center near there. Mr. Wallace stated he understood the concern and the two means of access would come from other ways, from the east, one being Pipeline Road, with Whitener being the third access. He stated it is not the intention of the developer to have the apartment traffic flow through the "R-l" district, and the site plan itself would be reviewed and approved by Staff. Mr. Pippin stated that he wished to make his concern known now in the event problems developed in the future. Mr.Cribbs asked if it would be easier to set the number of units to eight units per acre, on a 105 foot depth. Mr. Flynn said this would be all right. Mr. Wallace said this would be no problem and would be agreeable. Mrs. McCormick amended her motion to approve the zoning change to include a 105-foot depth with eight units as a buffer to Twin Creek Estates to the north, on Zoning Case No. 331, request of Helen Lightbody for change of zoningfrom "R-l" Single Family Dwelling District to "R-5" Multi-Family Dwelling District with "CUD" for Conforming Housing on Lots 14 through 19, Block 2, J. E. Whitener Estates, property located south of Whitener Road, west of Fort Worth City Limits, and north of South Pipeline Road, in compliance with Staff letter of June 9, 1981, and including eight special conditions as reflected on the approved site plan. Mr. Eden seconded the motion and the vote is as follows: Ayes: Mrs. McCormick, Messrs, Eden, Walker, and Pippin Nays: Mr. Sternfels MMMPMTq Mayor Samuels declared the motion carried. M 16 Mr. Sternfels commented on the need for more mosquito spraying. kW-1 Page Twelve, Regular Meeting, Euless City Council, June 9, 1981 Mr. Sustaire said the City is doing as much as possible when they can get out and spray. NORTH CENTRAL TEXAS COUNCIL OF GOVERNMENTS Mr. Sustaire commented that he had received a letter from the North Central Texas Council of Governments stating on June 29, 1981,they will vote to possibly increase dues of the City of Euless from $10,500 per year to $21,000 per year, based on per capita. Currently we are set at 4� per capita and this increase is to 8� per capita. Mayor Samuesl stated that we would study the issue when the new rates are set, and-if we did not utilize this service enough, we might not participate. Mr. Sustaire stated the North Central Texas Council of Governments are trying to reduce their staff and cut costs in every possible way to keep increases to a minimum.
