HomeMy WebLinkAbout2175 10-24-2017 ORDINANCE NO. 2175 AN ORDINANCE OF THE CITY OF EULESS, TEXAS, AMENDING CHAPTER 34 "FIRE PREVENTION AND PROTECTION," SECTION 34.105 "AMENDMENTS TO THE INTERNATIONAL FIRE CODE," OF THE CODE OF ORDINANCES OF THE CITY OF EULESS; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATION; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City adopted the 2015 Edition of the International Fire Code regulating conditions hazardous to life and property from fire, hazardous materials, and explosion in order to provide for the safety of the citizens of Euless; and WHEREAS, the Fire Chief has recommended certain amendments to the 2015 International Fire Code and the City Council has determined that the adoption of the local amendments are in the public interest and are necessary for the protection of the health, safety and welfare of the citizens of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1. AMENDMENTS TO THE 2015 INTERNATIONAL FIRE CODE Section 34-105 "Amendments to the International Fire Code" of Article IV, "Standards" of Chapter 34 "Fire Prevention and Protection" of the Code of Ordinances of the City of Euless, Texas is hereby amended to add the following amendments to the 2015 International Fire Code. The existing amendments adopted in Ordinance 2115 shall remain, with the addition of Section 506.1 and the following amendments to the existing language in Ordinance 2115 Sections 905.3.9 and 907.6.1.1: 1) Section 506.1 is added to read as follows: "506.1 Where required for fire or police department access. Where access to or within a structure or an area is restricted because of secured openings or where immediate access is necessary for police responses for service, life-saving, or fire-fighting purposes, the fire code official is authorized to require a key box, and may require other methods to access the building, to be installed at an approved location. The key box shall be of an approved type listed in accordance with UL 1037 and shall contain keys to gain necessary access as required by the fire code official. In buildings classified as a Residential Group R-1 or R-2, an approved method of entry that does not require a key shall be provided at ground floor entrances as determined necessary by the police chief or his representative. This method of entry shall be in addition to the Knox Box (key box) required herein." 2) Section 905.3.9 is amended to read as follows: "905.3.9 Buildings exceeding 10,000 square feet. When required by the fire code official, in buildings exceeding ten thousand (10,000) square feet in area per story, Class I wet standpipes shall be provided where any portion of the building's interior area is more than two hundred (200) feet of travel, vertically and horizontally, from the nearest point of fire department vehicle access. When approved by the fire code official, manual dry or other approved types of standpipes are permitted when conditions make a wet standpipe not practical. Standpipe piping shall be a minimum of Schedule 40 for dry standpipes or Schedule 10 for wet standpipes unless an approved alternative method is allowed. Exceptions: 1. Automatic dry and semi-automatic dry standpipes are allowed as provided in NFPA 14, when approved by the fire code official. 2 R-2 occupancies of four stories or less in height having no interior corridors when approved by the fire code official." 3) Section 907.6.1.1 is amended to read as follows: "907.6.1.1 Wiring Installation. All fire alarm systems shall be installed in such a manner that the failure of any single alarm initiating or alarm indicating (notification) device or single open in any circuit conductor will not interfere with the normal operation of any other such device. All systems and components shall be installed in accordance with NFPA 72 requirements for Class "A" circuits and shall have a minimum separation of six (6) feet horizontal and one (1) foot vertical between supply and return circuit conductors. All underground wiring shall use listed waterproof fire alarm wire and be installed in conduit." Ordinance No. 2175, Page 2 of 4 SECTION 2. CUMULATIVE CLAUSE. This ordinance shall be cumulative of all provisions of ordinances of the City of Euless, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 3. SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase. SECTION 4. PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Section 1-12 "General Penalty", Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder for violation of an ordinance governing fire safety. SECTION 5. SAVINGS CLAUSE. All rights and remedies of the City of Euless are expressly saved as to any and all violations of the provisions of the City Code or any other ordinances regulating fire safety that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 6. PUBLICATION CLAUSE. The City Secretary of the City of Euless is hereby directed to publish the caption, penalty clause and effective date in the official newspaper of the City of Euless, as required by Section 12 of Article II of the Charter of the City of Euless.
