HomeMy WebLinkAbout1997-04-22 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL April 22, 1997 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:20 p.m. on Tuesday, April 22, 1997, in the Administration Building Conference Room. Those present included Mayor Mary Lib Saleh, Mayor Pro Tern Bobby Baker and Council Members Carl Tyson, Leon Hogg, Charles Miller, Glenn Walker, and Katie Edwards. Precouncil discussion was held on agenda items and other scheduled items. CLOSED MEETING TO DISCUSS LAND ACQUISITION AS AUTHORIZED BY SECTION 551.072 OF THE TEXAS GOVERNMENT CODE. CITY COUNCIL MINUTES APRIL 22, 1997 PAGE 2 """ ITEM NO. 1 PRESENTATION OF 5 YEAR SERVICE PIN Mayor Saleh presented a five year service pin to Police Corporal Casey Sanders. ITEM NO. 2 PRESENTATION OF PROCLAMATION Mayor Saleh presented Andy Chesney, owner of Euless Wrecker Service, with a proclamation for the United Way Volunteer of the Year. Mr. Chesney introduced his wife Debi, his mother LaNell, and son John. ITEM NO. 3 PRESENTATION OF PROCLAMATION Mayor Saleh presented Charlene Conger of the National Organ Donor Association with a Proclamation declaring April 20-26, 1997 as National Organ and Tissue Donor Awareness week. ITEM NO. 4 APPROVAL OF SITE PLAN #97-07 - MOBILE CRETE Director of Planning and Development Bo Bass gave a brief description of Site Plan #97- 07 stating that the request from Mr. Ron Walker, with Mobile Crete, is for a 1,680 square foot building with outside storage of sand and gravel in concrete bins. Mr. Bass added the subject property is 1.72 acres located at the east end of Regal Parkway, between Aurora Casket's warehouse and the City's golf course. Mr. Ron Walker, with Mobile Crete, P.O. Box 210042, Bedford, TX 76095 distributed photographs showing the trucks his operation uses. He stated the trucks are loaded dry with sand on one side, rock on the other side, cement in the back and water in the front. The ingredients are mixed on the job site. They do sidewalks and slow jobs with wheelbarrows. He stated they do a lot of work for municipalities, including the City of Euless, such as manholes, curb cuts, etc. The trucks are on each job approximately 2 hours and do several jobs while they are out. The three trucks may load twice each day and would only be at the location 35-45 minutes each time they are loaded. He stated Mobile Crete had been in business about a year and a half, adding their hours of operation are from 6:30 a.m. to 5:30 p.m. Mr. Walker stated that the only noise involved would be the diesel engines on the trucks and the small tractor that will load the truck. They will need an airtank and a compressor, but if the compressor is placed outside the building, he has agreed to have it completely insulated and placed in a steel compartment. Mr. Hart asked how far the hopper would be from the golf course cart path. Mr. Walker stated that it would be approximately 250 feet, adding there are large trees on that side of the business and that there is a 12 foot slope in between the golf course fairway and the area where the building would be constructed. Mayor Pro Tem Baker asked about drainage requirements for Mobile Crete. Assistant City Engineer Andrea Baxter stated that she understood that Mr. Walker had gone above CITY COUNCIL MINUTES APRIL 22, 1997 PAGE 3 and beyond requirements. Mr. Walker described the drainage required for the property, and said the flow of water will be to the driveway as suggested by the City Engineer. Mr. Walker said he would be installing sprinklers on the grounds to control the dust. Council Member Edwards asked about the fencing around the facility. Mr. Walker stated that it would be a 6 foot brick fence going to the 40 foot opening which will have double gates. The east side fencing will be chain link with vinyl slats. Council Member Miller suggested planting 4 foot red tipped Photinia bushes against the east side chain link fencing to provide additional screening. Mr. Bass stated that there is a 10 foot easement between the property lines, five feet being on the proposed Mobile Crete site and 5 foot belonging to the City of Euless adding that the bushes would have to be planted on our side. Mayor Saleh asked Mr. Bass if the Mobile Crete fence would be on the outside or on the inside of the city's property. Mr. Bass stated the fence is on the inside of the city's property adding that Mr. Walker could plant the Photinia's on the inside of his fence. Mr. Bass further stated that the Photinia's could be placed on the outside of the fence in the easement but if work needed to be done they would have to be removed. Council Member Walker motioned to approve Site Plan #97-07 with the stipulation that the east chain link fence have 4 foot red tipped Photinias planted at 22 inch centers, rather than vinyl slats within the chain link fence, to give as much screening as possible. v.. ITEM NO. 5 ACKNOWLEDGE PROJECTS EXEMPTED FROM THE 120 DAY MULTI-FAMILY MORATORIUM Mayor Pro Tern Baker motioned to acknowledge projects exempted from the 120 day moratorium as follows: 1. Stonebridge @ Bear Creek (184 units, SE/c Fuller-Wiser Road & Mid Cities Boulevard); 2. Shavano @ Bear Creek (216 units, South and adjacent to the Landing @ Bear Creek; 3. Oakmont @ Bear Creek (226 units, SW/c Mid Cities Boulevard & Bear Creek Parkway) {SUP expires 2/27/98}; 4. Aviara @ Bear Creek (436 units, NE/c Fuller-Wiser Road & Bear CITY COUNCIL MINUTES APRIL 22, 1997 PAGE 4 Creek Parkway {being considered by Planning and Zoning}; 5. Norstar @ Bear Creek(256 units, SE/c of Ash Lane and Fuller-Wiser Road) {under construction}; 6. The Mansions by the Vineyard (226 units on S.H. 121 north of Mid Cities Boulevard) {under construction}; 7. Oak Park Apartments (80 units on N. Main Street next to water tower) {mostly complete}; 8. "Sandlin Town Home" development (98 units, 10.12 acres on Ash Lane, between Lakewood Town Homes and Willow Ridge Apartments); and 9. "Bennett" development @ Bear Creek (239 units, 14.97 acres on Bear Creek Parkway, between The Landing and The Sandstone) with the stipulation that the following documents be submitted to the City by May 13, 1997: (a) An affidavit indicating the date of contract and the timing of such sale, (b) A review letter from the Villages of Bear Creek Architectural Review Committee stating that they had submissions prior to April 22, 1997 (c) Site Plans dated prior to April 22, 1997. Council Member Walker seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Baker, Council Members Hogg, Miller, Walker, and Edwards Nays: Council Member Tyson Mayor Saleh declared the motion carried. ITEM NO. 6 APPROVAL OF MINUTES Council Member Edwards motioned to approve the April 8, 1997 City Council Meeting minutes as presented. Council Member Walker seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Baker, Council Members Tyson, Hogg, Miller, Walker, and Edwards Nays: None Mayor Saleh declared the motion carried. CITY COUNCIL MINUTES APRIL 22, 1997 PAGE 5 ITEM NO. 7 REPORTS City Manager City Manager Tom Hart congratulated Andy Chesney for receiving the United Way Volunteer of the Year award. City Attorney City Attorney Paul Wieneskie stated he had nothing to report. Staff Director of Planning and Development Bo Bass gave his presentation on Code Enforcement and Minimum Housing during precouncil. In it he covered the current building permit, minimum housing and code enforcement activity and reminded the Council Members of the lengthy procedure to process violations. Mr. Bass stated that the majority of the code enforcement violations are corrected within five days, and that it is the ones that do not comply that receive the most attention. Mayor Pro Tem Baker asked about the U-Haul trailers that are parked across Highway 10 from the Tileba business. Mr. Bass stated he would check on the specific use permit issued for that location. City Council Council Member Tyson congratulated Andy Chesney and thanked him for all he does for the City of Euless. Mr. Tyson commented that Arbor Daze was great. Council Member Hogg congratulated Casey Sanders for receiving his five year service pin and Andy Chesney for the Volunteer of the Year recognition. Mr. Hogg commented on Arbor Daze stating that he heard nothing but good comments about the event. Mayor Pro Tern Baker said he was happy to have his wife and daughter present at the meeting and that he was glad to see Andy Chesney receive the Volunteer of the Year award. Mr. Baker stated that he had a great time at Arbor Daze and that it is an enjoyable family event. Council Member Miller congratulated Casey Sanders and Andy Chesney. Mr. Miller commented that he has contacted Andy several times for things and that he has never said "No" to him for any request and added that Andy has deep concerns for the City of Euless and thoughts on how to help our city. Mr. Miller stated that Arbor Daze was great and everyone did a great job. Council Member Walker congratulated Andy Chesney and commented on Arbor Daze and ,`, stated it was a job well done. Ms. Edwards thanked Tom Hart, Rick Herold, and all the staff for the Arbor Daze event, adding the layout of the event was perfect and everyone did a nice job. Mayor Saleh stated that the Mayor of Nebraska City visited Arbor Daze this year and they said they had a wonderful time. Mayor Saleh asked if anyone in the audience would like to speak. Kurt Chapman, an employee of Andy Chesney for three years, congratulated Mr. Chesney on being recognized as Volunteer of the Year. Debi Chesney commented that she thought Arbor Daze was wonderful and the layout was great.
