HomeMy WebLinkAbout1997-11-25 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL NOVEMBER 25, 1997 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:15 p.m. on Tuesday, November 25, 1997, in the downstairs Administration Building Conference Room. Those present included Mayor Mary Lib Saleh, Mayor Pro Tem Charlie Miller and Council Members Bobby Baker, Carl Tyson, Katie Edwards, and Leon Hogg. Council Member Glenn Walker was out of town. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:11 p.m. for the consideration of scheduled items. ANNOUNCEMENT Mayor Saleh announced that Item Nos. 33 & 34 should not have been placed on the agenda and that Item No. 39 had received a number of written objections and needed additional review; therefore, the Council would consider tabling these items. Council Member Edwards motioned to Table Item Nos. 33, 34 & 39. Council Member Baker seconded the motion. ITEM NO. 1 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Allen Johnson, AIDS Outreach Center, proclaiming December 1, 1997, as World AIDS Day. CONSENT AGENDA Items 2 through 7 were approved as follows: ITEM NO. 2 APPROVAL OF RESOLUTION NO. 97-981 Approval of Resolution No. 97-981 supporting the City of Arlington in their bid for the 2012 Olympic Games. ITEM NO. 3 APPROVAL OF APPOINTMENTS TO BOARDS AND COMMISSIONS Approval of appointment of Patricia Lemoine to Place 10 on the Economic Development Advisory Board. ITEM NO. 4 APPROVAL OF BID FOR VEHICLE FOR CODE SERVICES DEPARTMENT Approval to purchase one mid-size pickup truck from Payton-Wright Ford, Grapevine, Texas, for the price of $12,315.00 to be used in the Code Services Department. ITEM NO. 6 APPROVAL OF BID NO. 97-35 Approval of awarding Bid No. 97-35 for weight equipment to Busy Body Fitness Warehouse, Dallas, Texas, in the amount of $33,470.80. ITEM NO. 7 APPROVAL OF MINUTES Approval of the minutes of the Regular City Council Meeting of November 11, 1997. Council Member Hogg motioned to approve Items 2 through 7 on the Consent Agenda. ITEM NO. 8 AUDIENCE REQUESTED BY KHALID ALICHAFAJI, 1410 BELL RANCH CIRCLE AND MARCELINO PABON, 1409 SIGNET STREET Mr. Khalid Alichafaji and Mr. Marcelino Pabon addressed the City Council regarding a fence erected on Signet Drive which they believed is not in compliance with the site plan ordinance. The Council will discuss the issue with the development staff and respond back to Mr. Alichafaji and Mr. Pabon. ITEM NO. 9 REJECTION OF AWARD OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) PROJECT NO. B96-UC-48-0001-22-50 Community Development Block Grant(CDBG) Project No. B96-UC-48-0001-22-50 consists of the replacement of approximately 2,350 I.f. of wastewater pipe in the Oakwood Terrace Addition utilizing trenchless technology. The project is an extension of last year's CDBG project and involves work in the backyards of 41 Euless citizens. Tarrant County's participation in the project is $165,509. The City's share is approximately $30,000. Tarrant County opened the bids for this project on October 22, 1997. Assistant City Engineer Andrea Baxter explained that the low bidder could not get bonding, the second low bidder, Nadesda Construction, has not performed work as a company, although Nadesda's President Jerry Manning has performed this type of work with another company. She noted that there were three options: 1) award the bid to Nadesda Construction; 2) award the contract to the third low bidder, Hall-Albert Construction; or 3) CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 4 N,,,. combine this year's grant with next year's grant, since next year's grant is an extension of the project. In response to questions regarding his experience, Mr. Jerry Manning, President of Nadesda Construction, stated that he is the owner and that he previously started Texas Sterling and was the Vice President and General Manager for five years. He sold the company and came back at a later date without ownership. He mentioned he was involved in Tarrant County CDBG projects in Saginaw and Richland Hills. In response to questions regarding combining this year's and next year's grant, Mr. David Hughes, Elliott & Hughes Engineering, stated that Tarrant County has agreed that both years work could be combined. This year's project includes 2,200 feet of pipe and next year's includes 1,000 feet. He noted that it would take approximately 75 calendar days to complete this project and 90-100 days total if combined. It would also take 60-75 days to rebid the project. After additional discussion, Mayor Pro Tern Miller motioned to recommend Tarrant County reject all bids and rebid combining the CDBG 22nd and 23rd year grants. ITEM NO. 10 APPROVAL OF RE-CERTIFICATION OF PARK GRANT Director of Community Services Rick Herold stated that the re-certification is necessary because the state will not accept the land value as matching for Phase II. The City Council must approve to receive the $500,000 grant and agree to match with $500,000 cash. The city would have two full years to start the project after approval in January, 1998. Council Member Hogg motioned to approve the re-certification of grant application for Phase II of The Parks at Texas Star Grant to the Texas Parks and Wildlife Department. CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 5 ITEM NO. 11 PUBUC HEARING REGARDING SPECIAL EXCEPTION TO ORDINANCE NO. 1244 Mayor Saleh opened the public hearing at 8:10 p.m. regarding the request of Mr. Bruce French, representing Genesis Capital Advisors, LLC., for a special exception to alleviate a hardship per Adjustment Ordinance No. 1244 - Section 7, to accommodate the proposed construction of a single story garden office complex on Tract 1 B2, S. Huitt Survey, Abstract 705, located on the southeast corner of Midway Drive and International Drive. Director of Planning & Development Bo Bass stated that the adjustment ordinance was approved to provide an adjustment period and temporary deferment of the filing of land plans, plats, zoning district changes, etc., for all land areas where the current zoning is not in conformance with the 1997 Comprehensive Land Development Plan. He stated that staff recommends approval with a specific time frame and site plan being submitted. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 8:15 p.m. ITEM NO. 12 APPROVAL OF EXCEPTION TO ORDINANCE NO. 1244 Mayor Pro Tem Miller motioned to approve the special exception requested by Mr. Bruce French, representing Genesis Capital Advisors, LLC., to alleviate a hardship per �, Adjustment Ordinance No. 1244 Section 7, to accommodate the proposed construction of a single story garden office complex on Tract 1B2, S. Huitt Survey, Abstract 705, located on the southeast corner of Midway Drive and International Drive subject to the exception ending on April 13, 1998, and planned development plans being submitted to staff. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 13 PUBUC HEARING FOR ZONING CASE #97-40-ZC Mayor Saleh opened the public hearing at 8:21 p.m. regarding the request of Jana Porter for a zoning change from C-2 (Community Business District) and R-3 (Multi-Family Dwelling District 12 units/acre) into R-1 C (Single Family Custom Dwelling District) on Tract 2, 21.735 acres of land out of the George Linney Survey, Abstract 939; generally located 500 feet north of West Ash Lane and east of North Industrial Boulevard, from C-2 and R-3 to R-1C. Director of Planning & Development Bo Bass stated that Bob Eden Lake is on a portion of the property which is to be developed with large lots and homes from 3,500 square feet in the price range of $300,000 to $500,000. CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 6 There being no proponents or opponents, Mayor Saleh closed the public hearing at 8:23 p.m. ITEM NO. 14 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1292 Council Member Edwards motioned to approve the first and final reading of Ordinance No. 1292 for Zoning Case #97-40-ZC to R-1C (Single Family Custom Dwelling District). Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 15 PUBLIC HEARING FOR ZONING CASE #97-60-ZC - R-1 (SINGLE FAMILY DETACHED DWEWNG DISTRICT) Mayor Saleh opened the public hearing at 8:26 p.m. regarding the rezoning of a portion of ta. Tracts 1B2, 1B, Rogers Elijah Survey, Abstract 1299; Lots Al, A2, A3, Oakwood Terrace West, and Street Right-Of-Way, from C-2 to R-1 (Single Family Detached Dwelling District). Director of Planning & Development Bo Bass stated that staff recommends tabling the zoning case due to several written letters of protest having been received, the lot being impacted by heavy drainage, and the fact the property could be developed as single family or commercial. He stated that the larger tract has a 99-year ground lease on the property and cannot be sold with any zoning other than commercial. He stated that staffs original recommendation was R-1 and the Planning & Zoning Commission agreed. He stated that the Planning & Zoning Commission recommended removing Tract 1B, Rogers Elijah Survey, A-1299, from consideration. Mr. Carlisle Smith, owner of Tract 1B, Rogers Elijah Survey, stated that he understood his piece of property was removed from this request because it was included in the map by mistake. In response to a question, Mr. Bass stated that Tract 1B was included by mistake and asked that it be excluded from action, other than tabling. The Planning & Zoning Commission recommended excluding that tract. Mr. Barry Knight, 5400 Renaissance Tower, Dallas, representing property owners of Tract 1 B2, stated that the property has been zoned commercial for the last 30 years. He stated that the 99-year ground lease on this property makes the property useless for anything other than commercial. He submitted a petition stating that the neighboring owners want it to remain commercial. He noted that when the three lots facing Pipeline Road were CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 7 T44. platted as part of the single family subdivision in Oakwood Terrace West Addition, the initial plat showed those lots being commercial along with deed restrictions placed on those lots for commercial use. He requested that instead of tabling this request, that it be denied in order to retain the commercial zoning. Susan Hensen, 309 Sunset Drive, stated her opposition to having more residential which would impact Oakwood Terrace Elementary. Planning & Zoning Commissioner George Zahn, homeowner in this area, stated that the current C-2 zoning is more intense than what is wanted. He requested that the council consider approving the R-1. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 8:40 p.m. ITEM NO. 16 APPROVAL TO TABLE ORDINANCE NO. 1274 Council Member Baker motioned to deny Ordinance No. 1274. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Council Members Hogg and Baker Nays: Mayor Pro Tem Miller and Council Members Tyson and Edwards Mayor Saleh declared the motion failed. Mayor Pro Tern Miller motioned to table Ordinance 1274 for Zoning Case#97-60-ZC to R-1 (Single Family Detached Dwelling District) with the stipulation that notification and publication be repeated when it is proposed for future consideration. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, and Edwards Nays: Council Member Baker Mayor Saleh declared the motion carried. City Attorney Bob McFarland noted that renotification and publication will be done on all items tabled throughout this rezoning project. ITEM NO. 17 PUBLIC HEARING FOR ZONING CASE #97-61-ZC - R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Mayor Saleh opened the public hearing at 8:59 p.m. on the rezoning of Block 10, Lots wpt- A, ept-A, Oakwood Terrace, from C-2 to R-1 (Single Family Detached Dwelling District). CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 8 Director of Planning & Development Bo Bass stated that the property is located at the northeast quadrant of Simmons Drive and S. Pipeline Road. Mr. Al Babar, 1005 Simmons Drive, spoke in favor of the proposed R-1. He presented a petition and stated that he did not like having the tour bus company currently located on the corner. Mr. Larry Hastings, 1006 Oakwood Drive, pointed out that homes are being built down S. Pipeline Road and he did not want to see a gas station there in the future. Mr. Bill Wade, owner of the subject property and the tour bus company, spoke in opposition of the proposed zoning change stating his concern, and requested that if the property is rezoned, he be allowed to continue his business as long as it is located on the subject property. City Attorney Bob McFarland noted that the rezoning would not terminate Mr. Wade's entitled use of the property. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 9:09 p.m. ITEM NO. 18 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1275 Council Member Edwards motioned to approve the first and final reading of Ordinance No. 1275 for Zoning Case #97-61-ZC to R-1 (Single Family Detached Dwelling District). Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 19 PUBLIC HEARING FOR ZONING CASE #97-62-ZC - R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Mayor Saleh opened the public hearing at 9:11 p.m. on the rezoning of Tracts 4, 4L1A, 4L, Andrew Huitt Survey, Abstract 684, from R-5 and C-2 to R-1 (Single Family Detached Dwelling District). Director of Planning & Development Bo Bass stated that the Planning and Zoning Commission recommended rezoning Tracts 4 and 4L1A to R-1 and rezoning Tract 4L to TX-10 on the northern area and R-1 on the southern portion with the FEMA 100-year flood plain being the dividing line. CITY COUNCIL MINUTES NOVEMBER 25, 1997 PAGE 9 Mr. Bill Barrow, Round Rock, Texas, owner of Tract 4L, stated that in addition to the subject property, he also owns four lots fronting on SH 10. He noted that a large part of his tract is in the flood plain, which is not conducive to single family. Also, access to the area would be limited. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 9:18 p.m. ITEM NO. 20 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1276 Council Member Baker motioned to approve the first and final reading of Ordinance No. 1276 to rezone Tracts 4 and 4L1A, A. Huitt Survey, A-684 to R-1 (Single Family Dwelling District) and Tract 4L, A. Huitt Survey, A-684 to TX-10 (Texas Ten District). Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Hogg, Baker, and Edwards Nays: Council Member Tyson Mayor Saleh declared the motion carried. ITEM NO. 21 PUBLIC HEARING FOR ZONING CASE #97-63-ZC - R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Mayor Saleh opened the public hearing at 9:45 p.m. on the rezoning of Lots A, D1A, D1, B3, B2, B1, D1B, C, Arnett Addition; Block 1, Lot A1R, and Lots B5, B1A, Oakwood Terrace Addition, from R-5 and C-2 to R-1. Director of Planning & Development Bo Bass stated that there are apartments currently on the subject properties. Mr. John Stewart spoke on behalf of Mr. Jamie Trinkle, owner of Oakwood Crest Apartments, located on Lots A, B1, B2, and C, Arnett Subdivision. He stated that Mr. Trinkle lives across the street on Lot D1B, Arnett Subdivision, which is also a part of the rezoning request, and takes very good care of the apartments. He believed that changing the zoning from R-5 to R-1 was reverse discrimination. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 9:49 p.m. ITEM NO. 22 APPROVAL OF FIRST READING OF ORDINANCE NO. 1277 Mayor Pro Tern Miller motioned to approve the first reading of Ordinance No. 1277 for Zoning Case #97-63-ZC to R-1 (Single Family Detached Dwelling District). ITEM NO. 23 PUBLIC HEARING FOR ZONING CASE #97-65-ZC - R-1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) Mayor Saleh opened the public hearing at 9:56 p.m. on the rezoning of Block 8, Lots 14, 15, 16, 17, 18, 19, 20, 21, 22, and Block 9, Lots 7, 19, 20, 21, Cedar Hill Estates; Block 1, Lot 1, Southland; Tracts 2B3, 2B4, 2B, 2C2, William G. Matthews Survey, Abstract 1052; Block 1, Lot A, Spring Valley Apartments; and Block 1, Lots 1B, 1A1, 1A1A, C, J.E. Whitener Estates, from R-5, C-1, C-2, and PD to R-1(Single Family Detached Dwelling District). Director of Planning & Development Bo Bass stated that a written letter of protest was received on Lot C, Block 1, J. E. Whitener Estates, from Mr. Joe Nazzaro. Mr. Joe Nazzaro, 1001 S. Main, owns Lot C as well as the lot south and directly on the corner of S. Main Street and S. Pipeline Rd. He stated that he has a skating supply company on Lot C. He noted that his property is adjacent on the north to an existing apartment complex and he owns the property to the south that is proposed to remain C-2. He did not believe that the R-1 was feasible zoning. ITEM NO. 25 PUBUC HEARING FOR ZONING CASE #97-66-ZC - R-1 (SINGLE FAMILY DETACHED DWEWNG DISTRICT) Mayor Saleh opened the public hearing at 10:23 p.m. on the rezoning of Lot 30B, Alexander & Cullum Subdivision, from C-1 to R-1 (Single Family Detached Dwelling District). Director of Planning & Development Bo Bass stated that there is a day care on the property. He noted that the properties surrounding the subject lot are zoned R-1. Ms. Cindy Laster, 805 Forest Crossing, Hurst, stated that she has owned the day care for 10 years and it has been in business for 25 years at the current location. She stated that she has invested $225,000 into the business and it was intended for an investment for retirement. She stated that if the property was rezoned for residential that she would incur a loss when trying to sell the property. ITEM NO. 27 PUBUC HEARING FOR ZONING CASE #97-67-ZC - R-1 (SINGLE FAMILY DETACHED DWEWNG DISTRICT) Mayor Saleh opened the public hearing at 10:30 p.m. on the rezoning of Block 1, Lot 1, Huie Addition; Tract 2, A.J. Huitt Survey, Abstract 709; and Block 6, Lots 4, 5, Huntington Place, from C-2 and CUD to R-1 (Single Family Dwelling District). Director of Planning & Development Bo Bass stated that the subject property is located east of Huntington Drive over to the eastern city limits line. Huitt Survey, Abstract 709, from CUD to R-1 (Single Family Detached Dwelling District).
