JANUARY 27, 1998
CALL TO ORDER
A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh
at 4:15 p.m. on Tuesday, January 27, 1998, in the downstairs Administration Building
Conference Room. Those present included Mayor Mary Lib Saleh, Mayor Pro Tem Charlie
Miller and Council Members Bobby Baker, Carl Tyson, Katie Edwards, Leon Hogg, and
Glenn Walker. Closed session was held for deliberation of real property action as
authorized by Section 551.072 and personnel matters as authorized by Section 551.074
of the Texas Government Code. Precouncil discussion was held on agenda items and
other scheduled items.

Director of Administration Tom Cox introduced Anniece McKanna, Personnel Technician,
and her family. Mayor Saleh presented Ms. McKanna with a plaque and certificate for
being the Employee of the Year for 1997.

REGULAR AGENDA
ITEM NO. 8 PUBLIC HEARING OF ZONING CASE NO. 98-01-ZC - C-2 - COMMUNITY
BUSINESS DISTRICT
Mayor Saleh opened the public hearing at 7:15 p.m. for the rezoning of Lot 4R2, Block 1,
Harwood Plaza Addition, from PD to C-2.
Director of Planning & Development Bo Bass stated the property was located at the
southeast corner of Harwood Road and N. Industrial Blvd. Mr. Bass stated that legal
notification of this public hearing was published in the Fort Worth Star Telegram not less
than 15 days prior to this hearing. He also noted that a written protest had been received.
There being no proponents, Mayor Saleh asked if there were any opponents.
Mr. Art Anderson, attorney with Winstead, Sechrest & Minick, 5400 Renaissance Tower,
Dallas, representing the owner Chris Sutherland, stated that Mr. Sutherland was unaware
that it was his property being rezoned until the day before since he had not initiated any
zoning change. Therefore, he was not at the Planning & Zoning Meeting. He noted that
Sutherland Lumber was temporarily closed soon after notice that FM 157 would be
widened. He did not think there was a problem in working out a resolution to the screening
of the materials stored outside. The concern is that they have not had time to evaluate the
impact of the rezoning to C-2. He stated that if the screening was the concern, he was
requesting a two week delay in order to work out the problem, preferably keeping the
current PD zoning.
Mr. Bass stated that going from PD to C-2 does not change the uses allowed. The only
difference is that the PD did not require screening for the outdoor storage. He noted that
C-2 zoning does allow outdoor storage, but requires a six foot screening fence on all sides
that do not face a public street and an eight foot tall masonry wall with texture on all sides
that face a public street. He further stated that staff would not have the tool to control the
outdoor storage if the PD zoning remained.
There being no additional opponents, Mayor Saleh closed the public hearing at 7:23 p.m.
ITEM NO. 9 TABLED FIRST AND FINAL READING OF ORDINANCE NO. 1293
Council Member Baker asked Mr. Bass what could be done tonight besides placing on a
future agenda.
Mr. Bass stated the owner could be instructed to request a modification to the PD; the
Council could rezone the property to C-2 and provide a grace period, allowing him to work
with Mr. Sutherland; or the Council could table the request allowing the owner to study the
issue.

°... City Attorney McFarland suggested the development plan could be modified with this
zoning request since it would be a more restrictive use, eliminating the need for
renotification or another hearing.
After discussion regarding the site plan which is required as a part of the PD, City Attorney
McFarland further suggested if the Council desired to postpone, he would work with staff
and the property owner to determine what form would be best to bring it back before the
Council.
City Manager Hart stated that he met with Chris Sutherland earlier today and that Mr.
Sutherland was of the understanding that he would be losing the outdoor storage altogether
with the proposed C-2 zoning. After learning that was not the case, the only question Mr.
Sutherland had was the fencing. Mr. Sutherland then asked to be allowed a couple of
weeks to walk the site and see what was entailed.
Mr. Chris Sutherland stated he was concerned that he may have trouble meeting the C-2
fencing requirements, since the site is already developed. With a PD, the Council could
approve something slightly modified if need be. In response to a question, he stated that
he is considering reopening Sutherland Lumber once the road improvements are completed
along FM 157.
Mr. Bass stated staff is willing to work with the owner if the fencing needs modifications.

Council Member Baker motioned to table the first and final reading of Ordinance No. 1293
for Zoning Case No. 98-01-ZC to C-2 (Community Business District) until the City Council
Meeting on February 10.

ITEM NO. 10 PUBLIC HEARING OF ZONING CASE NO. 98-02-ZC - C-2 -
COMMUNITY BUSINESS DISTRICT
Mayor Saleh opened the public hearing at 7:35 p.m. for the rezoning of Lots 1-9, Block 18,
Midway Park Addition, from R-1 to C-2.
Director of Planning & Development Bo Bass stated the property was located at the
southwest corner of Harwood Road and N. Main Street involving nine residential lots that
back up to a commercial strip center. He noted that the Comprehensive Land Plan shows
the subject property to be C-2. The Planning & Zoning Commission recommended denial
'" of the zoning change and staff will support that decision. Mr. Bass also stated that legal
notification of this public hearing was published in the Fort Worth Star Telegram not less
than 15 days prior to this hearing.

Mr. Al Morse, 104 Falls Drive; Mr. Rick DeChiara, 1011 Collins Drive; Ms. Barbara Lucas,
1015 Collins Drive; Ms. Kathy Anderson,608 Aransas Drive; Ms. Cheryl Armon, 710 Collins
Drive; Tom Grezeszak, 1014 Collins Drive; Raul Martinez, 811 Denton Drive; Ms. Ima Ruth
Jacoby, 1009 Collins Drive; and Mr. Alexander Blackshear, 200 W. Bear Creek #245, all
spoke in opposition to the rezoning request. The opponents noted that there would be
increased crime, property owners would not be able to sell their homes, property values
would decrease; the subject property would be too small for anything but a small strip
center; there would be no benefit to the people in the area; and the homeowners are
working to improve the appearances of the homes in the neighborhood. Concerns were
also expressed that eminent domain would occur and that this type request would not have
been suggested in an area such as Trailwood or Morrisdale.
A petition of signed protests against rezoning the property to C-2 was submitted to the City
Council.
After all opponents had spoken, Mayor Saleh closed the public hearing at 8:15 p.m.
ITEM NO. 11 DENIAL OF ORDINANCE NO. 1294
Council Member Edwards motioned to deny Ordinance No. 1294 for Zoning Case No. 98-
,,,,,, 02-ZC to C-2 (Community Business District).
Council Member Walker seconded the motion.

ITEM NO. 12 PUBLIC HEARING OF ZONING CASE NO. 98-03-ZC - C-1 -
NEIGHBORHOOD BUSINESS DISTRICT
Mayor Saleh opened the public hearing at 8:30 p.m. for the rezoning of Tracts 6C1 and
6C2, Solomon Huitt Survey, Abstract 705, from PD to C-1.
Director of Planning & Development Bo Bass stated the property was located east of N.
Main Street south of Harwood Crossing Shopping Center. He noted that the current PD
zoning is for mini-warehouses,which is inconsistent with the surrounding single-family and
commercial zoning. Mr. Bass also stated that legal notification of this public hearing was
published in the Fort Worth Star Telegram not less than 15 days prior to this hearing. He
noted that a written protest had been received regarding this request.

Mr. Bill Rose, Rose Investments, 2902 Carlisle, Suite 100, Dallas, stated he owns the
subject property and did not receive notice of the proposed rezoning change. He stated
he found out about it by happenstance today and would like time to study the situation.
Mayor Saleh asked him if two weeks would be enough time.
Mr. Rose stated that it would.
Mayor Saleh closed the public hearing at 8:35 p.m.
ITEM NO. 13 TABLED FIRST AND FINAL READING OF ORDINANCE NO. 1295
In response to a question, Mr. Rose stated that he had bought the property from a church
with 30,000 sq. ft. on the northwest quadrant zoned commercial with PD for mini-
warehouses on the remainder. He stated that the rezoning was a total surprise to him and
he had not had a chance to talk to staff.
Council Member Miller asked Mr. Bass what the reason was for the mix-up with the
notification.
Director of Planning & Development Bo Bass stated that he did not believe there was a
mix-up. He stated that the notifications are made from the Tarrant County tax rolls and it
is not uncommon for people to suggest that they were not notified. Notifications are not
made by certified mail because of the enormous cost and, therefore, he cannot verify
whether they were received. However, a list and labels are made up directly from the
database from Tarrant County Tax records and they have not made a mistake yet.
In response to a question regarding the correctness of his address, Mr. Rose stated that
he does receive his tax statements.
City Manager Hart stated that the Development staff has done a good job, but occasionally
mistakes have been made. He stated that he has been dealing with this company and
Marshall Van Dyke on another piece of property and that they take good care of their
business.
Mr. Marshall Van Dyke stated that he did receive a notice for the zoning request on the
Sutherland property and did not question it because Mr. Rose owns property near N.
Industrial Blvd., although not within 200 feet.
Council Member Baker stated that it is in the city's best interest to send the notices to the
owners of the property to be rezoned by registered mail.
Council Member Baker motioned to table the first and final reading of Ordinance No. 1295
for Zoning Case No. 98-03-ZC to C-1 (Neighborhood Business District) until the City
Council Meeting on February 10.

FAMILY DWELLING DISTRICT
Mayor Saleh opened the public hearing at 8:45 p.m. for the rezoning of Lot 1R, Block 3,
Oak Forest Addition, from C-1 to R-1.
Director of Planning & Development Bo Bass stated the property was located at the
northwest quadrant of Fair Oaks Blvd. and North Main Street. He stated that there is
currently a church located on the property and that the proposed R-1 is protective zoning.
Mr. Bass also stated that legal notification of this public hearing was published in the Fort
Worth Star Telegram not less than 15 days prior to this hearing.
There being no proponents or opponents, Mayor Saleh closed the public hearing at 8:48
p.m.
ITEM NO. 15 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1296
Council Member Walker motioned to approve the first and final reading of Ordinance No.
1296 for Zoning Case No. 98-04-ZC to R-1 (Single Family Dwelling District).

FAMILY DWELLING DISTRICT
Mayor Saleh opened the public hearing 8:50 p.m. for the rezoning of Lot 1, Block 1,
Harwood Park Townhome Addition, from PD to R-1.
Director of Planning & Development Bo Bass stated the property was located north of E.
�` Harwood Road and east of N. Main Street and developed with Harwood Park Townhomes.
Mr. Bass also stated that legal notification of this public hearing was published in the Fort
Worth Star Telegram not less than 15 days prior to this hearing.

ITEM NO. 17 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1298
Council Member Baker motioned to approve the first and final reading of Ordinance No.
1298 for Zoning Case No. 98-06-ZC to R-1 (Single Family Dwelling District).

ITEM NO. 18 PUBLIC HEARING OF ZONING CASE NO. 98-07-ZC - R-1 - SINGLE
FAMILY DWELLING DISTRICT
Mayor Saleh opened the public hearing at 8:55 p.m. for the rezoning of Lots 6, 6A, 6A1,
and 6B, Ray Shelton Subdivision, from R-3 to R-1.
Director of Planning & Development Bo Bass stated the property, which currently is
developed with low density apartments, is located just west of the Meadowview Addition
on the north side of East Harwood Road. He stated that since the time the Planning &
Zoning Commission met and recommended rezoning to R-1, the owner has talked to him
about Townhome zoning and the Planning & Zoning Commission is not aware of this
request. He further stated that Townhome zoning accomplishes the owner's needs and
also reduces the amount of apartment zoning the city is seeking to do. Mr. Bass also
stated that legal notification of this public hearing was published in the Fort Worth Star
Telegram not less than 15 days prior to this hearing.
There being no proponents for the proposed R-1, Mayor Saleh asked for any opponents.
Mr. Jerry Banks, 6336 Pershing Drive, Omaha, Nebraska, stated he owned the property.
He distributed photographs of the property, noting that the units were hooked up to
individual meters for utilities with individual backyards and carports. Mr. Banks stated that
if the property is rezoned to a non-conforming use, it markedly reduces the value of the
property. He noted that the units are in compliance with all the requirements of Townhome
zoning except for the number of units allowed per building. He requested that the Council
rezone the property to Townhome instead of R-1.

In response to a question about rezoning to Townhome when property owners were notified
of R-1, City Attorney McFarland agreed that renotification was not necessary because TH
falls between the current R-3 zoning and the proposed R-1. He also noted that Mr. Banks
could not get financing to convert to townhomes or to renovate if the property were rezoned
to R-1.
Council Member Walker motioned to approve the first and final reading of Ordinance No.
1299 for Zoning Case No. 98-07-ZC to TH (Townhome Dwelling District) instead of
proposed R-1 (Single Family Dwelling District).
Council Member Walker seconded the motion.

ITEM NO. 20 PUBLIC HEARING OF ZONING CASE NO. 98-08-ZC - R-1 - SINGLE
Nur FAMILY DWELLING DISTRICT
Mayor Saleh opened the public hearing at 9:08 p.m. for the rezoning of Lot 1, Block D,
Midway Square Addition, from C-1 to R-1.
Director of Planning & Development Bo Bass stated the property was located at the
northwest corner of East Harwood Road and Fuller-Wiser Road. Mr. Bass also stated that
legal notification of this public hearing was published in the Fort Worth Star Telegram not
less than 15 days prior to this hearing.
Mayor Saleh asked for any proponents.
Mr. Patrick O'Dea, 510 Arbor Creek Drive, stated he was very much in favor of the
proposed R-1 zoning.
There being no opponents, Mayor Saleh closed the public hearing at 9:10 p.m.
ITEM NO. 21 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1300
Council Member Baker stated he thought the best use of the property was the current C-1
zoning.
Now. After additional discussion, Council Member Tyson stated that if it was rezoned to R-1 and
someone came in with a plan for C-1 in the future, the Council could consider rezoning to
commercial providing for protection for the Arbor Glen residents.

1300 for Zoning Case No. 98-08-ZC to R-1 (Single Family Dwelling District).

ITEM NO. 22 PUBLIC HEARING OF ZONING CASE NO. 98-09-ZC - R-1 - SINGLE
FAMILY DWELLING DISTRICT
Mayor Saleh opened the public hearing 9:15 p.m. for the rezoning of Lot 1, Block A, Bear
Creek Villas I Addition and Lot 1, Block G, Woodcreek Addition, from R-4 and CUD to R-1.
Director of Planning & Development Bo Bass stated the property was located north of East
Denton Drive and west of Fuller-Wiser Road. He noted that there were written protests
received regarding this request. Mr. Bass also stated that legal notification of this public
hearing was published in the Fort Worth Star Telegram not less than 15 days prior to this
hearing.
There being no proponents, Mayor Saleh asked for any opponents.
Mr. Art Anderson, attorney with Winstead, Sechrest & Minick, 5400 Renaissance Tower,
Dallas, representing the owner on Lot 1, Block G, Woodcreek Addition, stated that the
properties surrounding the subject tracts are multi-family and rental properties. He stated
the subject property is not suitable for single-family homes. He noted that the property is
currently zoned CUD for R-5 multi-family and single family attached and his client is asking
for R-4 zoning. Mr. Anderson further stated that they would withdraw their protests if the
council approved R-4.
Mr. Printice L. Gary, 16304 Ranchita Drive, Dallas, stated he is developer for the owners
of both tracts. Having been a former developer for Trammell Crow Residential
Development, he stated that he would not develop this property as single family if he were
a home developer today. He stated the site reads as a multi-family site for development.
Mr. Mark Humphreys, 5350 Alpha, Dallas, architect for the subject properties, stated that
he designed The Mansions that recently opened in Euless, which has been highly
successful. He stated that a similar type product is being designed for the subject
properties, giving the design a single family look.
Mr. Mark Alfieri, 9400 N. Central Expressway, Suite 200, Dallas, stated he owned Lot 1,
Block A, Bear Creek Villas I Addition, and also developed Harwood Courts. His property
is north of Lot 1, Block G, Woodcreek Addition and is currently zoned R-4. The subject
property was inherited with the property he developed with condos in Harwood Court. He
noted that D. R. Horton has expressed interest in his site and was of the understanding

`�- that single family could be developed in R-4 zoning. He preferred keeping the R-4 zoning
and stated he intends to sell the land. He further stated that he has discussed with other
developers who agree that single family would not be good along E. Denton Drive.
After discussion, it was noted that single family would be allowed in R-4 with a specific use
permit.
There being no additional opponents, Mayor Saleh closed the public hearing at 9:38 p.m.
ITEM NO. 23 APPROVAL OF FIRST READING OF ORDINANCE NO. 1301
Council Member Edwards stated that she lived at the Hunt Club Apartments for four years
and concurred that the area is not a single family area.
Mayor Pro Tem Miller stated that building concepts have radically changed in recent years
as indicated in North Dallas where high value homes are next to very old apartments. He
noted that homes have developed behind Kroger and that residential would be better for
the property being considered.
Council Member Edwards motioned to approve the first reading of Ordinance No. 1301
regarding Zoning Case No. 98-09-ZC on Lot 1, Block G, Woodcreek to R-4 (Multi-Family
Dwelling 16 units/acre), and excluding Lot 1, Block A, Bear Creek Villas I Addition, leaving
.. it zoned R-4.
Council Member Baker seconded the motion.

Mayor Saleh declared the motion carried.
City Attorney McFarland noted that 3/4 vote was not required to approve the ordinance
because Mr. Anderson had withdrawn his protest. He noted, however, that a second
reading was required due to not receiving five affirmative votes.
ITEM NO. 24 PUBLIC HEARING OF ZONING CASE NO. 98-05-ZC - R-5 - MULTI-
FAMILY DWELLING DISTRICT 24 UNITS/ACRE
Mayor Saleh opened the public hearing at 9:55 p.m. for the rezoning of Lot 9A, Ray
Shelton Subdivision, from R-1 to R-5.
Director of Planning& Development Bo Bass stated the property was located at 304 E. Ash
Lane. He noted that there is a home on the site. He stated that the Planning & Zoning

had been received. Mr. Bass also stated that legal notification of this public hearing was
published in the Fort Worth Star Telegram not less than 15 days prior to this hearing.

Ms. Nancy Elliott, 304 E. Ash Lane stated that she and her husband, Steve, have
submitted a written letter of protest. She stated that they have lived there 18 years and
were surrounded by raw land at the time. She noted that they have not had one inquiry
in 18 years to buy the property and developed as multi-family. They are wanting to add
on to their home; however, if the property is rezoned to R-5 multi-family, they could not get
building permits or loans on the property.
There being no additional opponents, Mayor Saleh closed the public hearing at 9:59 p.m.
ITEM NO. 25 DENIAL OF ORDINANCE NO. 1297
Council Member Baker motioned to deny Ordinance No. 1297 for Zoning Case 98-05-ZC
to R-5 (Multi-Family Dwelling 24 Units/Acre).
Council Member Walker seconded the motion.
Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, Walker
and Edwards
Nays: None
Mayor Saleh declared the motion carried.
ITEM NO. 26 REPORTS
City Manager
Deputy City Manager Joe Hennig mentioned that actor Harrison Ford had lunch at Texas
Star today. He also mentioned that the Council and staff were not able to discuss the SH
121 development at precouncil; however, it would be going before the Planning & Zoning
Commission on February 3rd. He noted that the Council will have another opportunity to
discuss the issue on February 10 before consideration later in February.
City Attorney
City Attorney Bob McFarland had nothing to report.
City Council
The Council as a whole congratulated Ms. Anniece McKanna for being nominated as
Employee of the Year for 1997.
