HomeMy WebLinkAbout1999-01-26 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL JANUARY 26, 1999 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Pro Tern Charlie Miller at 4:15 p.m. on Tuesday, January 26, 1999, in the Administration Building Downstairs Conference Room. Those present included: Mayor Pro Tern Charlie Miller and Council Members Carl Tyson, Leon Hogg, Bobby Baker, Glenn Walker, and Katie Edwards. Mayor Mary Lib Saleh was attending the U. S. Conference of Mayors in Washington, D.C. Closed session was held to discuss real property and hold a conference with employees as authorized by Sections 551.072 and 551.075 of the Texas Government Code. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:09 p.m. for the consideration of scheduled items. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR JANUARY Director of Planning & Development Bo Bass introduced Development Secretary Dolores Tijerina. Mayor Pro Tem Miller presented her with a plaque for employee of the month for January. ITEM NO. 2 PRESENTATION OF EMPLOYEE SERVICE PINS FOR JANUARY Police Chief Gary McKamie introduced Police Corporal Richard Wong, receiving a 5-year service pin. Mayor Pro Tem Miller presented the pin to Officer Wong and noted that Police Corporal Kurt Davis, Police Corporal Don Meredith, Police Corporal Joe Portman, and Firefighter II/Paramedic Chanc Bennett were not able to attend the meeting to receive their service pins. Consent Agenda Consent Agenda Items 3 through 6, 8 and 9 were approved as follows: N` ITEM NO. 3 ACKNOWLEDGE RECEIPT OF ANNUAL INVESTMENT REPORT FOR FY98 Acknowledged receipt of City Annual Investment Report for FY98. ITEM NO. 4 ACKNOWLEDGE RECEIPT OF FY '97 - '98 ANNUAL AUDIT Acknowledged receipt of the Comprehensive Annual Financial Report (CAFR). ITEM NO. 5 APPROVAL OF BID NO. 97-55 Approval to renew Bid No. 97-55 for asphalt repairs for one year with Abcon Paving, Inc, at $1.76/sq. ft. ITEM NO. 6 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1348 Approval of first and final reading of Ordinance No. 1348 amending Chapter 30, "Fees", Section 30-33, "Water and Sewer Fees and Impact Fees" of the Euless Code of Ordinances. ITEM NO. 8 APPROVAL OF PROFESSIONAL SERVICES CONTRACT Approval of professional services contract with Shimek, Jacobs, and Finklea, L.L.P., in the amount of $26,000.00 for a water and sewer impact fee study. ITEM NO. 9 APPROVAL OF MINUTES Approval of the minutes of a Special Called City Council Meeting of January 9, 1999, and the Regular City Council Meeting of January 12, 1999. Council Member Walker motioned to approve Consent Agenda Items 3 through 6, 8 and 9. Council Member Edwards seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Walker, and Edwards Nays: None Mayor Pro Tern Miller declared the motion carried. Regular Agenda ITEM NO. 7 TABLED FIRST AND FINAL READING OF ORDINANCE NO. 1349 Council Member Walker motioned to table first and final reading of Ordinance No. 1349 to the February 23 council meeting, vacating and abandoning a portion of a 15-foot drainage and utility easement located in Lot 23-R, Block C of the Chelsea Park Estates Addition. Council Member Edwards seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Walker, and Edwards Nays: None Mayor Pro Tern Miller declared the motion carried. ITEM NO. 10 TABLED RFP NO. 99-P-02 Council Member Tyson motioned to table RFP No. 99-P-02 to the February 9 council meeting, for the purchase or lease of a network color copier. ITEM NO. 11 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1350 TU Electric District Manager Bob Burns explained that there are three new electric service rates being provided that are completely voluntary, which allow shifting peak load use to other times for some customers such as schools. Council Member Baker motioned to approve the first and final reading of Ordinance No. 1350 approving three voluntary "Time Of Use" rate schedule options for TU Electric customers. Council Member Walker seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Walker, and Edwards Nays: None Mayor Pro Tern Miller declared the motion carried. ITEM NO. 12 PUBLIC HEARING FOR SPECIFIC USE PERMIT - NO. 98-32- SUP - 801 W. MIDWAY DRIVE Mayor Pro Tem Miller opened the public hearing at 7:33 p.m. regarding Specific Use Permit No. 98-32-SUP for the request of Gary W. Scarlett, pastor of First Church of the Nazarene, 801 West Midway Drive, for an addition to an existing building to be used for classrooms, kitchen, restrooms, and fellowship/activity area in the R-1 (Single Family Detached Dwelling) Zoning District in the Midway Park Addition, Block 45, Lot 1. Director of Planning & Development gave a brief description of the request. Mayor Pro Tem Miller asked for any proponents. Rev. Gary Scarlett, pastor of First Church of the Nazarene, stated the request is being made because of the need for additional space. City Council Minutes Page 5 of 7 January 26, 1999 There being no additional proponents or opponents, Mayor Pro Tern Miller closed the public hearing at 7:37 p.m. ITEM NO. 13 APPROVAL OF SPECIFIC USE PERMIT - NO. 98-32-SUP - 801 W. MIDWAY DRIVE Council Member Hogg motioned to approve Specific Use Permit No. 98-32-SUP for the request of Gary W. Scarlett, pastor of First Church of the Nazarene, 801 West Midway Drive, for an addition to an existing building which will be used for classrooms, kitchen, restrooms, and fellowship/activity area in the R-1 (Single Family Detached Dwelling) Zoning District in the Midway Park Addition, Block 45, Lot 1, with the following conditions: (1) The fire lane in the back parking lot shown as 20' will be increased to 24'; (2) The sidewalk will be installed from east to west boundary of the property as shown on the exhibit.; and (3) Fire lane paving must be brought up to Unified Development Code standards with any future expansion of the church. Council Member Baker seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Walker, and Edwards Nays: None Mayor Pro Tem Miller declared the motion carried. ITEM NO. 14 PUBLIC HEARING FOR PLANNED DEVELOPMENT - NO. 98- 05-PD - HARWOOD COURTS PHASE II Mayor Pro Tem Miller opened the public hearing at 7:40 p.m. regarding Planned Development No. 98-05-PD for the request of Monarch Development to consider a change of zoning from R-1 (Single Family Detached Dwelling District) to Planned Development for Single Family Residential Dwellings with private gated streets. The property is located within Bear Creek Villas, Block A, Lot 1; south of Harwood Road, west of Fuller-Wiser Road, and east of the Harwood Courts Subdivision. Director of Planning & Development Bo Bass gave a description of the request noting that the development will be an extension of Harwood Court Phase I to the west. Access to Harwood Road will be provided through Harwood Court Phase I. Mayor Pro Tern Miller asked for any proponents. Mr. Henry Rahmani, 1502 Alberi Drive, Euless, stated the project will be similar to his development in Forest Pointe. City Council Minutes Page 6 of 7 January 26, 1999 There being no additional proponents or opponents, Mayor Pro Tern Miller closed the public hearing at 7:45 p.m. ITEM NO. 15 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1351 Council Member Walker motioned to approve the first and final reading of Ordinance No. 1351 for Planned Development No. 98-05-PD for the request of Monarch Development to change zoning from R-1 (Single Family Detached Dwelling District) to Planned Development for Single Family Residential Dwellings with private gated streets. The property is located within Bear Creek Villas, Block A, Lot 1; south of Harwood Road, west of Fuller-Wiser Road, and east of the Harwood Courts Subdivision. Council Member Edwards seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Walker, and Edwards Nays: None Mayor Pro Tem Miller declared the motion carried. ITEM NO. 16 REPORTS CITY MANAGER REPORT In response to Council Member Edwards announcement that City Manager Tom Hart received the Annual Community Leadership Award today from the Northeast Leadership Forum, Mr. Hart stated that he was quite surprised but honored. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. STAFF REPORT Director of Administration Tom Cox demonstrated the new audio/visual equipment that has been installed in the Council Chambers. CITY COUNCIL Council Member Tyson congratulated employee of the month Dolores Tijerina and Police Corporal Richard Wong on receiving his 5-year pin. He stated that he attended the dedication of the sculpture at the library and that it was well attended. City Council Minutes Page 7 of 7 January 26, 1999 Council Member Hogg noted that he attended the library statue dedication and ..,,s, also the Northeast Leadership Forum Annual Award Luncheon to see City Manager Tom Hart receive his award. Council Member Baker congratulated City Manager Tom Hart. Council Member Edwards stated she also attended the library dedication of the sculpture. She stated it was a wonderful statue and noted how the children sat on the bench and interacted with the statue. Council Member Walker also congratulated City Manager Tom Hart on the award he received. Mayor Pro Tem Miller also extended congratulations to City Manager Tom Hart. RECONVENE INTO CLOSED SESSION The meeting reconvened into closed session at 8:20 p.m. to continue the discussion of personnel matters and to hold a conference with employees, as authorized by Sections 551.074 and 551.075, of the Texas Government Code.
