HomeMy WebLinkAbout1999-10-12 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL OCTOBER 12, 1999 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:15 p.m. on Tuesday, October 12, 1999, in the Administration Building Downstairs Conference Room. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Charlie Miller and Council Members Carl Tyson, Leon Hogg, Bobby Baker, Glenn Porterfield and Katie Edwards. Closed session was held to discuss personnel matters as authorized by Section 551.074 and economic development as authorized by Section 551.086 of the Texas Government Code. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:07 p.m. for the consideration of scheduled items. INVOCATION Father Jim Hart, St. Michael Catholic Church, gave the invocation. PLEDGE OF ALLEGIANCE Girl Scout Troop#1471 led the Pledge of Allegiance. City Council Minutes Page 2 of 8 October 12, 1999 ITEM NO. 1 PRESENTATION OF EMPLOYEE FOR THE MONTH OF OCTOBER Director of Administration Tom Cox introduced Facility Maintenance Department employee, Brian McGarry, as employee of the month for October, and Mayor Saleh presented him with a plaque. ITEM NO. 2 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to a group of teenagers from Trinity High School proclaiming October 16-23, 1999, as Teen Read Week. Consent Agenda Consent agenda Items No. 3 through 6 were approved as follows: ITEM NO. 3 RENEWAL OF CONTRACT FOR BID NO. 98-22 Renewal of annual contract for Bid No. 98-22 for portable toilet rental and services to BFI Services Group, 2617 Willow Brook Rd., Dallas, Texas, 75220, for the 1999/2000 annual contract in the amount of$22,080. ITEM NO. 4 APPROVAL OF RESOLUTION NO. 99-1038 Approval of Resolution No. 99-1038 supporting the development of a Comprehensive Transportation Funding Solution for the State of Texas. ITEM NO. 5 APPROVAL OF RESOLUTION NO. 99-1039 Approval of Resolution No. 99-1039 supporting legislation regarding downstream discharge of surface water runoff. ITEM NO. 6 APPROVAL OF MINUTES Approval of the City Council minutes of the regular meeting of September 28, 1999. Council Member Edwards motioned to approve Consent Agenda Item Nos. 3 — 6. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 3 of 8 October 12, 1999 Regular Agenda ITEM NO. 7 APPROVAL OF WATER MAIN EASEMENT Council Member Baker motioned to authorize the Mayor to execute a water main easement to the Trinity River Authority for a water pipeline south of the proposed Trinity Blvd. Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 TABLED ORDINANCE NO. 1371 Council Member Edwards motioned to table to the November 9th meeting Ordinance No. 1371 amending Chapter 84 "Unified Development Code," Article X "Urban Design Principles and Improvement Standards," by adding Section 84- 447 "Right of Way and Easement Usage Requirements". Council Member Baker seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO 1381 Council Member Hogg motioned to approve the first and final reading of Ordinance No. 1381 annexing a tract of land known as Lot 1, Block 1, Flight Instrument Addition and a portion of South Pipeline Road, containing approximately 21.3 acres of land. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 4 of 8 October 12,1999 ITEM NO. 10 SETTING DATE TO HOLD PUBLIC HEARING FOR RECOVERY OF DEMOLITION COSTS AT 1302 WOODRIDGE CIRCLE Council Member Hogg motioned to set the date for November 9th to hold a public hearing for recovery of demolition costs at 1302 Woodridge Circle. Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 APPROVAL OF TEMPORARY USE PERMIT NO. 99-07-CC Mayor Pro Tern Miller motioned to approve Temporary Use Permit No. 99-07-CC for the request of Cornerstone Family Church for a Safe Halloween Alternative Outdoor Party to be held on Sunday, October 31, from 5:00 p.m. to 7:00 p.m. on Lot 1, Block 1, Dorris Addition No. 1, at 501 North Main. o.. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 12 APPROVAL OF TEMPORARY USE PERMIT NO. 99-08-CC Council Member Hogg motioned to approve Temporary Use Permit No. 99-08- CC for the request of North Euless Baptist Church for a rally and concert to be held on October 16, 1999, from 5:00 p.m. to 9:00 p.m. on Lot 12, Block 17, and Block 33, Midway Park Addition, at 505 West Harwood Road. Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, Porterfield and Edwards Nays: None Mayor Saleh declared the motion carried. Mayor Pro Tem Miller noted that a lot of people apply for the board and commission positions and it is a tough decision for the council to make. He stated the council appreciates those that have served and it's difficult to make everyone happy and have rotations on the boards so everyone has a chance to serve. Council Member Tyson noted that the Economic Development Advisory Board „p appointments will be made at a later date. Mayor Saleh stated that the appointment of board and commission members is a tough assignment and that the council appreciates the service of all the volunteers serving on the boards. She noted that there is a board member in the audience who has served diligently for a number of years and he is greatly appreciated. ITEM NO. 14 REPORTS STAFF REPORT There was no staff report. CITY MANAGER Deputy City Manager Gary McKamie stated that he looks forward to City Manager Hennig's return from Europe. He mentioned that there were two employees injured last week. CITY ATTORNEY City Attorney Bob McFarland stated that the only provision in the Dallas Stars' agreement with a timetable was the annexation, which was completed with the ordinance approval tonight. He stated that the agreement has been signed by all City Council Minutes Page 7 of 8 October 12, 1999 parties and the original document was delivered to the city last week. He stated he is working with Economic Development Director Andrea Baxter on the Centex Construction agreement. CITY COUNCIL Council Member Tyson congratulated Brian McGarry on being selected employee of the month. He stated that he does a great job for the council at precouncil meetings. Council Member Hogg congratulated Brian McGarry and stated that he is a nice young man who is willing to help them in any way he can. He noted that he was invited to play golf at Texas Star last Saturday by Glenn Walker who brought a tournament here from Little Rock, Arkansas. Council Member Baker also congratulated Brian McGarry. He stated he was at the Texas Star this morning as staff was preparing for the tournament for Athletes in Action, and that there were players from the Dallas Cowboys, Dallas Stars, and Texas Rangers. He stated that says a lot for the Texas Star Golf Course. Mayor Pro Tern Miller stated that he had the opportunity to speak at the Masonic Lodge on projects going on in the city, and he took Diane Eggers so she could explain how citizens could volunteer for the city. He noted that State Representative Todd Smith recommended him to be on Lt. Governor Rick Perry's National Federation of Independent Businesses Committee. He stated that he attended the Trinity High School football game where they beat Haltom High School. He congratulated Brian McGarry, who is one of his favorite people. Council Member Porterfield extended congratulations to Brian McGarry. He noted that he attended the Trinity High School football game and learned that Rick Herold is the voice of the Trinity Troyanns. Council Member Edwards congratulated Brian McGarry and noted that he does a great job and has a wonderful personality. She also congratulated the teens who attended for Teen Read Week. She thanked the volunteers that serve or have served on the boards and commissions and stated she is glad that additional people were put on the Teen Court Board. Mayor Saleh stated that the city keeps completed board and commission applications of those not appointed and use those to fill vacancies throughout the year. She stated that she rode in a helicopter with other area mayors and Tom Luce to look at proposed sites for the Olympic games. She stated that she is scheduling a meeting with Euless pastors to discuss a non-denominational service to be held on Sunday of Arbor Daze. She stated that HEB Chamber of Commerce will have a tent at Arbor Daze and HEBISD is planning to have 2,000 children there for the opening day. Mayor Saleh congratulated Brian McGarry and noted that he always has a happy smile and something nice to say about City Council Minutes Page 8 of 8 October 12, 1999 everybody. She mentioned the firefighter and Texas Star employee that were injured over the weekend.
