HomeMy WebLinkAbout2000-03-28 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL MARCH 28, 2000 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:15 p.m. on Tuesday, March 28, 2000, in the Administration Building Conference Room. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Charlie Miller and Council Members Carl Tyson, Leon Hogg, Bobby Baker, Glenn Porterfield, and Katie Edwards. Closed session was held to discuss real property and economic development incentives as authorized by Sections 551.072 and 551.086 of the Texas Government Code. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:05 p.m. for the consideration of scheduled items. City Council Meeting Page 2 of 22 March 28,2000 ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR MARCH Director of Development Bo Bass introduced Planning & Development Inspector Mike Moncada and his family, and Mayor Saleh presented him with a plaque. ITEM NO. 2 PRESENTATION OF EMPLOYEE SERVICE PINS FOR MARCH Police Captain Bob Freeman introduced Police Officer Scott Axton, receiving a 5- year pin and Police Corporal Bill Richardson, receiving a 20-year pin. City Manager Joe Hennig introduced Director of Administration Tom Cox, receiving a 10-year pin. Mayor Saleh presented the service pins and stated that Library Aide Julia Petrovich was not able to attend the meeting to receive her 15-year pin. ITEM NO. 3 PRESENTATION BY COMMUNITY WASTE DISPOSAL, INC. Greg Roemer, Community Waste Disposal, Inc., made a presentation highlighting the curbside recycling program in Euless. He noted that there has been a 2.6% increase in the number of pounds recycled per month in 1999. He presented the Mayor a "Certificate of Merit" plaque made out of recycled newspaper. Mayor Pro Tem Miller noted that Greg Roemer is one of the few vendors who comes before the council to give annual reports. Consent Agenda Consent Items No. 4 through 9 were approved as follows: ITEM NO. 4 APPROVAL OF WATER LINE REPLACEMENT PROJECTS Approval of water line replacements on Aransas Drive from Ector Drive to Midway Drive, in the amount of $12,057; Milam Drive from Ector Drive to Midway Drive, in the amount of $18,248; and Milam Drive from Midway Drive to Denton Drive, in the amount of$14,806. ITEM NO. 5 APPROVAL OF RESOLUTION NO. 1060 Approval of Resolution No. 1060 accepting a gift of conveyance from Arvind S. and Helen M. Patel of 2.513 acres out of the Terrell-Jasper Survey, Abstract No. 861, City of Euless, Texas. ITEM NO. 6 APPROVAL OF RESOLUTION NO. 00-1061 Approval of Resolution No. 00-1061 appointing Barbara Girouard as Election Judge and Helen Harvey as Alternate Judge at the Euless Public Library, and �•- Martha Burleson as Election Judge and Debbie Anderson as Alternate Judge at Bear Creek Elementary School for the General Council Election to be held May 6, 2000. City Council Meeting Page 3 of 22 March 28,2000 ITEM NO. 7 APPROVAL OF RESOLUTION NO. 00-1058 Approval of Resolution No. 00-1058 establishing the City Council's regular meeting dates and providing procedure for rescheduling a regular City Council meeting. ITEM NO. 8 ACCEPTANCE OF GRANT TO EULESS PUBLIC LIBARARY Acceptance of a grant awarded the Euless Public Library from Telecommunications Infrastructure Fund (TIF) in the amount of $96,548.00 to replace 30 PCs, upgrade networking equipment, add a UPS (uninterrupted power supply), a page scanner for the public and a video projector for Internet training. ITEM NO. 9 APPROVAL OF MINUTES Approval of the minutes of the Regular City Council Meeting of March 16, 2000. Mayor Pro Tern Miller motioned to approve Consent Agenda Items No. 4 through 9. Regular Agenda ITEM NO. 10 APPROVAL OF RESOLUTION NO. 00-1059 Council Member Hogg motioned to approve Resolution No. 00-1059 considering all matters incident and related to declaring expectation to reimburse expenditures with proceeds of future debt, including the adoption of a resolution pertaining thereto, for the purchase of golf carts. City Council Meeting Page 4 of 22 March 28,2000 ITEM NO. 11 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1412 -STREET IMPROVEMENTS Council Member Edwards motioned to approve the first and final reading of Ordinance No. 1412 considering all matters incident and related to the issuance and sale of$4,300,000 "City of Euless, Texas, General Obligation Bonds, Series 2000," to First Southwest Company, Inc., at the interest rate of 5.595723% including the receipt of bids thereof and the adoption of an ordinance authorizing the issuance of such bonds, for street improvements to Harwood Road, Main Street, and West Pipeline Road. Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 12 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1413 -WATER TOWER Council Member Baker motioned to approve the first and final reading of �•- Ordinance No. 1413 considering all matters incident and related to the issuance and sale of $3,260,000 "City of Euless, Texas, Waterworks and Sewer System Revenue Bonds, Series 2000," to PaineWebber, Inc., at the interest rate of 5.6256%, including the receipt of bids thereof and the adoption of an ordinance authorizing the issuance of such bonds, for the construction of a water tower. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 13 TABLED FIRST AND FINAL READING OF ORDINANCE NO. 1411 - DR. PEPPER STAR CENTER Council Member Hogg motioned to table the first and final reading of Ordinance No. 1411 to April 11, amending Ordinance No. 1404 considering all matters incident and related to the issuance and sale of $10,290,000 "City of Euless, Texas, Tax and Waterworks and Sewer System (Limited Pledge) Revenue Certificates of Obligation, Taxable Series 2000," for the purchase of an ice hockey facility which will be leased by the Dallas Stars. ITEM NO. 14 AUTHORIZE MAYOR TO EXECUTE QUIT CLAIM DEED FOR CLEARING TITLE TO CERTAIN PROPERTY IN THE EDWARD TAYLOR SURVEY, ABSTRACT NO. 1550, CITY OF EULESS, TEXAS Council Member Baker motioned to authorize the mayor to execute a Quit Claim Deed to clear title to the western half of Fuller-Wiser Road between SH 360 and Glade Road, containing 16,988 square feet of land in the E. Taylor Survey, A- 1550, owned by the Vaughn Family. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 15 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1415 Council Member Edwards motioned to approve the first and final reading of Ordinance No. 1415 amending Section 34-105 of Chapter 34 of the Code of Ordinances of the City of Euless, Texas, amending certain provisions of the Uniform Fire Code pertaining to open burning and recreational fires. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. Ciry Council Meeting Page 6 of 22 March 28,2000 ITEM NO. 16 PUBLIC HEARING REGARDING SPECIFIC USE PERMIT NO. 99-19-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1416 Mayor Saleh opened the public hearing at 7:59 p.m. regarding revisions to Specific Use Permit No. 99-19-SUP for a temple on Tracts 3E1 and 3N, A.M. Downing Survey, Abstract 415, TX-10 (Texas Highway Ten Multi-Use District) zoning, located at 1400 West Euless Boulevard. Director of Planning & Development Bo Bass stated that the applicant is requesting a revision to the specific use permit approved on February 8, 2000, by Ordinance No. 1402. He stated that the church had miscalculated the amount of funds needed for repaving the parking lot in concrete, and the applicant now requests that the third condition of the specific use permit requiring that "parking and fire lanes meet all requirements before issuance of a Certificate of Occupancy" be changed to read "A 3-inch asphalt overlay shall be placed over all areas designated as fire lanes. In addition, it is recommended that the overlay be placed on the parking in the center of the fire lane loop so that water will not collect in the parking spaces." He stated that the Development Review Committee recommended approval of the request. Mr. Bass further noted that the Planning & Zoning Commission recommended approval with the wording "A 3-inch asphalt overlay be placed over the entire eastern rectangular parking area including those areas designated as fire lanes •••- before issuance of a Certificate of Occupancy" with the intent that the parking area and fire lanes would be brought up to code with concrete. Kiepal Singh Bhogal, 137 Willow Ridge Road, Fort Worth, Texas, 76103, and Haeminder Singh Jassal, 1508 Oxford Drive, Mansfield, Texas, 76063, spoke in favor of the request as representatives of the temple, stating that due to a mistake in calculations of the cost of concrete, they are requesting to overlay the entire parking area with 3" of asphalt. There being no additional proponents or opponents, the public hearing was closed at 8:07 p.m. Several council members stated they understood the parking area and fire lanes would be concrete within three years. It was noted that Mr. Bhogal had not understood that the parking lot would have to be concrete within three years. After continued discussion, Mr. Bhogal agreed to commit to paving the parking area with four inches of concrete and the fire lanes with six inches of concrete within three years of receiving the Certificate of Occupancy. .�. Mayor Pro Tem Miller motioned to approve the first and final reading of Ordinance No. 1416 amending Ordinance No. 1402 for Specific Use Permit No. 99-19-SUP for a temple on Tracts 3E1 and 3N, A.M. Downing Survey, Abstract City Council Meeting Page 7 of 22 March 28,2000 415, TX-10 (Texas Highway Ten Multi-Use District) zoning, located at 1400 West Euless Boulevard with the following conditions: (1) A revised lighting plan approved by staff be submitted; (2) Limited to three years to the congregation Gudwar Sikh Sangat; (3) Three inch overlay of asphalt temporarily on parking lot to be converted within three years to four inches concrete on the parking lot and six inches concrete on fire lanes; and (4) Signage meet TX-10 sign requirements. ITEM NO. 17 PUBLIC HEARING FOR ZONING CHANGE NO. 00-01-ZC AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1409 NOTE: Items No. 17 and 18 were addressed before Item No. 10 on the agenda resulting in the time differences indicated. Mayor Saleh opened the public hearing at 7:28 p.m. for Zoning Case No. 00-01- �- ZC changing the zoning on Lots 2A, 2A2, Block 1A, Morrisdale Addition, located at 4319 West Pipeline Road, from C-1 (Neighborhood Business District) to C-2 (Community Business District). Director of Planning & Development Bo Bass stated that C-2 zoning would be required to allow dry cleaning on-site. He noted that one of the lease spaces in the strip center is currently zoned C-2 and the remaining portion is zoned C-1. He stated that there are offices zoned C-1 and vacant land that would be extremely difficult to develop between the strip center and the single family residences, thereby, providing a buffer. Steve Chown, owner of the building, P. O. Box 797844, Dallas, Texas, 75379, spoke in favor of the request. Hee D. Hawng, 2305 Sequoia Trail, Bedford, Texas, 76021, owner of Central Dry Cleaners, stated that they will be doing dry cleaning for the business to be located there and two satellite dry cleaners they own. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:32 p.m. In response to questions by the council, Mr. Bass stated that there is not a real danger from the chemicals because the dry cleaning process is a closed system with internal infiltration. He noted that this operation is similar to the one recently approved on North Main Street. He also stated that there would be adequate City Council Meeting Page 8 of 22 March 28,2000 lighting. He also stated that unless it is determined that the parking lot surface is a life safety issue, the city cannot require the parking lot be repaved with concrete; however, he would talk to the property owner about repaving the parking lot. Mayor Pro Tem Miller motioned to approve the first and final reading of Ordinance No. 1409 for Zoning Case No. 00-01-ZC changing the zoning on Lots 2A, 2A2, Block 1A, Morrisdale Addition, located at 4319 West Pipeline Road, from C-1 (Neighborhood Business District) to C-2 (Community Business District). Council Member Edwards seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, and Edwards Nays: Mayor Saleh and Council Member Porterfield Mayor Saleh declared the motion carried. ITEM NO. 18 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 00-01- SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1410 Mayor Saleh opened the public hearing at 7:48 p.m. for Specific Use Permit No. �-- 00-01-SUP for a drycleaning plant on Lots 2A, 2A2, Block 1A, Morrisdale Addition, in C-2 (Community Business District) zoning, located at 4319 West Pipeline Road. Director of Planning & Development Bo Bass stated that a specific use permit is required for a dry cleaning facility. He stated that the Planning & Zoning Commission recommended approval with the following conditions: (1) Limited to current building owner Steve Chown; (2) Limited to current business owner Hee D. ITEM NO. 19 PUBLIC HEARING REGARDING ZONING TEXT AMENDMENT AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1418 Mayor Saleh opened the public hearing at 8:30 p.m. regarding amending Section 84-84 "Permitted Uses Table," Table 4-A "Permitted Primary Uses," in order to require a Specific Use Permit for hotels and motels in C-2 (Community Business District), TX 10 (Texas Highway 10 Multi-Use District), TX 121 (121 Gateway District), and LI (Limited Industrial District) zoning categories. Director of Planning & Development Bo Bass stated that this change will require a specific use permit for approval of a hotel or motel. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 8:31 p.m. Council Member Baker motioned to approve the first and final reading of Ordinance No. 1418 amending Chapter 84 "Unified Development Code," of the Code of Ordinances, amending Section 84-84 "Permitted Uses Table," Table 4-A "Permitted Primary Uses," in order to require a Specific Use Permit for hotels and motels in C-2 (Community Business District), TX 10 (Texas Highway 10 Multi- Use District), TX 121 (121 Gateway District), and LI (Limited Industrial District) zoning categories. Council Member Porterfield seconded the motion. ITEM NO. 20 PUBLIC HEARING FOR ZONING TEXT AMENDMENT AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1417 Mayor Saleh opened the public hearing at 8:32 p.m. regarding amending Chapter 84 "Unified Development Code," of the Code of Ordinances, amending Section 84-84 "Permitted Uses Table," Table 4-A "Permitted Primary Uses," in order to require a Specific Use Permit for phone bank uses in C-2 (Community Business City Council Meeting Page 10 of 22 March 28,2000 District), TX 10 (Texas Highway 10 Multi-Use District), TX 121 (121 Gateway District), and LI (Limited Industrial District), 11 (Light Industrial District), 1-2 (Heavy Industrial District) zoning categories. Director of Planning & Development Bo Bass stated that this change will require a specific use permit for approval of phone banks. ITEM NO. 21 APPROVAL OF SITE PLAN NO. 99-17-SP Director of Planning & Development Bo Bass stated the site plan is for multi- family being developed by Fairfield Development on the east side of SH 121. He noted that as part of this project, the developer will be constructing the full section of Centurion Way from the SH 121 service road to proposed Gateway Blvd., which will run north and south. They will also construct a full section of the portion of proposed Gateway Blvd. at Centurion Way and escrow complete funds for one-half of the section of proposed Gateway Blvd. from Centurion Way down to their south property line. Mayor Saleh asked if Gateway Blvd. will extend all the way to Glade Road. Director of Planning & Development Bo Bass stated it will not until the Wilkins' property develops. Council Member Edwards motioned to approve Site Plan No. 99-17-SP for multi- family on a portion of Tract 3, B. Harrington Survey, Abstract 808, and portions of Tracts 4D, 4F, 4F1, L. Franklin Survey, Abstract 513, located on the east side of S.H. 121, between Mid-Cities Boulevard and Glade Road. ITEM NO. 22 APPROVAL OF SITE PLAN NO. 00-01-SP Director of Planning & Development Bo Bass stated the request is for a Days Inn hotel having 65 rooms. Council Member Baker motioned to approve Site Plan No. 00-01-SP for a hotel on T. Jasper Survey, Abstract 861, Tract 5F01, located at S. H. 183 at Dock McGinnis Drive. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 23 APPROVAL OF SITE PLAN NO. 00-04-SP Director of Planning & Development Bo Bass stated the applicant, Whitmore & Sons, plan to build an 11,900 sq. ft. building, which meets code requirements. He stated that the applicant has committed to no outdoor storage, sales or display. Barry Whitmore, 1501 Baccarac Court, Euless, Texas, stated they are expanding their business and will occupy a portion of the new building and will sublease the remaining portion until the time their business expands again. Council Member Hogg motioned to approve Site Plan No. 00-04-SP for an office/warehouse on John Groves Survey, Abstract 599, portion of Tract 1C1, 3H, and 3J, located approximately 200 feet east of Baccarac Court on West Euless Boulevard. Council Member Baker seconded the motion. ITEM NO. 24 PUBLIC HEARING WITHDRAWN FOR PLANNED DEVELOPMENT NO. 99-10-PD Mayor Saleh stated that the applicant withdrew his request and the public hearing would not be held for Planned Development No. 99-10-PD on Edward Taylor Survey, Abstract No. 1550, Tract 1A3, from TH (Townhouse Dwelling District) into PD (Planned Development based on TH, Townhouse Dwelling District), located to the north and west of the intersection of Fuller-Wiser Road and S.H. 360. ITEM NO. 25 PUBLIC HEARING WITHDRAWN FOR SPECIFIC USE PERMIT NO. 99-11-SUP Mayor Saleh stated that the applicant withdrew his request and the public hearing would not be held for Specific Use Permit No. 99-11-SUP for a private street gated community in Edward Taylor Survey, Abstract No. 1550, Tract 1A3, TH (Townhouse Dwelling District) zoning, located to the north and west of the intersection of Fuller-Wiser Road and S.H. 360. ITEM NO. 26 PUBLIC COMMENT There was no public comment. ITEM NO. 27 REPORTS STAFF REPORT There was no staff report. CITY MANAGER City Manager Joe Hennig complimented Director of Economic Development Andrea Baxter and Director of Planning & Development Bo Bass on all the development projects that are in progress at this time. CITY ATTORNEY City Attorney Bob McFarland stated he had nothing to report. CITY COUNCIL Council Member Tyson congratulated Mike Moncada on receiving employee of the month and Scott Axton, Bill Richardson, and Tom Cox on receiving their employee service pins. City Council Meeting Page 13 of 22 March 28,2000 Council Member Baker stated he attended the Hank Thompson concert and it was great, with a sell-out crowd. Mayor Pro Tern Miller also congratulated the employees receiving the awards. He stated that he threw out the first pitch at the Trinity High School baseball game and also at the Euless Athletic Association's first game. Council Member Glenn Porterfield read the following statement: Madam Mayor, Fellow Council Members and audience, I have a statement prepared which I would like to read. Reports have come to me that I am a disappointment to some people present tonight in regards to my service as a city council member representing the citizens of Euless. I really don't mind anyone expressing their opinion as to my record of service but I do think it important that certain facts of that record be made known. Susan Crim, City Secretary, has provided a record of the date of each city council function for the years 1999 and 2000 and those in attendance at each. I would like this record (attached as Exhibit A) to be made part of the minutes of this meeting along with a transcript of my remarks. Of eighteen (18) regular city council meetings from May 11, 1999, the date of my being sworn in as a city council member, I have `�— attended all. Of seven (7) special city council meetings, I have attended all but one. That one meeting was for the purpose of canvassing the election results of the November 8, 1999 election and was attended by only two city council members. Of two (2) City Council Work Sessions during my tenure on this council, I have attended both. Of four (4) Town Hall meetings, I have attended all. These items represent the extent of the record provided by Ms. Crim. In addition, I have represented the City of Euless at meetings of the Euless Crime Control and Prevention District, The Trinity River Authority, The North Central Texas Council of Governments, The Hurst Euless Bedford Chamber of Commerce, The North East Tarrant Board of Realtors, and various ribbon cuttings celebrating new businesses opening in Euless. I have supported the Euless Library Foundation, Arbor Daze, the Euless Police Association and the Euless Firefighters Association. Economic Development Advisory Committee and have attended each of the meetings of this group. I have also attended meetings of the Texas Municipal League and the Mayor's Council of Tarrant County. Not only have I represented the City of Euless, I have also been actively involved in my neighborhood by serving as a director of the Arbor Glen Owners Association. Please don't view my comments as saying that I am better than any other elected official of Euless. I have respect for each as a worthy representative of we who elected them. My time has become quite precious to me, but my objective is to be of service to the citizens of Euless, those who elected me to this Council. I was not elected to pour oil on the waters of local government, but rather to be as effective as possible in considering what is best for Euless and its citizens. I continue my pledge to do my best to get that job done. Council Member Edwards stated that CWD made a great presentation and she hopes there will be a compost program in Euless. She stated she went to the car rental facility's grand opening and the facility is very impressive. Mayor Saleh stated the car rental facility is super. She stated she made a presentation to the HEB ISD regarding Arbor Daze. She congratulated Bob McFarland on being a new grandfather. She introduced council candidate Carroll Scott and congratulated Council Member Glenn Porterfield on not having an opponent in the upcoming election. Mayor Saleh stated she attended the Tarrant County CDBG ranking meeting and that Euless will be receiving $117,000 in grant money. She noted that Library Manager JoAnn Rogers and the library hosted a sleepover for middle school students last Friday night, and that there are a lot of new and exciting activities taking place at the library.
