APRIL 11, 2000
CALL TO ORDER
A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh
at 4:10 p.m. on Tuesday, April 11, 2000, in the Administration Building Conference Room.
Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Charlie Miller and Council
Members Carl Tyson, Leon Hogg, Bobby Baker, Glenn Porterfield, and Katie Edwards.
Closed session was held to discuss contemplated litigation, personnel matters, and
economic development incentives as authorized by Sections 551.071, 551.074, and
551.086 of the Texas Government Code. Precouncil discussion was held on agenda
items and other scheduled items.
COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS
The Euless City Council continued their meeting in the Council Chambers at 7:15 p.m. for
the consideration of scheduled items.

ITEM NO. 1 PRESENTATION OF ARBOR DAY PROCLAMATION
Mayor Saleh presented Texas Star Golf Pro Duff Cunningham with a proclamation
proclaiming April 28, 2000, as Arbor Day.

Items No. 2 through 7 were approved as follows:
ITEM NO. 2 APPROVAL OF BID NO. 00-08
Approval of Bid No. 00-08 for the purchase of fertilizer and plant protectants for Texas
Star Golf Course from the following vendors: Estes, Inc., 8320 Chancellor Row, Dallas,
Texas, 75247, in the amount of $29,751.18; Greensmiths, Inc., P. O. Box 338, 6481
Railroad Street, Frisco, Texas, 75034, in the amount of $5,925; United Horticulture

ITEM NO. 3 APPROVAL OF RESOLUTION NO. 00-1062
Approval of Resolution No. 00-1062 accepting the donation of 8.0839 acres of land out
"�- of the R. Crowley and S. Tucker Surveys, Abstract Nos. 312 and 1512, adjacent to Bear
Creek Park from Parkside on the Creek, L.L.P., 8120 Penn Avenue South, Minneapolis,
Minnesota, 55431.
ITEM NO. 4 APPROVAL OF RESOLUTION NO. 00-1063
Approval of Resolution No. 00-1063 designating Tarrant County Juvenile Services the
recipient of the City of Euless' portion of the 1999 Juvenile Accountability Incentive
Block Grant.
ITEM NO. 5 APPROVAL OF RESOLUTION NO. 00-1064
Approval of Resolution No. 00-1064 supporting Transportation Excellence for the 21st
century (TEX-21).
ITEM NO. 6 AUTHORIZE MAYOR TO EXECUTE A DRAINAGE EASEMENT TO
BE USED IN CONJUNCTION WITH THE CONSTRUCTION OF FM
157 SOUTH OF SH 10
Authorized mayor to execute a drainage easement on the north side of Pipeline Road
and adjacent to the west side of Boyd Branch to the Texas Department of
Transportation to be used in conjunction with the construction of FM 157, south of SH
�- 10.

Approval of the City Council Minutes of the Regular Meeting of March 28, 2000.
Mayor Pro Tern Miller motioned to approve Consent Agenda Items No. 2 through 7.
Council Member Edwards seconded the motion.

ITEM NO. 8 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO.
1411 - DR PEPPER STARCENTER
Council Member Hogg motioned to approve the first and final reading of Ordinance No.
1411 amending and restating the provisions of Ordinance No. 1404 authorizing
issuance of City of Euless, Texas, Tax and Waterworks and Sewer System (Limited
Pledge) Revenue Certificates of Obligation, Taxable Series 2000, adopted on February
8, 2000, for the Dr. Pepper StarCenter.
Council Member Baker seconded the motion.
Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker,
Porterfield, and Edwards

ITEM NO. 9 PUBLIC HEARING REGARDING SPECIFIC USE PERMIT NO. 00-02-
SUP AND APPROVAL OF FIRST AND FINAL READING OF
ORDINANCE NO. 1422
Mayor Saleh opened the public hearing at 7:21 p.m. regarding the request from Primera
Iglesia Bautista Church for Specific Use Permit No. 00-02-SUP for a church.
Director of Planning & Development Bo Bass stated the church is located in the old
Bonanza Steak House building at Wilshire Village Shopping Center and is requesting
renewal of the previously approved specific use permit. Although the Planning & Zoning
Commission recommended a two-year time limit, staff is recommending a one-year time
... limit.

Mike Utzman, 811 Rock Creek, Euless, Texas, stated that he wanted the council to
make a point and let Restoration Church know that their sign needed to be replaced
�' prior to their receiving a specific use permit.
Jonathan Russell, Pastor of Primera Iglesia Bautista, 713 La Sonbra, Grand Prairie,
Texas, 75050, stated that their church is a mission of First Baptist Church of Euless, not
Restoration Church. He stated that Restoration Church is allowing them to use the
building for at least another year and then possibly another six or twelve months and
they prefer the specific use permit be for two years. He noted that they intend to build
their own building in the future.
There being no additional proponents or opponents, Mayor Saleh closed the public
hearing at 7:26 p.m.
Council Member Carl Tyson motioned to approve the first and final reading of
Ordinance No. 1422 with the following conditions: (1) the congregation will have no
opposition to alcohol sales within 300 feet; (2) the specific use permit be limited to two
years or to be limited to this congregation, whichever comes first; and (3) the degree of
maintenance that has been maintained at this time be continued, for a church on Tract
A, Wilshire Village Shopping Center Addition, zoned TX-10 (Texas Highway 10 Multi-
Use District), located at 1350 West Euless Boulevard.
Council Member Edwards seconded the motion.

ITEM NO. 10 PUBLIC HEARING REGARDING SPECIFIC USE PERMIT NO. 00-05-
SUP AND APPROVAL OF FIRST AND FINAL READING OF
ORDINANCE NO. 1423
Mayor Saleh opened the public hearing at 7:41 p.m. regarding the request from Mid
Cities Community Church for Specific Use Permit No. 00-05-SUP for a church.
Director of Planning & Development Bo Bass stated the church is requesting to locate in
the Morrisdale shopping center and that the lighting plan proposed meets city
standards. He pointed out that there is a sufficient number of parking spaces per code
requirements for the church, the dry cleaners and Kwik Copy.
Clay Hilton, 1824 Sotogrande Blvd. #1502, Hurst, Texas, stated he is the pastor of Mid-
Cities Community Church, a mission of First Baptist Church of Euless. He stated they
plan to begin holding services April 16, 2000. He said they plan to provide lighting
throughout the entire parking lot. He stated his lease at 4311 West Pipeline Road is for
nine months and the lease at 4323 West Pipeline Road is for one year.

There being no additional proponents or opponents, Mayor Saleh closed the public
hearing at 7:45 p.m.
Mayor Pro Tern Miller stated his desire to limit the hours of operation to prevent parking
problems.
Council Member Tyson motioned to approve the first and final reading of Ordinance
No.1423 with the conditions that it be tied to the terms of the lease and to Mid-Cities
Community Church for a church on Lots 1R and 2A, Block 1A, Morrisdale Addition,
zoned C2 (Community Business District), located at 4311 and 4323 West Pipeline
Road.
Council Member Edwards seconded the motion.
Ayes: Mayor Saleh, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards
Nays: Mayor Pro Tem Miller

ITEM NO. 11 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO.
1414
Council Member Baker motioned to approve the first and final reading of Ordinance No.
`ft. 1414 amending Chapter 82 "Traffic and Motor Vehicles," Article Ill "Operation of
Vehicle", Section 82-63 "Same-School Zones," to establish an additional school zone
for Lakewood Elementary School on Donley Drive and Bocowood Drive.
Mayor Pro Tern Miller seconded the motion.
Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker,
Porterfield, and Edwards

ITEM NO. 12 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO.
1419
Council Member Baker motioned to approve the first and final reading of Ordinance No.
1419 amending Chapter 86, "Utilities," Section 86-48(b) "Deposits" of the Euless Code
of Ordinances for master deposits for unoccupied properties.
Council Member Edwards seconded the motion.
Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker,
Porterfield, and Edwards

ITEM NO. 13 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO.
1420
Council Member Hogg motioned to approve the first and final reading of Ordinance No.
1420 authorizing the mayor to execute an Abandonment of Easement document to
abandon and vacate a drainage easement in the Terrell Jasper Survey, Abstract No.
861 on property belonging to A. S. Patel.
Council Member Edwards seconded the motion.

Porterfield, and Edwards

ITEM NO. 14 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO.
1421
`•► Council Member Baker motioned to approve the first and final reading of Ordinance No.
1421 amending Chapter 30, "Fees," Section 30-27, "Recreation Areas or Facilities,"
Subsection (i) (17) of the Euless Code of Ordinances, for changes to golf related cart
usage fees at Texas Star Golf Course.
Council Member Hogg seconded the motion.
Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker,
Porterfield, and Edwards

ITEM NO. 15 RECOMMEND TARRANT COUNTY REJECT BIDS FOR CDBG
PROJECT NO. B99-UC-48-0001-22-50 AND TO READVERTISE FOR
BIDS
Mayor Pro Tern Miller made a motion to recommend Tarrant County reject all bids for
Community Development Block Grant (CDBG) Project No. B99-UC-48-0001-22-50 and
to readvertise the project for new bids.

Mayor Pro Tern Miller stated he disagreed with the fourth reason stated in Elliott &
Hughes' letter recommending rejection of the bids.
ITEM NO. 16 APPROVAL OF AMENDMENT TO PURCHASE AND LEASE
AGREEMENT WITH THE DALLAS STARS
City Attorney Bob McFarland stated that this amendment to the lease agreement
between the City of Euless and the Dallas Stars, extends the lease to 25 years, 3
months, and approves a cash escrow agreement in lieu of a letter of credit.
Council Member Baker motioned to approve an Escrow Agreement amending the
Purchase and Lease Agreement with the Dallas Stars for the Dr. Pepper StarCenter.
Council Member Hogg seconded the motion.

Porterfield, and Edwards

ITEM NO. 17 PUBLIC COMMENT
Mike Utzman, 811 Rock Creek, Euless, Texas, stated he would like the council to
appoint a commission to study the need for a full warning system in the parks to warn of
impending tornadoes.
Mayor Saleh stated the staff is looking into a new warning system.
ITEM NO. 18 REPORTS
CITY MANAGER
City Manager Joe Hennig noted that the bachelor party for Dallas Cowboys Quarterback
Troy Aikman was held at Texas Star Golf Course on Thursday.
CITY ATTORNEY
�•.- City Attorney Bob McFarland stated he had nothing to report.

CITY COUNCIL
... Mayor Pro Tern Miller stated he went to the opening day at the Ballpark in Arlington and
met someone who complimented the city on the Texas Star Golf Course. He also
stated he participated in the Texas Trash Off.
Council Member Baker stated he had a good time at the HEB Education Foundation
Bowl-a-Thon, which raised about $15,000.
Council Member Hogg stated that he also enjoyed the HEB Education Foundation Bowl-
a-Thon.
Council Member Tyson congratulated Economic Development Director Andrea Baxter
for the report she prepared on economic development activities.
Mayor Saleh introduced Carroll Scott, a candidate for Place 6 on the City Council in the
May 6 election and congratulated Council Member Glenn Porterfield on being
unopposed in the election. She reminded everyone that early voting would begin on
April 19.
Note: The meeting convened into closed session at 8:25 p.m.
