HomeMy WebLinkAbout2000-04-25 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL APRIL 25, 2000 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:35 p.m. on Tuesday, April 25, 2000, in the Administration Building Conference Room. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Charlie Miller and Council Members Carl Tyson, Leon Hogg, Bobby Baker, Glenn Porterfield, and Katie Edwards. Closed session was held to discuss contemplated litigation as authorized by Section 551.071 of the Texas Government Code. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:07 p.m. for the consideration of scheduled items. City Council Minutes Page 2 of 7 Apri125, 2000 ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR APRIL Fire Chief Lee Koontz introduced Fire Inspector Christine Cox and Mayor Saleh presented her with a plaque recognizing her as employee of the month for April. ITEM NO. 2 PRESENTATION OF EMPLOYEE SERVICE PINS FOR APRIL Police Chief Leonard Carmack introduced Police Corporal Jerry Lee Cook and Director of Administration Tom Cox introduced Fleet and Facility Supervisor Kyle McAdams and his sons, Michael and Christopher. Mayor Saleh presented Jerry Cook with a 15-year service pin and Kyle McAdams with a 10-year service pin. Mayor Saleh noted that Police Officer Howard Berry was unable to attend the meeting to receive his 5-year service pin. ITEM NO. 3 PRESENTATION OF PROCLAMATION TO LOU BAUM AS VOLUNTEER OF THE YEAR Mayor Saleh presented a proclamation to Lou Baum recognizing him as the City of Euless Volunteer of the Year. Consent Agenda Items No. 4 through 6 were approved as follows: °' ITEM NO. 4 APPROVAL OF RESOLUTION NO. 00-1065 Approval of Resolution No. 00-1065 appointing Sue Eubanks as the Early Voting Ballot Board Judge for the May 6, 2000 City of Euless election. ITEM NO. 5 AUTHORIZED CITY MANAGER TO EXECUTE CONTRACT TO PROVIDE "ON CALL" TESTING SERVICES FOR CITY CONSTRUCTION PROJECTS Authorized city manager to execute a contract with TEAM Consultants, Inc., 3101 Pleasant Valley, Suite 101, Arlington, Texas, 76015, to provide construction materials testing on an "on-call" basis for a period of one year and allowing the city manager to extend the "on-call" agreement with TEAM Consultants, Inc., for two additional one-year periods upon favorable recommendation by the Director of Public Works. ITEM NO. 6 APPROVAL OF MINUTES Approval of the minutes of the Regular City Council Meeting of April 11, 2000. Mayor Pro Tem Miller motioned to approve Consent Agenda Items No. 4 through 6. Council Member Edwards seconded the motion. Regular Agenda ITEM NO. 7 TABLED AN ORDINANCE AUTHORIZING THE ISSUANCE OF CERTIFICATES OF OBLIGATION Council Member Edwards motioned to table an ordinance to May 9, 2000, authorizing the issuance of Certificates of Obligation for the purpose of paying contractual obligations to be incurred for: (1) the construction and equipment of police facilities; (2) the purchase of golf carts for the municipal golf course; and (3) professional services related to such projects and the financing thereof. Council Member Baker seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards r.. Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 00-04- SUP AND DENIAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1424 Mayor Saleh opened the public hearing at 7:22 p.m. regarding the request of Life Impact Fellowship Church for Specific Use Permit No. 00-04-SUP to allow a church on Lot 222R1 B, Sotogrande Addition, located at 3602 West Pipeline Road. Director of Planning & Development Bo Bass stated that Life Fellowship Church is requesting to use the building located next to the tennis courts at the multi- family complex formerly known as Sotogrande. He noted that the church will be leasing from the City of Bedford who had previously used the building as offices for their Parks & Recreation Department. He stated that the Planning & Zoning Commission recommended approval tying the specific use permit to the term of the lease, through December 31, 2001, and to the Life Fellowship Church congregation. There being no proponents or opponents, Mayor Saleh closed the public hearing r•- at 7:25 p.m. City Council Minutes Page 4 of 7 April 25,2000 Mayor Pro Tern Miller stated that he believed the best use for the facility to be for �.. recreational uses. Director of Community Services Rick Herold and City Manager Joe Hennig explained that the City of Euless inquired about purchasing the building and tennis courts; however, the City of Bedford will not consider selling the tennis courts and the cost of the building was extremely high. Mr. Hennig noted that the City of Euless was not interested in the building alone. Council Member Baker stated he felt the park and recreation area including the building should be maintained as a park or recreation facility as a whole. Council Member Baker motioned to deny Ordinance No. 1424 for Specific Use Permit No. 00-04-SUP to allow a church on Lot 222R1B, Sotogrande Addition, located at 3602 West Pipeline Road. Mayor Pro Tern Miller seconded the motion. Ayes: Mayor Pro Tern Miller, Council Members Baker and Edwards Nays: Mayor Saleh, Council Members Tyson, Hogg, and Porterfield Mayor Saleh declared the motion failed. Council Member Tyson motioned to approve first and final reading of Ordinance No. 1424 for Specific Use Permit No. 00-04-SUP tying the specific use permit to the term of the lease, through December 31, 2001, and to the Life Fellowship Church congregation on Lot 222R1 B, Sotogrande Addition, located at 3602 West Pipeline Road. Council Member Hogg seconded the motion. Ayes: Council Members Tyson, Hogg, and Porterfield Nays: Mayor Saleh, Mayor Pro Tem Miller, Council Members Baker and Edwards Mayor Saleh declared the motion failed. In response to a question, City Attorney Bob McFarland stated that the property is most likely not taxable since it is owned by the City of Bedford. Council Member Baker motioned to deny Ordinance No. 1424 for Specific Use Permit No. 00-04-SUP to allow a church on Lot 222R1B, Sotogrande Addition, located at 3602 West Pipeline Road. Mayor Pro Tern Miller seconded the motion. Janice Fowler stated that the building had been vacant for quite some time prior to the church leasing it. City Attorney Bob McFarland explained to the applicants, Karen Jackson and Janice Fowler that he understood that the majority of the city council feels the building should continue to be used as a recreation facility and they are sending a message to the City of Bedford by denying the specific use permit. ITEM NO. 9 AUTHORIZED CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR RELOCATION AND RESTORATION SERVICES FOR THE HIMES LOG CABIN Mayor Pro Tern Miller motioned to authorize the city manager to negotiate a contract with Bill Marquis, Marquis Construction and Restoration, Route 1, Box 104, Ponder, Texas, 76259, for relocation and restoration services for the Himes Log Cabin, located at 403 Himes Drive, in an amount not to exceed $44,000 and to establish a $6,000 contingency for the project. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards Nays: None Mayor Saleh declared the motion carried. ITEM NO. 10 CONSIDERATION OF APPOINTMENT TO CRIME CONTROL AND PREVENTION DISTRICT BOARD Council Member Tyson motioned to appoint Mayor Pro Tern Charlie Miller to the Crime Control and Prevention District Board for a term to expire September 1, 2001. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Miller, Council Members Tyson, Hogg, Baker, Porterfield, and Edwards -- Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 6 of 7 April 25,2000 ITEM NO. 11 PUBLIC COMMENT There was no public comment. ITEM NO. 12 REPORTS STAFF REPORT Director of Community Services Rick Herold gave an overview of the activities taking place at Arbor Daze April 28, 29 and 30. He noted that Euless has been designated as the official State of Texas Arbor Day site. He stated that the Texas Forest Service will be honoring the City of Euless at the opening ceremony for being one of only two cities in the state that kept the commitment to plant and promote trees for ten years. He noted the headlining concert will be the Beach Boys on Friday night. CITY MANAGER City Manager Joe Hennig stated that the City of Euless is blessed to have Director of Community Services Rick Herold and his staff working here. On behalf of the staff, he thanked Council Member Katie Edwards for her service on the city council and noted that this will be her last full council meeting, unless there is a run-off. CITY ATTORNEY City Attorney Bob McFarland stated he had nothing to report. CITY COUNCIL Council Member Katie Edwards congratulated Christine Cox on receiving employee of the month and Jerry Cook and Kyle McAdams receiving service pins. She also congratulated Lou Baum on receiving Volunteer of the Year. Council Member Glenn Porterfield congratulated the employees also and stated he would miss having Council Member Edwards sitting beside him during council meetings. Mayor Pro Tern Miller congratulated the employees and Lou Baum. He stated he will miss Council Member Edwards and stated she did a very good job. He noted that he attended the Tongan community event and that City Manager Joe Hennig did an excellent job in coordinating it. He noted that he also represented the city at a meeting at the Grapevine Colleyville ISD. Council Member Baker congratulated those receiving awards. He stated that he could not say enough about Rick Herold. He stated that he is an outstanding person and the city is fortunate to have him. He noted that the Dr. Pepper StarCenter will be opening on Thursday at 6:00 a.m. hosting skating contestants City Council Minutes Page 7 of 7 April 25,2000 from across the nation Thursday through Sunday. He stated that the media tour will be Thursday at 1:30 p.m. Council Member Hogg stated he enjoyed the Tongan affair. He also attended the luncheon at the American Indian Center. He noted that he and Jan will be running the souvenir stand for the city at Arbor Daze. Council Member Tyson congratulated those receiving recognition at the council meeting. He stated he appreciated City Manager Joe Hennig getting Mid-Cities Blvd. back on track for construction. He noted the city is 3% under budget the first six months of this fiscal year. He said goodbye to Council Member Edwards. Mayor Saleh asked Council Member Edwards to keep in touch with the council. She introduced council candidates Veva Lou Massey and Carroll Scott and commented that Council Member Glenn Porterfield did not have an opponent in the election this year. She noted that she spoke to the second graders at Bear Creek Elementary and attended the library's Night of a Thousand Stars. She reminded the citizens to vote and to attend Arbor Daze.
