HomeMy WebLinkAbout2001-05-08 MINUTES OF A REGULAR MEETING ,,,■ OF THE EULESS CITY COUNCIL MAY 8, 2001 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Pro Tern Hogg at 4:04 p.m. on Tuesday, May 8, 2001, in the Administration Building Conference Room. Those present included: Mayor Pro Tern Leon Hogg and Council Members Carl Tyson, Charlie Miller, Glenn Porterfield, Veva Lou Massey, and Council Member-Elect Bob Edwards. Mayor Mary Lib Saleh arrived at 5:30 p.m. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:15 p.m. for the consideration of scheduled items. INVOCATION Pastor Stephen Bell, Key Church, gave the invocation. PLEDGE OF ALLEGIANCE Girl Scout Troop No. 1521 led the pledge of allegiance. ti.. Director of Public Works Randy Byers introduced Public Works Field Tech Glen Boyett and his daughter Kristin, and Mayor Saleh presented him with a plaque for being selected employee of the month for May. ITEM NO. 2 APPROVAL OF RESOLUTION NO. 01-1098 Mayor Pro Tern Hogg motioned to approve Resolution No. 01-1098 canvassing the returns and declaring results of the General Election held on May 5, 2001, as follows: TOTAL Place 1 Carl Tyson 494 Place 3 Kevin Smith 216 Doyle Brown 53 Bob Edwards 411 TOTAL VOTERS: 698 Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, Council Members Tyson, Baker, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 3 RESOLUTION CALLING RUNOFF ELECTION The Council did not consider a resolution calling a runoff election for Place Three of the Euless City Council for June 2, 2001, because a runoff election was not needed. ITEM NO. 4 ADMINISTRATION OF OATH OF OFFICE AND PRESENTATION OF CERTIFICATES OF ELECTION City Attorney Paul Wieneskie administered the Oath of Office to Council Member Carl Tyson and Council Member Bob Edwards, and Mayor Saleh presented each with a Certificate of Election. ITEM NO. 5 ELECTION OF MAYOR PRO TEM Council Member Tyson motioned to nominate Council Member Miller as Mayor Pro Tem. Council Member Edwards seconded the motion. City Council Minutes Page 3 of 8 May 8,2001 Ayes: Council Members Tyson, Edwards, and Miller Nays: Mayor Saleh, Mayor Pro Tem Hogg, Council Members Porterfield, and Massey Mayor Saleh declared the motion denied. Mayor Pro Tern Hogg motioned to nominate Council Member Porterfield as Mayor Pro Tern. Council Member Porterfield seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, and Council Member Porterfield Nays: Council Members Tyson, Edwards, Miller, and Massey Mayor Saleh declared the motion denied. Council Member Miller motioned to nominate Council Member Tyson as Mayor Pro Tern. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Council Members Tyson, Edwards, and Miller Nays: Mayor Pro Tern Hogg, Council Members Porterfield, and Massey Mayor Saleh declared the motion carried. CONSENT AGENDA Council Member Hogg motioned to approve Consent Agenda Items numbered 6 through 9 as follows: ITEM NO. 6 APPROVAL OF RESOLUTION NO. 01-1099 Approval of Resolution No. 01-1099 acknowledging the reversionary interest of property to Raymond McLain and reverting the property to him and release of any and all claims to the property. ITEM NO. 7 APPROVAL OF EASEMENT AGREEMENT Approval of easement agreement with Southwestern Bell Telephone Company for perpetual use of a 20' x 20' site on the northwest corner of the Police and Courts building site (portion of Tract III, A.M. Downen Survey, A-415) for a communications equipment station for a lump sum of $1,500. ITEM NO. 8 AWARD OF BID NO. 040-01 Award of Bid No. 040-01 to Sprinkle 'N Sprout, 2708 Florence Road, Roanoke, Texas, City Council Minutes Page 4 of 8 May 8,2001 76262, for irrigation installation at South Euless Park, in the amount of $26,750, and to Irricon, P. O. Box 864162, Plano, Texas, 75086, for irrigation installation at J. A. Carr Park in the amount of $26,000. ITEM NO. 9 APPROVAL OF CITY COUNCIL MINUTES Approval of the minutes of the Regular City Council Meeting of April 24, 2001. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. REGULAR AGENDA ADDENDUM TO AGENDA BOARD AND COMMISSION APPOINTMENTS Council Member Miller motioned to make the following Board and Commission appointments: Crime Control and Prevention District Board Accepted resignation of Lou Baum and appointed Don Martin for a term to expire September 1, 2001. Euless Development Corporation Acknowledged that Council Member Bobby Baker's retirement created a vacancy on the Euless Development Corporation Board and accepted resignation of Council Member Charlie Miller and appointed Council Member Veva Lou Massey and Council Member Bob Edwards with terms to expire December 31, 2001. Library Board Appointed Marcia Brown, Toutai Kautai, Kate Lyon and Gracie Reyes as alternates with terms to expire December 31, 2001. Zoning Board of Adjustment Appointed Thomas Stover as Alternate 1 and Luther Dube as Alternate 2 with terms to expire December 31, 2001. ``" Council Member Hogg seconded the motion. ITEM NO. 10 APPROVAL OF SECOND AND FINAL READING OF ORDINANCE NO. 1471 Director of Planning and Development Mike Collins gave a brief overview of the project. In response to a question by Council Member Miller regarding the owners, Mr. Collins noted that the owner is John Wallace instead of Bill Wallace as stated in the January 9, 2001, minutes. Brian Cotter, 1805-C, W. Park Row Drive, Arlington, Texas, 76013, stated that John Wallace owns the dry cleaners, which is franchised through Comet Cleaners, and that John and Joyce Wallace, dba Shady Groves, Inc. will also own and operate the car wash. Council Member Hogg motioned to approve the second and final reading of Ordinance No. 1471 authorizing Specific Use Permit No. 01-02-SUP on Tracts 4B and 6C, S. Tucker Survey, A-1512, 801 East Mid-Cities Boulevard, for a car wash in C-2 (Community Business District) zoning. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1472 Mayor Pro Tern Tyson motioned to approve the first and final reading of Ordinance No. 1472 adding a new section 84-117 to Article IV, "Zoning District Regulations," of the Code of Ordinances establishing additional sign regulations for Euless Main Street with changes to the second sentence in the first paragraph under (a) Purpose and District Boundaries, to read as follows: "The boundaries are established as property abutting North Main Street between the center lines of South Pipeline Road and Glade Road or a sign located on an intersecting street, which sign is located within 300 feet of the nearest right-of-way line of Main Street." Council Member Hogg seconded the motion. ITEM NO. 12 TABLED PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 01-03-SUP AND ORDINANCE NO. 1473 City Manager Joe Hennig stated that staff was requesting items 12 and 13 be tabled because the Planning & Zoning Commission had tabled the items and they will be brought back for council consideration after the Planning & Zoning Commission has made a recommendation. City Attorney Paul Wieneskie noted that a new publication would be needed notifying the public of the date these items would be on the council agenda. Council Member Hogg motioned to table the public hearing and Ordinance No. 1473 for Specific Use Permit Case No. 01-03-SUP on a portion of Tract 1A3, A. Bradford Survey, Abstract No. 152, for a retirement center in CUD (Community Unit Development District) zoning, located at the southwest corner of Harwood Road and Bear Creek Parkway. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 13 TABLED PUBLIC HEARING FOR PLANNED DEVELOPMENT CASE NO. 01-10-PD AND ORDINANCE NO. 1474 Council Member Hogg motioned to table the public hearing and Ordinance No. 1474 for Planned Development No. 01-10-PD to change the zoning on a portion of Tract 1A3, A. Bradford Survey, Abstract No. 152, from CUD (Community Unit Development District) to Planned Development (based on R-5 Multi-Family High Density Dwelling District), located at the southwest corner of Harwood Road and Bear Creek Parkway. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 7 of 8 May 8,2001 ITEM NO. 14 PUBLIC COMMENT A citizen asked a question regarding the park area between Fuller-Wiser Road and Meadowview Addition. City Manager Hennig stated that it would be discussed in closed session, but so far the city has not found a document transferring ownership to the city for the area used as a park, although everyone involved remembers that was the intent. He stated that staff is continuing to work on a satisfactory resolution for the citizens adjacent to the area. ITEM NO. 15 REPORTS CITY MANAGER City Manager Joe Hennig welcomed Bob Edwards to the city council. He stated that Bobby Baker was a good friend and he served the council and city well. He noted that Mr. Baker had been honored at a farewell reception the previous Monday and stated that he will be missed. CITY ATTORNEY City Attorney Paul Wieneskie had nothing to report. 4■40/ STAFF REPORT There was no staff report. CITY COUNCIL Council Member Massey welcomed Council Member Edwards. She congratulated Public Works Field Tech Glen Boyett for receiving employee of the month. She stated she enjoyed the Employee Celebration report. Council Member Porterfield welcomed Council Member Edwards. He stated he was sorry to see Bobby Baker leave. He stated he was proud of city staff. He noted that Jon Snider was leaving and encouraged the parks staff to continue the good work that has been done at Texas Star. Council Member Miller congratulated Kevin Smith for conducting a good campaign in the City Council election. He also congratulated Glen Boyett as employee of the month, as well as Mayor Pro Tern Tyson on being selected Mayor Pro Tern. He welcomed Council Member Edwards. He noted that he had a friend come from Odessa to see the Temptations at Arbor Daze. Council Member Edwards thanked the citizens for electing him. He stated he and Kevin Smith became well acquainted on election day. He noted that he could not fill Bobby Baker's shoes and wished Bobby Baker well. He congratulated Glen Boyett. City Council Minutes Page 8 of 8 May 8,2001 Council Member Hogg stated he could not say enough about the dedicated employees �... of the City and stated he hated to lose Jon Snider at the golf course. He congratulated Council Member Edwards and Mayor Pro Tem Tyson. He noted that this year's Arbor Daze was the best. Mayor Pro Tem Tyson wished Bobby Baker well. He congratulated Council Member Edwards for being elected and Kevin Smith for the good campaign he conducted. He also congratulated Glen Boyett. He stated that Arbor Daze was a record breaker and congratulated Director of Community Services Rick Herold and his staff. He stated it was an honor to be elected mayor pro tem. Mayor Saleh stated she looked forward to working with Carl Tyson as mayor pro tem. She also noted that she enjoyed working with Council Members Hogg and Miller as mayor pro tem in the past. She welcomed Council Member Edwards. She stated she received a lot of good comments regarding Arbor Daze. ITEM NO. 15 RECONVENE CLOSED SESSION Mayor Saleh reconvened the council into closed session at 8:10 p.m. to deliberate real property and contemplated litigation as authorized by Section 551.071 and 551.072 of the Texas Government Code.
