HomeMy WebLinkAbout2001-10-23 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL OCTOBER 23, 2001 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:15 p.m. on Tuesday, October 23, 2001, in the Administration Building Conference Room. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Carl Tyson and Council Members Leon Hogg, Bob Edwards, Charlie Miller, Glenn Porterfield and Veva Lou Massey. Precouncil discussion was held on agenda items and other scheduled items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:05 p.m. for the consideration of scheduled items. INVOCATION Pastor Nick Wahl, Glade Crossing Baptist Church, gave the invocation. PLEDGE OF ALLEGIANCE Boy Scout Troop No. 253 led the Pledge of Allegiance. City Council Minutes Page 2 of 6 October 23,2001 ITEM NO. 1 PRESENTATION OF EMPLOYEE SERVICE PINS Director of Public Works Randy Byers introduced Public Works Superintendent Clyde Cullum and his wife Gail. Director of Fiscal and Administrative Services Loretta Getchell introduced Finance Office Tech Linda Free and her husband John and daughter Lisa Roberts and grandchildren Kaylynne and Blake. Police Chief Leonard Carmack introduced Police Corporal James Gordon and his fiancée Tracy Gable, and Police Officer John Haecker and his parents Kathy and Gary and brother Ben. Director of Community Services introduced Parks Field Tech Peni Sitani and his wife Salote and granddaughter Sitapeti Kogaika. Mayor Saleh presented Clyde Cullum with a 25-year service pin, Linda Free with a 20- year service pin, James Gordon and John Haecker with 5-year service pins, and Peni Sitani with a 10-year service pin. CONSENT AGENDA Council Member Hogg motioned to approve Consent Agenda items numbered 2 through 6 as follows: Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 2 AWARD OF BID NO. 053-01 Award of Bid No. 053-01 to Jefferson Pilot for Group Life Insurance in the amount of $47,423.40, and Long Term Disability Benefits in the amount of$41,599.52. ITEM NO. 3 APPROVAL OF RESOLUTION NO. 01-1112 Approval of Resolution No. 01-1112 endorsing, supporting and encouraging the passage by the voters of Texas of Proposition No. 15 "The Texas Mobility Fund" on the November 6th general election ballot. ITEM NO. 4 APPROVAL OF EXPENDITURE OF FUNDS FOR EMERGENCY REPAIR OF NORTH MAIN STREET WATER WELL Authorized the city manager to proceed with emergency rehabilitation of the Far North y.. Trinity Water Well by Layne-Texas, 5734 American Legion Road, Tyler, Texas, 75708- 9147 at an estimated expenditure of$92,254, with a ten percent contingency. City Council Minutes Page 3 of 6 October 23,2001 ITEM NO. 5 APPROVAL OF EXPENDITURE OF FUNDS FOR EMERGENCY PLUGGING OF HARWOOD ROAD WATER WELL Authorized the city manager to proceed with emergency plugging of Harwood Trinity Water Well by Layne-Texas, 5734 American Legion Road, Tyler, Texas, 75708-9147, in the amount of$29,450. ITEM NO. 6 APPROVAL OF CITY COUNCIL MINUTES Approval of the minutes of the Regular City Council Meeting of October 9, 2001. REGULAR AGENDA ITEM NO. 7 APPROVAL OF CONTRACT RENEWAL Council Member Edwards motioned to authorize the City Manager or Deputy City Manager to negotiate and execute a five-year contract renewal for the Plexar Service with Southwestern Bell, in the amount of $55,242 annually, with a one-time installation charge for the new police station in the amount of$7,162, for a total of$283,372. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 APPROVAL OF SECOND AND FINAL READING OF ORDINANCE NO. 1498 Council Member Edwards pointed out that the city is not approving the rates, only an extension of the franchise agreement. Council Member Miller motioned to approve the second and final reading of Ordinance No. 1498 extending the current AT&T Broadband Franchise agreement for the continued operation of a community antenna television system within the City of Euless, for 120 days from its current expiration date of December 11, 2001. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, and Massey `` Nays: Council Member Porterfield Mayor Saleh declared the motion carried. ITEM NO. 9 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1504 Council Member Hogg pointed out that the city will save approximately $114,000 in interest expense with this refunding of bonds. Council Member Hogg motioned to approve the first and final reading of Ordinance No. 1504 authorizing the issuance and sale of "City of Euless, Texas, Municipal Drainage Utility System Revenue Refunding Bonds, Series 2001". Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 10 PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 01-14- SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1503 Mayor Saleh opened the public hearing at 7:27 p.m. regarding Specific Use Permit No. 01-14-SUP on Lot 1, Block 1, Dorris Addition, for the Victorious Living Church, located at 501 North Main Street, Suite 107. Director of Planning and Development Mike Collins stated that the church is requesting use of the lease space of approximately 2,900 sq. ft. for three years. There will be a nursery during the services at 10:30 a.m. on Sunday and 7:30 p.m. on Wednesday, and the seating capacity will accommodate 75-100 people. The shopping center has allocated 32 parking spaces for the church's use. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:32 p.m. Council Member Edwards motioned to approve the first and final reading of Ordinance No. 1503 for Specific Use Permit No. 01-14-SUP on Lot 1, Block 1, Dorris Addition, for the Victorious Living Church, located at 501 North Main Street, Suite 107, with the following conditions: (1) the applicant remain as the pastor of the church; (2) the SUP is valid for one year. When the SUP is renewed, consideration will be given to a longer period of time; (3) worship services and related activities may take place on Sundays and Wednesday evenings; (4) the nursery may only be offered during the worship services and related activities; and (5) applicant will not object to the sale of alcohol in �... shopping center. ITEM NO. 11 PUBLIC COMMENT There was no public comments. ITEM NO. 12 REPORTS CITY MANAGER City Manager Joe Hennig stated that he could not say enough about the employees honored tonight. CITY ATTORNEY City Attorney Bob McFarland stated the requirement for candidates to disclose the source of campaign funding has been declared illegal according to a district court ruling. `" He also noted that the Texas Supreme Court overruled Judge Davis' redistricting plan and required him to rework and resubmit his plan. STAFF REPORT Fire Battalion Chief Jeff Morris gave an update regarding the city's State of Awareness and response to threats in the community. He said the city has been a part of a task force to address such issues for the past 12 years, and that they have close coordination with the airport and local hospitals. CITY COUNCIL Council Member Massey congratulated Public Works Superintendent Clyde Cullum, Finance Office Tech Linda Free, Police Corporal James Gordon, Police Officer John Haecker, and Parks Field Tech Peni Sitani on receiving their service pins. She thanked Fire Chief Lee Koontz and the fire department on the fire station open house. She also congratulated Communications/Marketing Manager Lori De La Cruz on a publication award she received. Council Member Porterfield congratulated Clyde Cullum, Linda Free, James Gordon, John Haecker, Peni Sitani, and Lori DeLaCruz stating he was impressed with the dedication shown by the city's employees. City Council Minutes Page 6 of 6 October 23,2001 Council Member Miller welcomed Reverend Ray of Victorious Living Church and stated that he voted against the specific use permit because he preferred commercial uses in the shopping center. He stated he participated in the Colleyville Heritage High School homecoming parade. He stated that the fire department did a great job on the fire station open house. Council Member Edwards congratulated Clyde Cullum, Linda Free, James Gordon, John Haecker, Peni Sitani, and Lori DeLaCruz stating he appreciated their efficiency. He stated his appreciation for the fire department report on the emergency management response. Council Member Hogg congratulated Clyde Cullum, Linda Free, James Gordon, John Haecker, Peni Sitani, and Lori DeLaCruz. He stated he attended the fire station open house as a volunteer and that there was a good crowd. He stated he would be going to Waco on Thursday for the award the parks department will received from the Texas Forestry Service regarding Arbor Daze. Mayor Pro Tern Tyson congratulated Clyde Cullum, Linda Free, James Gordon, John Haecker, Peni Sitani, and Lori DeLaCruz. He stated he also attended the fire station open house and that there were lots of children in attendance. He thanked Director of Fiscal and Administrative Services Loretta Getchell on the refunding of bonds, which brings the interest rate down from 6.84% to approximately 3%. He recognized Economic Development Director Bill Ridgway on the new businesses that have been opening in Euless recently. Mayor Saleh stated that the Euless Today magazine went out in the mail recently and includes the budget information. She stated she attended the Miss HEB Contest held at Trinity High School and welcomed the contestants. She stated that the Trinity High School Harmony choir sang and that Brooke Stout was crowned Miss HEB. She noted that the Halloween Thing will be held on October 31, from 6:00 p.m. to 8:00 p.m. on the city hall complex.
