HomeMy WebLinkAbout2002-11-26 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL NOVEMBER 26, 2002 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:05 p.m. on Tuesday, November 26, 2002, in the Administration Building Conference Room. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Carl Tyson and Council Members Leon Hogg, Charlie Miller, Glenn Porterfield, and Veva Lou Massey. Council Member Bob Edwards was absent. Precouncil discussion was held on agenda items and other scheduled items. Closed session was held to discuss contemplated litigation and personnel matters as authorized by Sections 551.071 and 551.074 of the Texas Government Code. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers, 201 N. Ector Drive, at 7:13 p.m. for the consideration of scheduled items. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR DECEMBER City Secretary Susan Crim introduced Secretary Karen Petty and her husband, Bill, and Mayor Saleh presented her with a plaque for being selected employee of the month for December. ITEM NO. 2 PRESENTATION OF EMPLOYEE SERVICE PINS Director of Public Works Ron Young introduced Public Works Field Tech Herbert Joseph and his girlfriend, Tambrina; Public Works Facilities Foreman Kenny Spargur and his wife, Kelly, and daughters, Kayla and Christa; Water Utilities Superintendent Paul Wrzesinski and his wife, Sharon, and children, Kaycie and Brady; and Waste Water Foreman Terry McGahey. Mayor Saleh presented 10-year service pins to Herbert Joseph and Kenny Spargur, 15-year service pin to Paul Wrzesinski, and a 20- year service pin to Terry McGahey. CONSENT AGENDA Council Member Miller motioned to approve Consent Agenda Items numbered 3 through 5. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 3 APPROVAL OF RESOLUTION NO. 02-1142 Approved Resolution No. 02-1142 designating Tarrant County Juvenile Services as the intended recipient of the city's allocated amount of the Juvenile Accountability Incentive Block Grant, and naming Steve Kockos to serve as a member of the Tarrant County/Fort Worth Juvenile Crime Enforcement Coalition. ITEM NO. 4 APPROVAL OF COMMUNICATION CENTER UPGRADE Authorized the city manager to negotiate and execute a contract with Motorola for "Gold Elite" communication equipment in the public safety communications center in the amount of$235,053. City Council Minutes Page 3 of 7 November 26,2002 ITEM NO. 5 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of November 12, 2002. REGULAR AGENDA ITEM NO. 6 TABLED ORDINANCE NO. 1561 Director of Planning and Development Mike Collins stated that Jerry Jenkins, who signed as owner on the Zoning District Change Application, telephoned city offices and asked that the zoning request be withdrawn. Since the developer was unable to attend the meeting and the developer's engineer who was present, was unaware of the request to withdraw, Council Member Hogg motioned to table Ordinance No. 1561 indefinitely regarding Zoning Case No. 02-04-ZC for a zoning change of a portion of Lot 22, Block 13, Morrisdale Estates, from R-1 (Single Family Detached Dwelling District) zoning to R-1 L (Single Family Limited Dwelling District) zoning, located on the south side of West Pipeline Road, opposite from where Forest Ridge Road dead ends. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 7 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 02-13-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1562 Mayor Saleh opened the public hearing at 7:33 p.m. regarding Specific Use Permit No. 02-13-SUP on Lot 1, Block 1, Dorris Addition, for Victorious Living Church in C-1 (Neighborhood Business District) zoning located at 501 N. Main Street, Suite 107. Director of Planning and Development Mike Collins stated that the request is a renewal of the specific use permit approved for Victorious Living Church in October 2001. He stated that it was the Planning and Zoning Commission's intent that the permit expire at the same time as the lease. Richard Ray, Pastor, 1812 Glade Road, Colleyville, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:35 p.m. Council Member Porterfield motioned to approve the first and final reading of Ordinance No. 1562 for Specific Use Permit No. 02-13-SUP on Lot 1, Block 1, Dorris Addition, for City Council Minutes Page 4 of 7 November 26,2002 Victorious Living Church in C-1 (Neighborhood Business District) zoning located at 501 N. Main Street, Suite 107, subject to the following: (1) Richard Ray remains as pastor; (2) SUP is valid for no more than two years and is tied to the expiration of the lease; (3) Worship services and related activities may take place on Sundays and Wednesday evenings; and (4) The nursery may only be offered during the worship services and related activities. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 02-14-SUP AND TABLED ORDINANCE NO. 1563 Mayor Saleh opened the public hearing at 7:37 p.m. regarding Specific Use Permit No. 02-14-SUP on Lot 1R, Block 1A, Morrisdale Square, for The Early Church in C-2 (Community Business District) zoning located at 4323 West Pipeline Road. Director of Planning and Development Mike Collins stated that the applicant, The Early Church, is seeking a specific use permit to operate a worship center at 4323 West Pipeline Road. The site has previously been used as a worship center. The church will occupy two suites totaling approximately 4,400 square feet, with 1400 square feet used as a children's play area. The church is averaging 37 attendees on Sundays. There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:38 p.m. Due to the applicant not being present to answer questions, Council Member Hogg motioned to table Ordinance No. 1563 to the December 10 city council meeting regarding Specific Use Permit No. 02-14-SUP for on Lot 1R, Block 1A, Morrisdale Square, for The Early Church in C-2 (Community Business District) zoning located at 4323 West Pipeline Road. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 5 of 7 November 26,2002 ITEM NO. 9 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 02-10-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1564 Mayor Saleh opened the public hearing at 7:43 p.m. regarding Specific Use Permit No. 02-10-SUP on Tract 3A3A, Samuel Tucker Survey, A-1512, for a gated townhome community in CUD 754 (Multi-Family Variable Densities) zoning located at 2740 Fuller- Wiser Road. Director of Planning and Development Mike Collins stated that the zoning already allows townhomes and the specific use permit is to allow a gated subdivision. The lots will range from 3,000 to 5,000 sq. ft. with homes ranging from 1,500 sq. ft. to 2,000 sq. ft. Mark DuPont, developer, 606 Jamboree Way, Euless, stated the project will be similar to Newport Villas. After discussion on the type of fencing and amount of stucco used, City Attorney Bob McFarland noted that the specific use permit is only to allow the development to be gated, since the townhomes meet all the zoning requirements and, therefore, stipulations could not be added. Council Member Miller motioned to approve the first and final reading of Ordinance No. 1564 regarding Specific Use Permit No. 02-10-SUP on Tract 3A3A, Samuel Tucker Survey, A-1512, for a gated townhome community in CUD 754 (Multi-Family Variable Densities) zoning located at 2740 Fuller-Wiser Road. ITEM NO. 10 APPROVAL OF SITE PLAN NO. 02-04-SP Council Member Hogg motioned to approve Site Plan No. 02-04-SP as presented for a gated townhome community on Tract 3A3A, Samuel Tucker Survey, A-1512, located at 2740 Fuller-Wiser Road. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None City Council Minutes Page 6 of 7 November 26,2002 Mayor Saleh declared the motion carried. ITEM NO. 11 PUBLIC COMMENTS Billy Owens thanked the city council for keeping the trash service with the same providers and service. ITEM NO. 12 REPORTS CITY MANAGER City Manager Joe Hennig stated he was thankful for many things this year, including: the car rental funds; HEB Harris Hospital; Super Value Pharmacy and the good job Pete Allen and his employees do; City Secretary Susan Crim; the finest team of directors; Deputy City Manager Gary McKamie who is a great partner; his family; three grandchildren; all the employees; city council; citizens; and he sent best wishes to Ray Saleh for improved health soon. CITY ATTORNEY City Attorney Bob McFarland stated he was thankful to be a part of the city. He noted his firm has been city attorney since incorporation and he has been the city attorney for almost 35 years. STAFF REPORT There was no staff report. CITY COUNCIL Council Member Massey stated she appreciated Mayor Saleh and her prayers are with Ray. She stated she is thankful for all the council members, her family and citizens. She congratulated Karen Petty for being selected employee of the month. She also congratulated Herbert Joseph, Terry McGahey, Kenny Spargur, and Paul Wrzesinski on receiving their service pins. She stated she had a great time at the senior's luncheon. Council Member Porterfield extended congratulations to Karen Petty, Herbert Joseph, Terry McGahey, Kenny Spargur, and Paul Wrzesinski. He attended the senior's luncheon, and stated he is thankful to be on the City Council. Council Member Miller congratulated Karen Petty, Herbert Joseph, Terry McGahey, Kenny Spargur, and Paul Wrzesinski, stating the employees in public works never get enough recognition. Council Member Hogg also congratulated the employees and said he could not say enough good things about all of the employees. He stated he enjoyed the senior's luncheon. He said that he is thankful for the VA Hospital because he recently learned he is diabetic. He attended the Citizens Fire Academy graduation. He stated his prayers were with Ray Saleh. City Council Minutes Page 7 of 7 November 26,2002 Mayor Pro Tern Tyson requested staff revisit the stucco and rock masonry ••- requirements. He congratulated Karen Petty stating that she really does a good job and is a friendly person. He also congratulated Herbert Joseph, Terry McGahey, Kenny Spargur, and Paul Wrzesinski. He stated he is thankful for all the city staff. He attended the Mayors Conference on Transportation for Mayor Saleh and attended the Library Foundation Fundraiser, which raised approximately $21,000. He also attended the Rockettes at NextStage and stated his prayers were with Ray and Mayor Saleh. Library Administrator JoAnn Rogers reported that a lady recently visited the Library and brought in the keys and title for a 2000 Nissan Altima to be donated to the Library. Mayor Saleh stated she attended the 16th Citizens Police Academy graduation. She stated that the casino night was a plus for the Library Foundation, which is working towards an art project of glass flowers for the south window in the library. She stated the Euless Today will be delivered this week and urged citizens to read the magazine. She announced that IceFest will be Saturday, November 30, and the Christmas Parade of Lights will be Saturday, December 7. She noted that a city employee designed the ornament being sold for the city's 50th Anniversary celebration. She stated that citizens could call Terri Goines to reserve their ornament at a cost of$15.00.
