HomeMy WebLinkAbout2003-09-23 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL SEPTEMBER 23, 2003 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:10 p.m. on Tuesday, September 23, 2003, in the City Council Chambers, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Carl Tyson, Council Members Leon Hogg, Charlie Miller, Glenn Porterfield, and Veva Lou Massey. Council Member Bob Edwards was absent. Precouncil discussion was held on agenda items and other scheduled items. Closed session was held to discuss pending litigation on Grace Community Church and the Dickey Apartments, as authorized by Section 551.071, of the Texas Government Code. The Council recessed for dinner at 6:25 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:03 p.m. for the consideration of scheduled items. City Council Minutes Page 2 of 7 September 23,2003 INVOCATION Mayor Saleh gave the invocation. PLEDGE OF ALLEGIANCE Cub Scout Pack#253 led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR OCTOBER Director of Parks and Community Services Ray McDonald introduced Recreation Center Supervisor Randy Smith and Mayor Saleh presented Randy with a plaque for being selected employee of the month for October. ITEM NO. 2 PRESENTATION OF EMPLOYEE SERVICE PINS Director of Public Works Ron Young introduced Public Works Equipment Operator Glen Boyett and Public Works/Engineering Administrative Secretary Cynthia Daniel. Director of Parks and Community Services Ray McDonald introduced Urban Forester Ralph Klein, his wife, Shelly, and children, Christopher, Bryan, Shawn, and Sara. Police Chief Leonard Carmack introduced Police Sergeant Eric Starnes, his wife, Stephanie, and Police Records Clerk Rona Owen and her husband, Jim. Police Chief Carmack noted that CID Office Technician Michelle Hastings was unable to attend the meeting to receive her 15-year pin. Glen Boyett and Ralph Klein each received 5-year service pins, Cynthia Daniel and Eric Starnes each received 10-year pins, and Rona Owen received a 15-year pin. ITEM NO. 3 PRESENTATION OF CERTIFICATES OF APPRECIATION Director of Parks and Community Services Ray McDonald introduced Randy Marsh, job coordinator, and Mandy Miller, job coach, of the Hurst-Euless-Bedford Summer Youth Work Program. Mr. Marsh explained that students, Elizabeth Leonard, Jonathan Richardson, and Bert Dixon participated by planting the tree seedlings for trees given away at Arbor Daze, as well as performing work in the city's parks. Mayor Saleh presented Certificates of Appreciation to Randy Marsh, Mandy Miller, and Elizabeth Leonard. Mayor Pro Tern Tyson presented a Certificate of Appreciation to Jonathan Richardson. Randy Marsh indicated that Bert Dixon was unable to attend the meeting. ITEM NO. 4 PRESENTATION OF PROCLAMATION Mayor Saleh read the proclamation designating September 28, 2003, as National Good Neighbor Day. She noted that she will present the proclamation to the senior citizens later in the week. City Council Minutes Page 3 of 7 September 23,2003 ‘4.. CONSENT AGENDA Council Member Porterfield motioned to approve Consent Agenda Items numbered 5 through 9: Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 5 REJECTION OF ALL BIDS RECEIVED FOR BID NO. 023-03 Rejected all bids received for Bid No. 023-03 for office supplies and authorized the city manager to join the U.S. Communities contract with Office Depot for office supplies. ITEM NO. 6 APPROVAL OF INTERLOCAL AGREEMENT Approved an interlocal agreement for participation at the rate of $52 per household in 'taw Fort Worth's Environmental Collection Center Household Hazardous Waste Collection program from October 1, 2003, through September 30, 2004. This includes year-round access for residents to the Environmental Collection Center on Bridge Street in Fort Worth, at city hall once in the spring, and once in the fall when the city schedules the Crud Cruiser. ITEM NO. 7 AMENDED INTERLOCAL AGREEMENT WITH NORTHEAST TRANSPORTATION SERVICES URBAN TRANSIT DISTRICT Amended the interlocal agreement with the Northeast Transportation Services Urban Transit District (NETSUTD) to provide for $.50 per capita annual contribution. ITEM NO. 8 APPROVAL OF RESOLUTION NO. 03-1157 Approved Resolution No. 03-1157 authorizing the city manager or his designee to execute an electric supply agreement pursuant to the contract to be signed by Cities Aggregation Power Project, Inc., for deliveries of electricity effective January 1, 2004. ITEM NO. 9 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of September 9, 2003. City Council Minutes Page 4 of 7 September 23,2003 REGULAR AGENDA ITEM NO. 10 PUBLIC HEARING AND APPROVAL OF SECOND AND FINAL READING OF ORDINANCE NO. 1599 Mayor Saleh opened the public hearing at 7:27 p.m. regarding Ordinance No. 1599 extending the current franchise of Oncor Electric Delivery Company for six months from its current expiration date of October 30, 2003, to April 30, 2004, for the continued operation of delivery of electricity. Director of Economic Development Bill Ridgway stated the extension allows Hurst, Euless, Bedford, and Oncor time to negotiate a new franchise agreement. There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:28 p.m. Council Member Massey motioned to approve the second and final reading of Ordinance No. 1599 extending the current franchise of Oncor Electric Delivery Company for six months from its current expiration date of October 30, 2003, to April 30, 2004, for the continued operation of delivery of electricity. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 APPROVAL OF A TEMPORARY USE PERMIT - SEASONAL Director of Planning and Development Mike Collins stated that Key Ministries is requesting a temporary use permit for their Fall Festival Saturday, October 11. Parking will be at Central Junior High and the Sotogrande Tennis Courts. Council Member Miller motioned to approve a temporary use permit for a Fall Festival on Tract 3A1 and a 30 ft. strip of Tract E, Hinson McCoy Survey, A-1073, 3201 West Pipeline Road, on October 11, 2003, from 10:00 a.m. to 8:00 p.m., subject to staff verifying use of parking lots at Central Junior High and Sotogrande Tennis Courts. Mayor Pro Tern Tyson seconded the motion. ITEM NO. 12 PUBLIC HEARING FOR PLANNED DEVELOPMENT NO. 03-03-PD AND ORDINANCE NO. 1604 Mayor Saleh stated that the applicant, Carmelia Barbul, had withdrawn the request for Planned Development No. 03-03-PD changing the zoning on Lot 1-R, Block 2, Arnett Addition, 220 South Main Street, from R-1 (Single Family Detached Dwelling District) to PD (Planned Development). ITEM NO. 13 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1605 Council Member Hogg motioned to approve the first and final reading of Ordinance No. 1605 amending Section 86-32, "Delinquency and Service Discontinuance Procedure", of Article II, "Water and Sanitary Sewer Systems", of Chapter 86 "Utilities", of the Code of Ordinances authorizing the city to impose a lien against non-homestead property for delinquent bills for municipal utility service to that property. Council Member Porterfield seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 14 APPROVAL OF RESOLUTION NO. 03-1158 Council Member Miller motioned to approve Resolution No. 03-1158 nominating John Clanton for the Tarrant Appraisal District Board of Directors for a two-year term beginning January 1, 2004. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 15 PUBLIC COMMENTS David Scott, 1802 Toplea, addressed the council regarding various safety issues in the Wilshire area. City Council Minutes Page 6 of 7 September 23,2003 Alex Horton, 806 Little Creek, addressed the council about the need for a 4-way stop �.. sign at North Main Street and Denton Drive during the construction. Lorein Cuevas, 115 Stoney Creek, supported the request for a 4-way stop sign, but did not want to speak. Ji Sohn, 911 Waterford Way, addressed the council regarding the constant noise of trucks behind the Kroger shopping center adjacent to her residence. ITEM NO. 16 REPORTS STAFF REPORT Recreation Manager Suzanne Hendrickson presented the end of summer recreation report. She also noted that the City of Euless won an award from the Texas Amateur Athletic Federation (TAAF) for hosting the 2003 Games of Texas. Director of Parks and Community Services Ray McDonald presented Suzanne Hendrickson the President's Excellence award she received from the Texas Amateur Athletic Federation. Ray also noted that Suzanne is the director of gymnastics for the TAAF. Director of Parks and Community Services Ray McDonald mentioned that the VCR tapes given to city council were the 50th Anniversary Celebration program held at Arbor Daze. CITY MANAGER Deputy City Manager Gary McKamie stated that notes have been made regarding citizen concerns expressed tonight and staff will look into the situations. He noted that David Scott is the son of Wes Scott. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. CITY COUNCIL Mayor Pro Tem Tyson congratulated Recreation Center Supervisor Randy Smith, Public Works/Engineering Administrative Secretary Cynthia Daniel, Public Works Equipment Operator Glen Boyett, Urban Forester Ralph Klein, Police Sergeant Eric Starnes, and Police Records Clerk Rona Owen. He complimented Randy Marsh on the good job he does with the children in the Summer Youth Work Program. He stated his appreciation for the citizens' comments, and thanked Recreation Manager Suzanne Hendrickson for all she does. Council Member Hogg thanked all the employees for their time and services. City Council Minutes Page 7 of 7 September 23,2003 Council Member Miller stated that Euless has a special group of employees, and that no �•- one hosts events better than Euless. He thanked the citizens for their comments. Council Member Porterfield stated it was always fun to hear reports from parks and recreation, and our staff is very fortunate to benefit from the citizens who volunteer. Council Member Massey complimented Jerry Poteet on the banquet he held as appreciation for volunteers. She thanked Randy Smith on how well the Midway Recreation Center is kept. She also congratulated Cynthia Daniel, Glen Boyett, Ralph Klein, Eric Starnes, Rona Owen, Suzanne Hendrickson and the participants of the HEB Summer Youth Work Program. She noted that Good Neighbor Day is September 28. Mayor Saleh stated that Kathy Haecker's report on the Crime Victim's Assistance Program during precouncil was very interesting, and she thanked all of the city's employees stating they make the council members look good. She stated the Euless Library Foundation had a wonderful program supporting the proposed artwork, and noted that Casino Night will be held in November.
