OCTOBER 28, 2003
CALL TO ORDER
A regular meeting of the Euless City Council was called to order by Mayor Mary Lib
Saleh at 4:10 p.m. on Tuesday, October 28, 2003, in the City Council Chambers, 201 N.
Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Carl
Tyson, Council Members Leon Hogg, Bob Edwards, Charlie Miller, Glenn Porterfield,
and Veva Lou Massey. Precouncil discussion was held regarding the Pipeline Road
reconstruction project update, Governmental Accounting Standards Board (GASB) audit
presentation, final tax roll review, and items on the agenda. Closed session was held to
discuss pending litigation on Grace Community Church, as authorized by Section
551.071 of the Texas Government Code. The Council recessed for dinner at 6:20 p.m.

presented Linda with a plaque for being selected as employee of the month for
November.

Edgar Hurtado and Michael Renaker both received 5-year service pins, Betty Thomas
received a 10-year service pin, Zella Stierwalt received a 15-year service pin, Carolyn
Hoots received a 25-year service pin, and Wayne Britt received a 30-year service pin.
Mayor Saleh noted that Senior Police Officer Scott Peterson was unable to attend the
meeting to receive his 10-year service pin.
CONSENT AGENDA
Council Member Porterfield motioned to approve Consent Agenda Items numbered 3
through 6.
Council Member Hogg seconded the motion.

Porterfield, and Massey
Nays: None
Mayor Saleh declared the motion carried.
ITEM NO. 3 APPROVAL TO PURCHASE
`.. Approved the purchase of a Cues pan and tilt color camera, camera controller,
transporter, and DataCap 4.0 system software and hardware from Renfro Equipment &
Supplies, P. O. Box 162403, Fort Worth, Texas, 76161, in the amount of $48,189. The
purchase is being made through the Texas Local Government Purchasing Cooperative.
ITEM NO. 4 AWARD OF BID NO. 027-03
Awarded Bid No. 027-03 to EZ-Go Southwest, 745 Hurst Blvd., Hurst, Texas, 76053 for
the purchase of 85 four-wheeled electric and gas golf cars for the Texas Star Golf
Course in the amount of $126,500. EZ-Go Southwest will also provide the use of up to
20 tournament cars during the month of October, at no charge, for a 3-year period
beginning October, 2003.
ITEM NO. 5 APPROVAL OF PAYMENT TO TXDOT
Approved the payment of $28,208 to the Texas Department of Transportation (TXDOT)
for the reconstruction of South Pipeline Road bridge over Hurricane Creek. The
estimated project cost is $328,000, of which the City of Euless will be responsible for
$32,800. The advanced funding agreement was approved by Resolution No. 02-1126
on June 25, 2002. The agreement required a contribution of $4,592 for preliminary
engineering within 30 days after execution of the agreement. The City of Euless has
paid the $4,592, and the balance of the city's contribution ($28,208) is payable 45 days
prior to the date set for receipt of bids and is currently due. The project is scheduled for
bidding on December 4, 2003.

ITEM NO. 6 APPROVAL OF CITY COUNCIL MINUTES
Approved the minutes of the Regular City Council Meeting of October 28, 2003.
Council Member Miller noted that the city is only paying 10% of the cost on the
reconstruction of South Pipeline Road bridge.
Mayor Pro Tern Tyson stated that Texas Star staff did a great job on the golf car bids.
REGULAR AGENDA
ITEM NO. 7 PUBLIC HEARING AND APPROVAL OF FIRST AND FINAL
READING OF ORDINANCE NO. 1609
Mayor Saleh opened the public hearing at 7:27 p.m. regarding the first and final reading
of Ordinance No. 1609 amending "Table 4-A Permitted Primary Uses" and "Exhibit A
`TX-121' 121 Gateway District Use Table", of Section 84-84, "Permitted Uses Table",
and Section 84-85, "Special Conditions by Use Type", of Chapter 84, of the Unified
Development Code of the Code of Ordinances to allow churches and other places of
worship as permitted uses in residential zoning districts; establishing minimum and
maximum lot size and single story and maximum height requirements for churches and
other places of worship in single family and duplex residential zoning districts.
b.. Director of Planning and Development Mike Collins stated that, currently, specific
assembly uses, including churches, are not a permitted use by right in any zoning
district. Instead, these land uses are permitted in certain zoning districts with a specific
use permit. After conducting an analysis to ensure that assembly uses are dealt with
fairly and consistently, staff recommends that churches be a permitted land use in the
following residential zoning districts: R-1 C, R-1, R-1 L, R-1A, R-2, R-3, TH, R-4, and R-
5. Section 84-85, "Special Conditions by Use Type", is being amended to establish two
conditions: (1) 50,000 sq. ft. minimum lot size with 5-acre maximum lot sizes in land
zoned for one- or two-family dwellings; and (2) any structures located within 25 feet of
land zoned for one- or two-family dwellings are limited to a single story. A maximum
height of 35 feet is allowed, provided all yards are increased an additional foot for each
foot the building exceeds 25 feet. The minimum lot size would ensure that off-street
parking requirements could be satisfied.
Mike Collins stated that other assembly uses, including churches, non-profit
organizations, museums, zoos, botanical gardens, general motion pictures, drive-in
motion pictures, bowling centers, dance halls, studios, membership sports and
recreation clubs, would be permitted land uses only after obtaining a specific use permit
in the following zoning districts: C-2, TX-10, LI, I-1, 1-2, and TX-121. Adult motion
pictures would only be permitted with an SUP in 1-2.
Mayor Saleh asked for any proponents. There being none, Mayor Saleh asked for any
opponents. There being none, Mayor Saleh closed the public hearing at 7:32 p.m.
Council Member Edwards inquired about the setbacks required in a residential area.
He also asked how the 50,000 sq. ft. lot minimum was determined.

Mike Collins stated that the setback is determined by the residential zoning where the
church is located. He stated that staff looked at locations in the community that could
be utilized as a church and, after evaluation, determined that a typical size building of
7,000 with 34-35 parking spaces would require a minimum lot size of 50,000 sq. ft.
Council Member Miller stated the concern in the residential area would be parking.
Mike Collins stated that parking is based on the size of the sanctuary. Currently,
requirements are one parking space for every four seats.
Council Member Porterfield stated that Table 4A in the ordinance needed amending to
indicate that churches would be allowed in the Townhome district.
Mike Collins confirmed that churches are a permitted use in the Townhome district and
the table would be amended.
Council Member Miller motioned to approve the first and final reading of Ordinance No.

Mayor Saleh declared the motion carried.
Council Member Edwards stated that although he voted to approve the ordinance, he is
concerned with the 50,000 sq. ft. minimum requirement. He stated that it is a lot of
space to be required for a small church just starting out. He wanted to see if there is a
way to tie the square footage to the size of the sanctuary, so that a smaller church with
10-12 parishioners would not have to start out with a 7,000 sq. ft. size building.
City Manager Joe Hennig stated that an option would be planned development zoning.
ITEM NO. 8 PUBLIC COMMENTS
Jack Weiss, 518 E. Ash Lane, addressed the council regarding the deteriorating
condition of the trails in Bear Creek Park.

Mayor Saleh directed Mr. Weiss to speak with Director of Parks and Community
... Services Ray McDonald and City Manager Joe Hennig, and thanked him for bringing it
to the council's attention.
ITEM NO. 9 REPORTS
CITY MANAGER
City Manager Joe Hennig stated that staff is also concerned about the erosion of the
trails and noted that correction could cost $14 million. He congratulated Linda Minor on
receiving employee of the month, noting that it was a great accomplishment. He also
congratulated Edgar Hurtado, Michael Renaker, Betty Thomas, Zella Stierwalt, Carolyn
Hoots, and Wayne Britt on receiving their service pins.
CITY ATTORNEY
City Attorney Bob McFarland explained the open meetings act and stated that the city
council members could not address Mr. Weiss' concerns, as it was not an item on the
posted agenda.
STAFF REPORT
There was no staff report.
CITY COUNCIL
Mayor Pro Tem Tyson congratulated Linda Minor, Edgar Hurtado, Michael Renaker,
Betty Thomas, Zella Stierwalt, Carolyn Hoots, and Wayne Britt, stating it indicates how
good the employees are. He stated there is a new car dealership in town, and that the
council helped move Baillargeon Audi cars from Grapevine to Euless. He attended the
Trinity High School vs. Grapevine High School football game and noted that Trinity won.
Council Member Hogg stated he could never say enough good things about employees,
stating he remembered when Wayne Britt was made captain. He stated he represented
Euless at the City of Elgin Hogeye Festival last weekend.
Council Member Miller stated that Rick Herold was honored recently as the first person
selected to be placed in the Walk of Champions at the Parks at Texas Star. He stated
that he, Gary McKamie and Council Member Massey attended the Masonic Lodge
ceremony honoring Jimmy Payton, Billy Byers, Robert Nail, Sam Harrington, Alton Ray,
and Billy Joe Wilcox who have been members for 50 years.
Council Member Porterfield extended his congratulations to the employees honored
tonight, noting that October must have been a great month for hiring employees over
the years. He stated that he was pleased to see Rick Herold honored and that he
enjoyed the employee hamburger cookout.

Council Member Massey stated her dad was a Mason. She noted she missed the fire
`.. department open house, but understood there was a great crowd.
Mayor Saleh stated her dad was also a Mason. She attended the fire department open
house last weekend. She reminded everyone to attend the Veterans Field dedication
on November 8, and that over 500 veterans have been invited to attend.
ITEM NO. 10 CLOSED SESSION
Mayor Saleh convened into closed session at 7:54 p.m. to discuss pending litigation on
Dickey Apartments, as authorized by Section 551.071 of the Texas Government Code.
ITEM NO. 11 ADJOURNMENT
Mayor Saleh reconvened the meeting into open session and the meeting was adjourned
at 8:52 p.m.
