MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL JANUARY 13, 2004 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:05 p.m. on Tuesday, January 13, 2004, in the pre-council room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Carl Tyson, Council Members Leon Hogg, Bob Edwards, Charlie Miller, Glenn Porterfield, and Veva Lou Massey. Precouncil discussion included a report by Planning and Development Manager Eric Wilhite on the 30th Year CDBG Project proposal; a report from Director of Parks and Community Services Ray McDonald on funding for Phase III of the Parks at Texas Star; and a review of agenda items. Closed session was held to discuss economic development negotiations for property located at FM 157 and SH 183 and Bennett property development, as authorized by Section 551.087; pending litigation of Dickey Apartments and Grace Community Church, as authorized by Section 551.071; real property regarding Lots 7 and 8, Ross Cannon Addition, as authorized by Section 551.072; and personnel matters as authorized by Section 551.074, of the Texas Government Code. The Council recessed for dinner at 6:25 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:04 p.m. for the consideration of scheduled items. INVOCATION Pastor Scott Fisher, Metroplex Chapel, gave the invocation. PLEDGE OF ALLEGIANCE Girl Scout Troop #1501 lead the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE YEAR - 2003 Director of Parks and Community Services Ray McDonald introduced Parks Manager Johnnie Green and his wife, Elaine, and Mayor Saleh presented Johnnie with a plaque for being selected employee of the year for 2003. ITEM NO. 2 PRESENTATION OF EMPLOYEE OF THE MONTH FOR JANUARY Library Administrator JoAnn Rogers introduced Library Computer Specialist Becky Moren, her husband, Gene, daughter, Jennifer, son, Grant, and parents, Lanny and June Partin. Mayor Saleh presented Becky with a plaque for being selected employee of the month for January. ITEM NO. 3 PRESENTATION OF CERTIFICATE OF RECOGNITION Eagle Scout Pauliasi Falahola introduced his mother and sister, and Mayor Saleh presented him with a Certificate of Recognition for attaining the rank of Eagle Scout. CONSENT AGENDA Council Member Hogg motioned to approve Consent Agenda Items numbered 4 through 7. Council Member Edwards seconded the motion. ITEM NO. 4 APPROVAL FOR POLICE DEPARTMENT TO PURCHASE IN-CAR VIDEO SYSTEMS FOR POLICE PATROL VEHICLES Approved purchase of 14 in-car video systems for police patrol vehicles from Mobile Vision In-Car Video Systems through a state contract, in the amount of $41,146, to be paid from the 2002 and 2003 Local Law Enforcement Block Grants. ITEM NO. 5 AWARD OF BID NO. 011-04 Awarded Bid No. 011-04 to C. Green Scaping, L.P., 8917 Cardinal Lane, North Richland Hills, Texas, 76180, for the irrigation project at West Park in the amount of $39,700, and authorized the city manager to execute the contract. ITEM NO. 6 APPROVAL OF RESOLUTION NO. 04-1165 Approved Resolution No. 04-1165 authorizing the filing of an application with the North Central Texas Council of Governments (NCTCOG) for a regional solid waste local project funding program to develop and distribute educational materials to expand the existing recycling program. �.. ITEM NO. 7 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of December 9, 2003. REGULAR AGENDA ITEM NO. 8 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1619 Council Member Massey motioned to approve the first and final reading of Ordinance No. 1619 establishing an ad valorem tax limitation as authorized and defined by the Texas Constitution, Article VIII, Section 1-b, and the Texas Tax Code, Section 11.261 on residential homesteads of the disabled and persons sixty-five (65) years of age or older and their spouses beginning with tax year 2004. Council Member Porterfield seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None ``" Mayor Saleh declared the motion carried. City Council Minutes Page 4 of 8 January 13,2004 ITEM NO. 9 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. Nom, 1620 Director of Planning and Development Mike Collins stated that the San Marino Villas Homeowners Association submitted a petition requesting the city extend specific traffic rules that apply to roads owned by the city to the roads within their subdivision. Council Member Miller motioned to approve the first and final reading of Ordinance No. 1620 extending certain specified traffic rules that apply to roads owned by the City of Euless to the roads in the San Marino Villas Addition on petition by the governing body of the entity that maintains the roads in said subdivision. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 10 INSTRUCT CITY MANAGER TO TAKE APPROPRIATE ACTION REGARDING PARKS AT TEXAS STAR PHASE III CONSTRUCTION No action was taken on this item. ITEM NO. 11 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1621 Council Member Miller motioned to approve the first and final reading of Ordinance No. 1621, amending the budget for fiscal year beginning October 1, 2003, and ending September 30, 2004, to provide $200,000 additional funding from the Car Rental Tax Fund for the completion of the Parks at Texas Star Phase III. Council Member Hogg seconded the motion. Council Member Porterfield requested to amend the motion with the stipulation that staff continue to seek funds in the amount of $200,000, from the Texas Rangers, as previously pledged, and that any funds received be repaid to the Car Rental Tax Fund. Council Members Miller and Hogg agreed to the amendment. Council Member Miller stated that, although he is opposed to the amendment, he is accepting the amendment because he knows the majority of the council is in agreement. He stated that when you shake hands and make an agreement, the agreement should be honored. He doesn't believe the Texas Rangers honored their agreement. ITEM NO. 12 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 03-19-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1622 Mayor Saleh opened the public hearing at 7:35 p.m. for Specific Use Permit No. 03-19- SUP on Tracts A, B, and C, Wilshire Village Shopping Center, for Restoration Church in TX-10 (Texas Highway 10 Multi-Use District) zoning located at 1350 West Euless Boulevard. Director of Planning and Development Mike Collins stated that Ken Harp, Executive Pastor of Restoration Church, is requesting renewal of the specific use permit. He stated that the original specific use permit had conditions attached, all of which have been completed except the fire lane improvements. Mayor Saleh asked for any proponents. Ken Harp, Executive Pastor of Restoration Church, 1350 W. Euless Blvd., Euless, stated they acquired the property in 1998 and have made extensive renovations of the property, and requested approval of the specific use permit. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:40 p.m. Several council members had questions regarding whether the church had the reserves when they planned to replace the fire lanes, and whether Pastor Harp had any problem with limiting retail uses to incidental church related functions. Ken Harp stated that the church did not have the reserves to replace the fire lanes and would have to borrow or have a concerted effort to raise the funds. He stated that the Fire Marshal and Planning and Zoning Commission did not stipulate a time frame, but he agreed to replace any failed areas with concrete as they fail. Mr. Harp stated he did not have a problem with limiting retail to incidental church related functions, and noted that the laundromat's lease will expire at the end of the year and will not be renewed. Mayor Pro Tem Tyson motioned to approve the first and final reading of Ordinance No. 1622 for Specific Use Permit No. 03-19-SUP on Tracts A, B, and C, Wilshire Village Shopping Center, for Restoration Church in TX-10 (Texas Highway 10 Multi-Use District) zoning located at 1350 West Euless Boulevard with the following conditions: City Council Minutes Page 6 of 8 January 13,2004 (1) Exclude retail and wholesale uses except operations incidental to church functions; (2) Limited to Restoration Church congregation; (3) Building identified as #3 on site plan remain under the TX-10 zoning with the required parking spaces; and (4) Fire lanes replaced with concrete as they fail or as directed by the fire marshal. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 13 APPROVAL OF RESOLUTION NO. 04-1164 Council Member Porterfield motioned to approve Resolution No. 04-1164 declaring a public necessity for the acquisition of two parcels of real estate, Lots 7 and 8, of Ross Cannon Addition, required for the construction of a fire station at the southwest corner of South Main Street and Ross Avenue, and authorized the mayor to take such actions as necessary to acquire such property. Mayor Pro Tem Tyson seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 14 PUBLIC COMMENTS Dora Watson addressed the council regarding traffic problems at the light on FM 157 and Trojan Trail and the ingress/egress of the shopping center on the west side of FM 157. She also asked when Pipeline Road was going to be finished. City Manager Joe Hennig stated that West Pipeline Road from Central Drive to SH 10 will begin construction in the fall. He noted that South Pipeline Road belongs to Fort Worth except the portion along Texas Star that was annexed into the City of Euless with the construction of the golf course. Jack Rose, 212 South Main Street, questioned if the property proposed for the new fire station had been rezoned for that use. Deputy City Manager Gary McKamie stated that the purchase of the property is contingent upon approval of the specific use permit. He noted that property owners within 200 feet will be notified when the specific use permit goes before the Planning and Zoning Commission for consideration. Boyce Byers and Eric Owens both stated their appreciation for the council support of the irrigation project in West Park and approval of funding the Parks at Texas Star Phase III. Boyce Byers stated that she opposed putting any reimbursement from the Texas Rangers back into the Car Rental Fund. She stated it should be used for additional improvements to the Parks at Texas Star. George Watkins stated he is really impressed with the Euless Police and Fire departments and expressed his appreciation for the council's caring attitude. ITEM NO. 15 REPORTS Mayor Saleh read the names of the citizens who were present at the meeting in favor of the tax limitation for seniors and disabled, but who did not wish to speak: Joyce and Walter Whitaker, Jack and Corenne Hill, Billie McMillan, Dora Watson, Jean Bullard, Betty Chamberlin, Shirley Holley, and Bob Perry. CITY MANAGER City Manager Joe Hennig had nothing to report. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. STAFF REPORT There was no staff report. CITY COUNCIL Council Member Massey congratulated Johnnie Green for being selected employee of the year and Becky Moren for being selected employee of the month. She stated the first town hall meeting was great and noted the next town hall meetings will be January 22, and February 5. She stated a pamphlet regarding homeland security is being distributed at the meetings. Council Member Porterfield congratulated Johnnie Green and Becky Moren. He also congratulated Pauliasi Falahola for receiving his Eagle Scout badge. He thanked Fire Chief Koontz and the Fire Department for their quick response and good care last week when he called 911. He was having chest pains which turned out to be gall bladder and had surgery the next day. Council Member Miller also congratulated Becky Moren and Johnnie Green. He spoke at the employee Christmas lunch and stated he appreciates the employees and wonderful staff. He attended the Heritage Park Christmas event and said it was an enjoyable evening. He thanked the senior citizens for attending and staying for the entire council meeting. City Council Minutes Page 8 of 8 January 13,2004 Council Member Edwards stated his appreciation for Johnnie Green, Becky Moren, and ,w Pauliasi Falahola. He stated he attended the town hall meeting and the presentations were good. He encouraged the audience to attend the upcoming town hall meetings. He noted that he and several other council members attended the National League of Cities Conference recently in Nashville, and noted that Euless is doing great compared to many other cities. He noted that completion of the first phase of North Main Street construction is getting close. Council Member Hogg congratulated Johnnie Green and Becky Moren, noting that he has known Johnnie for 20 years. Mayor Pro Tern Tyson stated that Johnnie Green is very deserving of being selected employee of the year. He also congratulated Becky Moren. He stated that he is on the Regional Transportation Committee representing HEB, Grapevine and Trophy Club, and that they have completed the 2025 plan. He noted there is a $20 billion shortage in area road needs. Mayor Saleh noted that Council Member Porterfield's birthday was last week. She stated her appreciation for Johnnie Green, Becky Moren, and Pauliasi Falahola. She mentioned the compliments received regarding the City of Euless Christmas tree, including one in the Cheers column of the Star Telegram. She said she also attended the National League of Cities Conference in Nashville and it was an excellent conference.
