HomeMy WebLinkAbout2004-04-13 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL APRIL 13, 2004 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:10 p.m. on Tuesday, April 13, 2004, in the pre-council room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Carl Tyson, Council Members Leon Hogg, Bob Edwards, Charlie Miller, Glenn Porterfield, and Veva Lou Massey. Precouncil discussion included a report from Parks and Community Services Director Ray McDonald on Arbor Daze to be held April 23-25; an update from Public Works Director Ron Young on water tower painting and a quarterly status report on wastewater; a report from Director of Economic Development Bill Ridgway on the successful Hazardous Waste Day that was held on April 3; a discussion of city council parking plans at city hall; and a review of agenda items. Closed session was held to discuss pending litigation of Dickey Apartments as authorized by Section 551.071 of the Texas Government Code. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:10 p.m. for the consideration of scheduled items. PLEDGE OF ALLEGIANCE Girl Scout Troop No. 1546 led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR APRIL Police Chief Leonard Carmack introduced Senior Police Officer Deana Ramsour and Mayor Saleh presented her with a plaque for being selected employee of the month for April. ITEM NO. 2 ANNUAL REPORT FROM TRINITY WASTE SERVICES Randy Shiflet, Municipal Marketing Manager with Trinity Waste Services, 6100 Elliott Reeder Road, Fort Worth, Texas, 76117, gave an annual report on solid waste disposal in Euless. Council Member Miller asked Mr. Shiflet how the City of Euless could achieve Monday and Thursday pickup days throughout the city. Mr. Shiflet replied that it is negotiable. ITEM NO. 3 PRESENTATION FROM ECONOMIC DEVELOPMENT DIRECTOR Director of Economic Development Bill Ridgway presented a report on the economic impact wine sales would have on Euless. ITEM NO. 4 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Director of Parks and Community Services Ray McDonald proclaiming April 30, 2004, as Arbor Day. ITEM NO. 5 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Library Administrator JoAnn Rogers proclaiming the week of April 18-25, 2004, as Library Week. Jo Ann Rogers stated she was accepting the proclamation in memory of Lloyd Baldwin, who passed away today, and who was their most ardent supporter of the library. City Council Minutes Page 3 of 8 April 13, 2004 REGULAR AGENDA ITEM NO. 6 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1636 Council Member Hogg motioned to approve the first and final reading of Ordinance No. 1636 vacating and abandoning a 10 ft. pedestrian easement between Lots 19 and 20, Block A, Fountain Park Addition Phase 1. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 7 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 04-06-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1637 Mayor Saleh opened the public hearing at 7:45 p.m. for Specific Use Permit No. 04-06- ;`, SUP on Lot 1-R, Block 1, Airport Business Park, for Auto Buyers of Texas, a motor vehicle dealership, in 1-2 (Heavy Industrial District) zoning at 1205 Texas Star Parkway, Suite 130. Director of Planning and Development Mike Collins stated that John Harmon, owner of Auto Buyers of Texas, is requesting the permit to operate an internet sales business selling used sport utility vehicles that would be warehoused at the Texas Star Business Centre. The prospective buyers typically make an appointment for the viewing and test driving of the vehicles. No more than 15 vehicles will be kept in the warehouse showroom at any one time. No onsite repairs will be made to the vehicles. There will be no outdoor display or storage of the vehicles. Mayor Saleh asked for any proponents. David Hagar, owner/manager of the Texas Star Business Centre, 1205 Texas Star Parkway, Suite 120, Euless, stated that Mr. Harmon was unable to attend the meeting as he received an emergency call on his way to the meeting. Mr. Hagar spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:49 p.m. Council Member Miller motioned to approve Specific Use Permit No. 04-06-SUP and the first and final reading of Ordinance No. 1637 on Lot 1-R, Block 1, Airport Business Park, for Auto Buyers of Texas, a motor vehicle dealership, in 1-2 (Heavy Industrial District) zoning at 1205 Texas Star Parkway, Suite 130, subject to the following City Council Minutes Page 4 of 8 April 13, 2004 conditions: (1) Tied to Auto Buyers of Texas, Mr. John Harman owner; (2) Tied to `.. three-year term of lease; (3) No outside storage, display of vehicles, or advertising on premises; (4) No onsite repair or mechanical work completed on vehicles; and (5) No more than five gallons of fuel to be stored in the gas tank of each vehicle. Council Member Edwards seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. Mayor Saleh and Council Member Miller both congratulated Mr. Hagar on operating a great business. ITEM NO. 8 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 04-07-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1638 Mayor Saleh opened the public hearing at 7:51 p.m. for Specific Use Permit No. 04-07- SUP on Lot 1, Block 1, Dorris Subdivision, for K's Furniture Consignment, a miscellaneous retail store in C-1 (Neighborhood Business District) zoning at 501 North Main Street, #105-107. Director of Planning and Development Mike Collins stated that Brenda Moore and Kay Simpson, owners of K's Furniture Consignment, are requesting to operate a furniture and furnishing consignment business. Ms. Moore is moving the business that she had operated with her husband in Irving for over 10 years and is partnering with Ms. Simpson. Mayor Saleh asked for any proponents. Kay Simpson, 501 N. Main, Euless, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:54 p.m. In response to a question by Council Member Edwards, Kay Simpson stated that they do not have any other consignment stores and the store does $100-150,000 in yearly sales. Council Member Miller stated that he liked the sign they put up in the shopping center. Council Member Hogg motioned to approve Specific Use Permit No. 04-07-SUP and the first and final reading of Ordinance No. 1638 on Lot 1, Block 1, Dorris Subdivision, for K's Furniture Consignment, a miscellaneous retail store in C-1 (Neighborhood Business District) zoning at 501 North Main Street, #105-107, subject to the following City Council Minutes Page 5 of 8 April 13, 2004 conditions: (1) Brenda Moore or Kay Simpson must own and operate the business; and (2) Valid for two years. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9 PUBLIC HEARING FOR PLANNED DEVELOPMENT NO. 04-02-PD AND DENIAL OF ORDINANCE NO. 1639 Mayor Saleh opened the public hearing at 7:55 p.m. for Planned Development No. 04- 02-PD on Lot 24, Block 2, Arnett Addition, for Lone Star Home Loan, a financially- related professional service in R-1 (Single Family Detached Dwelling District) zoning at 300 South Main Street. Director of Planning and Development Mike Collins stated that Rick Busby and John Hutchens, owners of Lone Star Home Loan, are requesting a planned development for a professional office use in a single family dwelling on the northwest corner of South Main Street and Arnett Drive at 300 South Main Street. The financial service business employs six people. The normal business hours are Monday through Friday, 8:00 a.m. to 5:00 p.m. The conduct of their business is performed primarily by electronic communications, with very few customers physically visiting the office. All site plan requirements will be satisfied. Site improvements will be made to accommodate the commercial use. Additional pavement with landscaping will be added to the south of the existing driveway to create handicap parking. All vehicles will be able to maneuver in such a manner that they will not have to back out onto South Main Street to exit. Two parking spaces exist in the garage, with four spaces created in the rear. Site lighting will be installed that meets code and safety standards without creating light trespass. He stated that the Planning and Zoning Commission recommended denial. Mayor Saleh asked for any proponents. John Hutchens, 109 Shelmar, Euless, and Rick Busby, 3907 Parker Oaks, Arlington, spoke in favor of the request. Their business currently operates out of 416 N. Main Street and stated that 95% of their business is by phone or internet. Mayor Saleh asked for any opponents. Jack Rose, 212 S. Main Street, and Lynette Hosey, 103 Arnett, spoke against turning a residence into a commercial business. Ms. Hosey, representing a majority of the neighborhood, submitted a petition signed by neighbors against the request. Mayor Saleh read the following names of those who signed the petition: Charles and Lynette Hosey, 103 Arnett; Don and Claire Hilliard, 111 W. H., and Shana Mitchell, 118 Arnett Drive; Saeko and Mark Schoener, 200 Arnett Drive; Larry Watson, 119 Arnett Drive; Robi Lusa, 705 Brownstone; Betty Cook, 101 Arnett; Rhianna Tavarez, 114 Arnett Drive; Steve Opotsea, 114 Arnett Drive; Carole Matcham, 313 Primrose Court; Luz Pearl, 201 Arnett Drive; Jose Hernandez, 207 Arnett Drive; Juan Garcia, 201 Arnett Drive; Jesus Yanes, Jr., 112 Linda Lane; and Maggie Olgium, 101 E. Huitt. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 8:08 p.m. Council Member Massey motioned to deny Ordinance No. 1639 on Lot 24, Block 2, Arnett Addition, for Lone Star Home Loan, a financially-related professional service in R-1 (Single Family Detached Dwelling District) zoning at 300 South Main Street. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None ,` Mayor Saleh declared the motion carried. Council Member Miller stated he had mixed emotions on this issue, because he feels residential is the best use for this location, especially since there is a pool in the back yard. In other instances, he may approve changing property along South Main Street to commercial in the future. ITEM NO. 10 APPROVAL OF CITY COUNCIL MINUTES Council Member Porterfield motioned to approve the minutes of the Regular City Council Meeting of March 23, 2004. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Tyson, Council Members Hogg, Edwards, Miller, Porterfield, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 PUBLIC COMMENTS Karin Newell, introduced herself as the new president of ARTSNETS and expressed her appreciation to the City of Euless for their participation in the ARTSNETS program, City Council Minutes Page 7 of 8 April 13,2004 especially, Director of Parks and Community Services Ray McDonald and Library Administrator JoAnn Rogers. ITEM NO. 12 REPORTS CITY MANAGER Deputy City Manager Gary McKamie had nothing to report. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. STAFF REPORT There was no staff report. CITY COUNCIL Council Member Bob Edwards congratulated Deana Ramsour for being the employee of the month. He stated that Kay Simpson has helped the city by moving her business to Euless. He reported that he helped city employees work the hazardous waste collection event. Mayor Pro Tem Tyson congratulated Deana Ramsour. He also congratulated JoAnn Rogers noting that the youth want to go the library now due to JoAnn's programs. Council Member Miller stated that he picked up trash on Saturday along SH 10 during Texas Trash Off and stated there was a very good turnout. He congratulated Bill Ridgway on his report. He thanked Karin Newell for her recognition of JoAnn Rogers and Ray McDonald. Council Member Porterfield commended Deana Ramsour. He stated the Euless Library Foundation had an event in which the newly formed advisory board met for the first time and saw a film about the proposed art project. He noted that JoAnn and those on the foundation work hard. He stated Ray McDonald always make the council proud with Texas Star, the parks, and Arbor Daze. He thanked Bill Ridgway for the Hazardous Waste Day and reports from Trinity Waste Services and Community Waste Disposal. He noted that Lloyd Baldwin was a true gentleman and dedicated to the City of Euless in so many ways. Council Member Massey stated Lloyd Baldwin will be missed. She congratulated Deana Ramsour and thanked Bill Ridgway and Karin Newell for their reports. She reminded everyone of Library Week and Arbor Daze. Mayor Saleh stated Lloyd Baldwin is the person the man on the bench in front of the library was designed after. She introduced the candidates Carl Tyson and Greg Black for Place One, and Bob Edwards, Linda Martin, and Mike Utzman for Place Three. City Council Minutes Page 8 of 8 April 13, 2004 City Secretary Susan Crim stated that early voting will be held April 28 to May 11, weekdays from 8:00 a.m. to 5:00 p.m. and on Saturday, May 8, from 9:00 a.m. to 5:00 p.m. The election will be held May 15, at the Euless Public Library and Bear Creek Elementary from 7:00 a.m. to 7:00 p.m. ITEM NO. 13 ADJOURNMENT Mayor Saleh adjourned the meeting at 8:28 p.m. APPROVED: Mary Lit aleh,11layor ATTEST: usan Crim, ' MC, City Secretary
