HomeMy WebLinkAbout2004-11-09 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL NOVEMBER 9, 2004 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:10 p.m. on Tuesday, November 9, 2004, in the precouncil room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Glenn Porterfield, Council Members Carl Tyson, Leon Hogg Linda Martin, Charlie Miller, and Veva Lou Massey. The precouncil meeting included a report from Director of Public Works Ron Young on the Trinity River Authority water line alignment; a discussion led by Director of Planning and Development Mike Collins on a proposed ordinance regulating gas well drilling; and a review of agenda items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:00 p.m. for the consideration of scheduled items. INVOCATION Pastor Alex Latu, Tongan First United Methodist Church, gave the invocation. ITEM NO. 1 PRESENTATION OF EMPLOYEE SERVICE PINS Parks Manager Johnnie Green introduced Parks Field Tech Chris Hurst and his wife, Dorothy, and Mayor Saleh presented Chris with a 5-year service pin. REGULAR AGENDA ITEM NO. 2 AUTHORIZED THE PURCHASE OF REPLACEMENT PC'S FROM DELL COMPUTER CORPORATION Council Member Miller motioned to authorize the purchase of replacement personal computers from Dell Computer Corporation through the State of Texas purchasing contract, in an amount not to exceed $71,240. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey `'" Nays: None Mayor Saleh declared the motion carried. ITEM NO. 3 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1663 Council Member Miller motioned to approve the first and final reading of Ordinance No. 1663 for the vacation and abandonment of 5 feet of a 10 foot utility easement and a 10 foot by 10 foot pad easement on Lot 20, Block A, Fountain Park Addition, Phase 1. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 4 PUBLIC HEARING FOR PLANNED DEVELOPMENT NO. 04-05-PD AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1666 Mayor Saleh opened the public hearing at 7:12 p.m. regarding Planned Development No. 04-05-PD changing the zoning on Lots 1-4, Block A, Raider Place Addition, from R- City Council Minutes Page 3 of 6 November 9, 2004 1L (Single Family Limited Dwelling District) to PD 1666 (Planned Development) based on R-1 L. Director of Planning and Development Mike Collins stated the applicant, C & N Group, L.P.A., dba Colonnade Homes, is proposing to develop four lots on a 0.658 acre tract located in the 1100 to 1200 blocks of David Drive. The applicant is requesting to construct 1,500 sq. ft. homes instead of the 1,700 sq. ft. required minimum in R-1L (Single Family Limited Dwelling) zoning district. The lots range from 6,875 sq. ft. to 8,045 sq. ft. Superior Concrete was granted C-2 zoning on 1.3 acres west of the subject property and the subject property was rezoned to R-1 L in November, 2003. The applicant purchased the R-1 L property from Superior Concrete. Colonnade is seeking an exception to the minimum single family square footage requirement due to the existing homes across the street ranging in size from 1,000 to 1,400 sq. ft. The sales price of a new home built to the minimum dwelling unit standard would exceed the average appraised value of the existing homes. Mayor Saleh asked for any proponents. Bill Pasteur, 1900 Trailwood Drive, representing Colonnade Homes, stated that 1,700 sq. ft. homes would be grossly overbuilt for the area. He distributed a list indicating values and square footage of homes on David Drive ranging from $65,800 to $80,964 with square footages ranging from 1,020 sq. ft. to 1,450 sq. ft. He noted there is multi- ,,,, family to the north and south, and commercial to the west. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:22 p.m. Council Member Miller stated that he is not against housing, but he is against reducing the minimum size of the homes from 1,700 sq. ft. He distributed information showing home sizes and values of larger homes built in older neighborhoods on infill lots in Euless and Hurst and requested the handout be made an official attachment to the minutes. Mayor Pro Tern Porterfield noted that because the Planning and Zoning Commission recommended denial, it requires at least six affirmative votes to approve the request. He urged the other council members to approve the request stating that it is a rather minimal variance. He stated that even at 1,500 sq. ft., these homes will be significantly larger than the existing homes. City Manager Joe Hennig clarified that staff and the Development Review Committee recommended approval to the Planning and Zoning Commission. He noted that there may be other areas in the city that would lend itself to such an exception. Mayor Saleh asked what the selling prices will be. Mr. Pasteur stated that $75 to $80 a square foot is the current market rate. She noted that the neighborhood is very well kept. Mayor Pro Tem Porterfield motioned to approve the first and final reading of Ordinance No. 1666 for Specific Use Permit No. 04-05-PD changing the zoning on Lots 1-4, Block A, Raider Place Addition, from R-1 L (Single Family Limited Dwelling District) to PD 1666 (Planned Development) based on R-1 L with 1,500 minimum square footage of dwelling units. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, and Massey Nays: Council Member Miller Mayor Saleh declared the motion carried. ITEM NO. 5 APPROVAL OF TEMPORARY USE PERMIT NO. 04-11-CC Council Member Massey motioned to approve Temporary Use Permit No. 04-11-CC for Christmas tree sales on Lot 5R, Block 2, S. W. Mills Subdivision, located at B & B Auto Body, 605 W. Euless Blvd., from November 25, through December 25, 2005, Thursday ""' — Sunday, between 5pm and 11 pm. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 6 REQUEST FROM SCOTT WOOLEY TO ADDRESS COUNCIL Mr. Scott Wooley, 607 Parker Drive, and Rick and Dawna Jennings, 609 Parker Drive, addressed the council regarding the noise problems with the Laser Car Wash on FM 157, just north of Midway Drive. In response to several questions from the council, Mr. Wooley stated that the car wash is required by the specific use permit to close from midnight to 6:00 a.m. and is in operation the remainder of the time. He stated that the owner of the car wash agreed to extend the fencing behind the car wash to the property line on the south, but that the owner doesn't own the property further to the south. Extending the fence a few feet will not solve the problem. Mayor Saleh stated the city is trying to help the homeowners and will follow up with city staff. City Council Minutes Page 5 of 6 November 9, 2004 Council Member Miller asked if the city has tried to have an acoustical engineer look at '1- the problem. City Manager Hennig stated that they have not, which would be at the city's expense, but that is an option. He stated that staff plans to do what they can to help find a solution. ITEM NO. 7 APPROVAL OF CITY COUNCIL MINUTES Council Member Massey motioned to approve the minutes of the Regular City Council Meeting of October 26, 2004. Council Member Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 PUBLIC COMMENTS There were no public comments ITEM NO. 9 REPORTS CITY MANAGER City Manager Joe Hennig stated that Director of Parks and Community Services Ray McDonald is out of town accepting an award for Arbor Daze from the International Festival and Events Association. He noted that the city will be receiving three additional awards for Arbor Daze in the near future. He thanked JoAnn Rogers and the Euless Library Foundation for the wonderful event held to raise money for the new art. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. CITY COUNCIL Council Member Miller stated the council will do everything to help the Wooleys and Jennings regarding the problem with the car wash, and assured them that Planning and Development Manager Eric Wilhite is willing to help them. Council Member Martin congratulated Chris Hurst on receiving his service pin. She thanked Fire Chief Lee Koontz on the latest Citizens Fire Academy graduation, and stated that Deputy City Secretary Becky Null was one of the graduates. The issue will now go before the legislature. He also congratulated Chris Hurst on his five years of service to the city. Council Member Tyson congratulated Chris Hurst, and stated that Euless has some of the best employees of any city. He agreed with the Wooleys and Jennings that it is frustrating to try to get things done sometimes, but encouraged them to continue working with the city to solve their problem. Council Member Massey congratulated Chris Hurst on receiving his service pin. Mayor Pro Tern Porterfield also congratulated Chris Hurst. He thanked everyone involved in the Library Foundation fundraiser. He commended the most recent graduates of the Citizens Fire Academy. He stated that he also attended the TML conference, which had a lot of educational classes and good opportunities to visit with vendors of products that cities use. Mayor Saleh stated the Citizens Fire Academy and Citizens Police Academy are a worthwhile opportunity for citizens. She noted that the next Citizens Fire Academy class is full, but there are openings in the Citizens Police Academy. She noted that several council members did attend the TML conference and there were some very interesting _„ sessions. She stated that the Library Foundation provided a great fundraiser.
