HomeMy WebLinkAbout2005-12-13 Noaw MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL DECEMBER 13, 2005 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:10 p.m. on Tuesday, December 13, 2005, in the Council Chambers of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Glenn Porterfield, Council Members Carl Tyson, Leon Hogg, Linda Martin, Charlie Miller, and Veva Lou Massey. PRESENTATION OF CERTIFICATE OF CONGRATULATIONS Mayor Saleh presented Coach Lineweaver, Trinity High School, with a Certificate of Congratulations recognizing the football team, the Trinity Trojans, for winning the 5A Division 1 State Championship. Each coach and member of the team received an individual Certificate of Congratulations. The football players performed the Haka dance that was done prior to each game. r.. PRECOUNCIL The city council then convened into precouncil at 4:20 p.m. The precouncil meeting included a financial update by Finance Controller Gary Yakesch; discussion of the depository contract by Assistant City Manager Loretta Getchell; discussion of bond refunding opportunities by Assistant City Manager Loretta Getchell and Bond Counsel Boyd London; discussion of the masonry policy by Director of Planning and Development Mike Collins, Planning Manager Eric Wilhite, and Building Official Kurt Kasson; and a review of agenda items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:10 p.m. for the consideration of scheduled items. INVOCATION Salome Mahe, Tongan First United Methodist Church, gave the invocation. PLEDGE OF ALLEGIANCE Boy Scout Troop 342 led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR DECEMBER Division Fire Chief Jeff Morris introduced Firefighter II/Paramedic Jeff Hayden. Mayor Saleh presented him with a plaque for being selected employee of the month for December. ITEM NO. 2 PRESENTATION OF EMPLOYEE OF THE YEAR Director of Planning and Development Ray McDonald and Recreation Manager Suzanne Hendrickson introduced Volunteer Coordinator Jerry Poteet, his wife, Peggy, daughter, Carly, and parents, Jerry and Carolyn Poteet. Mayor Saleh presented Jerry with a plaque for being selected employee of the year for 2005. ITEM NO. 3 PRESENTATION OF EMPLOYEE SERVICE PINS Assistant City Manager Loretta Getchell, Director of Planning and Development Ray McDonald, and Texas Star General Manager Glenda Hartsell-Shelton introduced Finance Controller Gary Yakesch. Mayor Saleh presented Gary with a 5-year service pin. ITEM NO. 4 PRESENTATION OF CERTIFICATE OF RECOGNITION Mayor Saleh presented David Robbins, Principal, Euless Junior High School, with a Certificate of Recognition for the school being named to a statewide honor roll list of schools for the best academic performance in Texas. Just for the Kids (JFTK) and the Texas Business and Education Coalition (TBEC) named Euless Junior High School as one of only 33 middle school/junior high schools in Texas named to the JFTK/TBEC City Council Minutes Page 3 of 8 December 13, 2005 Honor Roll. Mr. Robbins introduced Ginger Garner, 8th grade History teacher, Jane �.. Heilskov, 7th grade History teacher, Rachel Lomax, 9th grade Algebra & Geometry teacher, and Sheree West, 7, 8, 9th grade Resource Reading teacher. CONSENT AGENDA Council Member Martin motioned to approve Consent Agenda Items numbered 5 through 12. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 5 AWARD OF BID NO. 008-05 Awarded Bid No. 008-05 to Branch Smith Printing, P. O. Box 1868, Fort Worth, Texas, 76101, for a one-year contract renewal for printing of the "Euless Today" magazine through calendar year 2006, in the approximate expenditure of$37,580. ITEM NO. 6 APPROVAL OF PURCHASE Approved the purchase of playground equipment for the Villages of Bear Creek Park from Miracle Recreation Equipment Company, 1200 Commercial Blvd., Suite 102, Arlington, Texas, 76001, through the Texas Local Government Purchasing Cooperative, also known as the Texas Buy Board Program, in the estimated expenditure of$67,000. ITEM NO. 7 APPROVAL OF PURCHASE Approved the purchase of a one-ton ambulance prep package cab and chassis from Philpott Ford, Port Neches, Texas, through the Houston Galveston Area Purchasing Cooperative (HGAC) in the estimated expenditure of $25,175.60 to be used in the remount of the city's existing ambulance module. ITEM NO. 8 AUTHORIZED CITY MANAGER TO EXECUTE AN ARCHITECTURAL AGREEMENT Authorized the city manager to execute an architectural agreement with Byron Folse & Associates for the design of the public works facility proposed to be constructed on Westpark Way next to Fire Station No. 2, in the fixed fee amount of $140,000, which represents 7% of the budgeted construction estimate. City Council Minutes Page 4 of 8 December 13, 2005 r., ITEM NO. 9 APPROVAL OF RESOLUTION NO. 05-1214 Approved Resolution No. 05-1214 amending the contract for the collection of delinquent property taxes with Linebarger Goggan Blair& Sampson, LLP. ITEM NO. 10 APPROVAL OF RESOLUTION NO. 05-1212 Approved Resolution No. 05-1212 reappointing Lacy Britten as municipal judge of the Euless Municipal Court of Record for a two (2) year term to expire December 31, 2007. ITEM NO. 11 APPROVED EXTENSION OF CONTRACT FOR MUNICIPAL COURT JUDGE Approved the extension of the contract for Municipal Court Judge Lacy Britten for a one- year term to expire December 31, 2006. ITEM NO. 12 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of November 22, 2005, and Special Called Meeting of November 29, 2005. REGULAR AGENDA ITEM NO. 13 DENIAL OF RESOLUTION NO. 05-1215 Council Members Tyson and Miller both stated they would not vote for the sale of the property because the appraisal is considerably higher than the bid offer. Council Member Hogg motioned to approve Resolution No. 05-1215 ratifying the sale of Lot 2R, Block 13, Oak Ridge Estates, and authorizing the mayor to execute a conveyance in the amount of $125,000.00 for the sale of the property. Council Member Martin seconded the motion. Ayes: Council Members Hogg, Martin, and Massey Nays: Mayor Saleh, Mayor Pro Tem Porterfield, Council Members Tyson and Miller Mayor Saleh declared the motion failed. ITEM NO. 14 AUTHORIZED CITY MANAGER TO ENTER INTO PROFESSIONAL SERVICES AGREEMENT WITH JP MORGAN CHASE & COMPANY FOR MINERAL MANAGEMENT SERVICES Council Member Tyson motioned to authorize the city manager to enter into a professional services agreement with JP Morgan Chase & Company for mineral management consulting services relating to the lease of public land for gas drilling, with the amendment to page 1, Section 4. Fees and Expenses, second sentence, to read as City Council Minutes Page 5 of 8 December 13, 2005 follows: "City shall also reimburse Consultant for reasonable and customary business .. expenses not to exceed $2,500 without city manager approval." The agreement establishes that Paul Midkiff, JP Morgan Chase, will provide the following primary services: Market public lands eligible for gas drilling; develop gas lease document and prepare for sealed bid process; seek competitive bid proposals for gas leases; and evaluate bid proposals and make recommendation to the city council regarding an award of contract. The initial term of the contract is two years with the opportunity of renewing for consecutive terms under the same conditions. JP Morgan Chase compensation will be five percent (5%) of sums received by the city on gross lease bonus. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: Mayor Pro Tem Porterfield Mayor Saleh declared the motion carried. ITEM NO. 15 OPENED AND TABLED PUBLIC HEARING FOR SPECIFIC USE PERMIT CASE NO. 05-12-SUP AND ORDINANCE NO. 1715 Director of Planning and Development Mike Collins stated that the applicant could not be present for the meeting and asked that the specific use permit and site plan be tabled to the next meeting. Mayor Saleh opened the public hearing at 7:44 p.m. for Specific Use Permit No. 05-12- SUP on Lots 3 and 4, Block A, Main Centre Addition, for Self Storage Facility in C-2 (Community Business District) zoning located at 331 North Main Street and 401 North Main Street. Mayor Pro Tern Porterfield motioned to table the public hearing and consideration of Ordinance No. 1715 to the first council meeting in January, 2006. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 16 TABLED SITE PLAN NO. 05-10-SP Mayor Pro Tern Porterfield motioned to table Site Plan No. 05-10-SP to the first council meeting in January for Central Self Storage proposed on Lots 3 and 4, Block A, Main Centre Addition, located at 331 and 401 North Main Street. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 17 AUTHORIZED THE MAYOR TO EXECUTE A CONSENT TO THE CLOSURE OF THE RIGHT-OF-WAY ON OLD GREENBELT ROAD Council Member Miller motioned to authorize the mayor to execute a consent to the closure of the right-of-way on Old Greenbelt Road, located in the J. Armendaris Survey, A-57 and the W. F. Loving Survey, A-944, Fort Worth, Tarrant County, Texas, with the following conditions: (1) all the other easement property owners agree to the closure of right-of-way; and (2) Fort Worth will provide, at their expense, a paved access off Trinity Blvd. to the City of Euless property. Said right-of-way being recorded in Volume 7726, Page 1848, Deed Records of Tarrant County, Texas. Council Member Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 18 PUBLIC COMMENTS There were no public comments. ITEM NO. 19 REPORTS STAFF REPORT There was no staff report. CITY MANAGER City Manager Joe Hennig wished everyone a Merry Christmas and Prosperous New Year, and stated he appreciated the council's support. City Council Minutes Page 7 of 8 December 13, 2005 CITY ATTORNEY City Attorney Bob McFarland clarified that denial of Resolution No. 05-1215 was a rejection of the bid. CITY COUNCIL Mayor Pro Tern Porterfield stated that the Trinity High School football team represented Euless well on Saturday at the state championship game. He noted that the council honored the football players earlier in the city council meeting and that he is very proud of the team. He congratulated Volunteer Coordinator Jerry Poteet for being selected employee of the year, Firefighter Jeff Hayden for being selected employee of the month, Finance Controller Gary Yakesch for receiving his 5-year service, and Euless Junior High for their recent honors. He stated he has a lot to be thankful for and wished everyone a Merry Christmas and Happy New Year. Council Member Miller congratulated the employees who received awards and said Jerry Poteet is a very humble employee. He stated the Parks and Community Services Department had a great week with the Christmas Parade and the Heritage Park Celebration. He noted that the Fire Department welcomed the football players home, and Channel 5 and citizens were there, also. Council Member Martin congratulated Jeff Hayden, and stated that it has been a privilege seeing him at work and that he cares deeply about what he does. She also congratulated Gary Yakesch and Jerry Poteet. She noted that Jerry keeps the volunteers together and she is proud he was selected employee of the year. She recently returned from the National League of Cities conference and is thankful Euless does not have a lot of the problems that other cities have. She thanked City Manager Joe Hennig for his direction of the city. She wished everyone a Merry Christmas and Happy New Year. Council Member Hogg stated he appreciates the employees recognized tonight. He stated he wishes he had been in town to greet the Trinity High School football players on their return, but he was in North Carolina attending the National League of Cities Conference at the time. He wished everyone a Merry Christmas and Happy New Year. Council Member Tyson congratulated Jeff Hayden, Gary Yakesch, and Jerry Poteet. He stated that Jerry really deserves employee of the year. He congratulated the Trinity Trojans stating they deserved being state champions. He stated he is proud of the award received by Euless Junior High. He wished everyone a Merry Christmas and Happy New Year. Council Member Massey stated she is proud of the Trinity Trojans and Euless Junior High, and she said they have helped put Euless on the map. She congratulated Jerry Poteet, Jeff Hayden, and Gary Yakesch. She stated the Christmas Parade was outstanding. She thanked the Parks Department for the poinsettias, and wished y` everyone a Merry Christmas and Happy New Year. City Council Minutes Page 8 of 8 December 13, 2005 Mayor Saleh stated the accolades for the Trinity Trojans and Euless Junior High School makes Euless proud. She noted it is great to have the citizens come to a council meeting and express their opinions, and she commented that we have a great city council who work together for the benefit of all our citizens. She wished everyone a Merry Christmas and Prosperous New Year.
