HomeMy WebLinkAbout2006-04-11 MINUTES OF A REGULAR MEETING �.• OF THE EULESS CITY COUNCIL APRIL 11, 2006 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 5:05 p.m. on Tuesday, April 11, 2006, in the Precouncil Conference Room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Glenn Porterfield, Council Members Carl Tyson, Leon Hogg, Linda Martin, Charlie Miller, and Veva Lou Massey. The precouncil meeting included a waste water update by Director of Public Works Ron Young; discussion by Police Chief Leonard Carmack regarding the city's towing policy and an upcoming multi-city warrant roundup; and a review of agenda items. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:03 p.m. for the consideration of scheduled items. PLEDGE OF ALLEGIANCE Mayor Pro Tern Glenn Porterfield led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF SERVICE PINS Library Administrator Kate Lyon introduced Library Secretary Karan Jasper. City Secretary Susan Crim introduced Receptionist Sandi McGarry, her husband Brian, son, Zachary, and daughter, Madyson. Mayor Saleh presented 5-year service pins to Karan and Sandi. ITEM NO. 2 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Director of Parks and Community Services Ray McDonald proclaiming April 28, 2006, as Arbor Day. REGULAR AGENDA ITEM NO. 3 AWARD OF BID NO. 016-06 `` Council Member Miller motioned to award Bid No. 016-06 to Linder Construction Company, Inc., for the Fuller Branch drainage improvement project, in the amount of $622,598 and authorized the city manager to execute the contract. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 4 REJECTION OF BID NO. 018-06 Council Member Massey motioned to reject all bids received for Bid No. 018-06 for the irrigation of Bob Eden Park. Council Member Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None City Council Minutes Page 3 of 8 April 11, 2006 Mayor Saleh declared the motion carried. ITEM NO. 5 APPROVAL OF RESOLUTION NO. 06-1222 Council Member Martin motioned to approve Resolution No. 06-1222 granting approval to the Tarrant County Housing Finance Corporation for the use of the proceeds of its Series 2006 Single Family Mortgage Revenue Bonds to finance home mortgages for single family homes located within the city. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Porterfield, Council Members Hogg, Martin, and Massey Nays: Council Member Miller Abstentions: Council Member Tyson Mayor Saleh declared the motion carried. Council Member Tyson stated he abstained because he was unsure if there could be negative results. ti.. City Manager Hennig stated that this program has been approved in the past and does not have any financial impact on the city's revenues or obligations. The program allows Euless residents to take advantage of the mortgages with reduced down payments. ITEM NO. 6 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1731 Council Member Hogg motioned to approve the first and final reading of Ordinance No. 1731 prohibiting the use of designated groundwater from beneath the properties located at 1101-1107 Pamela Drive, 1103-1109, 1110, 1114, and 1118 South Airport Circle, and 1205 Texas Star Parkway to facilitate certification of Municipal Setting Designation of said properties by the Texas Commission on Environmental Quality pursuant to the Texas Solid Waste Disposal Act. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. Nftp City Council Minutes Page 4 of 8 April 11, 2006 ITEM NO. 7 HELD PUBLIC HEARING REGARDING AN AMENDMENT TO THE �.• UNIFIED DEVELOPMENT CODE AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1732 Mayor Saleh opened the public hearing at 7:24 p.m. regarding Chapter 84 "Unified Development Code" amending Section 84-113(c)(6) "LI" "Limited Industrial District", Section 84-114(c)(5) "I-1" "Light Industrial District", Section 84-115(c)(5) "1-2" "Heavy Industrial District", and Section 84-181 "Exterior Facade Requirements". Planning and Development Manager Eric Wilhite stated the recommended changes to the masonry facade requirements are: (1) 100% masonry on the street facing elevations required; (2) 75% for all other wall elevations permitted; (3) The design of the structure must substantially incorporate at least two of the following enhanced exterior masonry treatments or elements: enhanced course projections; coining; coping; colonnade; cornice; pilaster; or other masonry enhancements approved by the Building Official. The intent is that the treatments and elements are architecturally compatible with the overall design and will result in creating a structure that enhances the economic and aesthetic value of the City of Euless; (4) The current masonry exception process would be eliminated; and (5) Establish that in addition to common smooth face masonry units, smooth tilt wall surface is specifically prohibited unless used in combination with other types of concrete masonry units and architectural enhancements and do not exceed 25% of the area covered by the concrete masonry units or tilt wall. __ There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:26 p.m. Council Member Miller motioned to approve amending the Code of Ordinances, Chapter 84 "Unified Development Code", Section 84-113(c)(6) "LI" "Limited Industrial District", Section 84-114(c)(5) "I-1" "Light Industrial District", Section 84-115(c)(5) "1-2" "Heavy Industrial District", and Section 84-181 "Exterior Facade Requirements". ITEM NO. 8 APPROVAL OF SITE PLAN NO. 06-02-SP Director of Planning and Development Mike Collins stated The Pegasus Group is requesting approval of a site plan for office/retail on 2.209 acres on Lot 3, Block A, Main Centre Addition, located at 331 N. Main Street. The development will contain an 8,400 sq. ft. single structure that can be subdivided for retail/office use. In order to accommodate any future development of the western portion of the site, the interior drives on the south, north, and east sides will be constructed with 6-inch concrete to meet fire lane standards. Main Street. Council Member Martin seconded the motion. ITEM NO. 9 ACCEPTANCE OF CAPITAL IMPROVEMENTS ADVISORY COMMITTEE SEMI-ANNUAL REPORT The council accepted the Capital Improvements Advisory Committee Semi-Annual Report for the period of April 1, 2005 through September 30, 2005. ITEM NO. 10 HELD PUBLIC HEARING AND AUTHORIZED CITY MANAGER TO CONVERT PARK LAND IN TEXAS STAR SPORTS COMPLEX FOR SUBSURFACE DRILLING AND EXTRACTION OF NATURAL GAS Mayor Saleh opened the public hearing at 7:30 p.m. regarding subsurface drilling and N.00- extraction of natural gas from land in the Texas Star Sports Complex. Director of Planning and Development Mike Collins stated that the city has contracted with JP Morgan Chase for mineral asset consulting. The city is now prepared to seek competitive bid proposals to lease approximately 300 acres located in the Texas Star Sports Complex. Approximately 90 acres, which includes the Dr. Pepper Stars Center, the Parks at Texas Star, and Softball World, is declared park land. Therefore, in accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Euless seeks to convert the subsurface areas of portions of the Texas Star Sports Complex for the purpose of off-site subsurface gas drilling and extraction. The Texas Star Golf Course is not defined as park land and is, therefore, not subject the Texas Parks and Wildlife Code, Chapter 26. He pointed out that there will be no surface rights granted for drilling or any other related activities. Therefore, there will be no property damage or drilling activity nuisance. This conversion only proposes the use of the subsurface. Any drilling activity proposed on property located within the city limits will be subject to the City of Euless Gas Drilling Ordinance. There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:37 p.m. Mayor Pro Tern Porterfield motioned to find that no feasible or prudent alternative exists to drilling and extracting gas from underneath the park sites; the proposed conversion ... includes all reasonable planning to minimize harm to the park land; and authorized the city manager to convert park land in Texas Star Sports Complex, specifically located in certain portions of land situated in Lot 1, Block A, Softball World Addition; Lot 1, Block City Council Minutes Page 6 of 8 April 11, 2006 A, Texas Star Addition; and Lot 1, Block 1, Flight Instrument Addition, for subsurface �... drilling and extraction of natural gas. Council Member Massey seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 APPROVAL OF CITY COUNCIL MINUTES Council Member Hogg motioned to approve the minutes of the Regular City Council Meeting of March 28, 2006. Council Member Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Porterfield, Council Members Tyson, Hogg, Martin, Miller, and Massey Nays: None Mayor Saleh declared the motion carried. ITEM NO. 12 PUBLIC COMMENTS There were no public comments. ITEM NO. 13 REPORTS STAFF REPORT There was no staff report. CITY MANAGER City Manager Joe Hennig stated that Texas Star General Manager Glenda Hartsell Shelton is doing well after ankle surgery and is back at work most of each day. CITY ATTORNEY City Attorney Bob McFarland stated that the Texas Legislature will convene into its fourth special session next week. City Council Minutes Page 7 of 8 April 11, 2006 CITY COUNCIL Council Member Tyson congratulated Library Secretary Karan Jasper on receiving her 5-year service pin, and stated that she helps him a lot when he visits the library. He also congratulated Receptionist Sandi McGarry on receiving her 5-year service pin noting that the city could not find anyone better suited for greeting people because she is always smiling. Council Member Hogg congratulated all the employees stating that they make the city council's jobs much easier. Council Member Martin congratulated Karan Jasper and Sandi McGarry on being with the city five years, and said she is grateful for everything they do for the city. She congratulated Ray McDonald and his department on the great Easter egg hunt. She stated that all the city employees are the best. Council Member Miller congratulated Karan Jasper and Sandi McGarry, and said they both do a great job. He stated that the approved masonry amendments were excellent, and stated his appreciation for staff's efforts to make Euless more balanced with Southlake, Colleyville, and Grapevine, and at the same time, separating Euless from the south side of Fort Worth. He congratulated Jerry Poteet, Ray McDonald, Diane Eggers, and all the Parks and Community Services staff on the great job they did at the Texas Trash Off. He noted that there were over 300 volunteers, which included Billy Owens, Boyce Byers, Barney Snitz and his wife, Ann Marie, Carroll Scott, Ray Kunze, and Bill Ridgway. He stated that the city will be kicking off the Healthy New Euless physical fitness program and recognized 88 year old Carroll Scott as an example of physical fitness. He stated he attended a Colleyville Women's Club function where Euless student Crystal Gwartney, a student a Colleyville Heritage High School, was recognized for her volunteer work in the community. Mayor Pro Tem Porterfield congratulated Karan Jasper and Sandi McGarry, stating that he is glad they are with the City of Euless. He stated that ARTSNET held a program in the Euless library on Monday night, and that the band Fingerprints played Jazz music with the "Blooms of Enlightenment" art work as a background, making for an outstanding evening. He thanked the council and staff for providing the funds to support ARTSNET. Council Member Massey stated her appreciation for Karan Jasper and Sandi McGarry stating that she hopes they are around for many more years. She encouraged citizens to participate in the Healthy New Euless program. She stated that she will walk on April 27, at 11:00 a.m. at Can Park. She noted that the city will give away free trees at the May 6th Mother's Day plant sale and tree giveaway, to be held at the Parks at Texas Star. Mayor Saleh stated that Sandi McGarry gives a great first impression to the city, and noted that if something needs to be done at the library that Karan Jasper is the person to go to. She mentioned meeting someone at Tarrant County College who participated in the Texas Trash Off. She noted that the Relay for Life will be held for the first time in Euless on April 28, with the kick-off at 5:00 p.m. followed by an all-night walk. She City Council Minutes Page 8 of 8 April 11, 2006 stated that the Trinity High School football team will do the Hakah dance. She wished Ni.. everyone a beautiful Easter season.
