MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL JUNE 13, 2006 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:12 p.m. on Tuesday, June 13, 2006, in the Precouncil Conference Room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Linda Martin, Council Members Carl Tyson, Leon Hogg, Charlie Miller, Glenn Porterfield, and Michael Brown. The precouncil meeting included discussion of telecommunication legislation, cable franchises, and a tower lease update by Director of Economic Development Bill Ridgway, and the Parks at Texas Star Walk of Champions induction by Director of Parks and Community Services Ray McDonald. Assistant Police Chief Harland Westmoreland reported that the Federal Communication Commission is in the process of rebanding public safety radios to segregate them from the private sector. Assistant Police Chief Bob Freeman updated the city council members on the upcoming regional Emergency Operation Center exercise to be conducted by the state in a 16-county area. Chief Freeman gave an update on the Citizen Emergency Response Team (C.E.R.T.) program. He stated that approximately 60 people have been trained through the program and they are a huge resource for the City of Euless. Library Administrator Kate Lyon gave an update on the plans for the Library's 10th birthday celebration in July. The agenda items were reviewed. The city council convened into closed session at 5:35 p.m. for deliberation regarding pending litigation of God's Chariot vs. City of Euless and economic development incentives for The Shops at Vineyard Village as authorized by Sections 551.071 and 551.087 of the Texas Government Code. The city council recessed for dinner at 6:00 p.m. and reconvened into closed session at 6:25 p.m. The city council reconvened into open session at 7:00 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:08 p.m. for the consideration of scheduled items. PLEDGE OF ALLEGIANCE Mayor Pro Tern Linda Martin led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF SERVICE PINS Director of Parks and Community Services Ray McDonald and Recreation Manager Suzanne Hendrickson introduced Graphic Artist Jeff Towne and his wife Amy. Police Chief Leonard Carmack introduced Sr. Police Officer Brian Brennan and his wife Christy. Mayor Saleh presented Jeff with a 5-year service pin and Brian with a 10-year service pin. Mayor Saleh noted that Animal Control Officer Richard Boatright was unable to attend the meeting to receive his 15-year service pin. ITEM NO. 2 RECOGNITION OF EULESS MARINES RETURNED FROM IRAQ Donnie Huber introduced his sons Marine Reservist Corporal Brian Huber and Marine Reservist Lance Corporal Michael Huber, and his wife Kitty and baby daughter Emma. Mayor Saleh presented Certificates of Recognition to the two brothers who were stationed in Al Qa'im, Iraq, with the 3rd Battalion, 6th Marine Regiment's Motor Transport Section. ITEM NO. 3 PRESENTATION OF AWARD Mayor Saleh presented a video of the U.S. Conference of Mayors – City Livability Award the City of Euless received. She recognized Communications/Marketing Manager Betsy Boyett, Recycling Coordinator Kaye Anderson, Consulting Program Development Instructor Lori De La Cruz, HEB Science Coordinator Gloria Chatelaine, and Kathy Haecker who were involved in creating the compost-ology program and in making the video. Mayor Saleh presented Marie with a Euless lapel pin. ITEM NO. 5 APPROVAL OF RESOLUTION NO. 06-1225 Council Member Hogg motioned to approve Resolution No. 06-1225 supporting the naming of a U.S. Navy Ship the USS Fort Worth. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, Porterfield, and Brown Nays: None Mayor Saleh declared the motion carried. ITEM NO. 6 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1739 Mayor Pro Tern Martin motioned to approve the first and final reading of Ordinance No. 1739 denying a 3.6% rate increase proposed by Atmos Energy Corp. Council Member Brown seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, Porterfield, and Brown Nays: None Mayor Saleh declared the motion carried. ITEM NO. 7 APPROVAL OF RESOLUTION NO. 06-1226 Council Member Miller motioned to approve Resolution No. 06-1226 authorizing Cities Aggregation Power Project, Inc. (CAPP), to negotiate and execute an electric supply agreement on behalf of the City of Euless for delivery of electricity purchases in 2007 and 2008. Mayor Pro Tem Martin seconded the motion. ITEM NO. 8 PUBLIC HEARING AND APPROVAL OF FIRST READING OF ORDINANCE NO. 1738 Mayor Saleh opened the public hearing at 7:36 p.m. regarding Ordinance No. 1738 amending the existing TXU Electric Delivery Company franchise agreement to provide for a different payment schedule and an extension of the franchise term. City Manager Joe Hennig stated that franchise payments are currently made on an annual basis, and the agreement is being changed to provide for quarterly payments and to extend the contract five years. There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:37 p.m. Council Member Hogg motioned to approve the first reading of Ordinance No. 1738 amending the existing TXU Electric Delivery Company franchise agreement by providing for quarterly payments instead of annual payments, and extending the term for an additional five years to expire on April 30, 2025. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Martin, Council Members Tyson, Hogg, Miller, Porterfield, and Brown Nays: None Mayor Saleh declared the motion carried. Mayor Saleh noted that the second reading of the ordinance will be on August 15, 2006. ITEM NO. 9 AWARD OF BID NO. 023-06 Mayor Pro Tern Martin motioned to award Bid No. 023-06 to Estes, Inc., of Dallas, UAP of Irving, and Helena Chemical of Greenville, for various plant protectants and fertilizers for Texas Star Golf Course and the parks department, in the estimated expenditure of $99,876. Council Member Porterfield seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, Porterfield, and Brown Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 5 of 7 June 13, 2006 ITEM NO. 10 AWARD OF BID NO. 025-06 Council Member Miller motioned to award Bid No. 025-06 to TMC Service Co., 9806 Brockbank Drive, Dallas, Texas, 75220, for the irrigation of Bob Eden Park, in the amount of$49,976. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, Porterfield, and Brown Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 APPROVAL OF CITY COUNCIL MINUTES Council Member Hogg motioned to approve the minutes of the Regular City Council Meeting of May 30, 2006. ITEM NO. 12 REQUEST BY GEORGE R. MOORE TO ADDRESS CITY COUNCIL George Moore addressed the council regarding various issues. ITEM NO. 13 PUBLIC COMMENTS There were no public comments. ITEM NO. 14 REPORTS STAFF REPORT There was no staff report. CITY MANAGER City Manager Joe Hennig stated the city won a significant decision in federal court last week regarding the Dickey Apartment lawsuit, and that the final order will be issued next City Council Minutes Page 6 of 7 June 13, 2006 week. He stated the city is still faced with the issue of the property being cleaned up. �... He thanked Director of Planning and Development Mike Collins and his efforts on this issue. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. CITY COUNCIL Council Member Tyson congratulated Police Investigator Brian Brennan and Graphics Artist Jeff Towne on receiving their service pins. He stated that the city employees do their jobs well and congratulated them all. Council Member Hogg congratulated the employees. He stated that Michael and Brian Huber look too young to have already been in Iraq. He noted that the City Livability Award is great for Euless. He welcomed Marie Gauthier to Euless. Mayor Pro Tem Martin congratulated Brian Brennan and Jeff Towne. She noted that this is Computer Specialist Kim Ross' last council meeting and wished her well at her new job, stating she will be missed. She congratulated those involved with the Compost-ology program and Civil Livability Award the city won. She also thanked all of the volunteers, military people, citizens, and employees who make the City of Euless Nor such a great, livable city. Council Member Miller congratulated Brian Brennan and Jeff Towne. He stated that the court decision was a great victory regarding the Dickey Apartments. He welcomed Marie Gauthier and stated his admiration for her coming here. Council Member Porterfield congratulated the employees and the young marines and welcomed Marie Gauthier from France. He also congratulated Mayor Saleh on the City Livability Award, stating that he is sure her appearance at the U. S. Conference of Mayors contributed to Euless receiving this award. He stated he recently saw a billboard indicating that Alvarado is "one city under God", and also thinks that applies to Euless. Council Member Brown thanked Brian Brennan and Jeff Towne for their service to the city. He also thanked Kim Ross for her service to the city, stating that she has been a partner in many of his successes since they both worked together in the police department. He congratulated Mayor Saleh on the City Livability Award. He also congratulated Michael and Brian Huber noting they are a testament of the next great generation. Mayor Saleh stated Kim Ross will be missed and wished her well. She thanked staff and stated it was great to have the young Marines at the meeting. She stated she appreciates everyone in the city.
