HomeMy WebLinkAbout2007-02-13 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL FEBRUARY 13, 2007 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 5:05 p.m. on Tuesday, February 13, 2007, in the Precouncil Conference Room of City Hall, 201 N. Ector Drive. Those present included: Mayor Saleh, Mayor Pro Tern Linda Martin, and Council Members Carl Tyson, Leon Hogg, Charlie Miller, and Glenn Porterfield. The precouncil meeting included a development and code update by Director of Planning and Development Mike Collins and City Manager Joe Hennig; a report on upcoming street overlays, installation of signal lights, enlargement of employee parking area at the police and courts building, and a quarterly report on wastewater by Director of Public Works Ron Young; and a review of agenda items. The city council convened into closed session at 6:46 p.m. for deliberation of pending litigation as authorized by Sections 551.071 of the Texas Government Code and reconvened into open session at 6:55 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:05 p.m. for the consideration of scheduled items. PLEDGE OF ALLEGIANCE Council Member Leon Hogg led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE SERVICE PIN Interim Police Chief Bob Freeman introduced Police Officer Sheli Hartley, and Mayor Saleh presented Sheli with a 5-year service pin. ITEM NO. 2 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Director of Public Works Ron Young, City Engineer Robert Barker, and Sr. Civil Engineer Allen Harts, proclaiming the week of February 18 - 24, 2007, as National Engineer's Week. CONSENT AGENDA Council Member Miller motioned to approve Consent Agenda Items numbered 3 through 5. Mayor Pro Tem Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, and Porterfield Nays: None Mayor Saleh declared the motion carried. ITEM NO. 3 AWARD OF BID NO. 009-07 Awarded Bid No. 009-07 to Whitmore & Sons, Inc., P. O. Box 210203, Bedford, Texas, 76095, in the amount of $129,130 for mowing maintenance of city medians and parks, and to O'Donnell's Landscape Services, Inc., 2140 E. Southlake Blvd., Suite L607, Southlake, Texas, 76092, in the amount of $60,494 for mowing maintenance of the city hall complex, city facilities, city rights-of-way, and the police and courts building, for a total expenditure of $189,624. ITEM NO. 4 APPROVAL OF PURCHASE Approved the purchase of an automated voice mail network, Interactive Intelligence Communite Voice Mail (ININ) — Centrex, from AT&T DataComm through the State of Texas Purchasing Contract, in the amount of$52,765.75. City Council Minutes Page 3 of 7 February 13, 2007 ITEM NO. 5 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of January 23, 2007. REGULAR AGENDA ITEM NO. 6 ACCEPTED RESIGNATION OF COUNCIL MEMBER, PLACE 6 Council Member Hogg motioned to accept the resignation of Michael Brown, Council Member, Place 6. Mayor Pro Tem Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, and Porterfield Nays: None Mayor Saleh declared the motion carried. Mayor Saleh presented Mike with a plaque and a council photograph for his service on the city council. City Manager Joe Hennig announced that Mike Brown has resigned from the city council to become the new Euless Police Chief. Michael introduced his wife, Anicia, and son, Leland. ITEM NO. 7 APPROVAL OF RESOLUTION NO. 07-1240 Council Member Hogg motioned to approve Resolution No. 07-1240 calling a special election to be held on May 12, 2007, for City Council Place Six, for an unexpired term of two years. Mayor Pro Tem Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, and Porterfield Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 07-01-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1771 ,` Mayor Saleh opened the public hearing at 7:24 p.m. regarding Specific Use Permit No. 07-01-SUP on Lot 1, Block 3, Euless Industrial Park Addition, for The Redeemed City Council Minutes Page 4 of 7 February 13, 2007 Christian Church of God in TX-10 (Texas Highway 10 Multi-Use District) zoning located �.. at 1717 W. Euless Boulevard. Director of Planning and Development Mike Collins stated that this is the fourth request for a renewal of a specific use permit; the original being approved in November, 2002. Abbey Adeyeye, 1717 W. Euless Blvd, applicant, thanked the city council for their leadership and support. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:26 p.m. Council Member Miller asked why the applicant is being required to come back before the council every year for approval? Director of Planning and Development Mike Collins stated that it is because of staff's uncertainty regarding future ownership of the property since the applicant has been operating under a lease to purchase option and is attempting to purchase the property. Council Member Miller motioned to approve the first and final reading of Ordinance No. 1771 for Specific Use Permit No. 07-01-SUP on Lot 1, Block 3, Euless Industrial Park Addition, for The Redeemed Christian Church of God in TX-10 (Texas Highway 10 Multi-Use District) zoning, located at 1717 W. Euless Boulevard, without a time limit and it being tied to the Pastor Abbey Adeyeye and The Redeemed Christian Church of God. However, in the event there is a change of pastor, church name, or ownership of the property, the specific use permit would become null and void. Mayor Pro Tem Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, and Porterfield Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9 PUBLIC HEARING FOR PLANNED DEVELOPMENT NO. 06-03-PD AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1770 Mayor Saleh opened the public hearing at 7:30 p.m. regarding Planned Development No. 06-03-PD changing the zoning on a portion of Tract A, Oakwood Terrace West Addition, from C-2 (Community Business District) to PD (Planned Development District) based on R-1 L, located on South Pipeline Road. ... Director of Planning and Development Mike Collins stated that the applicant, Integer Development, LP, represented by Charles Dibrell, is requesting to construct 24 homes on a 4.692 acre tract on South Pipeline Road, west of Simmons Drive. The R-1 L district standards allow for a minimum lot size of 5,500 sq. ft., minimum lot width of 50 ft., City Council Minutes Page 5 of 7 February 13, 2007 minimum front yard of 20 ft., and minimum rear yard of 15 ft. The lot sizes will range ti.. from 5,500 sq. ft. to 13,711 sq. ft., with the average being 6,604 sq. ft. The subdivision will include private streets without a gated entry, minimum dwelling unit size of 1,850 sq. ft., and a homeowner's association to maintain the private streets, open spaces, entrances, landscaping on homeowner's association lots, screening walls, emergency access gate and sidewalks. A masonry screening wall will be constructed along the property boundary adjacent to South Pipeline Road and continue along the eastern property boundary across the entire length of Lot 1, Block A. From that point continuing northward along Lots 2-4, Block A, an 8 ft. wooden fence will be installed featuring metal posts and cedar stain. The masonry screening wall will contain two sections of wrought iron flanking the primary entry as necessitated by the location of an existing gas easement. In addition, a wrought iron fence will be constructed along the western portion of the property along the existing floodway. Mayor Saleh asked for any proponents. Billy Owens, 508 Sunset Drive, Euless, stated from the audience that he did not want to speak, but was in favor of the project. Charles Dibrell, 2403 Cales Drive, Arlington, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:35 p.m. Council Member Tyson asked the difference between the floodway and floodplain shown on the development plan. City Engineer Robert Barker stated that the floodway is the overbank area of the creek, and no obstruction can be built in that area. He stated that the floodplain has a 1% chance of flooding in a year. He stated the area between the floodway and floodplain can be developed when the elevation is built up 2 ft. higher than the floodplain elevation. He noted that the lots will be graded to drain towards the creek. Council Member Miller motioned to approve the first and final reading of Ordinance No. 1770 for Planned Development No. 06-03-PD changing the zoning on a portion of Tract A, Oakwood Terrace West Addition, from C-2 (Community Business District) to PD (Planned Development District) based on R-1 L, located on South Pipeline Road, with second story windows on the north side of the homes to have opaque glass. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Tyson, Hogg, Miller, and Porterfield Nays: None Mayor Saleh declared the motion carried. City Council Minutes Page 6 of 7 February 13, 2007 ITEM NO. 10 PUBLIC COMMENTS There were no public comments. ITEM NO. 11 REPORTS STAFF REPORT There was no staff report. CITY MANAGER City Manager Joe Hennig stated he is pleased to have Mike Brown joining the staff and noted that it has been a long search and decision process to find a police chief. He stated that Mike has the expertise and background and is a great guy with a great family. He stated that the city has many great employees, noting that Bob Freeman has stood in as interim chief for the second time. The first time was about six months after Gary McKamie resigned to become Deputy City Manager, and this time since Leonard Carmack resigned in August. He thanked Bob Freeman and stated how much he appreciated him. CITY ATTORNEY ,` City Attorney Bob McFarland had nothing to report. CITY COUNCIL Council Member Porterfield congratulated Mike Brown and stated Mike will be missed on the city council, but he is proud that Mike is still around. He congratulated Sheli Hartley on receiving her 5-year pin and the engineering staff on National Engineering Week, stating they are a great group of men. Council Member Miller congratulated Mike Brown and the engineering department, stating that they do a wonderful job day in and day out. He also congratulated Sheli Hartley on receiving her 5-year service pin. Mayor Pro Tern Martin thanked the city's engineers for all their work. She congratulated Sheli Hartley and noted that she met Sheli when she was a dispatcher, and that Sheli recently received the Lifesaving award. She congratulated Fire Chief Koontz on the fantastic fire department award banquet. She noted that Vernon Gilmore received the Fire Employee of the Year award after being a Euless employee only two years. She stated she has filed for reelection and thanked everyone for their support. Council Member Hogg congratulated Mike Brown and all the employees. Council Member Tyson congratulated Sheli Hartley and the city's engineering staff for always doing a good job for us. He thanked Bob Freeman for his work as interim police chief and Mike Brown for his service on the city council. City Council Minutes Page 7 of 7 February 13, 2007 Mayor Saleh stated it will be fun working with Mike Brown as police chief. She noted *t., that Bob Freeman and several other police officers are charter members of the new HEB Lion's Club. She stated she attended a transportation meeting where it was noted that the Grapevine funnel and Interstate 35 improvements will be constructed prior to the widening of SH 183. She congratulated Lee Koontz for the great awards dinner and the honor guard presentation.
