HomeMy WebLinkAbout1198 12-12-1995 Reconfiguring boundariesORDINANCE NO. 1198 AN ORDINANCE AMENDING ORDINANCE NO. 1163 AND RECONFIGURING AND REDUCING THE BOUNDARIES OF REINVESTMENT ZONE NUMBER ONE, CITY OF EULESS, TEXAS; MAKING CERTAIN FINDINGS AND DETERMINATIONS IN RELATION TO SUCH REINVESTMENT ZONE AND RESOLVING OTHER MATTERS INCIDENT AND RELATED THERETO. WHEREAS, in accordance with the provisions of the Tax Increment Financing Act, V.T.C.A., Tax Code, Chapter 311 (the "Act"), the City of Euless did on December 13, 1994, adopt Ordinance No. 1163, designating a certain area of the City as Reinvestment Zone Number One, City of Euless, Texas; and WHEREAS, the City Council of the City of Euless, Texas (the "City"), in accordance with the provisions of the Tax Increment Financing Act, V.T.C.A., Tax Code, Chapter 311 (the "Act"), particularly Section 311.007(a) of the Act, desires to reconfigure and reduce the boundaries of the existing reinvestment zone; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1: That the facts and recitations contained in the preamble of this ordinance are found and declared to be true and correct and are hereby incorporated by reference for all purposes as if same had been restated in this section. SECTION 2: The City Council hereby makes the following findings and determinations based on the evidence presented to it: -1- (a) That the changed boundaries of the reinvestment zone do not cause the zone to include property more than 10 percent of which, excluding property dedicated to public use, is used for residential purposes (as that term is defined by the Act). (b) That the changed boundaries of the reinvestment zone do not cause the total appraised value of all taxable real property in the zone, according to the most recent appraisal rolls of the City, together with the total appraised value of taxable real property in all other existing reinvestment zones within the City, if any, according to the most recent appraisal rolls of the City, to exceed 15 percent of the current total appraised value of taxable real property in the City and in the industrial districts created by the City, if any. (c) That the changed boundaries of the reinvestment zone do not cause the zone to contain more than 15 percent of the total appraised value of real property taxable by a county or school district. SECTION 3: That the City hereby amends Ordinance No. 1 163 and reconfigures and reduces the boundaries of Reinvestment Zone Number One, City of Euless, Texas pursuant to Section 311.007(a) of the act, over the area described by the metes and bounds in Exhibit "1" attached hereto and depicted in the map attached hereto as Exhibit "2" and such reinvestment zone shall continue to be identified as Reinvestment Zone Number One, City of Euless, Texas (the "Zone" or "Reinvestment Zone"). SECTION 4: That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable, and if any section, paragraph, sentence, clause or phrase of this Ordinance shall for any reason he held to -2- be invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the invalidity or unconstitutionality of such section, paragraph, sentence, clause or phrase shall not affect any of the remaining provisions of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such invalid or unconstitutional section, paragraph, sentence, clause or phrase. SECTION 5: It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by V.T.C.A., Government Code, Chapter 551, as amended. SECTION 6: This Ordinance shall be in full force and effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Euless and the laws of the State of Texas and it is accordingly so ordained. SECTION 7: That the provisions of Ordinance #1163 shall remain in full force and effect, except as expressly amended by the provisions of this Ordinance. -3 - PRESENTED AND GIVEN FIRST READING and approved at a regular meeting of the Euless City Council on the 12th day of December, 1995; by a vote of 7 ayes, 0 nays and 0 abstentions.
