HomeMy WebLinkAbout2007-12-11 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL DECEMBER 11, 2007 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:05 p.m. on Tuesday, December 11, 2007, in the Precouncil Conference Room of City Hall, 201 N. Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tern Leon Hogg, Council Members Tim Stinneford, Linda Martin, Charlie Miller, Glenn Porterfield, and Perry Bynum. The precouncil meeting included: • A discussion led by Director of Planning and Development Mike Collins, Planning and Development Manager Chris Barker, and City Manager Gary McKamie regarding the proposed agreement between the City of Euless and the Texas Star Town House development in Fort Worth; Nom. > A discussion of proposed changes to the City's sign ordinance led by Director of Planning and Development Mike Collins and City Manager Gary McKamie; • A report from City Manager Gary McKamie regarding the plans for the City to begin mowing the right-of-way along SH 183 within the Euless city limits; > A discussion led by City Manager Gary McKamie regarding the maintenance issues of the Concord Apartments; > A video presentation of proposed development on DFW Airport property located within the Euless city limits presented by City Manager Gary McKamie; > and the review of agenda items. The city council convened into closed session at 6:30 p.m. for pending litigation concerning George Moore and deliberation of real property, as authorized by Sections 551.071, and 551.072 of the Texas Government Code. They reconvened into open session at 7:00 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:06 p.m. for the consideration of scheduled items. INVOCATION Reverend Johnny Kimberllin, Pastor of South Euless Baptist Church, gave the invocation. PLEDGE OF ALLEGIANCE Boy Scout Troop No. 273 led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE SERVICE PINS Fire Chief Lee Koontz introduced Fire Marshal/Division Chief Paul Smith, and Public Works Director Ron Young introduced Sr. Civil Engineer Allen Harts. Mayor Saleh presented each of them with a five-year service pin. ITEM NO. 2 PRESENTATION OF EMPLOYEE OF THE YEAR Director of Parks and Community Services Ray McDonald introduced Parks Field Tech Cary Stephenson, and Mayor Saleh presented Cary with a plaque for being selected Employee of the Year for 2007. City Council Minutes Page 3 of 7 December 11, 2007 ITEM NO. 3 RECOGNITION OF RECIPIENTS OF THE EAGLE SCOUT AWARD �- FROM THE BOY SCOUTS OF AMERICA Mayor Saleh presented Certificates of Recognition to Folasa Galeai and Michael Vea, recipients of the Eagle Scout Award from the Boy Scouts of America. CONSENT AGENDA Council Member Stinneford motioned to approve Consent Agenda Items numbered 4 through 6. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Hogg, Council Members Stinneford, Martin, Porterfield, Miller, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 4 APPROVAL OF INTERLOCAL AGREEMENT Approved an interlocal agreement with Tarrant County for asphalt overlay improvements to North Main Street (Harwood Road to Little Bear Creek) and Cullum Drive (SH 10 to Iron Bridge Place) in the amount of $290,000. ITEM NO. 5 APPROVAL OF PURCHASE Approved purchase of golf course maintenance mowers and greens spray rig for the Texas Star Golf Course from Professional Turf Products, 1010 North Industrial Boulevard, Euless, Texas, 76039, through the Texas Local Government Purchasing Cooperative, also known as the Texas Buy Board Program, in the amount of $148,801.70. ITEM NO. 6 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of November 27, 2007. REGULAR AGENDA ITEM NO. 7 APPROVAL OF RESOLUTION NO. 07-1267 Mayor Pro Tem Hogg motioned to approve Resolution No. 07-1267 appointing Lacy Britten as Municipal Court Judge of the Euless Municipal Court of Record for a two-year term to expire December 31, 2009. Council Member Stinneford seconded the motion. ITEM NO. 8 EXTENSION OF CONTRACT FOR MUNICIPAL COURT JUDGE Council Member Stinneford motioned to extend the contract for Municipal Court Judge Lacy Britten for a one-year term to expire December 31, 2008. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, Council Members Stinneford, Martin, Porterfield, Miller, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9 AUTHORIZED THE MAYOR TO NEGOTIATE AND EXECUTE CONVEYANCE DOCUMENTS Nor Council Member Martin motioned to authorize the Mayor to negotiate and execute conveyance documents for the purchase of commercial property located at 710 South Main Street, described as Lots 17 & 18, Block 8, Cedar Hill Estates Addition. Mayor Pro Tem Hogg seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, Council Members Stinneford, Martin, Porterfield, Miller, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 10 APPROVAL OF RESOLUTION NO. 07-1268 Council Member Bynum motioned to approve Resolution No. 07-1268 authorizing a public auction to take place on January 2, 2008, at 10:00 a.m. in the City Council Chambers for the sale of a .645 acre parcel of land known as Parcel C, Little Bear Addition in the Levi Franklin Survey, Abstract 513, Tarrant County, located on the northwest corner of Gateway Boulevard and Mid-Cities Boulevard. Mayor Pro Tern Hogg seconded the motion. ITEM NO. 11 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 07-23-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1800 Mayor Saleh opened the public hearing at 7:28 p.m. for Specific Use Permit No. 07-23- SUP on Lot A43R, Block 1, Oakwood Terrace Addition, for The Chop Shop, a motorcycle repair service in TX-10 (Texas Highway 10 Multi-Use District) zoning, located at 230 Vine Street, #3. Director of Planning and Development Mike Collins stated that the applicant, Che Eccles, owner of the Chop Shop, is requesting renewal of the specific use permit that was approved in December, 2006. He stated that the Chop Shop has operated successfully during the past year without incident. Mayor Saleh asked for any proponents. Mr. Che Eccles, 509 Vine Street, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public ,r,. hearing at 7:31 p.m. Council Member Martin motioned to approve first and final reading of Ordinance No. 1800 for Specific Use Permit No. 07-23-SUP on Lot A43R, Block 1, Oakwood Terrace Addition, for The Chop Shop, a motorcycle repair service in TX-10 (Texas Highway 10 Multi-Use District) zoning, located at 230 Vine Street, #3, with the following conditions: (1) All of the activity is internal to the structure, and will not negatively impact adjacent property/business owners; (2) No permanent outdoor display/storage of merchandise; (3) The Fire Marshal has established that a maximum of twenty gallons of fuel will be allowed, including fuel in vehicle tanks; (4) Tied to business owner Mr. Che Eccles; and (5) Valid for five years. Council Member Bynum seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Hogg, Council Members Stinneford, Martin, Porterfield, Miller, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 12 PUBLIC COMMENTS There were no public comments. City Council Minutes Page 6 of 7 December 11, 2007 ITEM NO. 13 REPORTS STAFF REPORT Building Official Kurt Kasson reviewed the process that occurs in the Planning and Development Department after a project receives city council approval. Mr. Tom Winn, project manager for Burk Collins, praised the staff and building process in Euless. He named some of the businesses scheduled to be open by March, 2008, in the Shops at Vineyard Village including Staples, Bed, Bath & Beyond, Famous Footwear, Marshalls, and Pet Smart. CITY MANAGER City Manager Gary McKamie stated his appreciation for Tom Winn and Burk Collins and the development they have brought to Euless. He thanked Cary Stephens for his work and congratulated him on being selected Employee of the Year for 2007. He announced the Town Hall meetings on January 10 and January 24, 2008, at 7:00 p.m. in the City Council Chambers. He thanked employees and citizens for a good year, which he noted has been a year of transition. CITY ATTORNEY r.r• City Attorney Bob McFarland wished everyone a Happy Holiday and asked that he be remembered as he has hip replacement surgery this week. CITY COUNCIL Mayor Pro Tem Hogg congratulated all the employees, but especially the ones recognized tonight. He stated he has known Parks Field Tech Cary Stephenson all the years he has worked for the city, and no one works harder than Cary. Council Member Martin stated that no one is more deserving of employee of the year than Cary. She thanked Cary for all he has done for the city, citizens, and staff. She stated that Fire Marshal Paul Smith and Sr. Civil Engineer Allen Harts are an important part of why our city staff is so great. She thanked Tom Winn for his kind words and Building Official Kurt Kasson for his report. She noted that she understands why everything works so well here, because the great staff is dedicated to their jobs and doing the right thing. She congratulated the Eagle Scouts recognized tonight, stating they are the leaders of tomorrow. She stated that Bob McFarland would be in her prayers, and she hoped his surgery goes well. She wished everyone a Merry Christmas. She noted that 2007 was a good year and that 2008 will be even better. Council Member Miller congratulated the Eagle Scouts who were recognized and commended them on their projects. He congratulated Cary Stephenson on being awarded the honor of Employee of the Year. He thanked Kurt Kasson and Tom Winn for their reports and comments. He congratulated the Parks Department on the Christmas Parade and the Heritage Park Christmas Event. He wished the citizens a City Council Minutes Page 7 of 7 December 11, 2007 Merry Christmas. He stated that the employees give a lot of their personal time and generosity and wished them a special Merry Christmas. Council Member Porterfield thanked Cary Stephenson for being an employee of Euless. He congratulated Paul Smith and Allen Harts on receiving their 5-year service pins. He thanked Kurt Kasson for a great report and Tom Winn on a user's viewpoint. He said he saluted the Eagle Scouts who are a group of special young men, and he urged them to continue to be examples to the other scouts and to be leaders. Council Member Bynum congratulated Cary Stephenson. He thanked Kurt Kasson on a great report, stating that the development department's hard work is starting to show in the new development at the Shops at Vineyard Village. He wished everyone a Merry Christmas and urged the citizens to come to the town hall meetings. Council Member Stinneford congratulated Cary Stephenson, stating he should be proud that he is number one out of all the employees this year. He congratulated Paul Smith and Allen Harts on their years of service with the city and stated he hoped they will be here a lot longer. He congratulated the Eagle Scouts on their achievements. He wished everyone a Merry Christmas and great holiday season. He noted that the Euless Citizens Police Academy Alumni Association has Euless afghans for sale. Mayor Saleh stated that Cary Stephenson received a well-deserved award. She thanked Tom Winn for coming to support our Development Department. She `... recognized Harvey Little, a citizen in the audience, who is a great benefactor to the city. She reminded everyone of the next city council meeting on January 8, 2008, and urged the citizens to attend the Town Hall meetings. She asked everyone to remember Bob McFarland as he has surgery this week and Eagle Scout Michael Vea's father who is in Iraq. She urged everyone to support the Trinity Trojans and noted that several of the Eagle Scouts in attendance tonight are on the Trinity High School football team.
