HomeMy WebLinkAbout2008-03-11 `�- MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL MARCH 11, 2008 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:06 p.m. on Tuesday, March 11, 2008, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Leon Hogg, Council Members Tim Stinneford, Linda Martin, Charlie Miller, Glenn Porterfield, and Perry Bynum. The precouncil meeting included: > A briefing by Parks and Community Services Director Ray McDonald regarding the proposed Parks, Recreation and Open Space Master Plan; > Discussion regarding the condition and repairs of the City's swimming pools and the future of the aquatics program by Director of Parks and Community Services Ray McDonald and City Manager Gary McKamie; > Discussion of proposed changes to the current gas drilling ordinance led by Planning and Development Manager Chris Barker and Fire Marshal Paul Smith; • Discussion led by City Manager Gary McKamie of the Euless Home Program and Tarrant County funding assistance; • and the review of agenda items. The city council convened into closed session at 6:40 p.m. for deliberation regarding pending litigation regarding George R. Moore vs. City of Euless, and Merced vs. City of Euless as authorized by Sections 551.071 of the Texas Government Code, and deliberation regarding economic development negotiations regarding Glade Park and Redico, as authorized by Sections 551.087 of the Texas Government Code. They reconvened into open session at 7:00 p.m. COUNCIL CONSIDERATION OF SCHEDULED ITEMS - COUNCIL CHAMBERS The Euless City Council continued their meeting in the Council Chambers at 7:05 p.m. for the consideration of scheduled items. INVOCATION Mayor Saleh gave the invocation. PLEDGE OF ALLEGIANCE Council Member Perry Bynum led the Pledge of Allegiance. ITEM NO. 1 PRESENTATION OF EMPLOYEE SERVICE PINS Deputy City Manager Loretta Getchell introduced Interim Fire Chief Robert Isbell, his wife, Laura, and daughters, Hannah & Emily. Interim Fire Chief Robert Isbell introduced Driver Engineer Steve Mayo and his wife, Vanessa. Mayor Saleh presented Robert Isbell with a 5-year service pin and Steve Mayo with a 25-year service pin. ITEM NO. 2 PRESENTATION OF PROCLAMATION City Manager Gary McKamie introduced Retired Fire Chief Lee Koontz and his wife, Lark. Mayor Saleh presented Lee Koontz with a proclamation in honor of his retirement with over twenty-six years of service. City Council Minutes Page 3 of 7 March 11, 2008 ITEM NO. 3 PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Emily Getzschman, Director of Communications and Government Relations with the Chisholm Trail Chapter of the American Red Cross, proclaiming March, 2008, as American Red Cross Month. ITEM NO. 4 PRESENTATION OF LIFE SAVING AWARD Lieutenant John Williams introduced Anthony Casey Randolph and described the event that led to Mr. Randolph being recognized. Mayor Saleh presented a Life Saving Award to Casey Randolph for preventing a man from jumping from the Main Street bridge over SH 183. ITEM NO. 5 RECOGNITION OF RECIPIENT OF THE EAGLE SCOUT AWARD FROM THE BOY SCOUTS OF AMERICA Mayor Saleh noted that Ian Nafziger was unable to attend the meeting due to a school function. REGULAR AGENDA ITEM NO. 6 AUTHORIZED MAYOR TO EXECUTE AN INTERLOCAL AGREEMENT Council Member Miller motioned to authorize the Mayor to execute an interlocal agreement with the City of Colleyville establishing the conditions under which Glade 121, L.P., can construct improvements to Heritage Avenue, the scope of the improvements, and the level of coordination regarding construction inspection and construction management work. Council Member Stinneford seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Hogg, Council Members Stinneford, Martin, Miller, Porterfield and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 7 APPROVAL OF RESOLUTION NO. 08-1272 Council Member Porterfield motioned to approve Resolution No. 08-1272, a commitment to enter into good faith negotiations to participate in an agreement with the City of Fort Worth regarding the purchase of reclaimed water delivered through Fort Worth's proposed Reclaimed Water Delivery System. Mayor Pro Tem Hogg seconded the motion. ITEM NO. 8 PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 08-01-SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1807 Mayor Saleh opened the public hearing at 7:36 p.m. regarding Specific Use Permit No. 08-01-SUP on Lot 5D, Jasper Addition, for Sycotic Designs, a paint shop in C-2 (Community Business District) zoning, located at 2021 W. Airport Freeway #A. Planning and Development Manager Chris Barker stated the applicant, John E. Philips, currently occupies approximately 5,000 sq. ft. of the existing building, which until recently, had been an ancillary use to the primary user, Wild West Custom Choppers. Wild West Custom Choppers had operated under a specific use permit, but has vacated the building. Mr. Philips desires to remain in the building to continue operating the paint shop, Sycotic Designs. The hours of operation are Monday through Friday from 8:00 a.m. until 7:00 p.m. and Saturday 8:00 a.m. until 5:00 p.m. `... Mayor Saleh asked for any proponents. John Philips, 2021 W. Airport Freeway #A, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:39 p.m. Council Member Martin motioned to approve the first and final reading of Ordinance No. 1807 for Specific Use Permit No. 08-01-SUP on Lot 5D, Jasper Addition, for Sycotic Designs, a paint shop in C-2 (Community Business District) zoning, located at 2021 W. Airport Freeway #A, with the following conditions: (1) Tied to the owner, John E. Philips; (2) Tied to the business name, Sycotic Designs; and (3) Valid for one year. Council Member Stinneford seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, Council Members Stinneford, Martin, Miller, Porterfield and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9 APPROVAL OF SITE PLAN NO. 08-01-SP Planning and Development Manager Chris Barker stated Ronzani, Inc., represented by Flavio Ronzani, seeks approval to locate his commercial construction administrative City Council Minutes Page 5 of 7 March 11, 2008 office and warehouse on 0.626 acre site at the southwest corner of Marlene Drive and Mary Drive. Mr. Ronzani intends to construct a 4,480 sq. ft, single-story building, with 2,000 sq. ft. of office space and 2,480 sq. ft. of warehouse area. A drive approach would be provided off of Marlene Drive. Mr. Ronzani's lot is adjacent on the west side to two lots, with the northern lot zoned residential and the southern lot zoned commercial. He will maintain a 20 ft. setback from these properties and will construct masonry screening along his west property line the full length of his building. The building will feature 100% masonry construction through a combination of true stucco and rock. The proposed site landscaping will meet or exceed all city requirements. Mayor Pro Tem Hogg motioned to approve Site Plan No. 08-01-SP for Ronzani, Inc., a commercial development, on Lot B1, Block 21, Oakwood Terrace North Addition, located at the southwest corner of Marlene Drive and Mary Drive. Council Member Miller seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Hogg, Council Members Stinneford, Martin, Miller, Porterfield and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 10 APPROVAL OF CITY COUNCIL MINUTES Council Member Bynum motioned to approve the minutes of the Regular City Council Meeting of February 26, 2008. Council Member Stinneford seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Hogg, Council Members Stinneford, Martin, Miller, Porterfield and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 11 PUBLIC COMMENTS There were no public comments. ITEM NO. 12 REPORTS STAFF REPORT Communications and Marketing Manager Betsy Deck gave a report describing the email program called MyEuless in which citizens can register to receive regular notification from the city regarding current and upcoming events. The program also gives the city feedback regarding citizens' interests. City Council Minutes Page 6 of 7 March 11, 2008 CITY MANAGER City Manager Gary McKamie congratulated Betsy Deck on the good report she gave, stating he doesn't know of anything she can't do. He noted that she has been working with the Home Program involving churches helping some citizens with needed home repairs. He stated she far exceeds her job description. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. CITY COUNCIL Council Member Bynum congratulated Casey Randolph for making a quick decision that affected not only the man he rescued, but many others who would have been affected had the man jumped from the bridge. He congratulated Lee Koontz on his retirement, stating that as a firefighter, he knows what a big commitment Lee has made as fire chief. He congratulated Texas Star General Manager Glenda Hartsell-Shelton, and noted that Texas Star Golf Course received another high mark, having been listed in the top three public courses in the area. He noted that Director of Parks and Community Services Ray McDonald presented the proposed Parks, Recreation and Open Space Master Plan in precouncil, and thanked him for the work involved in that presentation. Council Member Porterfield commended Interim Fire Chief Robert Isbell and Driver Engineer Steve Mayo on their years of service to the city. He congratulated Lee Koontz stating he is a special man. He commended the American Red Cross on their recognition. He stated that Casey Randolph is a special person and is glad he was recognized for his rescue efforts that saved a life. He stated that Gary McKamie's comments regarding Betsy Deck are absolutely true. Council Member Miller thanked Mr. Ronzani for the nice building he is planning to build in Euless, and noted SH 10 zoning gets all the amenities the council is wanting. He congratulated Robert Isbell, Steve Mayo, and Lee Koontz, stating Lee fought for excellence in the fire department. He congratulated Casey Randolph for the wonderful feat he performed. Council Member Martin stated it was a great night to recognize those people who have an impact, and congratulated Robert Isbell, Steve Mayo, and Lee Koontz. She stated Lee had set the standard for excellence, and he and his wife, Lark, have earned their retirement. She congratulated Casey Randolph for his bravery. She thanked Betsy Deck for a great report. Mayor Pro Tem Hogg expressed kudos to all the employees. He stated yesterday was the last day to file for council election, and that there will not be a runoff. Council Member Stinneford congratulated Robert Isbell, Steve Mayo, and Lee Koontz. He stated Lee had an incredible staff and base of firefighters, and that he worked with him on the Citizens Fire Academy. He stated Lee is as good a person as he is a City Council Minutes Page 7 of 7 March 11, 2008 firefighter. He thanked Betsy Deck for an incredible job. He thanked Casey Randolph �- for saving a life, and noted that he could have easily been pulled off the bridge himself. Mayor Saleh thanked all the employees, citizens, and heroes recognized tonight. She stated that those who did not attend the Verlon Thompson and Mike Brown program at the library missed a great night. She stated her appreciation for everything the library does. She announced the following candidates who have filed for council: Place Two: Leon Hogg and Lorren Britton and Place Four: Donna Mickan and Jay Heilman.
