HomeMy WebLinkAbout2008-05-27 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL MAY 27, 2008 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:07 p.m. on Tuesday, May 27, 2008, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included: Mayor Mary Lib Saleh, Council Members Tim Stinneford, Linda Martin, Donna Mickan Glenn Porterfield, and Perry Bynum. Mayor Pro Tem Leon Hogg was absent. The precouncil meeting included: > The financial report for April given by Director of Finance Vicki Rodriquez; > An update by Director of Planning and Development Mike Collins regarding new commercial and residential developments and the Community Code Action Team (C-CAT) projects. Inspectors Brian McGarry and Rick Eldredge, Police Senior Corporal Joe Hoerth and Neighborhood Police Officer Shelli Hartley were introduced as part of the team; ti... > Discussion led by Director of Planning and Development Mike Collins and City Manager Gary McKamie regarding potential development of an automotive business and a tire and battery firm south of the Shops at Vineyard Village; and a proposed Verizon switching station and cell tower at the southwest corner of Harwood Road and Bear Creek Parkway; • Discussion by Deputy City Manager Loretta Getchell regarding the need for a resolution on a future city council agenda, acknowledging and accepting that the appropriate taxes were paid to the city upon the city's purchase of property at a tax sale for the police and court facility, formerly known as Western Hills Inn. > and the review of agenda items. The city council convened into closed session at 6:20 p.m. for deliberation regarding contemplated or pending litigation concerning a nuisance abatement and Champion Sweeping vs. City of Euless as authorized by Section 551.071 of the Texas Government Code. INVOCATION Council Member Perry Bynum gave the invocation. PLEDGE OF ALLEGIANCE Cub Scout Pack No. 546 led the Pledge of Allegiance. ITEM NO. 1 ADMINISTRATION OF OATHS OF OFFICE AND PRESENTATION OF CERTIFICATES OF ELECTION City Attorney Bob McFarland administered the Oath of Office to Mary Lib Saleh, elected to the office of Mayor, and to Donna Mickan, elected to the office of Council Member `"r Place 4. City Council Minutes Page 3 of 8 May 27, 2008 ITEM NO. 2 SELECTION OF MAYOR PRO TEM Council Member Stinneford motioned to elect Council Member Linda Martin as Mayor Pro Tem. Council Member Bynum seconded the motion. Ayes: Mayor Saleh, Council Members Stinneford, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 3 PRESENTATION OF EMPLOYEE OF THE MONTH FOR JUNE Library Administrator Kate Lyon introduced Library Assistant Paula Myers, her friend, Kenneth Beene, parents, Darrell & Glenda Glinkerman, and children, Michael and Lauren Myers. Mayor Saleh presented Paula with a plaque for being selected employee of the month for June. ITEM NO. 4 PRESENTATION OF EMPLOYEE SERVICE PIN AND PROCLAMATION Director of Parks and Community Services Ray McDonald introduced Parks Manager Johnnie Green and his wife, Elaine. Mayor Saleh presented Johnnie with his 25-year service pin and a proclamation recognizing his retirement with twenty-five years of service. ITEM NO. 5 PRESENTATION OF DISTINGUISHED BUDGET PRESENTATION AWARD Mayor Saleh presented Director of Finance Vicki Rodriquez and Assistant Director of Finance Jackie Theriot with the Distinguished Budget Presentation Award given by the Government Finance Officers Association. CONSENT AGENDA Mayor Pro Tem Martin motioned to approve Consent Agenda Items numbered 6 through 11. Council Member Stinneford seconded the motion. City Council Minutes Page 4 of 8 May 27, 2008 ITEM NO. 6 AWARD OF BID NO. 019-06 Awarded the second and final one-year renewal of Bid No. 019-06 with Estrada Concrete, 1623 Garza Avenue, Dallas, Texas, 75216, for concrete repairs in an amount not to exceed $179,200. ITEM NO. 7 AWARD OF BID NO. 023-07 Awarded the first one-year renewal of Bid No. 023-07 with Reliable Paving, Inc., 1903 North Peyco, Arlington, Texas, for asphalt street repairs, in an amount not to exceed $72,000. ITEM NO. 8 AUTHORIZED CITY MANAGER TO EXECUTE A CONTRACT FOR UNIFORM RENTAL SERVICES Authorized the city manager to execute a three-year contract through the Texas Buy Board Program with G & K Services, Inc., 603 Airline Drive, Coppell, Texas, 75019- 8131, for uniform rental services, with an estimated expenditure of$45,000. ITEM NO. 9 APPROVAL OF RESOLUTION NO. 08-1280 Approved Resolution No. 08-1280 authorizing the filing of a project application with the North Central Texas Council of Governments (NCTCOG) for a Regional Solid Waste Program Local Implementation Project, with the funds to be used to implement a Time to Recycle project in compliance with the SEE Less Trash Regional Solid Waste Management Plan. ITEM NO. 10 APPROVAL OF RESOLUTION NO. 08-1281 Approved Resolution No. 08-1821 committing to continue Euless' participation in an "Energy Reduction Program" to reduce electrical consumption as prescribed in State SB12. ITEM NO. 11 APPROVAL OF CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of May 13, 2008, and the Special Called Meeting of May 19, 2008. ITEM NO. 13 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1811 Mayor Pro Tern Martin motioned to approve the first and final reading of Ordinance No. 1811 amending Chapter 10, "Animals," Article III, "Care and Control," of the Euless Code of Ordinances by adding Section 10-74, "Registration of Dogs and Cats," and amending Chapter 30, "Fees," Section 30-4, "Animals." Council Member Stinneford seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tern Martin, Council Members Stinneford, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 14 HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 08-03- SUP AND APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1813 Mayor Saleh opened the public hearing at 7:35 p.m. regarding Specific Use Permit No. 08-03-SUP on Lot 2R, Block 1, Airport Business Park, for 6 & Under Auto Sales, a motor vehicle dealer, in 1-2 (Heavy Industrial District) zoning, located at 1118 S. Airport Circle#150. Director of Planning and Development Mike Collins stated that the applicant, Robb O'Brien, is proposing to occupy approximately 1,024 sq. ft. of the existing 1,650 sq. ft. building. Mr. O'Brien intends to fulfill a market niche in the automobile industry specializing in the sale of dependable, affordable automobiles in a specific price range through the internet. He only plans to have five or six autos inside at any one time. He noted that he is subleasing the property from James Kinsey, dba Capital Roofing, who still maintains an office in the lease space. `"" Mayor Saleh asked for any proponents. City Council Minutes Page 6 of 8 May 27, 2008 Mr. Rob O'Brien, 2192 Raines Court, Euless, stated having two children in college, he has realized the need for dependable and affordable transportation for young drivers. The vehicles will be thoroughly checked and will sell in the price range of $2,500 to $6,000. He will also cover the first year of oil changes and roadside assistance. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:43 p.m. Council Member Bynum motioned to approve the first and final reading of Ordinance No. 1813 for Specific Use Permit No. 08-03-SUP on Lot 2R, Block 1, Airport Business Park, for 6 & Under Auto Sales, a motor vehicle dealer, in 1-2 (Heavy Industrial District) zoning, located at 1118 S. Airport Circle #150, subject to the following conditions: (1) Tied to the owner, Robb O'Brien; (2) No outdoor display allowed (advertising or banners); (3) No outdoor storage or display of vehicles; (4) No on-site repair of mechanical work to vehicles on the premises; (5) No more than five gallons of fuel stored per vehicle (including fuel in the vehicle gas tank); and (6) Valid for one year. Council Member Stinneford seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Stinneford, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 15 APPROVAL OF FIRST AND FINAL READING OF ORDINANCE NO. 1809 Council Member Mickan motioned to approve the first and final reading of Ordinance No. 1809 for Planned Development No. 08-01-PD amending Planned Development 1775 on Lots 1-8, Block E, of The Enclave at Wilshire Park, changing the rear setback from 30 ft. to 20 ft. only if a single-story product is constructed. Mayor Pro Tem Martin seconded the motion. Ayes: Mayor Saleh, Mayor Pro Tem Martin, Council Members Stinneford, Mickan, and Bynum Nays: Council Member Porterfield Mayor Saleh declared the motion carried. ITEM NO. 16 PUBLIC COMMENTS John Schleeter, 2121 Bear Creek #532, Euless, addressed the council regarding "" adopting a green cement initiative requiring cement with low pollution production factor. City Council Minutes Page 7 of 8 May 27, 2008 Ellen and Zachary Weaver, 2506 Morrison Drive, Euless, addressed the council 'o• regarding a neighbor who keeps bee hives, and they asked the council to adopt an ordinance similar to the one Plano has providing guidelines for beekeeping. ITEM NO. 17 REPORTS STAFF REPORT Director of Public Works Ron Young gave a presentation regarding the variety of services provided by the Animal Services Department. He described their facility and showed pictures of it along with pictures of the personnel and volunteers, and reported on the numerous activities they host. CITY MANAGER City Manager Gary McKamie welcomed new Council Member Donna Mickan, and congratulated Linda Martin on being selected Mayor Pro Tem. He noted that Johnnie Green is a park institution and cannot be replaced. He wished Johnnie and Elaine great fun and happiness in retirement. CITY ATTORNEY City Attorney Bob McFarland had nothing to report. CITY COUNCIL Mayor Saleh welcomed Donna Mickan to the council, and stated she looked forward to getting to know and work with her. She also congratulated Linda Martin on being selected Mayor Pro Tern, stating she looked forward to working closely with her this year. She stated how proud she was of the staff and how often staff is recognized for their extraordinary service. She noted that tonight, Director of Finance Vicki Rodriquez was recognized for the Government Finance Officers Award, and at recent meetings, Library Administrator Kate Lyon was recognized for the library's achievements and Ron Young for the engineering department. She wanted staff to know how much the council appreciates all they do to make the City of Euless such a great place to live. She stated it is always sad to say goodbye to long time employees who have served so well. She stated the council will miss Johnnie Green, but they can see evidence of his presence everywhere around the city. She thanked Johnnie, stating it has been such a joy to know him and see the fruits of his talents. She expressed excitement about all the new developments happening in the city, the great staff the council works with, the citizens being served, and the opportunities to find new and better ways to serve the community. She stated the city has come a long way in the past fifteen years with all the beautiful parks and facilities, and she looks forward to another great year serving with good and talented people. Council Member Stinneford congratulated Mayor Saleh and Council Members Donna Mickan and Leon Hogg on winning their election, and Linda Martin on being named Mayor Pro Tern. He also congratulated Park Manager Johnnie Green on his retirement, Library Assistant Paula Myers on being selected employee of the month, and Director of City Council Minutes Page 8 of 8 May 27, 2008 Finance Vicki Rodriquez on the finance award. He noted he recently attended the r•- International Conference of Shopping Centers and stated that Director of Economic Development Bill Ridgway does a great job. He stated Deputy City Manager Loretta Getchell impresses him, and she is an incredible ambassador for the city. He explained that he will not be at the next council meeting, but will be in New Jersey celebrating his mother's 90th birthday. Mayor Pro Tem Martin congratulated Paula Myers. She stated Johnnie Green will have big shoes to fill. She congratulated Council Member Donna Mickan and stated she looks forward to working with her. She noted that Mayor Saleh is a great leader and congratulated her on her reelection. She thanked the citizens for bringing their concerns to the council, and stated she looks forward to a new year on the council. Council Member Mickan stated she is glad to be on the council. She congratulated Paula Myers and Vicki Rodriquez. She stated the city was lucky to have Johnnie Green for so long and thanked Ray McDonald for the gorgeous flowers in the council chambers. Council Member Porterfield congratulated Mayor Saleh, and Council Members Donna Mickan and Leon Hogg for winning their election. He congratulated Johnnie Green, Paula Myers, and Vicki Rodriquez on their recognition tonight. He thanked Ron Young for his report on the animal control services. To the concerned citizens who spoke tonight, he stated the council and staff will look into their concerns and see if action is appropriate. Council Member Bynum stated that Ron Young is doing a lot with very little staff. He stated he has known Johnnie Green for a long time, and he was one of those guys who would do what was needed and will be hard to replace. He congratulated Police Chief Mike Brown on the national award one of the dispatchers received.
