HomeMy WebLinkAbout2010-04-13 MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL TUESDAY, APRIL 13, 2010 A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:05 p.m. on Tuesday, April 13, 2010, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included: Mayor Mary Lib Saleh, Council Members Leon Hogg, Linda Martin, Donna Mickan, Glenn Porterfield, and Perry Bynum. Mayor Pro Tern Tim Stinneford was out of town. During the Precouncil meeting: ➢ Council Member Glenn Porterfield reported that he recently attended a meeting of the HEB Chamber of Commerce Governmental Affairs Committee and heard an update on the North Tarrant Express. ➢ Council Member Leon Hogg advised that he attended the "Ke Anuenue Polynesian Revue" held at the library on Monday, April 12, and stated that he enjoyed the performance and the event was well attended. ➢ Council Member Linda Martin stated that several members of the City Council and city staff attended the Municipal Night Award Dinner hosted by the Greater Fort Worth Builders Association, and advised that the City was nominated for the Community Spotlight Award, an award that recognizes a community whose policies and actions reflect an innovative approach to providing for the housing needs of the entire community. Council Member Martin also reported that she attended the Northwest Leadership Forum meeting and heard reports from the mayors of 13 cities. ➢ Council Member Donna Mickan announced that she attended the H-E-B Chamber of Commerce luncheon and heard a report from Dr. Gene Buinger, Superintendent of the H-E-B Independent School District, related to the state of the district. ➢ Communications and Marketing Manager Betsy Deck updated the City Council regarding the response statistics of the 2010 Census. She stated that the national average response rate is 66 percent, and the city of Euless response rate is 62 percent. Additionally, she stated that the Census was promoted at the recent Trash- Off and 275 volunteers received Census t-shirts and had an opportunity to ask questions related to the Census. ➢ City Manager Gary McKamie addressed the City Council regarding the April and May Council meeting schedule. ➢ City Secretary Susan Crim advised the City Council that due to Tarrant County's participation in the upcoming May election, Federal Postcard Applications (FPCA) must be mailed to overseas voters. She advised that 38 FPCA's will be mailed to Euless voters outside of the United States, and that this could delay the canvassing of the returns as the last day to receive ballots from outside of the United States is May 13, 2010, five days following election day. Additionally, she advised of the necessity to hold a special called meeting to canvass the returns by the May 19, 2010, Council Minutes Page 2 of 8 April 13, 2010 canvassing deadline, and that elected officials will assume office at the May 25, 2010, regular meeting. ➢ Recreation Superintendent Mike Davenport announced and reviewed the activities planned for Arbor Daze 2010 to be held April 24 and 25, 2010, at the City Hall complex. He stated that over 20 different community groups will perform over the two-day event, and 5,000 tree seedlings will be given away. ➢ Special Projects Manager Kay Godbey addressed the City Council regarding an application for designation as a Certified Retirement Community, and stated that the application fee is based on the 2000 Census figures. She advised that, as part of the designation, marketing assistance and specialized training would be provided by the State. Additionally, she stated that 32 cities in Texas currently hold the designation. City Manager McKamie advised the City Council that staff would move forward with submitting the application. ➢ Public Works Director Ron Young addressed the City Council regarding a proposed Illicit Discharge Ordinance. He stated that an ordinance would be presented to the City Council for consideration at an upcoming meeting. ➢ Planning and Development Director Chris Barker addressed the City Council regarding three upcoming Development Projects: Davis Machine Site Plan; 2) Texas Car Title Loan Site Plan; and 3) Community Mortuary Services Specific Use Permit (SUP). ➢ Finance Director Vicki Rodriquez advised that sales tax revenue is down by 15.9 percent from the same month last year, while the car rental tax saw a 4 percent increase, which may be attributed to a recent sporting event. ➢ City Manager McKamie reviewed the Regular Agenda items. Mr. McKamie advised that one change had been made to Ordinance No. 1871, related to the Drought Contingency Plan. He added that the following language has been added to Stage 3 restrictions for municipal and commercial uses, "Restrictions do not apply to locations using treated wastewater effluent for irrigation". ➢ City Manager McKamie asked Library Administrator Kate Lyon, Public Works Director Ron Young, and Finance Director Vicki Rodriquez to present their proposed fee amendments to the City Council. Additionally, Director of Economic Development and Administrative Services Mike Collins reminded the City Council of the fee increases that went into effect April 1 for waste and recycling collection services. Mr. McKamie stated that other fee increases have also been proposed and will be presented at an upcoming meeting, followed by the consideration of an ordinance to adopt the proposed amendments. Council Minutes Page 3 of 8 April 13, 2010 CLOSED SESSION The City Council convened into closed session at 5:43 p.m. for deliberation regarding security devices as authorized by Section 551.076 of the Texas Government Code, economic development incentives related to Glade Parks as authorized by Section 551.087 of the Texas Government Code. Kyle has completed 20 years of service with the City Police Chief Mike Brown introduced Jerry Cook, Senior Police Officer. Jerry was accompanied by his wife, Noriko, Assistant Police Chief Bob Freeman, Lieutenant Steve Eskew, Assistant Police Chief Harland Westmoreland, Sergeant Gary Landers, Lieutenant Steve Kockos, Technical Services Manager Gary Gregg, and Dispatchers Melissa Van Winkle, Mary Weber, Holly Burnett, Darla Wilson, Courtney Flory, Kymberly Pitman, Kate Livingston, Beverly Williams, Cynthia Pena, and Kathy Bowden. Jerry has completed 25 years of service with the City. Each employee was presented with a service pin commemorating their years of service with the City. ITEM NO. 2. PRESENTATION OF PROCLAMATION Council Member Hogg presented a proclamation to Dispatchers Melissa Van Winkle, Mary Weber, Holly Burnett, Darla Wilson, Courtney Flory, Kymberly Pitman, Kate Livingston, Beverly Williams, Cynthia Pena, and Kathy Bowden, proclaiming April 11 through 17, 2010, as Public Safety Telecommunicator Week. Police Chief Mike Brown recognized the importance of the duties performed by the dispatchers. All of the Police and Fire personnel who were present at the meeting stood with the Dispatchers during the presentation. Council Minutes Page 6 of 8 April 13, 2010 ITEM NO. 3. PRESENTATION OF PROCLAMATION Council Member Mickan presented a proclamation to Library Administrator Kate Lyon proclaiming April 11 - 17, 2010, as National Library Week. Kate announced that the fifth annual edible books contest is taking place this week as part of National Library Week. ITEM NO. 4. PRESENTATION OF PROCLAMATION Mayor Saleh presented a proclamation to Director of Parks and Community Services Ray McDonald proclaiming April 24, 2010, as Arbor Day in the City of Euless. REGULAR AGENDA ITEM NO. 5. APPROVED RESOLUTION NO. 10-1340, AMENDING RESOLUTION NO. 10-1333, BY LISTING THE LOCATION OF EACH EARLY VOTING POLLING PLACE AS REQUIRED BY THE TEXAS ELECTION CODE. Council Member Martin motioned to approve Resolution No. 10-1340, amending Resolution No. 10-1333, by listing the location of each early voting polling place as required by the Texas Election Code. Council Member Bynum seconded the motion. Ayes: Mayor Saleh, Council Members Hogg, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 6. APPROVED ENTERING INTO A JOINT PURCHASE AGREEMENT Council Member Mickan motioned to approve entering into a joint purchase agreement with Tarrant County for various types of automotive and equipment fuels. The supplier will be Martin-Eagle Oil Company, Denton, Texas, and the estimated annual expenditure is $398,400.00. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Council Members Hogg, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. Council Minutes Page 7 of 8 April 13, 2010 ITEM NO. 7 APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 1871 Council Member Hogg motioned to approve Ordinance No. 1871, amending Chapter 86, "Utilities", Article II, "Water and Sanitary Sewer Systems", Section 86-36, "Drought Contingency Plan" of the Euless Code of Ordinances, with the addition of language to Stage 3 of the plan, related to Municipal Government and Commercial or Industrial to read as follows: "Restrictions do not apply to locations using treated wastewater effluent for irrigation". Council Member Bynum seconded the motion. City Manager McKamie explained that effluent wastewater is not part of the city's water system, is not potable water and is exempted from the restrictions. Ayes: Mayor Saleh, Council Members Hogg, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 APPROVED CITY COUNCIL MINUTES Council Member Martin motioned to approve the City Council minutes of March 23, 2010. Council Member Hogg seconded the motion. Ayes: Mayor Saleh, Council Members Hogg, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 9. PUBLIC COMMENTS There were no public comments. ITEM NO. 10. REPORTS CITY COUNCIL Mayor Saleh reminded everyone of the May 8, 2010, General Election. Additionally, she announced that the City of Euless was nominated by members of the Fort Worth Builders Association for the Community Spotlight Award, an award that recognizes a community whose policies and actions reflect an innovative approach to providing for the housing needs of the entire community.
