HomeMy WebLinkAbout2009-06-23 `.• MINUTES OF A REGULAR MEETING OF THE EULESS CITY COUNCIL TUESDAY, JUNE 23, 2009 CALL TO ORDER A regular meeting of the Euless City Council was called to order by Mayor Mary Lib Saleh at 4:08 p.m. on Tuesday, June 23, 2009, in the Precouncil Conference Room of City Hall, 201 North Ector Drive. Those present included: Mayor Mary Lib Saleh, Mayor Pro Tem Tim Stinneford, Council Members Leon Hogg, Linda Martin, Donna Mickan, Glenn Porterfield, and Perry Bynum. During the precouncil meeting: ➢ Mayor Saleh reported that she recently attended a very interesting US Conference of Mayors meeting held in Providence, Rhode Island. • City Secretary Susan Crim reviewed the calendar of future city activities and events. ,NE. ➢ Deputy City Manager Loretta Getchell thanked the employees in all of the departments who assisted recently with some of the worst flooding ever in the City of Euless. She noted that the Police, Fire, Public Works and Parks Departments were all called upon to assist citizens. ➢ Deputy City Manager Loretta Getchell reported that the contractors on the Redi Mix facility will begin pouring concrete at 2:00 a.m. on Friday. They are forced to do so at that hour due to the heat. Neighbors will be notified prior to the work beginning, and the sound will be muffled as much as possible. ➢ Communications/Marketing Manager Betsy Deck reported that approximately 500 volunteers helped with the successful Euless Revitalization project last weekend when 15 homes were repaired and given a new lease on life. She noted that 70 different vendors participated, and that Home Depot had 60 employees from around the region involved. ➢ Director of Planning and Development Mike Collins gave an update on residential and commercial development and foreclosure activity in the City. He reported that the new Comfort Inn was close to opening and the LaQuinta Inn should be open in about six weeks. He said a new public charter school is opening in the building at the southeast corner of SH10 and FM157. ➢ Director of Finance Vicki Rodriquez gave a financial report for the month of May. The City Council Members complimented the staff for containing expenses while not decreasing services. City Council Minutes Page 2 of 9 June 23, 2009 ➢ City Attorney Bob McFarland gave an update on the legislative bills that were `r•• recently approved as well as those that were not. ➢ The agenda items were reviewed. The City Council convened into closed session at 6:25 p.m. for deliberation regarding contemplated litigation concerning Primary Purpose Homes and R & L Associates, as authorized by Section 551.071 of the Texas Government Code, and for deliberation regarding economic development incentives related to 1375 West Euless Boulevard, as authorized by Section 551.087 of the Texas Government Code. PLEDGE OF ALLEGIANCE Boy Scout Troop No. 161 led the Pledge of Allegiance. ITEM NO. 3. RECOGNITION OF RECIPIENTS OF THE EAGLE SCOUT AWARD FROM THE BOY SCOUTS OF AMERICA Mayor Saleh recognized the recipients of the Eagle Scout Award from the Boy Scouts of America who were in attendance at the council meeting. Council Member Bynum presented a Certificate of Recognition to Brandon Foley, Troop 161. Council Member Mickan presented a Certificate of Recognition to Ryan Foley, Troop 161. Council Member Martin presented a Certificate of Recognition to Michael Halleck, Troop 161. Council Member Hogg presented a Certificate of Recognition to Patrick Lemoine, Troop 161. Mayor Pro Tern Stinneford presented a Certificate of Recognition to Joachim Valdez, Troop 773. Each of the scouts gave a brief description of their projects that they completed to attain their Eagle badges. ITEM NO. 1 PRESENTATION OF EMPLOYEE OF THE MONTH FOR JULY Library Administrator Kate Lyon introduced Librarian Assistant Leta Jones. Council Member Porterfield presented Leta with a plaque for being selected employee of the month for July. ITEM NO. 2 PRESENTATION OF PROCLAMATION City Secretary Susan Crim and City Manager Gary McKamie introduced Deputy City Secretary Becky Null. Becky introduced her son and daughter-in-law, Jody and Jana Null, and sister and brother-in-law, Susan and Mark Thomasson. Mayor Saleh presented Becky with a proclamation in honor of retiring with over 35 years of service to the City of Euless. ITEM NO. 5 APPROVED CITY COUNCIL MINUTES Approved the minutes of the Regular City Council Meeting of June 9, 2009. REGULAR AGENDA ITEM NO. 6 HELD PUBLIC HEARING FOR SPECIFIC USE PERMIT NO. 09-04- SUP AND APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 1850 Mayor Saleh opened the public hearing at 7:24 p.m. for Specific Use Permit No. 09-04- SUP for The Redeemed Christian Church of God on Lot 1, Block 1, J. W. Lewellyn Addition, in TX-10 (Texas Highway 10 Multi-Use District) zoning, located at 2807 West Euless Boulevard. Director of Planning and Development Mike Collins stated the applicant, Mr. Abbey Adeyeye, has held a specific use permit at a previous location, 1717 West Euless Boulevard since 2002. The new location has better parking availability and the church's need for parking will be primarily on the weekends, while the other occupant of the facility operates during regular business hours. Mayor Saleh asked for any proponents. The applicant, Mr. Abbey Adeyeye, spoke in favor of the request. There being no additional proponents or opponents, Mayor Saleh closed the public hearing at 7:28 p.m. Mayor Pro Tem Stinneford motioned to approve the first and final reading of Ordinance No. 1850 for Lot 1, Block 1, J. W. Lewellyn Addition, for The Redeemed Christian Church of God in TX-10 (Texas Highway 10 Multi-Use District) zoning, located at 2807 West Euless Boulevard, subject to the following conditions: (1) Tied to the pastor, Abbey Adeyeye; (2) Tied to the Redeemed Christian Church of God; and (3) Valid for two years. City Council Minutes Page 5 of 9 June 23, 2009 ITEM NO. 7 HELD PUBLIC HEARING AND APPROVED FIRST AND FINAL �.• READING OF ORDINANCE NO. 1843 Mayor Saleh opened the public hearing at 7:29 p.m. regarding extending the juvenile curfew ordinance. Police Chief Mike Brown stated the original curfew ordinance was approved in 1994 and has to be renewed every three years to continue in effect. There being no proponents or opponents, Mayor Saleh closed the public hearing at 7:30 p.m. Council Member Martin motioned to approve the first and final reading of Ordinance No. 1843 extending the current juvenile curfew ordinance. Council Member Mickan seconded the motion Ayes: Mayor Saleh, Mayor Pro Tern Stinneford, Council Members Hogg, Martin, Mickan, Porterfield, and Bynum Nays: None Mayor Saleh declared the motion carried. ITEM NO. 8 APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 1851 Director of Planning and Development Mike Collins stated that Ordinance No. 1851 represents the most significant overhaul of the city's apartment inspection process since adoption of the minimum housing codes and fees in 1992. It will amend Chapter 14, "Buildings and Building Regulations," by replacing Article X, "Minimum Housing Standards," with a new article, and amend Chapter 30, "Fees," Section 30-42, "Minimum Housing Licensing and Related Fees". The ordinance will implement a new annual owner registration process and fee, improve the effectiveness of all inspections, and increase the frequency of inspections in the appropriate properties. The ordinance also adjusts the fees based on the delivery of services. He stated that a Primary Team Inspection will be completed for each multi-family complex. A report will be provided to the landlord of the complex that specifically identifies all code violations. Based on the number of violations identified, a score will be calculated using a 100 point system and a tier designation assigned that will determine the number of additional Primary Team Inspections that will be conducted in the next twelve month period. Mayor Saleh asked if there were any public comments on this item. There were none. Council Member Bynum praised staff for the excellent job they did on this ordinance, and stated the purpose is to protect the citizens. City Council Minutes Page 6 of 9 June 23, 2009 Council Member Hogg motioned to approve the first and final reading of Ordinance No. �.• 1851 amending Chapter 14, "Buildings and Building Regulations," of the Code of Ordinances by repealing Article X, in its entirety and replacing it with a new Article X, "Minimum Housing Standards," and amending Chapter 30, "Fees," Section 30-42, "Minimum Housing Licensing and Related Fees." ITEM NO. 9 APPROVED FIRST AND FINAL READING OF ORDINANCE NO. 1852 Director of Planning and Development Mike Collins noted that a lot of work was involved over the last year in revising the ordinance that regulates gas drilling and production. He said it has been a collaborative effort including Fire Marshal Paul Smith, Director of Public Works Ron Young, Assistant Director of Planning and Development Chris Barker, and Senior Planner Stephen Cook. He stated that since 2000, the gas industry and the cities in which the operators are active have learned new techniques and methods about drilling and producing natural gas in the Barnett Shale. The proposed revisions are a product of the experiences of cities in Tarrant, Denton, Wise, and Johnson counties. In addition, the proposed revisions have been reviewed by several active gas drilling operators. Mayor Saleh asked for any public comments. John Schleeter, 2121 Bear Creek Parkway, Euless, stated he was concerned that this ordinance would be more lenient than council members had expressed in the past that our ordinance would be to control the gas drilling process. In response to a question, Director of Planning and Development Mike Collins stated that the well sites will be platted. Council Member Mickan motioned to approve the first and final reading of Ordinance No. 1852, with the deletion in Section 40-7 of item (2) under "L. Floodway/Flood Plain" on page 13, replacing the current Chapter 40, "Gas Drilling and Production," with a new Chapter 40, to provide revised regulations regarding distance, noise, gas pipelines and technical provisions, and amending Chapter 30, "Fees," Section 30-45, "Gas Well Permit and Contract Fees." `. Mayor Saleh declared the motion carried. ITEM NO. 10 PUBLIC COMMENTS Billy Owens noted that the Euless Revitalization program had a successful weekend. ITEM NO. 11 REPORTS STAFF REPORT Fire Marshal Paul Smith presented a slide show of the activities in which the Citizens Fire Academy Alumni Association are involved. He reported that they currently have 58 members and they spend hundreds of man hours each year giving back to the community. They provide rehab duties at major incidents, assist with smoke detector checks, pick up and return stretcher back boards, and assist with school safety programs, among many other things. He stated that the Euless Citizens Fire Academy Alumni Association was the founding organization for the State Citizens Fire Academy Alumni Association, which now has 16 cities involved. CITY MANAGER City Manager Gary McKamie thanked Deputy City Secretary Becky Null for all the years she has served and all that she's done for the City. He thanked Communications and Marketing Manager Betsy Deck and Fire Inspector Ken Rawlinson for their coordination of the Euless Revitalization project last weekend. He noted that a lot of churches, businesses, citizens and volunteers came together to help people they didn't even know. He stated his appreciation for everyone involved. CITY ATTORNEY City Attorney Bob McFarland stated he was city attorney when Becky Null came to work for the City of Euless. He said there has not been an employee he has enjoyed working with more, noting that he could always count on her to find information when he needed it. He stated she was a joy to work with. CITY COUNCIL Mayor Saleh thanked the city staff for all the excellent work they did during the recent storm taking care of the citizens to see that they had the services they needed. She stated her appreciation for everyone in the City who responded, creating Raving Fans in the citizens. She stated the Euless Revitalization project weekend was fabulous in spite of the heat. She reminded the audience that the City is hosting a Water Forum on Thursday, June 25 in the Council Chambers to inform citizens of ways to conserve water. She reported that she recently attended the US Conference of Mayors meeting in Providence, Rhode Island, and was very proud of her City and all the things we are doing that other cities are just now talking about doing. City Council Minutes Page 8 of 9 June 23, 2009 Mayor Pro Tern Stinneford congratulated Leta Jones on being selected Employee of the ``• Month for July. He also commended the five Eagle Scouts who attended the meeting and were recognized for their achievements in scouting. He congratulated Becky Null on her retirement after 35 years of service to the City of Euless and stated that she will be missed. Mayor Pro Tern Stinneford reported that he attended the North Central Texas Council of Governments Awards Luncheon on June 12 and was honored to accept the Regional Cooperation Award on behalf of the City of Euless. It was given to the cities of Euless, Bedford and Hurst for their cooperation in the creation and operation of the HEB Transit System, which provides transport to and from work and work-related activities for people who do not qualify for the existing NETS or WHEELS transportation programs. He stated that this is the fourth time the City of Euless has received this award, and no other local government has received it that many times. The other three times the City of Euless received the Regional Cooperation Award were: 1996 to the cities of Euless, Bedford and Hurst for an assortment of cooperative programs including, HEB Economic Development Foundation, HEB Joint Facilities Evaluation Project, HEB Libraries Reciprocal Borrowing Programs, HEB Teen Court, HEB Joint Purchasing Agreements and various HEB Joint Public Safety Programs; 1999 to the cities of Euless, Dallas, Fort Worth and the Dallas/Fort Worth International Airport Board for their ability to work together on a collaborative effort to create and share new revenue and to help the DFW Region grow and continue to be a successful economic force in Texas; and 2004 to the cities of Euless, Bedford, Colleyville, Grapevine, Haltom City, Hurst, Keller and North Richland Hills for their cooperation in creating an "urban transit district" in order to keep the existing NETS Urban Transit System, a transportation service for seniors and persons with disabilities, intact. Council Member Hogg expressed his thanks to the employees for all that they do. He said he visited all of the houses that were repaired during the Euless Revitalization week-end and the program was great. Council Member Martin congratulated the Eagle Scouts who were recognized and said their enthusiasm and accomplishments restore her faith in the youth of today. She congratulated Leta Jones on being selected Employee of the Month and told Becky Null that she is a special lady and that she can look forward to great new adventures in her retirement. She said Becky would be missed and she looked forward to seeing her at future City events. Council Member Martin thanked Deputy City Manager Loretta Getchell for handling the city manager's job so well during Gary McKamie's absence the past week. Council Member Mickan congratulated Becky Null on her retirement and said she will be missed. She congratulated Leta Jones on being selected Employee of the Month. She echoed the other council members praise of the Euless Revitalization program and thanked the staff for coming up with the idea for this project. She said the program is not only a wonderful project for the homeowners who receive the help, and it is heart warming and bonding for the people doing the work, but it is also a blessing for the neighborhood as well. City Council Minutes Page 9 of 9 June 23, 2009 Council Member Porterfield wished Becky Null well in her retirement and told her that .• she will be missed. He said Leta Jones is deserving of being recognized as Employee of the Month. He stated that he is always proud when we honor Eagle Scouts. He thanked the Citizens Fire Academy Alumni Association for all they do for the City. He said the Euless Revitalization Program was a tremendous program and it is a wonderful thing that speaks of what Euless is about in many ways. He reported that the financial report given in the precouncil session indicated that the City of Euless is going through a period where revenues are down, but the staff is operating in a fashion that he is extremely proud of. There is no lack of services to citizens and he commended the staff for their good work in keeping up that level. Council Member Bynum said all of the good things discussed tonight are representative of what Euless stands for. Through good leadership in years past, we are able to carry out the programs we are doing today. He congratulated Becky Null on 35 years of service to the City and said he was impressed with that length of service. He thanked Betsy Deck for her part in coordinating the Euless Revitalization program and all of the employees who worked tirelessly to help citizens during the recent storms and flooding. He thanked Deputy City Manager Loretta Getchell for a good job during the absence of City Manager Gary McKamie.
